which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to reauthorize brownfields revitalization funding, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Brownfields Reauthorization Act of 2025</short-title></quote>.</text></section><section id="idc4ee12c080e64444888663647c37462f"><enum>2.</enum><header>Improving small and disadvantaged community access to grant opportunities</header><text display-inline="no-display-inline">Section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) is amended—</text><paragraph id="ide1066620e8604b139769d5aa16c20faa"><enum>(1)</enum><text>in paragraph (1)(I), by inserting <quote>or 501(c)(6)</quote> after <quote>section 501(c)(3)</quote>;</text></paragraph><paragraph id="idca767cb7a8f241c6b2bd3428deecf741"><enum>(2)</enum><text>in paragraph (5)(E)(i), by striking <quote>up to 5 percent of the</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id00377f7e60994c05a5630f0331b5bb8a"><enum>(3)</enum><text>in paragraph (6)(C), by striking clause (ix) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id38A2BB0DBD8C484E872CDA15A52381DF"><clause id="idb70a47be47f348faa69104673568b398"><enum>(ix)</enum><text>The extent to which the applicant has a plan—</text><subclause commented="no" display-inline="no-display-inline" id="ide624c036e0804230a3fb389ea9afdba5"><enum>(I)</enum><text display-inline="yes-display-inline">to engage a diverse set of local groups and organizations that effectively represent the views of the local community that will be directly affected by the proposed brownfield project; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id524a67ee1db147209943308df1e55cc4"><enum>(II)</enum><text display-inline="yes-display-inline">to meaningfully involve the local community described in subclause (I) in making decisions relating to the proposed brownfield project.</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id69cb8b871c0e411c8b8f62941e2f6e70"><enum>(4)</enum><text>in paragraph (10)(B)(iii)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1d9f1caf3d2948e280804f04e416ec3d"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>20 percent</quote> and inserting <quote>10 percent</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id138ebbe23d7f4771b383aa2751fa7d27"><enum>(B)</enum><text>by inserting <quote>the eligible entity is located in a small community or disadvantaged area (as those terms are defined in section 128(a)(1)(B)(iv)) or</quote> after <quote>unless</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id501660b3d1fe4be1b4958d1ab67ecd65"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting <quote>, in which case the Administrator shall waive the matching share requirement under this clause</quote> before <quote>; and</quote>; and</text></subparagraph></paragraph><paragraph id="iddef35bd2b7fc496e8aeac067a31b14e4"><enum>(5)</enum><text>in paragraph (13), by striking <quote>2019 through 2023</quote> and inserting <quote>2025 through 2030</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="idA9329D008755459DAB3067B1EEC9F8F2"><enum>3.</enum><header>Increasing grant amounts</header><text display-inline="no-display-inline">Section 104(k)(3)(A)(ii) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(3)(A)(ii)</external-xref>) is amended by striking <quote>$500,000</quote> and all that follows through the period at the end and inserting <quote>$1,000,000 for each site to be remediated.</quote></text></section><section commented="no" display-inline="no-display-inline" id="iddd69a07c002f47aa8cf47756c9918f93"><enum>4.</enum><header>State response programs</header><text display-inline="no-display-inline">Section 128(a) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9628">42 U.S.C. 9628(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id6cef425cddb8428986ed205943eff4cb"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(B)(i), by striking <quote>or enhance</quote> and inserting <quote>, enhance, or implement</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3ab0a7174de64c1bb2dfc9d76babace0"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0149D69878BC4AB3806A58B126779AD0"><paragraph commented="no" display-inline="no-display-inline" id="id32faaca6cfa942668182875a9be581da"><enum>(3)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this subsection—</text><subparagraph commented="no" display-inline="no-display-inline" id="id905969a0e030498facf68d6b32e84cfd"><enum>(A)</enum><text display-inline="yes-display-inline">$50,000,000 for fiscal year 2025;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id40ffb003559549a2a39b1206b9c0f47e"><enum>(B)</enum><text>$55,000,000 for fiscal year 2026;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc6c64ac9b7854c1ebf18bf6cd2b9a891"><enum>(C)</enum><text>$60,000,000 for fiscal year 2027;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1c3fbdfbaa774d38a38bdad4db3694ef"><enum>(D)</enum><text display-inline="yes-display-inline">$65,000,000 for fiscal year 2028;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id102cc314d4a543eda05a1ac5563762c2"><enum>(E)</enum><text display-inline="yes-display-inline">$70,000,000 for fiscal year 2029; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2a5a7a1816f64e5b8adefa545ec03741"><enum>(F)</enum><text display-inline="yes-display-inline">$75,000,000 for fiscal year 2030.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="id9bde7699c5134c4bac3f9644bbd87442"><enum>5.</enum><header>Report to identify opportunities to streamline application process; updating guidance</header><subsection commented="no" display-inline="no-display-inline" id="id6bd60a96a54e4fdab3a4ea0c18fddca1"><enum>(a)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator of the Environmental Protection Agency (referred to in this section as the <term>Administrator</term>) shall submit to Congress a report that evaluates the application ranking criteria and approval process for grants and loans under section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>), which shall include, with respect to those grants and loans—</text><paragraph commented="no" display-inline="no-display-inline" id="id37608fb339e14a96a948e7a8e12139fa"><enum>(1)</enum><text>an evaluation of the shortcomings in the existing application requirements that are a recurring source of confusion for potential recipients of those grants or loans;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04f34b98b97d4deb9f9b7ab33b57552d"><enum>(2)</enum><text>an identification of the most common sources of point deductions on application reviews;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida83305c30fbc42aa8c8c9f0a56f29d5e"><enum>(3)</enum><text>strategies to incentivize the submission of applications from small communities and disadvantaged areas (as those terms are defined in section 128(a)(1)(B)(iv) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9628">42 U.S.C. 9628(a)(1)(B)(iv)</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8f00976306c041939030d33400b1f945"><enum>(4)</enum><text>recommendations, if any, to Congress on suggested legislative changes to the ranking criteria that would achieve the goal of streamlining the application process for small communities and disadvantaged areas (as so defined).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id56ead091c455472da8db817d63d8eb9a"><enum>(b)</enum><header>Updating guidance</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall update the guidance relating to the application ranking criteria and approval process for grants and loans under section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) to reduce the complexity of the application process while ensuring competitive integrity.</text></subsection></section><section id="id32d38d834b404efd93bddfaca649c2fc"><enum>6.</enum><header>Brownfield revitalization funding for Alaska Native tribes</header><text display-inline="no-display-inline">Section 104(k)(1) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(1)</external-xref>) is amended—</text><paragraph id="idf53876179f63420cb2e18341a6a08f5a"><enum>(1)</enum><text>in subparagraph (G), by striking <quote>other than in Alaska</quote>; and</text></paragraph><paragraph id="idfe0c1cce3bc242d1874c1081124e1c3c"><enum>(2)</enum><text>by striking subparagraph (H) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id42EFAC0F65FE4E199DF3DB755B93815E"><subparagraph commented="no" display-inline="no-display-inline" id="id9994865f7ca24d1fabac7440640e55d3"><enum>(H)</enum><text>a Regional Corporation or a Village Corporation (as those terms are defined in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>));</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
