<section id="H7B5E9F2A8CC247038788CC417CC6741D" section-type="section-one" changed="added" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Illegal Red Snapper and Tuna Enforcement Act</short-title></quote>.</text></section> <section id="H33F25178636F4B13B87DB5F280A9ECD0" commented="no" display-inline="no-display-inline"><enum>2.</enum><header>Methodology for identifying country of origin of seafood</header> <subsection id="H2A7A6AFC301F4013891634820B039A05"><enum>(a)</enum><header>Definitions</header><text>In this section: </text>
<paragraph id="HCF676AB96F79498398D2C29290E2B184"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the National Oceanic and Atmospheric Administration.</text></paragraph> <paragraph id="H5F9E89F074CD446AB87A18067E66D95F"><enum>(2)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text>
<subparagraph id="HB42F73E092464FCC93445E1681C265D7" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and Transportation of the Senate; and </text></subparagraph> <subparagraph id="H10E3569443604BFCA4526F8B071984D8" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Science, Space, and Technology, the Committee on Transportation and Infrastructure, and the Committee on Natural Resources of the House of Representatives.</text></subparagraph></paragraph>
<paragraph id="H4D3085A1F5D2400F983B976E6E7DF6F4" commented="no"><enum>(3)</enum><header>Illegal, unreported, or unregulated fishing; IUU fishing</header><text display-inline="yes-display-inline">The terms <quote>illegal, unreported, or unregulated fishing</quote> and <quote>IUU fishing</quote> mean <quote>illegal, unreported, or unregulated fishing</quote> as such term is defined for purposes of section 609(e) of the High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826j">16 U.S.C. 1826j(e)</external-xref>).</text></paragraph> <paragraph id="H9FAA13E1FCAE4D7AAF806E324AB8C385" commented="no"><enum>(4)</enum><header>Key agency leadership</header><text>The term <term>key agency leadership</term> means the Administrator and the Under Secretary, in consultation with the Commissioner of U.S. Customs and Border Protection and the Commandant of the Coast Guard.</text></paragraph>
<paragraph id="H57A86FFC7621453CB6E99480ED58B3EB"><enum>(5)</enum><header>Red snapper</header><text>The term <term>red snapper</term> means the species <italic>Lutjanus campechanus</italic>.</text></paragraph> <paragraph id="HBB0AAE344D4049D6B7CFF735D705ED7A"><enum>(6)</enum><header>Tuna</header><text>The term <term>tuna</term> means the following species of tuna: </text>
<subparagraph id="HCCE59FF2B36048B9B6C94BB0176F7B82" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Bigeye tuna (<italic>Thunnus obesus</italic>). </text></subparagraph> <subparagraph id="H8F5624BAA20B48948C62D679838FAF82" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">Yellowfin tuna (<italic>Thunnus albacares</italic>). </text></subparagraph>
<subparagraph id="HD055B863C8764ACA9BCAF6A82BD39D67" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">Bluefin tuna (<italic>Thunnus thynnus</italic>).</text></subparagraph></paragraph> <paragraph id="HC321F82417B9420FBB2FB440A89538F1" commented="no"><enum>(7)</enum><header>Under Secretary</header><text>The term <term>Under Secretary</term> means the Under Secretary of Commerce for Standards and Technology.</text></paragraph></subsection>
<subsection id="H5E267626F2C04CBAA291EE82A08527DD"><enum>(b)</enum><header>Standard methodology for identification</header>
<paragraph id="H2ACECCA7F3AF4CACA94609108A22C96D" commented="no"><enum>(1)</enum><header>In general</header><text>Key agency leadership shall jointly develop a standard methodology, based on chemical analysis, for identifying the country of origin of seafood to support enforcement against IUU fishing and seafood fraud. </text></paragraph> <paragraph id="H0D455BFA7F8149E398A11C4B944DC122" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">Key agency leadership shall ensure that the methodology developed under this subsection—</text>
<subparagraph id="H6B70D360A62343DEB54816B6D581E691" commented="no"><enum>(A)</enum><text>is consistent with the needs of Federal and State law enforcement agencies in combating IUU fishing and seafood fraud;</text></subparagraph> <subparagraph id="H7A267BEC37B24B848E175881AE4F4A11"><enum>(B)</enum><text>minimizes processing time;</text></subparagraph>
<subparagraph id="HB92E3EE5D5DF4F72B698D553A783636C"><enum>(C)</enum><text>involves the use of a field kit that can be easily carried by one individual; and</text></subparagraph> <subparagraph id="H059C4B750B55434ABB2B0F64D40FFB3B" commented="no"><enum>(D)</enum><text>to the extent practicable, can be used to test prepared food, including raw preparations of seafood, such as ceviche, sashimi, sushi, and poke.</text></subparagraph></paragraph>
<paragraph id="HB23741B4372649D8B921867BB0B9A3DE" commented="no"><enum>(3)</enum><header>Initial species for identification</header><text>In developing the methodology under this subsection, key agency leadership shall conduct pilot studies on red snapper, as an example of a stationary stock, and tuna, as an example of a highly migratory stock.</text></paragraph></subsection> <subsection id="HA69EA4CDA1FA41DAAEA4C10591ADCED1"><enum>(c)</enum><header>Report</header><text>Not later than 2 years after the date of the enactment of this Act, the Under Secretary shall submit to the appropriate committees of Congress a report that includes the following: </text>
<paragraph id="H26A4591774BF4667B5D422315AF6E2C4"><enum>(1)</enum><text>A summary of the methodology developed under subsection (b). </text></paragraph> <paragraph id="H24797D35BBC8468E92F88D65CDBE9A70" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>A plan for operationalizing such methodology. </text></paragraph>
<paragraph id="H4C168107B16240FFA7A85C3D3BC3C908" commented="no"><enum>(3)</enum><text>If the Under Secretary determines any aspect of such methodology is impractical, an explanation relating thereto, whether additional research would make developing such a methodology practicable, and whether a different approach other than chemical analysis might be practicable.</text></paragraph></subsection></section> </amendment-block></amendment></engrossed-amendment-body><attestation><attestation-group><attestor display="no">Kevin F.
