which was read twice and referred to the <committee-name committee-id="SSJU00" added-display-style="italic" deleted-display-style="strikethrough">Committee on the Judiciary</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20260511">May 11, 2026</action-date><action-desc>Reported by <sponsor name-id="S153">Mr. Grassley</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To require artificial intelligence chatbots to implement age verification measures and make certain disclosures, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guidelines for User Age-verification and Responsible Dialogue Act of 2025</short-title></quote> or the <quote><short-title>GUARD Act</short-title></quote>.</text></section><section id="id4cc1a98ace494017a3e17ae2d41ca5d0" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="idb1f1fe1589cc4c28ab4bc8e5ca559ae0"><enum>(1)</enum><text>Artificial intelligence chatbots are increasingly being deployed on social media platforms and in consumer applications used by minors.</text></paragraph><paragraph id="id6e603077d9a2425bacd04ca2ab36ebbd"><enum>(2)</enum><text>These chatbots can generate and disseminate harmful or sexually explicit content to children.</text></paragraph><paragraph id="idf7859f6b4e1042c78712f63a1164c6d2"><enum>(3)</enum><text>These chatbots can manipulate emotions and influence behavior in ways that exploit the developmental vulnerabilities of minors.</text></paragraph><paragraph id="ideebbd7aa2a2a455b957fb8303361e680"><enum>(4)</enum><text>The widespread availability of such chatbots exposes children to physical and psychological safety risks, including grooming, addiction, self-harm, and harm to others.</text></paragraph><paragraph id="id1f750b67dfbd4253939d0f7d041c92f7"><enum>(5)</enum><text>Protecting children from artificial intelligence chatbots that simulate human interaction without accountability is a compelling governmental interest.</text></paragraph></section><section id="idc4a9d69ff14045599c60a04b8a9daf4e" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idae4fea52c2954ebd958a285ee5a65e8a"><enum>(1)</enum><header>AI companion</header><text>The term <term>AI companion</term> means an artificial intelligence chatbot that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4bf9cf8c42a44034bc3216510850ec4e"><enum>(A)</enum><text display-inline="yes-display-inline">provides adaptive, human-like responses to user inputs; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcd336e7f4a6640688f7169941201f184"><enum>(B)</enum><text display-inline="yes-display-inline">is designed to encourage or facilitate the simulation of interpersonal or emotional interaction, friendship, companionship, or therapeutic communication.</text></subparagraph></paragraph><paragraph id="id00c6309bb21c4b369030ed820e5d72e6" commented="no"><enum>(2)</enum><header>Artificial intelligence chatbot</header><text display-inline="yes-display-inline">The term <term>artificial intelligence chatbot</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfd4a30961b204dae81de383539e96180"><enum>(A)</enum><text display-inline="yes-display-inline">means any interactive computer service or software application that—</text><clause id="idb16f6fbf7bd84d43992f7b1658badbab" commented="no"><enum>(i)</enum><text>produces new expressive content or responses not fully predetermined by the developer or operator of the service or application; and</text></clause><clause id="id3b1a4dcc65ff49b9840c330c0ec09c3b" commented="no"><enum>(ii)</enum><text>accepts open-ended natural-language or multimodal user input and produces adaptive or context-responsive output; and</text></clause></subparagraph><subparagraph id="id6356adc4e56741d0b0fbf37a51fc674a" commented="no"><enum>(B)</enum><text>does not include an interactive computer service or software application—</text><clause commented="no" display-inline="no-display-inline" id="id4139cf9df7404b3eb182b9af6b42e341"><enum>(i)</enum><text display-inline="yes-display-inline">the responses of which are limited to contextualized replies; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id18beee19f0834368b5e71c3a287604df"><enum>(ii)</enum><text display-inline="yes-display-inline">that is unable to respond on a range of topics outside of a narrow specified purpose.</text></clause></subparagraph></paragraph><paragraph id="id092e164c0df34d3788851c6bba7dd192"><enum>(3)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means any person who owns, operates, or otherwise makes available an artificial intelligence chatbot to individuals in the United States.</text></paragraph><paragraph id="id2c87fb0b34aa47a48faee8dd07bd9ee0"><enum>(4)</enum><header>Minor</header><text>The term <term>minor</term> means any individual who has not attained 18 years of age.</text></paragraph><paragraph id="id647dd285799149e687fdf806d64e0deb" commented="no"><enum>(5)</enum><header>Reasonable age verification measure</header><text>The term <term>reasonable age verification measure</term> means a method that is authenticated to relate to a user of an artificial intelligence chatbot, such as—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6d21a0d84b804328a6341df4fb7cdeb3"><enum>(A)</enum><text display-inline="yes-display-inline">a government-issued identification; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id09cb1bb0d2b6495289ebb9d415cc0d75"><enum>(B)</enum><text display-inline="yes-display-inline">any other commercially reasonable method that can reliably and accurately—</text><clause commented="no" display-inline="no-display-inline" id="ida0ea4f79a2454ed8bff34235be21e3b2"><enum>(i)</enum><text display-inline="yes-display-inline">determine whether a user is an adult; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idcb4910bfd3fa4c4a9166336b7fed1b16"><enum>(ii)</enum><text display-inline="yes-display-inline">prevent access by minors to AI companions, as required by section 6.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94b8ddc559c44e23813860d90d455157"><enum>(6)</enum><header display-inline="yes-display-inline">Reasonable age verification process</header><text display-inline="yes-display-inline">The term <term>reasonable age verification process</term> means an age verification process employed by a covered entity that—</text><subparagraph id="id525fb639ac484378b6bd27a391643f4c" commented="no"><enum>(A)</enum><text>uses one or more reasonable age verification measures in order to verify the age of a user of an artificial intelligence chatbot owned, operated, or otherwise made available by the covered entity;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id56ba54628e2447869563a6e7210c7b45"><enum>(B)</enum><text display-inline="yes-display-inline">provides that requiring a user to confirm that the user is not a minor, or to insert the user's birth date, is not sufficient to constitute a reasonable age verification measure;</text></subparagraph><subparagraph id="id08e975ddbf4949ba9ae6c145a3b7cf66" commented="no"><enum>(C)</enum><text>ensures that each user is subjected to each reasonable age verification measure used by the covered entity as part of the age verification process; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4af025b7e7ac44009f50bda0565fd273"><enum>(D)</enum><text display-inline="yes-display-inline">does not base verification of a user's age on factors such as whether the user shares an Internet Protocol address, hardware identifier, or other technical indicator with another user determined to not be a minor.</text></subparagraph></paragraph></section><section id="id571f944c15594925875d7a692404380d" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>4.</enum><header>Criminal prohibitions</header><subsection commented="no" display-inline="no-display-inline" id="id1b87513a6d21487ea9a11ec3f9fd98bb"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Part I of title 18, United States Code, is amended by inserting after chapter 5 the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id1afcc6f412284528b590621b162d9224" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><chapter id="id9b4022f995714c0ea369ee9a8c13b5b5" style="OLC"><enum>6</enum><header>Artificial intelligence</header><toc><toc-entry level="section">Sec.</toc-entry><toc-entry level="section" idref="idc8fd9d8fa9ad46adb84d681ca270ccd1">91. Artificial intelligence chatbots.</toc-entry></toc><section id="idc8fd9d8fa9ad46adb84d681ca270ccd1"><enum>91.</enum><header>Artificial intelligence chatbots</header><subsection commented="no" display-inline="no-display-inline" id="id5a7e02d99c8f46b092a8c493aac39533"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id5adddfe48d15417eaf201489a8a02e76" commented="no"><enum>(1)</enum><header>Artificial intelligence chatbot</header><text display-inline="yes-display-inline">The term <term>artificial intelligence chatbot</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id54eb0457929143b58ff4fb71667c96f0"><enum>(A)</enum><text display-inline="yes-display-inline">means any interactive computer service or software application that—</text><clause id="id84f60a1892dc4cbdb676bd10257638ca" commented="no"><enum>(i)</enum><text>produces new expressive content or responses not fully predetermined by the developer or operator of the service or application; and</text></clause><clause id="id3bc9fd2d5a9c46229e0ac603b16cb562" commented="no"><enum>(ii)</enum><text>accepts open-ended natural-language or multimodal user input and produces adaptive or context-responsive output; and</text></clause></subparagraph><subparagraph id="id829fccc11e11476eb89bf40a2a1dfbd2" commented="no"><enum>(B)</enum><text>does not include an interactive computer service or software application—</text><clause commented="no" display-inline="no-display-inline" id="idd72a8b29533f485a9bb0d367a1c07487"><enum>(i)</enum><text display-inline="yes-display-inline">the responses of which are limited to contextualized replies; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd19fffe98d984826b620e91422f756af"><enum>(ii)</enum><text display-inline="yes-display-inline">that is unable to respond on a range of topics outside of a narrow specified purpose.</text></clause></subparagraph></paragraph><paragraph id="iddad14520e85345f682d9c9bfb97b7fc6"><enum>(2)</enum><header>Minor</header><text>The term <term>minor</term> means any individual who has not attained 18 years of age.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb2f1522ec8bf4a4ba0a61ad992ebd56c"><enum>(3)</enum><header>Sexually explicit conduct</header><text>The term <term>sexually explicit conduct</term> has the meaning given the term in section 2256.</text></paragraph></subsection><subsection id="iddef317713cdd44a1861e830072d2a365"><enum>(b)</enum><header>Solicitation of minors</header><paragraph id="id04a2811e78ec459b8864cc1d4bffaddd"><enum>(1)</enum><header>Offense</header><text>It shall be unlawful to design, develop, or make available an artificial intelligence chatbot, knowing or with reckless disregard for the fact that the artificial intelligence chatbot poses a risk of soliciting, encouraging, or inducing minors to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbbb3e90e0f87425c8e38f2e0de8b03a0"><enum>(A)</enum><text display-inline="yes-display-inline">engage in, describe, or simulate sexually explicit conduct; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id72b4a31e950d4d8f863851cd6e0c0b7c"><enum>(B)</enum><text display-inline="yes-display-inline">create or transmit any visual depiction of sexually explicit conduct, including any visual depiction described in section 1466A(a).</text></subparagraph></paragraph><paragraph id="id7d8941be2b1445eea69122d00db4b992"><enum>(2)</enum><header>Penalty</header><text>Any person who violates paragraph (1) shall be fined not more than $100,000 per offense.</text></paragraph></subsection><subsection id="idf095e35c35c446798fc3d2b0ab4a5849"><enum>(c)</enum><header>Promotion of physical violence</header><paragraph id="idace38c86fde1441dbaff44321b09053a"><enum>(1)</enum><header>Offense</header><text>It shall be unlawful to design, develop, or make available an artificial intelligence chatbot, knowing or with reckless disregard for the fact that the artificial intelligence chatbot encourages, promotes, or coerces suicide, non-suicidal self-injury, or imminent physical or sexual violence.</text></paragraph><paragraph id="id51b4822c19ab4ab68c9baa8b6de244a6" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Penalty</header><text>Any person who violates paragraph (1) shall be fined not more than $100,000 per offense.</text></paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idf4a1f10076c14e5dbe443db3e45b074d"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of chapters for part I of title 18, United States Code, is amended by inserting after the item relating to chapter 5 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idac528d62604d47cd9d1ed78b30f91d80" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><toc changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><multi-column-toc-entry level="chapter" bold="on"><toc-enum>6.</toc-enum><level-header level="chapter">Artificial intelligence</level-header><target>91</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id34a0deecffa94d9ca3352d080fcb86b9" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>5.</enum><header>Covered entity obligations</header><subsection id="id4dc23f3fcfff4c90927bfa338c450bbc"><enum>(a)</enum><header>Creation of user accounts</header><text>A covered entity shall require each individual accessing an artificial intelligence chatbot to make a user account in order to use or otherwise interact with such chatbot.</text></subsection><subsection id="idc7e64e44db814cae96b2047d12cd900f"><enum>(b)</enum><header>Age verification</header><paragraph id="id5c1e584b861141f487bdcbcb348466fe"><enum>(1)</enum><header>Age verification of existing accounts</header><text>With respect to each user account of an artificial intelligence chatbot that exists as of the effective date of this Act, a covered entity shall—</text><subparagraph id="id0bb5fe3f638147c1ba5e9c281a17e3d3"><enum>(A)</enum><text>on such date, freeze any such account;</text></subparagraph><subparagraph id="idd51cc2422ebb4106b82d58adf03d1225"><enum>(B)</enum><text>in order to restore the functionality of such account, require that the user provide age data that is verifiable using a reasonable age verification process, subject to paragraph (4); and</text></subparagraph><subparagraph id="id58fd09b3fbb845aeb6006b59e83efd76"><enum>(C)</enum><text>using such age data, classify each user as a minor or an adult.</text></subparagraph></paragraph><paragraph id="idd0516243f7094d7b9e3ec9b5b11e051a"><enum>(2)</enum><header>Age verification of new accounts</header><text>At the time an individual creates a new user account to use or interact with an artificial intelligence chatbot, a covered entity shall—</text><subparagraph id="idb9176fda76fa40b89f5b4319c5c3470c"><enum>(A)</enum><text>request age data from the individual;</text></subparagraph><subparagraph id="idd31c549a45e444739ed2772f74a3383e"><enum>(B)</enum><text>verify the individual’s age using a reasonable age verification process, subject to paragraph (4); and</text></subparagraph><subparagraph id="id12a4d6e123bb4d7a9d6c4960d18757c6"><enum>(C)</enum><text>using such age data, classify each user as a minor or an adult.</text></subparagraph></paragraph><paragraph id="idf201aa213a4d44b2847ddd30ec6f54b2"><enum>(3)</enum><header>Periodic age verification</header><text>A covered entity shall periodically review previously verified user accounts using a reasonable age verification process, subject to paragraph (4), to ensure compliance with this Act.</text></paragraph><paragraph id="id0824451054c94b25bc5e588b9cec1c14" commented="no"><enum>(4)</enum><header>Use of third parties</header><text>For purposes of paragraphs (1)(B), (2)(B), and (3), a covered entity may contract with a third party to employ reasonable age verification measures as part of the covered entity's reasonable age verification process, but the use of such a third party shall not relieve the covered entity of its obligations under this Act or from liability under this Act.</text></paragraph><paragraph id="idcefe2939e8a64794b45d76cc7b9df1fb"><enum>(5)</enum><header>Age verification measure data security</header><text>A covered entity—</text><subparagraph id="id0f34a6f66ae248f28d2bcbbf1b7107b8"><enum>(A)</enum><text>shall establish, implement, and maintain reasonable data security to—</text><clause id="idb516e83cf3044fac8cc05436bb1f8801"><enum>(i)</enum><text>limit collection of personal data to that which is minimally necessary to verify a user’s age or maintain compliance with this Act; and</text></clause><clause id="id140455ef14814f4384160f4ed5659c3a"><enum>(ii)</enum><text>protect such age verification data against unauthorized access;</text></clause></subparagraph><subparagraph id="ida617a56189f74ad1a2fbc2849c7e1c92"><enum>(B)</enum><text>shall protect such age verification data against unauthorized access;</text></subparagraph><subparagraph id="id773194c947464a03b9f637130bf94f1b"><enum>(C)</enum><text>shall protect the integrity and confidentiality of such data by only transmitting such data using industry-standard encryption protocols;</text></subparagraph><subparagraph id="id59f3f1de2a4e41d8b690b8b69cd5416c"><enum>(D)</enum><text>shall retain such data for no longer than is reasonably necessary to verify a user’s age or maintain compliance with this Act; and</text></subparagraph><subparagraph id="id0e090b69b173432982df68325f2524a4"><enum>(E)</enum><text>may not share with, transfer to, or sell to, any other entity such data.</text></subparagraph></paragraph></subsection><subsection id="id5f2b690309e64043ac8527e6a1320c0d"><enum>(c)</enum><header>Required disclosures for artificial intelligence chatbots</header><paragraph id="id6a8d98e24fde431197934416f5324827"><enum>(1)</enum><header>Disclosure of non-human status</header><text>Each artificial intelligence chatbot made available to users shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6aa8d08c586e4ae59d35a9a90e89eeae"><enum>(A)</enum><text display-inline="yes-display-inline">at the initiation of each conversation with a user and at 30-minute intervals, clearly and conspicuously disclose to the user that the chatbot is an artificial intelligence system and not a human being; and</text></subparagraph><subparagraph id="id49f2ac61cf6a469baff38791a0377e09"><enum>(B)</enum><text>be programmed to ensure that the chatbot does not claim to be a human being or otherwise respond deceptively when asked by a user if the chatbot is a human being.</text></subparagraph></paragraph><paragraph id="id0074e46d1c1940d68a27f70a5a9c5194"><enum>(2)</enum><header>Disclosure regarding non-professional status</header><subparagraph id="ida69a9d80d9a140f8a0a8e3bfc02742ba"><enum>(A)</enum><header>In general</header><text>An artificial intelligence chatbot may not represent, directly or indirectly, that the chatbot is a licensed professional, including a therapist, physician, lawyer, financial advisor, or other professional.</text></subparagraph><subparagraph id="id988e367075fb404ebfb731d27016ac6c"><enum>(B)</enum><header>Other limitations</header><text>Each artificial intelligence chatbot made available to users shall, at the initiation of each conversation with a user and at reasonably regular intervals, clearly and conspicuously disclose to the user that—</text><clause id="id6896a085193c44c587970ef08b00beed"><enum>(i)</enum><text>the chatbot does not provide medical, legal, financial, or psychological services; and</text></clause><clause id="id6b6605bca7ea437193baff38dbe4d62e"><enum>(ii)</enum><text>users of the chatbot should consult a licensed professional for such advice.</text></clause></subparagraph></paragraph></subsection></section><section id="id630f14555c6f44148043fcf3a253802b" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>6.</enum><header>Prohibition on minor use of AI companions</header><text display-inline="no-display-inline">If the age verification process described in section 5(b) determines that an individual is a minor, a covered entity shall prohibit the minor from accessing or using any AI companion owned, operated, or otherwise made available by the covered entity.</text></section><section id="id41a9556f02b44658bf63f2ddc910f093" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>7.</enum><header>Enforcement</header><subsection id="id38165a99471b47f585dc674eb85edefc"><enum>(a)</enum><header>In general</header><text>In the case of a violation of section 5 or 6, or a regulation promulgated thereunder, the Attorney General may bring a civil action in an appropriate district court of the United States to—</text><paragraph commented="no" display-inline="no-display-inline" id="idd977e805039d407e8c6c0f9dc3740c09"><enum>(1)</enum><text display-inline="yes-display-inline">enjoin the violation;</text></paragraph><paragraph commented="no" promulgated thereunder; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd655a3c9ff0e436393ff19495f4aacae"><enum>(3)</enum><text display-inline="yes-display-inline">obtain civil penalties under subsection (c) of this section, restitution, and other appropriate relief.</text></paragraph></subsection><subsection id="ida1c31f73a7524d3c96c11f9f1f6ea205"><enum>(b)</enum><header>Attorney General powers</header><paragraph id="id63b2b8410a134fa6927f41bffe0ac8f9"><enum>(1)</enum><header>Investigatory powers</header><text>For the purpose of conducting investigations or bringing enforcement actions under this section, the Attorney General may issue subpoenas, administer oaths, and compel the production of documents or testimony.</text></paragraph><paragraph id="idf8a1d480abd649b2982dc63696c4e1a9"><enum>(2)</enum><header>Rulemaking</header><text>The Attorney General may promulgate any regulations necessary to carry out this Act.</text></paragraph></subsection><subsection id="id1d1a0928bea94cc99f4c783863357a49"><enum>(c)</enum><header>Civil penalties</header><paragraph id="idd2add63123d54961aaa52619d95ab604"><enum>(1)</enum><header>In general</header><text>Any person who violates section 5 or 6, or a regulation promulgated thereunder, shall be subject to a civil penalty not to exceed $100,000 for each violation.</text></paragraph><paragraph id="idfa574bae427b44a39f30f171f7542e46" commented="no"><enum>(2)</enum><header>Separate violations</header><text>Each violation described in paragraph (1) shall be considered a separate violation.</text></paragraph></subsection><subsection id="idc5ae0bd2e37e4e84b3be6f51c34c5ceb"><enum>(d)</enum><header>State enforcement</header><text>In any case in which the attorney general of a State has reason to believe that an interest of the residents of that State has been or is threatened or adversely affected by the engagement of any covered entity in a violation of this Act or a regulation promulgated thereunder, the State, as parens patriae, may bring a civil action on behalf of the residents of the State in a district court of the United States or a State court of appropriate jurisdiction to obtain injunctive relief.</text></subsection><subsection id="ida4724ee4659b445d9c6b2418cd9a1111"><enum>(e)</enum><header>Relationship to State laws</header><text display-inline="yes-display-inline">Nothing in this Act or an amendment made by this Act, or any regulation promulgated thereunder, shall be construed to prohibit or otherwise affect the enforcement of any State law or regulation that is at least as protective of users of artificial intelligence chatbots as this Act and the amendments made by this Act, and the regulations promulgated thereunder.</text></subsection></section><section id="idb398878771e747f5afad5858ef76ba48" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>8.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on the date that is 180 days after the date of enactment of this Act.</text></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="idc1409214-8961-4b76-9b0b-72b5158c90fe" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guidelines for User Age-verification and Responsible Dialogue Act of 2026</short-title></quote> or the <quote><short-title>GUARD Act</short-title></quote>.</text></section><section id="id3569619f-734a-46f3-a84c-fc14594df0fa" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id98ead047-15fa-4066-913b-6d817cc4dc74"><enum>(1)</enum><text>Artificial intelligence companions are increasingly being deployed on social media platforms and in consumer applications used by minors.</text></paragraph><paragraph id="idd2bf668f-df7b-4392-b825-d09827fe18d6"><enum>(2)</enum><text>These companions can generate and disseminate harmful or sexually explicit content to children.</text></paragraph><paragraph id="id8118f767-8c31-480a-9eaa-8e02cd81a608"><enum>(3)</enum><text>These companions can manipulate emotions and influence behavior in ways that exploit the developmental vulnerabilities of minors.</text></paragraph><paragraph id="idb0890b22-4b20-46d7-899d-8f9c71d052b4"><enum>(4)</enum><text>The widespread availability of such companions exposes children to physical and psychological safety risks, including grooming, addiction, self-harm, and harm to others.</text></paragraph><paragraph id="idd9231b28-486e-4a85-9265-6464b212a987"><enum>(5)</enum><text>Protecting children from artificial intelligence companions that simulate human interaction without accountability is a compelling governmental interest.</text></paragraph></section><section id="id696a20bf-4893-45a7-b4e3-c930cb09eac8" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id8dfb14b1-2e75-4c73-a1f3-43fffacf9080"><enum>(1)</enum><header>AI companion</header><text>The term <term>AI companion</term> means an artificial intelligence chatbot that, in a manner that simulates a sustained interpersonal relationship or emotional interaction with the user—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbeb5a765ce5141ba850165171e301090"><enum>(A)</enum><text>exhibits persistent responses suggesting affection or attachment directed toward the user or engages in interactions involving emotional disclosures from the user; or</text></subparagraph><subparagraph id="idc22f8f4a33c64798b64a4d946af8bf62"><enum>(B)</enum><text>presents at least one persistent identity, persona, or character and holds itself out as a sentient being, fictional character, or social entity.</text></subparagraph></paragraph><paragraph id="idef683738-cd93-4c12-b837-76b1569d2cf3" commented="no"><enum>(2)</enum><header>Artificial intelligence chatbot</header><text display-inline="yes-display-inline">The term <term>artificial intelligence chatbot</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcff3a8df-a762-4742-90c0-2554fc47d346"><enum>(A)</enum><text display-inline="yes-display-inline">means any interactive computer service or software application that—</text><clause id="idd2338255bcc849f68df481078e9f51b9"><enum>(i)</enum><text>generates responses that are not fully predetermined; and</text></clause><clause id="idae9408d7-3823-4871-9817-2016ed28202a" commented="no"><enum>(ii)</enum><text>accepts open-ended, natural-language or multimodal user input and produces adaptive or context-responsive output; and</text></clause></subparagraph><subparagraph id="idb50ccffc-552a-43a7-8b57-da796f9a2cd6" commented="no"><enum>(B)</enum><text>does not include an interactive computer service or software application—</text><clause commented="no" display-inline="no-display-inline" id="id492d3803-f499-4798-a60d-8fc409733547"><enum>(i)</enum><text display-inline="yes-display-inline">the responses of which are limited to contextualized replies; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idfb89e07f-ca74-45e8-9972-1a92157a3223"><enum>(ii)</enum><text display-inline="yes-display-inline">that is unable to respond on a range of topics outside of a narrow specified purpose.</text></clause></subparagraph></paragraph><paragraph id="id1981d899-06e2-4732-be2e-982ae3ed0505"><enum>(3)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means any person who makes publicly available to end consumers an artificial intelligence chatbot.</text></paragraph><paragraph id="id89c2c188-ded9-4118-b1f0-4be9d9e3c71a"><enum>(4)</enum><header>Minor</header><text>The term <term>minor</term> means any individual who has not attained 18 years of age.</text></paragraph><paragraph id="id79e48a15a922476db537cc1bfbf502e5"><enum>(5)</enum><header>Reasonable age verification measure</header><text>The term <term>reasonable age verification measure</term> means a method that, whether alone or in conjunction with other age verification measures, can, with reasonable certainty, determine whether the user of an interactive computer service or software application is an adult, such as—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbecf5e46-74ff-4327-bed9-ba40da66937f"><enum>(A)</enum><text display-inline="yes-display-inline">a verified form of identification;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbf6d3858-6dc0-471f-b2b4-2d8ac9a5ff68"><enum>(B)</enum><text display-inline="yes-display-inline">age information associated with the user’s account at a financial institution, such as a credit card, that is derived from a verified form of identification submitted to the financial institution;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4b074d52fb4c46f1a255081255f3651b"><enum>(C)</enum><text display-inline="yes-display-inline">age information associated with the user’s account for the operating system of a computer, mobile device, or other general purpose computing device that is derived from a verified form of identification submitted to the operating system provider;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcbc44d3ad1864ab48e47766bf07036e4"><enum>(D)</enum><text>age information associated with the user’s account for a software application store that is derived from a verified form of identification submitted to the store or operating system provider; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id95adc016da1047ebbc802ce314108593"><enum>(E)</enum><text display-inline="yes-display-inline">any other commercially reasonable method that can determine whether a user is an adult.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfdbc9662-a909-4ea7-9e0b-bb1bae41a980"><enum>(6)</enum><header display-inline="yes-display-inline">Reasonable age verification process</header><text display-inline="yes-display-inline">The term <term>reasonable age verification process</term> means an age verification process employed by a covered entity that—</text><subparagraph id="ida9015718c22a4f61bbe729e30713771d"><enum>(A)</enum><text>uses 1 or more reasonable age verification measures in order to, with reasonable certainty, determine whether the user of an interactive computer service or software application is an adult;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4fdcf315-1b47-418b-a8ae-abdc4cb03012"><enum>(B)</enum><text display-inline="yes-display-inline">does not solely require a user to confirm that the user is not a minor or to insert the user’s birth date; and </text></subparagraph><subparagraph id="id8f045ac7aafb449b9077e0861a84838d"><enum>(C)</enum><text>does not base the verification of a user’s adult status on factors such as whether the user shares an Internet Protocol address, hardware identifier, or other technical indicator with another user determined to not be a minor.</text></subparagraph></paragraph><paragraph id="idbd0a57e471504c95a42f0d4f16e9f6e7"><enum>(7)</enum><header>Verified form of identification</header><text>The term <term>verified form of identification</term> means—</text><subparagraph id="id565e510bd9f84aa7bcc26d3f6718d7e8"><enum>(A)</enum><text>a government-issued identification that can determine the adult status of the person identified; or</text></subparagraph><subparagraph id="idca7a53159a864e6582e805a83930e9a8"><enum>(B)</enum><text>another form of identification corroborated by authentic documentation that can, with reasonable certainty, determine the adult status of the person identified.</text></subparagraph></paragraph></section><section id="id4506754b-ba5b-4373-af8f-8f9aaa1154df" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>4.</enum><header>Criminal prohibitions</header><subsection commented="no" display-inline="no-display-inline" id="ided930d38-aab2-4be6-84d5-01466b9db0c2"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Part I of title 18, United States Code, is amended by inserting after chapter 5 the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id37d29335-8306-45c7-b76e-5b995ce20174" changed="added" Artificial intelligence chatbots. </toc-entry></toc><section id="id0ab5ccca-2b92-494e-b78c-d5b551566cc6"><enum>91.</enum><header>Artificial intelligence chatbots</header><subsection commented="no" display-inline="no-display-inline" id="id952e0bd0-a854-4419-a582-9832388adc1b"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id2de0030f-4e7d-44d4-8633-d6b37dff8f88" commented="no"><enum>(1)</enum><header>Artificial intelligence chatbot</header><text display-inline="yes-display-inline">The term <term>artificial intelligence chatbot</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb498a8ce-6e7e-42c5-b28f-e870537a4703"><enum>(A)</enum><text display-inline="yes-display-inline">means any interactive computer service or software application that—</text><clause id="id24b93a03-15ae-487e-9ef0-18b8f0eaf794" commented="no"><enum>(i)</enum><text>generates responses that are not fully predetermined; and</text></clause><clause id="id538308e2-05f5-400d-bc00-e49ffc9eac45" commented="no"><enum>(ii)</enum><text>accepts open-ended, natural-language or multimodal user input and produces adaptive or context-responsive output; and</text></clause></subparagraph><subparagraph id="id0d0a89f5-90ff-433b-b48b-3e4665128830" commented="no"><enum>(B)</enum><text>does not include an interactive computer service or software application—</text><clause commented="no" display-inline="no-display-inline" id="idb4cb895d-e424-48d9-9a34-57c05ac1ee8d"><enum>(i)</enum><text display-inline="yes-display-inline">the responses of which are limited to contextualized replies; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id06315b11-b2ce-4043-8c03-231c7699a954"><enum>(ii)</enum><text display-inline="yes-display-inline">that is unable to respond on a range of topics outside of a narrow specified purpose.</text></clause></subparagraph></paragraph><paragraph id="ide205989b-ca07-4d44-9ac5-6a4d2c24282f"><enum>(2)</enum><header>Minor</header><text>The term <term>minor</term> means any individual who has not attained 18 years of age.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8da97bb9-1460-46ae-a8ca-90c82e5f5b04"><enum>(3)</enum><header>Sexually explicit conduct</header><text>The term <term>sexually explicit conduct</term> has the meaning given the term in section 2256(2)(A).</text></paragraph></subsection><subsection id="idc2ec5487-f6ad-46f8-af10-a7c61c6d2377"><enum>(b)</enum><header>Offense relating to sexually explicit conduct</header><paragraph id="id27fd63b91afa4281b1ed3ac9ec47554d"><enum>(1)</enum><header>Offense</header><text>It shall be unlawful to make publicly available an artificial intelligence chatbot, knowing or with reckless disregard for the fact that the artificial intelligence chatbot—</text><subparagraph id="id6b9f68fba46f47a8bea1eec3319d8c59"><enum>(A)</enum><text>engages minors in, erotically describes to minors, or erotically simulates to minors sexually explicit conduct or obscene material (as applicable); or</text></subparagraph><subparagraph id="idbbee858a96c44a46bb83fdf44f885d2d"><enum>(B)</enum><text>makes available to a minor any material that erotically depicts, erotically describes, or erotically simulates—</text><clause id="id17553b9c568b46dfa475471a739ce07f"><enum>(i)</enum><text>any visual depiction of sexually explicit conduct; or</text></clause><clause id="idcc084b99f06f4c2b9eb2df6f12b1cd2d"><enum>(ii)</enum><text>any visual depiction described in section 1466A(a).</text></clause></subparagraph></paragraph><paragraph id="id3aba3bd8-11da-4bec-b709-22a5b985efd1"><enum>(2)</enum><header>Penalty</header><text>Any person who violates paragraph (1) shall be fined not more than $250,000 per offense.</text></paragraph></subsection><subsection id="id5287bde5-1711-42b2-9a46-a98d38072716"><enum>(c)</enum><header>Offense relating to physical violence</header><paragraph id="idd9014000-be4f-4368-892f-d4c8ff1c1afa"><enum>(1)</enum><header>Offense</header><text>It shall be unlawful to make publicly available an artificial intelligence chatbot, knowing or with reckless disregard for the fact that the artificial intelligence chatbot solicits, induces, or coerces minors to commit suicide or carry out non-suicidal self-injury, imminent unlawful physical or sexual violence, or homicide.</text></paragraph><paragraph id="id27811957-879c-43b4-bf45-b6165e07f6f4" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Penalty</header><text>Any person who violates paragraph (1) shall be fined not more than $250,000 per offense.</text></paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idd3d5eb1a-89ef-46b4-a852-6de05c0c05fb"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of chapters for part I of title 18, United States Code, is amended by inserting after the item relating to chapter 5 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id875d5d18-f3e7-4c8c-9801-ec9e59a80180" changed="added" reported-display-style="italic" committee-id="SSJU00"><toc changed="added" reported-display-style="italic" committee-id="SSJU00"><multi-column-toc-entry level="chapter" bold="on"><toc-enum>6.</toc-enum><level-header level="chapter">Artificial intelligence</level-header><target>91</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id6b6a867f-0590-4ff5-b113-32c67f483104" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>5.</enum><header>Covered entity obligations</header><subsection id="id39df7fa8-9b7d-488f-86d1-98ac00d4e516"><enum>(a)</enum><header>Creation of user accounts</header><text>A covered entity shall require each individual accessing an AI companion to make a user account in order to use or otherwise interact with the AI companion.</text></subsection><subsection id="id43caa57e-7963-466f-9122-c0b4dfaf50c7"><enum>(b)</enum><header>Age verification</header><paragraph id="id9cb51267-01be-4116-9e74-aef6cf77dcec"><enum>(1)</enum><header>Age verification of existing accounts</header><text>With respect to each user account of an AI companion that exists as of the effective date of this Act, a covered entity shall—</text><subparagraph id="ide914371e58384ac985b9b986507c84fc"><enum>(A)</enum><text>on that date, freeze the account;</text></subparagraph><subparagraph id="idea1d04e1a56942e58bea173475509030"><enum>(B)</enum><text>in order to restore the functionality of the account, require verification that the user is an adult using a reasonable age verification process, subject to paragraph (4); and</text></subparagraph><subparagraph id="id773f8fbe-d15e-4de6-b1e1-82ea76aec085"><enum>(C)</enum><text>using the verification described in subparagraph (B), classify the user as a minor or an adult.</text></subparagraph></paragraph><paragraph id="id0909b743-842b-4929-9aa2-f1d9281f5f1e"><enum>(2)</enum><header>Age verification of new accounts</header><text>At the time an individual creates a new user account to use or interact with an AI companion, a covered entity shall—</text><subparagraph id="id1c4adbb67a904fe7824ba3d5734f083c"><enum>(A)</enum><text>require verification that the user is an adult using a reasonable age verification process, subject to paragraph (4); and</text></subparagraph><subparagraph id="id3db90b9ef9474ac4919e34e51748b78f"><enum>(B)</enum><text>using the verification described in subparagraph (A), classify the user as a minor or an adult.</text></subparagraph></paragraph><paragraph id="id718800a3-d1d5-42ce-8967-c42275f2034a"><enum>(3)</enum><header>Periodic age verification</header><text>A covered entity shall periodically re-verify previously verified user accounts using a reasonable age verification process, subject to paragraph (4), to ensure compliance with this Act.</text></paragraph><paragraph id="id5c3d0c0d-766f-440f-83ae-50bbe48fa0cb" commented="no"><enum>(4)</enum><header>Use of third parties</header><text>For purposes of paragraphs (1)(B), (2)(A), and (3), a covered entity—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb8fa06837f6f4f7cb0a3cedc506e5d6c"><enum>(A)</enum><text display-inline="yes-display-inline">subject to subparagraph (B), may contract with a third party to employ reasonable age verification measures as part of the covered entity's reasonable age verification process, but the use of such a third party shall not relieve the covered entity of its obligations under this Act or from liability under this Act; and</text></subparagraph><subparagraph id="idb9a07ac8c20143df9b2583042b23ff96"><enum>(B)</enum><text>may not contract with a third party closely affiliated with, incorporated in, organized under the laws of, or with a principal place of business in, a covered nation, as defined in section 4872 of title 10, United States Code.</text></subparagraph></paragraph><paragraph id="idd4791eba-d363-4d8f-a282-92ffbc9a4ecd"><enum>(5)</enum><header>Age verification measure data security</header><text>A covered entity and any third party used by a covered entity to employ reasonable age verification measures under paragraph (4)—</text><subparagraph id="idcf3cdf81-4577-40bb-bd86-47fd6f2cc4b5"><enum>(A)</enum><text>shall establish, implement, and maintain reasonable data security to—</text><clause id="idac231ca8-a298-48c9-8651-bd4f6311bf03"><enum>(i)</enum><text>limit collection of personal data to that which is minimally necessary to verify a user’s adult status or maintain compliance with this Act; and</text></clause><clause id="idb8e243fa-7fda-41c2-a8b4-c9bc4353e17e"><enum>(ii)</enum><text>protect such age verification data against unauthorized access;</text></clause></subparagraph><subparagraph id="ide36e069f-6710-44c4-8d5b-fb18785198d1"><enum>(B)</enum><text>shall protect such age verification data against unauthorized access;</text></subparagraph><subparagraph id="idc582c921-2337-4d6e-83ef-8f927eec5b1b"><enum>(C)</enum><text>shall protect the integrity and confidentiality of such data by only transmitting such data using industry-standard encryption protocols;</text></subparagraph><subparagraph id="id26dffc40-ee45-4fa3-bfbd-8810d56433e7"><enum>(D)</enum><text>shall retain such data for no longer than is reasonably necessary to verify a user’s adult status or maintain compliance with this Act; and</text></subparagraph><subparagraph id="idc05bb92f-e0a5-4a62-a504-22c4bc46bd88"><enum>(E)</enum><text>may not share with, transfer to, or sell to, any other entity such data.</text></subparagraph></paragraph></subsection><subsection id="id5770b0ec-0c73-4f73-967b-468c15b52df0"><enum>(c)</enum><header>Required disclosures for artificial intelligence chatbots</header><paragraph id="id73021b04-78ee-41bf-8c4c-c5f9876aac1b"><enum>(1)</enum><header>Disclosure of non-human status</header><text>Each artificial intelligence chatbot made publicly available to end consumers shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id663fb44f-333d-4e96-b4fc-ada02f64e406"><enum>(A)</enum><text display-inline="yes-display-inline">at the initiation of each conversation with a user, clearly and conspicuously disclose to the user that the chatbot is an artificial intelligence system and not a human being; and</text></subparagraph><subparagraph id="id3a3c53b0-35f0-4622-a3d6-b096d40928b1"><enum>(B)</enum><text>be programmed to ensure that the chatbot does not claim to be a human being or otherwise respond deceptively when asked by a user if the chatbot is a human being.</text></subparagraph></paragraph><paragraph id="ided7f893d-c932-44cb-b165-e10d9c29f509"><enum>(2)</enum><header>Disclosure regarding non-professional status</header><subparagraph id="id19866d31-4808-4bc8-b7e2-df8700795282"><enum>(A)</enum><header>In general</header><text>An artificial intelligence chatbot made publicly available to end consumers may not represent, directly or indirectly, that the chatbot is a licensed professional, including a therapist, physician, lawyer, financial advisor, or other professional.</text></subparagraph><subparagraph id="id1cf47ba2-b62d-4acc-9d42-e7fe537367c2"><enum>(B)</enum><header>Other limitations</header><text>Each artificial intelligence chatbot made publicly available to end consumers shall, at the initiation of each conversation with a user and at reasonably regular intervals, clearly and conspicuously disclose to the user that—</text><clause id="id2edc346f-5c23-4278-966c-f309443da96b"><enum>(i)</enum><text>the chatbot does not provide medical, legal, financial, or psychological services; and</text></clause><clause id="idd29792d0-b432-4e40-80ca-e114b612e434"><enum>(ii)</enum><text>users of the chatbot should consult a licensed professional for such advice.</text></clause></subparagraph></paragraph></subsection></section><section id="id0532aec0-8da6-423b-9dc2-fc01e893731c" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>6.</enum><header>Prohibition on minor use of AI companions</header><text display-inline="no-display-inline">If the age verification process described in section 5(b) determines that an individual is a minor, a covered entity shall prohibit the minor from accessing or using any AI companion made publicly available to end consumers by the covered entity.</text></section><section id="id9511fdd0-b7a7-4c94-b2c8-a81ce7a85f08" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>7.</enum><header>Enforcement</header><subsection id="id2da6a6f5-040c-4472-87e0-1a6c76114236"><enum>(a)</enum><header>In general</header><text>In the case of a violation of section 5 or 6, or a regulation promulgated thereunder, the Attorney General may bring a civil action in an appropriate district court of the United States to—</text><paragraph commented="no" display-inline="no-display-inline" id="id58e6bcba-b160-4b07-89d7-1bd2bc18e116"><enum>(1)</enum><text display-inline="yes-display-inline">enjoin the violation;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf6b81b03-2aa3-437b-b0e6-c48798c0fa41"><enum>(2)</enum><text display-inline="yes-display-inline">enforce compliance with section 5 or 6, or the regulation promulgated thereunder; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idee0eb142-6f9c-4246-97c7-d93aa5b6b4a1"><enum>(3)</enum><text display-inline="yes-display-inline">obtain civil penalties under subsection (c) of this section, restitution, and other appropriate relief.</text></paragraph></subsection><subsection id="id549db47c-a237-4571-b508-b4f396fccb9e"><enum>(b)</enum><header>Attorney General rulemaking</header><paragraph commented="no" display-inline="no-display-inline" id="idd08429813c24491496bd39980e55b533"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Subject to paragraph (2), the Attorney General may promulgate any regulations necessary to carry out section 5 or 6 of this Act and the amendments made by this Act.</text></paragraph><paragraph id="id5c1e0aa93b2b49cf94abec97eea2cc2d"><enum>(2)</enum><header>Limitation</header><text>No regulation promulgated under paragraph (1) may—</text><subparagraph commented="no" display-inline="no-display-inline" id="id77905d478a4942c682517e8d917a8404"><enum>(A)</enum><text display-inline="yes-display-inline">impose a requirement on a covered entity that is not expressly authorized by this Act or an amendment made by this Act; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id09bf39ba00e94853b6f09d476d05858f"><enum>(B)</enum><text display-inline="yes-display-inline">address the development, deployment, or general operation of artificial intelligence systems outside the scope of obligations and offenses set forth in this Act and the amendments made by this Act.</text></subparagraph></paragraph></subsection><subsection id="id61dcde04-1cd8-4e90-b631-b61fcc455f7a"><enum>(c)</enum><header>Civil penalties</header><paragraph id="idcf475e0f-9a4e-4f33-a1b8-b2dbca3ba5c0"><enum>(1)</enum><header>In general</header><text>Any person who violates section 5 or 6, or a regulation promulgated thereunder, shall be subject to a civil penalty not to exceed $250,000 for each violation.</text></paragraph><paragraph id="idbef46021-73f9-4438-b887-24efdc577a83" commented="no"><enum>(2)</enum><header>Separate violations</header><text>Each violation described in paragraph (1) shall be considered a separate violation.</text></paragraph></subsection><subsection id="id0c5c9e7c-24b0-47bc-89a3-02e4d37f0a72"><enum>(d)</enum><header>State enforcement</header><text>In any case in which the attorney general of a State has reason to believe that an interest of the residents of that State has been or is threatened or adversely affected by the engagement of any covered entity in a violation of section 5 or 6, or a regulation promulgated thereunder, the State, as parens patriae, may bring a civil action on behalf of the residents of the State in a district court of the United States or a State court of appropriate jurisdiction to obtain injunctive relief.</text></subsection><subsection id="id5f742d9d-feb3-4de6-b0ab-7f792e2f3da5"><enum>(e)</enum><header>Relationship to State laws</header><text display-inline="yes-display-inline">Nothing in this Act or an amendment made by this Act, or any regulation promulgated thereunder, shall be construed to prohibit or otherwise affect the enforcement of any State law or regulation that is at least as protective of users of artificial intelligence chatbots as this Act and the amendments made by this Act, and the regulations promulgated thereunder.</text></subsection></section><section id="idd65cd89e-752a-4ad9-bd40-cfcbc6cefc21" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>8.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of or amendment made by this Act, or the application thereof to any person or circumstance, is held to be unconstitutional, the remainder of this Act and the amendments made by this Act, and the application of the provision or amendment to any other person or circumstance, shall not be affected.</text></section><section id="idd6b2df2895b944a6879c9e4068a12ea1" commented="no" display-inline="no-display-inline" section-type="subsequent-section" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>9.</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on the date that is 180 days after the date of enactment of this Act.</text></section></legis-body><endorsement><action-date>May 11, 2026</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
