(Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9fb5ae92aa2446d9bdde42f076c88b8a" changed="added" reported-display-style="italic"><enum>(2)</enum><header>Biological Data</header><text display-inline="yes-display-inline">The term <term>biological data</term> means the information, including associated descriptors, derived from the structure, function, or process of a biological system that is either measured, collected, or aggregated for analysis.</text></paragraph><paragraph id="id3f3a4aac1db14ea2898f537ac61aeeaa"><enum>(<deleted-phrase reported-display-style="strikethrough">2</deleted-phrase><added-phrase reported-display-style="italic">3</added-phrase>)</enum><header>Director</header><text>Unless otherwise provided, the term <term>Director</term> means the Director of the National Science Foundation.</text></paragraph><paragraph id="id7c77d5d1a8c94b228c713c4da1ad9cb8"><enum>(<deleted-phrase reported-display-style="strikethrough">3</deleted-phrase><added-phrase reported-display-style="italic">4</added-phrase>)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph id="id2dda9bd6c957443cb6379e4a85034d03"><enum>(<deleted-phrase reported-display-style="strikethrough">4</deleted-phrase><added-phrase reported-display-style="italic">5</added-phrase>)</enum><header>Network</header><text>The term <term>Network</term> means the National Programmable Cloud Laboratories Network.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id952bca15dcf14fd280174a9206239057"><enum>(<deleted-phrase reported-display-style="strikethrough">5</deleted-phrase><added-phrase reported-display-style="italic">6</added-phrase>)</enum><header>Node</header><text>The term <term>node</term> means a programmable cloud laboratory designated as part of the Network.</text></paragraph><paragraph id="idb9736233b5f144e7896875b025871203"><enum>(<deleted-phrase reported-display-style="strikethrough">6</deleted-phrase><added-phrase reported-display-style="italic">7</added-phrase>)</enum><header>Non-designated laboratory</header><text>The term <term>non-designated laboratory</term> means any Federal, academic, nonprofit, or private industry programmable cloud laboratory not selected as a node under section 3.</text></paragraph><paragraph id="ida3f954208987451aa1ca13cb13cee02e"><enum>(<deleted-phrase reported-display-style="strikethrough">7</deleted-phrase><added-phrase reported-display-style="italic">8</added-phrase>)</enum><header>Programmable cloud laboratory</header><text>The term <term>programmable cloud laboratory</term> means a physical laboratory that is equipped with research instrumentation and advanced manufacturing capabilities, including robotics and artificial intelligence, that can be securely and remotely programmed and controlled in order to conduct experiments and collect associated data.</text></paragraph></subsection></section><section id="id389e57d01d3c41c2b44b8723a669e528"><enum>3.</enum><header>National Programmable Cloud Laboratories Network</header><subsection id="id19e39552213345c9ac98925721e4025f"><enum>(a)</enum><header>Purposes</header><text>The purposes of the Network established under this Act are—</text><paragraph id="id2191fdcacc6045239b4ffaaa8ac875bd"><enum>(1)</enum><text>to maintain leadership by the United States in advanced experimentation, <added-phrase reported-display-style="italic">biotechnology,</added-phrase> laboratory automation, and artificial intelligence for scientific research, advanced manufacturing, long-term economic competitiveness, and national security;</text></paragraph><paragraph id="idf37efda00b654e19b9a65b54b78153ac"><enum>(2)</enum><text>to reduce the cost of federally funded research through automation and reproducibility;</text></paragraph><paragraph id="id42e33476c9cd444daf811c3c1ae917f8"><enum>(3)</enum><text>to accelerate national competitiveness by transferring government-funded research to private-sector commercial applications;</text></paragraph><paragraph id="idb9bf466d36294e988b8b272d9ae0a9ff"><enum>(4)</enum><text>to improve collaboration among federally funded national laboratories, institutions of higher education, and private industry;</text></paragraph><paragraph id="id6954390c13fd422ab73a20dfce7472a4"><enum>(5)</enum><text>to ensure that investment in programmable cloud laboratories results in measurable cost savings, efficiencies, and long-term fiscal sustainability;</text></paragraph><paragraph id="ida475a04d0e84422eaa3f56bc49391690"><enum>(6)</enum><text>to incentivize private-sector cost-sharing in research infrastructure and equipment;</text></paragraph><paragraph id="id7c2d967b38bf474886e189b912fa1807"><enum>(7)</enum><text>to support workforce development aligned with the technical needs of industry in the United States;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id20d91040ebd843829a34d069b1b0a2cc" changed="added" reported-display-style="italic"><enum>(8)</enum><text>to provide funding for nodes;</text></paragraph><paragraph id="idd4b92e91601a40b499144c768d2f9485"><enum>(<deleted-phrase reported-display-style="strikethrough">8</deleted-phrase><added-phrase reported-display-style="italic">9</added-phrase>)</enum><text>to advance the development of a domestic industrial base for scientific automation tools, <added-phrase reported-display-style="italic">biotechnology,</added-phrase> artificial intelligence systems for experimentation, and robotics platforms for use in laboratory settings; and</text></paragraph><paragraph id="idfd876c437d4e49f1921dfd5f8342b656"><enum>(<deleted-phrase reported-display-style="strikethrough">9</deleted-phrase><added-phrase reported-display-style="italic">10</added-phrase>)</enum><text>to further programmable cloud laboratory research in areas such as materials science, biotechnology, chemistry, and other scientific or engineering disciplines where automation and cloud-enabled experimentation can deliver transformative results, including advanced materials synthesis and characterization, scalable biotechnology experimentation, and high-throughput chemical catalyst development.</text></paragraph></subsection><subsection id="id80b77b1c68bf47b4aaac32c7e629c1aa" changed="deleted" reported-display-style="strikethrough"><enum>(b)</enum><header>Establishment</header><paragraph id="id7a5b6fbd1b774582a9cdd6cd9a3deeb4"><enum>(1)</enum><header>In general</header><text>Not later </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id735c5987afbd4cfcb23c680fc7faf010" changed="added" reported-display-style="italic"><enum>(b)</enum><header>Establishment; awards</header><paragraph commented="no" display-inline="no-display-inline" id="id7f68ac2276404162bd2c3ecf96444f64" changed="added" reported-display-style="italic"><enum>(1)</enum><header display-inline="yes-display-inline">In General</header><subparagraph commented="no" display-inline="no-display-inline" id="id279f73592b134b6dbe091df549375fdd" changed="not-changed"><enum><added-phrase reported-display-style="italic">(A)</added-phrase></enum><header display-inline="yes-display-inline"><added-phrase reported-display-style="italic">Establishment</added-phrase></header><text display-inline="yes-display-inline"><added-phrase reported-display-style="italic">Not later</added-phrase> than 1 year after the date of enactment of this Act, the Director, in consultation with the Director of the National Institute of Standards and Technology, shall designate and oversee a National Programmable Cloud Laboratories Network of not more than 6 nodes to support secure, standards-based, and cost-effective remote experimentation and automated research.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0438ea71b50d4889ac04d0c5279bed68" changed="added" reported-display-style="italic"><enum>(B)</enum><header>Awards</header><text>The Director shall award a grant to each node, in an amount not greater than $5,000,000 per fiscal year for a period of not more than 5 years, to support the National Programmable Cloud Laboratories Network.</text></subparagraph></paragraph><paragraph id="id44fbaf7480d546c78c9bf2b899c34fb3" changed="not-changed"><enum>(2)</enum><header>Assessment sequencing</header><text>The assessment required under section 5 shall be conducted only after the final designation of nodes under paragraph (1).</text></paragraph><paragraph id="id5653989379784966825e53cf287c7de3" changed="not-changed"><enum>(3)</enum><header>Nodes</header><text>The Network shall consist of nodes that—</text><subparagraph id="idcefe30bf0c64430d959dcc021ee22707"><enum>(A)</enum><text>enable programmable workflows and automated science;</text></subparagraph><subparagraph id="id7659fda0d3c645ac9ae42da28ce8169e"><enum>(B)</enum><text>provide access to advanced scientific and manufacturing instruments, including artificial intelligence-enabled tools;</text></subparagraph><subparagraph id="ida99e26fe93904328b24b797f645e0f06"><enum>(C)</enum><text>collaborate to establish and adopt common standards, protocols, and best practices; and</text></subparagraph><subparagraph id="id82f7bb43b58349c58360bc9a76b07fb2"><enum>(D)</enum><text>support interoperability across and between nodes.</text></subparagraph></paragraph></subsection><subsection id="idc39c787d41f44a69a4177e0f5fc24175"><enum>(c)</enum><header>Application and selection</header><paragraph id="idbeaa7a548675499d848d2e554d06f8ef"><enum>(1)</enum><header>In general</header><text>The Director shall issue a public solicitation for eligible entities to apply for node designation.</text></paragraph><paragraph id="id70c74bacd7a1462999dac4c044486156"><enum>(2)</enum><header>Eligible entities</header><text>Eligible entities that may apply for designation as a node include—</text><subparagraph id="idbcf9af6354fd426dbd89fa83d7f103e6"><enum>(A)</enum><text>institutions of higher education;</text></subparagraph><subparagraph id="idb92d40613a874d81b7f640d5f4a0eed2"><enum>(B)</enum><text>nonprofit research organizations;</text></subparagraph><subparagraph id="id1483155d83d349cdb48e3188443b8458"><enum>(C)</enum><text>private<deleted-phrase reported-display-style="strikethrough">-</deleted-phrase> sector research entities; and</text></subparagraph><subparagraph id="idade8934eab6e4b9fbf3d2d0ca5120965"><enum>(D)</enum><text>consortia or collaborations of the entities described in subparagraphs (A) through (C).</text></subparagraph></paragraph></subsection><subsection id="id46a86114dd4446e6b67a6762673750c4" commented="no"><enum>(d)</enum><header>Applications for designation</header><text>An eligible entity that desires to apply for designation as a node in the Network shall submit an application to the Director at such time and in such manner as the Director may require. The application shall include—</text><paragraph id="idd96f66e9143c42919cae5e0560022045"><enum>(1)</enum><text>a technical and programmatic plan for laboratory operations, automation capabilities, and data integration;</text></paragraph><paragraph id="id471aa8a94a2a46e4afbc51eedad1d1dd"><enum>(2)</enum><text>a plan to achieve long-term self-sustainability, including metrics, interim milestones, and a timeline for reducing reliance on Federal funding; and</text></paragraph><paragraph id="id61040c5c68e14731893387064216bcb8"><enum>(3)</enum><text>evidence of non-Federal cost share, private capital, or other third-party contributions demonstrating self-sustainability potential.</text></paragraph></subsection><subsection id="id7baa48d0d2be4f6fa07d33fe09778408"><enum>(e)</enum><header>Evaluation of applicants</header><text>The Director shall ensure that the process for selecting eligible entities for designation in the Network <added-phrase reported-display-style="italic">is competitive, merit-based, and transparent, through the evaluation of, with respect to each entity—</added-phrase><deleted-phrase reported-display-style="strikethrough">shall be competitive, merit-reviewed, and transparent, evaluating</deleted-phrase>—</text><paragraph id="id13fd456f52754622a12d4fd9541ae725"><enum>(1)</enum><text>pre-existing laboratory infrastructure and suitability for automated science;</text></paragraph><paragraph id="id94a8ce9eec2244348a0ab59d6d98dfad"><enum>(2)</enum><text>capacity to support distributed, cloud-enabled programmable workflows for multiple users;</text></paragraph><paragraph id="ide80faf9cc1954f059c44f5b2bda9e7e6"><enum>(3)</enum><text>likelihood of achieving long-term sustainability without continued Federal funding;</text></paragraph><paragraph id="idcf1adf8abc3a44aaa9830cce37cfb89d"><enum>(4)</enum><text>demonstrated ability to collaborate with other nodes, academic partners, industry partners, or other Federal research agencies (as defined in section 10002 of the Research and Development, Competition, and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18901">42 U.S.C. 18901</external-xref>));</text></paragraph><paragraph id="id6740259022804c989cb574e27d994aa1"><enum>(5)</enum><text>protocols for research security, cybersecurity, and responsible access; and</text></paragraph><paragraph id="id8cdd28ba3d1148a1a7f676c6d13d250f"><enum>(6)</enum><text>demonstration of user interest and research needs.</text></paragraph></subsection><subsection id="idc9057d751df74012ad9485ea1ed24664" changed="deleted" reported-display-style="strikethrough"><enum>(f)</enum><header>Designation</header><text>In designating nodes, the Director shall provide preference for applications demonstrating meaningful third-party cost share and pre-existing infrastructure.</text></subsection><subsection id="ide8da1580e0fe4cff87b2fcfee274d69e" changed="added" reported-display-style="italic"><enum>(f)</enum><header>Designation</header><text>In designating nodes, the Director shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id5706082aabec4d9182d4dd076c760d3f"><enum>(1)</enum><text>give preference to applicants demonstrating meaningful third-party cost share and pre-existing infrastructure; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5413e87f14284bcf83b69a95cf344a51"><enum>(2)</enum><text>to the extent practicable, ensure that at least 1 node demonstrates the capability to support cloud-enabled biotechnology research, including automated experimentation or quality control workflows.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfaecfe0886ad45a68a23343bf90a8b56"><enum>(g)</enum><header display-inline="yes-display-inline">Responsibilities</header><text>Each node selected by the Director shall—</text><paragraph id="idbacfa8f3baea434ba849133552f448be"><enum>(1)</enum><text>support the purposes described in subsection (a)(9);</text></paragraph><paragraph id="id34cc963a2885473e99b96e347ecc0b45"><enum>(2)</enum><text>facilitate collaboration among Network members to expand and integrate automated science capabilities and best practices;</text></paragraph><paragraph id="id00f25abb14de47b8b86edd2f3e9463fa"><enum>(3)</enum><text>actively participate with the Director of <added-phrase reported-display-style="italic">the</added-phrase> National Institute of Standards and Technology in developing network-wide interoperability, data-sharing, cybersecurity, and artificial intelligence-assisted experimentation standards;</text></paragraph><paragraph id="id07898ae81ea24cf5b6a0694b5be9edd0"><enum>(4)</enum><text>support secure sharing of experimental data, <added-phrase reported-display-style="italic">including biological data,</added-phrase> models, and results across institutions of higher education participating in the Network, if applicable;</text></paragraph><paragraph id="ide6f8c053c496453594044f874fdf5933"><enum>(5)</enum><text>provide a secure digital infrastructure to enable remote experimentation, artificial intelligence-assisted analysis, and reproducible science;</text></paragraph><paragraph id="id0f0291ed8b214b6f8361f401fcdb1942"><enum>(6)</enum><text>engage in public-private partnerships to streamline the transfer of technology developed using Network infrastructure;</text></paragraph><paragraph id="ida66dd081ae294ebd89c543c42bd29083"><enum>(7)</enum><text>develop and maintain a financial sustainability plan to reduce long-term reliance on Federal funds, including through user fees, licensing, consortia membership, or other revenue-generating models;</text></paragraph><paragraph id="id49bfb25af2d0458f8cfeedf643a64e4d"><enum>(8)</enum><text>establish performance metrics, including scientific output, cost-effectiveness, academic engagement, private-sector engagement, user satisfaction, and reproducibility of results; and</text></paragraph><paragraph id="id6c56c5fb3f424b31a4ad14c8cdd2eb6d"><enum>(9)</enum><text>where practicable, leverage commercially available hardware and software solutions to minimize cost and accelerate deployment of automated science capabilities.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id2afe4fd77fb045d9ad23a7f9be915d24"><enum>4.</enum><header>Interagency collaboration</header><text display-inline="no-display-inline">Not later than 180 days after all nodes of the Network are designated, the Director of the National Institute of Standards and Technology, in cooperation with the Director and participating eligible entities (including institutions of higher education), shall—</text><paragraph id="id562a6d5e1b4c4c00a269e9fac055dc14"><enum>(1)</enum><text>develop and promulgate standards to ensure interoperability across Network nodes, including laboratory instrumentation, data infrastructure, communication protocols, and experiment execution systems;</text></paragraph><paragraph id="id3776465a98cd44a89de4271b1b9c186c"><enum>(2)</enum><text>establish protocols for secure, seamless, and standardized data-sharing among all members of the Network<added-phrase reported-display-style="italic">, including sharing of biological data,</added-phrase> aligned with node-level cybersecurity and research security protocols;</text></paragraph><paragraph id="ide836e41b9ede4397878724f59bd99f29"><enum>(3)</enum><text>define minimum technical requirements and operating procedures to support remote experimentation, experiment reproducibility, and artificial intelligence-assisted workflows; and</text></paragraph><paragraph id="id5fce22f0085b40df91cf0740ce4585ba"><enum>(4)</enum><text>periodically update such standards in consultation with private<deleted-phrase reported-display-style="strikethrough">-</deleted-phrase> sector partners and nodes of the Network to reflect advancements in hardware, software, and automation technology.</text></paragraph></section><section id="ide47cbc7d2c8645c7863f30576f7feedf"><enum>5.</enum><header>Assessment of non-designated laboratories</header><subsection id="id42c52e83cfed4b8880d2e9cca3c60d0c"><enum>(a)</enum><header>Assessment requirement</header><text>Not later than 180 days after the Director designates the final node of the Network under section 3, the Director, in consultation with the Secretary of Energy and the Director of the National Institute of Standards and Technology, shall conduct and submit to the appropriate committees of Congress, a comprehensive assessment of non-designated laboratories.</text></subsection><subsection id="idca16e4faf4ed416a827182227c9b3bbc"><enum>(b)</enum><header>Scope</header><text>The assessment shall identify, to the extent practicable—</text><paragraph id="id9bcac9f0a7704389897c03cfe41877c2"><enum>(1)</enum><text>Federal laboratories, institutions of higher education, nonprofit organizations, and private-sector laboratories that possess or are developing programmable, automated, or remotely accessible research infrastructure;</text></paragraph><paragraph id="idd412ed94ae4f4b99a4139c53a32d709d"><enum>(2)</enum><text>the instrumentation, automation, and data capabilities of such laboratories;</text></paragraph><paragraph id="id6f54baad8a6b40a2a4b22efc134f12d5"><enum>(3)</enum><text>cybersecurity and research security measures relevant to interoperability;</text></paragraph><paragraph id="ide9f31013f6bd4953b1e53515ff00f6ce"><enum>(4)</enum><text>existing or potential pathways for such laboratories to coordinate with Network nodes in areas such as data-sharing, standards adoption, or pilot interoperability projects; and</text></paragraph><paragraph id="id14d3242f7cde4a199741d84d9043b0ae"><enum>(5)</enum><text>legal, contractual, or intellectual property considerations that may affect participation <added-phrase reported-display-style="italic">in the Network</added-phrase>.</text></paragraph></subsection><subsection id="idf10b88d6785e46f6b049ccf6e7452166"><enum>(c)</enum><header>Confidentiality and security</header><text>Proprietary information shall be protected from public disclosure consistent with applicable law. The Director shall publish a nonproprietary public summary of the assessment and may submit a proprietary annex to the congressional committees of jurisdiction.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id09b2ee0ff8414e299e38733b2c09632b"><enum>6.</enum><header>Reporting and oversight</header><subsection id="id261b9570af8e4b0f892b078aeee84ef2"><enum>(a)</enum><header>Annual Briefings</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Director shall brief the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="HSY00">Committee on Science, Space, and Technology of the House of Representatives</committee-name> on the status of the Network.</text></subsection><subsection id="idd3bf775a451a4256a36b7d9610f1d3da"><enum>(b)</enum><header>Contents</header><text>Each briefing required under subsection (a) shall include an assessment of—</text><paragraph id="idb4959fa95b3d44c681a8423cf0c00466"><enum>(1)</enum><text>the alignment of supported research with national scientific and economic priorities;</text></paragraph><paragraph id="id2005386b85e349a7b7fd851495df5135"><enum>(2)</enum><text>the progress each node of the Network has made toward achieving self-sustainability as described in section 3(d)(2); and</text></paragraph><paragraph id="id031dbe5071994e96867fc063ce626535"><enum>(3)</enum><text>the performance metrics established in section 3(g)(8).</text></paragraph></subsection></section><section id="idba419f6e74b54ec1ba6757ec1bc8cfb0" changed="added" reported-display-style="italic"><enum>7.</enum><header>Funding</header><text display-inline="no-display-inline">From amounts appropriated or otherwise made available to the National Science Foundation, the Director shall allocate $30,000,000 for each of the fiscal years 2026 through 2030 to carry out this Act, subject to the availability of appropriations.</text></section><section id="idd48df2baf4b8419aa2d73718a8bcd455"><enum><deleted-phrase reported-display-style="strikethrough">7</deleted-phrase><added-phrase reported-display-style="italic">8</added-phrase>.</enum><header>Sunset</header><text display-inline="no-display-inline">The National Programmable Cloud Laboratories Network, including all authorities, programs, and funding provided under this Act, shall terminate on September 30, 2031.</text></section></legis-body><endorsement><action-date>July 13, 2026</action-date><action-desc>Reported with amendments</action-desc></endorsement></bill>
