<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 289</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250129">January 29, 2025</action-date><action-desc><sponsor name-id="S386">Ms. Duckworth</sponsor> (for herself, <cosponsor name-id="S431">Mr. Curtis</cosponsor>, and <cosponsor name-id="S434">Mr. Moreno</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ban the sale of products with a high concentration of sodium nitrite to individuals, and for other purposes. </official-title></form><legis-body><section id="id0dec3561a07b4119bbb968944c85d4ad" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Youth Poisoning Protection Act</short-title></quote>.</text></section><section id="H249ED46171BA463A8D2FB5F4C4E254DB"><enum>2.</enum><header>Banning of products containing a high concentration of sodium nitrite</header><subsection id="HE4EE2FE885414D26BC9F30CD44FA91F9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any consumer product containing a high concentration of sodium nitrite shall be considered to be a banned hazardous product under section 8 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2057">15 U.S.C. 2057</external-xref>).</text></subsection><subsection id="idc8ebb1a734d4439cb4fb69c8d6f58931"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to—</text><paragraph commented="no" display-inline="no-display-inline" id="id6e7cae4f12da495b94bc3b4a33b6c1fb"><enum>(1)</enum><text display-inline="yes-display-inline">prohibit any commercial or industrial purpose in which high concentration sodium nitrite is not customarily produced or distributed for sale to, or use or consumption by, or enjoyment of, a consumer; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1fccd5cb9bde49dba186aeaa525494b8"><enum>(2)</enum><text display-inline="yes-display-inline">apply to high concentration sodium nitrite that meets the definition of a <quote>drug</quote>, <quote>device</quote>, or <quote>cosmetic</quote> (as such terms are defined in sections 201(g), (h), and (i) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321(g)</external-xref>, (h), and (i))), or <quote>food</quote> (as defined in section 201(f) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321(f)</external-xref>)), including poultry and poultry products (as such terms are defined in sections 4(e) and (f) of the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/453">21 U.S.C. 453(e)</external-xref>and (f))), meat and meat food products (as such terms are defined in section 1(j) of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601(j)</external-xref>)), and eggs and egg products (as such terms are defined in section 4 of the Egg Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1033">21 U.S.C. 1033</external-xref>)). </text></paragraph></subsection><subsection id="HACA47BB855F540DB876DDD6F41BE5587"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section:</text><paragraph id="HAFA87C9700E6494595801439AE939407"><enum>(1)</enum><header>Consumer product</header><text display-inline="yes-display-inline">The term <term>consumer product</term> has the meaning given that term under section 3(a)(5) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)(5)</external-xref>).</text></paragraph><paragraph id="HCD20DE5F31CB4D24952152ED43064E72"><enum>(2)</enum><header>High concentration of sodium nitrite</header><text>The term <term>high concentration of sodium nitrite</term> means a concentration of 10 or more percent by weight of sodium nitrite.</text></paragraph></subsection><subsection id="H3D6F333F7E254D52B89ED293DCA9865E"><enum>(d)</enum><header>Effective date</header><text>This section shall take effect 90 days after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
