which was read twice and referred to the <committee-name committee-id="SSHR00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20260728">July 28, 2026</action-date><action-desc>Reported by <sponsor name-id="S373">Mr. Cassidy</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To require sponsors of drug applications and holders of approved applications to provide certain submissions and communications to the Food and Drug Administration and the United States Patent and Trademark Office.</official-title></form><legis-body><section section-type="section-one" id="S1" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medication Affordability and Patent Integrity Act</short-title></quote>.</text></section><section id="id562F7FB98F334120975D338CAE3BC41B" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><enum>2.</enum><header>Disclosure of information</header><subsection id="idB2B2C5A5FEC143469AD04C752D29F9B2"><enum>(a)</enum><header>In general</header><paragraph id="id52980FC2AF194AF89ECB03DDC974210E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 505(b) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC065CB1443EC454A88478C2110F40AD6" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><paragraph id="idE09868FD35B145C18B09C8690F0E1D15" indent="up1"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id8612D847AD3A4A90857E191BBE185393"><enum>(A)</enum><text>With respect to any application submitted under this subsection or approved under subsection (c), the sponsor of the application or holder of the approved application shall, for any applicable patent— </text><clause indent="up1" id="id708B8D855E384BE48BF2887621DE0E67"><enum>(i)</enum><text>certify to the Food and Drug Administration that the information described in subparagraph (B) that is submitted to the Secretary is, to the best knowledge of the sponsor or holder, consistent with the information such sponsor or holder provided to the United States Patent and Trademark Office and any communications such sponsor or holder had with the United States Patent and Trademark Office; and</text></clause><clause indent="up1" id="id493D2AD0AF9F45FB8EB95B3C1C3467F2"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id4415FDF562C44660A75EA06535638F62"><enum>(I)</enum><text>submit to the United States Patent and Trademark Office any information material to patentability with respect to such applicable patent that the sponsor or holder submits to the Food and Drug Administration, and any information the Food and Drug Administration provided in response; and</text></subclause><subclause indent="up1" id="id830C416AC2B346CF89CFDFA49A6962D2"><enum>(II)</enum><text>certify to the United States Patent and Trademark Office that the submission under subclause (I), to the best knowledge of the sponsor or holder, includes all information material to patentability, and is consistent with the information such sponsor or holder provided to the Food and Drug Administration and any communications such sponsor or holder had with the Food and Drug Administration.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id1f63619d20404057a1a335af8f802448"><enum>(B)</enum><text display-inline="yes-display-inline">The information described in this subparagraph is limited to information that is material to patentability, as defined in regulations promulgated by the United States Patent and Trademark Office, and that is—</text><clause commented="no" display-inline="no-display-inline" id="idef787873edfd4d83942a4a39ee93858f"><enum>(i)</enum><text display-inline="yes-display-inline">any statement or characterization of analytical data set forth in the chemistry, manufacturing, and controls section of a new drug application disclosed by the sponsor of the application or holder of the approved application under this section to the United States Patent and Trademark Office that has been, or will be, submitted to the Food and Drug Administration to support the approval of an application under this section;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7e240ef6df984763886071730cc3faf6"><enum>(ii)</enum><text display-inline="yes-display-inline">any statement or characterization with respect to an applicable patent, including any statement or characterization of prior art, submitted by the sponsor of the application or holder of the approved application to the United States Patent and Trademark Office in support of patentability; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id4b231edbb23e46ccaa3e2c4d10eefdc2"><enum>(iii)</enum><text display-inline="yes-display-inline">other information, as the Secretary or the Secretary of Commerce may by regulation require.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id0cb16c53759749478bb6a9cc539c5110"><enum>(C)</enum><text display-inline="yes-display-inline">In this paragraph, the term <term>applicable patent</term> means—</text><clause id="idDB80C9DC75F4406F8BCD919D23217AE2"><enum>(i)</enum><text> a patent that—</text><subclause id="id121378E57F8844CA9611B486E24442A8"><enum>(I)</enum><text>claims a drug that is the subject of an application described in subparagraph (A), including any patent that claims, with respect to such a drug, a formulation or composition, method of use, or method of manufacturing; and </text></subclause><subclause id="id06D0C01E4C5941FB81287FA6A460426C"><enum>(II)</enum><text>is issued, assigned, or licensed to the sponsor of the application or holder of the approved application described in subparagraph (A); </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf7580b0fb2d44782a5b16f5b212e69ee"><enum>(ii)</enum><text display-inline="yes-display-inline">an application for a patent described in clause (i)(I) that is sought by the sponsor of the application or holder of the approved application described in subparagraph (A); or</text></clause><clause id="idB7ECFBD5E69E4D01BCC42AB457883F8F"><enum>(iii)</enum><text>such other patent or application for a patent as the Secretary or the Secretary of Commerce may by regulation require.</text></clause></subparagraph><subparagraph indent="up1" id="id187E04B6A5FF4E85A6E2419E90CA20C8"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="id3EB3294FD51F460A8453FD22DECB070B"><enum>(i)</enum><text>Except as provided in clause (ii), subparagraph (A) shall apply with respect to any original application submitted under this subsection on or after the date of enactment of the <short-title>Medication Affordability and Patent Integrity Act</short-title> and to any amendments or supplements to such original application.</text></clause><clause indent="up1" id="id29A146E0FFE14D07B4CB13ABA92D5A42"><enum>(ii)</enum><text>In the case of an application submitted before the date of enactment of the <short-title>Medication Affordability and Patent Integrity Act</short-title>, the requirements of subparagraph (A) apply only with respect to—</text><subclause id="id9CC1155867B4400B813AB43449DBD6B1"><enum>(I)</enum><text>any applicable patent issued on or after such date of enactment; and</text></subclause><subclause id="id47A8B42B19C84B508C792E1F8D1F4EF9"><enum>(II)</enum><text>in the case of an applicable patent issued before such date of enactment, only to submissions and communications described in clauses (i) and (ii) of subparagraph (A) made on or after such date of enactment.</text></subclause></clause></subparagraph><subparagraph id="idda282eecec6d4eeba41b85deca68a0cc" indent="up1"><enum>(E)</enum><text>The United States Patent and Trademark Office shall, as necessary, update its applicable regulations or establish new procedures to ensure that any information that the sponsor or holder of the application has submitted to or received from the Food and Drug Administration and that is submitted to the United States Patent and Trademark Office to fulfill the requirements of subparagraph (A), and that would not otherwise be submitted to the United States Patent and Trademark Office, shall remain subject to application protections for trade secret or confidential information or financial information as if the information were held by the Food and Drug Administration.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idfecf216ef6154d30a96a8f2b46c6d27d"><enum>(2)</enum><header>Inclusion of certifications in application</header><text>Section 505(b)(1)(A) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355(b)(1)(A)</external-xref>) is amended—</text><subparagraph id="id78349605ca29484eb962b7e0457703f6"><enum>(A)</enum><text>in clause (vii), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="idbe66aaa676b348f49f1ddee034c80f90"><enum>(B)</enum><text>in clause (viii)(II), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id6f337de1561a490daf2e0a0290fbbc47"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbbc9b229af374c6c85a0032a9685b279" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><clause id="ida49afb748873406cbe8c07ea40f11979" indent="up2"><enum>(ix)</enum><text>with respect to each patent listed in the application pursuant to clause (viii) that is an applicable patent (as defined in paragraph (7)(C)), the certifications required under clauses (i) and (ii)(II) of paragraph (7)(A).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="idAF3135A101DB4AF09CA6C102D14B11B3"><enum>(b)</enum><header>Biological product applications</header><text>Section 351(a)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262(a)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3D609B9D38BF43F4979BB577B3E99C13" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><subparagraph id="id7DC2951F445346408C20E4F54218B46F" indent="up2"><enum>(F)</enum><clause commented="no" display-inline="yes-display-inline" id="id84E00D83CAE14FA0B780B208FA819698"><enum>(i)</enum><text>With respect to any application submitted under this subsection or biological product licensed under this subsection, the sponsor of the application or holder of the licensure shall, for any applicable patent—</text><subclause indent="up1" id="id20F18EEFDCE1416C8E44AFDCFAB118E5"><enum>(I)</enum><text>certify to the Food and Drug Administration that the information described in clause (ii) that is submitted to the Secretary is, to the best knowledge of the sponsor or holder, consistent with the information such sponsor or holder provided to the United States Patent and Trademark Office and any communications such sponsor or holder had with the United States Patent and Trademark Office; and</text></subclause><subclause indent="up1" id="idE494290329C04901A034895590ACF0C3"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id59F19598526247EFB6041F3209B4BDF0"><enum>(aa)</enum><text>submit to the United States Patent and Trademark Office any information material to patentability with respect to such applicable patent that the sponsor or holder submits to the Food and Drug Administration provided in response; and</text></item><item indent="up1" id="id105E3C9CB28F45CDBFA1602407AB8DBB"><enum>(bb)</enum><text>certify to the United States Patent and Trademark Office that the submission under item (aa), to the best knowledge of the sponsor or holder, includes all information material to patentability and is consistent with the information such sponsor or holder provided to the Food and Drug Administration and any communications such sponsor or holder had with the Food and Drug Administration.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="idea8240b0c56f463783124a7cddea26bf"><enum>(ii)</enum><text>The information described in this clause is limited to information that is material to patentability, as defined in regulations promulgated by the United States Patent and Trademark Office, and that is—</text><subclause commented="no" display-inline="no-display-inline" id="idcd52495810b04bfab5a3cf2f6aed70cb"><enum>(I)</enum><text display-inline="yes-display-inline">any statement or characterization of analytical data set forth in the chemistry, manufacturing, and controls section in a biological product license application disclosed by the sponsor of the application or holder of the approved application under this section to the United States Patent and Trademark Office that has been, or will be, submitted to the Food and Drug Administration to support the approval of an application under this section;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5cf9cf5035e44b83903e97490de8b5fd"><enum>(II)</enum><text display-inline="yes-display-inline">any statement or characterization with respect to an applicable patent, including any statement or characterization of prior art, submitted by the sponsor of the application or holder of the approved application to the United States Patent and Trademark Office in support of patentability; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0d0c1ac322174cd686e56c716eb28b3d"><enum>(III)</enum><text display-inline="yes-display-inline">other information, as the Secretary or the Secretary of Commerce may by regulation require.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id72cfd9f2374e40ef83057d8628f57d39"><enum>(iii)</enum><text display-inline="yes-display-inline">In this subparagraph, the term <term>applicable patent</term> means—</text><subclause id="idEA6FD899EA9C4FBA80892303B179556C"><enum>(I)</enum><text>a patent that—</text><item id="idB6473280749F4D8AB820F463A30AFFB4"><enum>(aa)</enum><text>claims a biological product that is the subject of an application described in clause (i), including any patent that claims, with respect to such biological product, a formulation or composition, method of use, or method of manufacturing; and</text></item><item id="idDB06A1A837E64B62B6F3B715F1D63F4E"><enum>(bb)</enum><text>is issued, assigned, or exclusively licensed to the sponsor of the application or holder of the licensure described in clause (i);</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id63afe0181d954d3992fdcddc2f603948"><enum>(II)</enum><text display-inline="yes-display-inline">an application for a patent described in subclause (I)(aa) that is sought by the sponsor of the application or holder of the licensure described in clause (i); or</text></subclause><subclause id="id18E19126F22D45938026E879236C3970"><enum>(III)</enum><text>such other patent or application for a patent as the Secretary or Secretary of Commerce may by regulation require.</text></subclause></clause><clause indent="up1" id="id3E2DC650D1FC4BC09940FB087C047BD9"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="id8ADB278221DB4AB6B7A82418E451481C"><enum>(I)</enum><text>Except as provided in subclause (II), clause (i) shall apply with respect to any original application submitted under this subsection on or after the date of enactment of the <short-title>Medication Affordability and Patent Integrity Act</short-title> and to any amendments or supplements to such original application.</text></subclause><subclause indent="up1" id="id109C5A5A6B3F4369AB06C51504331782"><enum>(II)</enum><text>In the case of an application submitted under this subsection before the date of enactment of the <short-title>Medication Affordability and Patent Integrity Act</short-title>, the requirements of clause (i) apply only with respect to—</text><item id="id02757CC2D8354245AF1CB0FE62F2221F"><enum>(aa)</enum><text>any applicable patent issued on or after such date of enactment; and</text></item><item id="id41BC57BA8FC9489697D35165E8514BE3"><enum>(bb)</enum><text>in the case of an applicable patent issued before such date of enactment, only to submissions and communications described in subclauses (I) and (II) of clause (i) made on or after such date of enactment.</text></item></subclause></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="idccc1f7afc6ac4020b5dc0bf1fa2099a6"><enum>(v)</enum><subclause commented="no" display-inline="yes-display-inline" id="id99bdbd098efd4dda8aa17857ef74eacb"><enum>(I)</enum><text>Any information that the sponsor of the application or holder of the licensure has submitted to or received from the Food and Drug Administration that is submitted to the United States Patent and Trademark office to fulfill the requirements of clause (i) shall remain subject to application protections for trade secret or confidential information or financial information as if the information were held by the Food and Drug Administration.</text></subclause><subclause indent="up1" commented="no" display-inline="no-display-inline" id="id69055ba9a0e642eabc7988d5e37a130a"><enum>(II)</enum><text display-inline="yes-display-inline">The United States Patent and Trademark Office shall, as necessary, update its applicable regulations or create new procedures to ensure compliance with subclause (I) for information submitted under this subparagraph.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idAF1F16D86F9446B0867ECBF521BAC3E0"><enum>(c)</enum><header>Enforcement</header><paragraph commented="no" display-inline="no-display-inline" id="ide33e505baac34cb3a1eecbf7596980a9"><enum>(1)</enum><header>FDA enforcement</header><text display-inline="yes-display-inline">Section 301(q)(1) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331(q)(1)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id69fc88b927af4dcda8434b78a9795667"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (B), by striking <quote>; or</quote> and inserting a semicolon;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida3ba03ff33e64e609f4600316e7b0442"><enum>(B)</enum><text>in clause (C), by striking the period and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id47afcce3b43e4041a29aee9ec9c9b3c4"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id19E70C35324C4BAFBE6D0DFA48A21BF7" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><subparagraph id="id894203d4773d4f948bdc0c6877785b21" indent="up1"><enum>(D)</enum><text>to submit the certification required under section 505(b)(7) of this Act or section 351(a)(2)(F) of the Public Health Service Act.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id64BCDFEDACAF4B6BA651B025526D8EB1"><enum>(2)</enum><header>Defense against patent infringement actions</header><subparagraph id="id86C2DD722E9A47DDA88D77A9FC35CCB9"><enum>(A)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/28">Chapter 28</external-xref> of title 35, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id7F85A91906B741D5B5BB89A77AFAB69A" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><section id="id67CFDDC20013488281907F9506649D33"><enum>274.</enum><header>Non-disclosure defense to infringement of drug patent</header><text display-inline="no-display-inline">A person shall be entitled to a defense under section 282(b) in an action asserting infringement of an applicable patent (as defined in paragraph (7)(C) of section 505(b) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355(b)</external-xref>) or subparagraph (F)(ii) of section 351(a)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262(a)(2)</external-xref>)) if the owner or predecessor owner of the applicable patent violated paragraph (7)(A) of such section 505(b) or subparagraph (F)(i) of such section 351(a)(2) with respect to the applicable patent by negligently or intentionally failing to disclose any information required to be disclosed pursuant to such paragraph (7)(A) or such subparagraph (F)(i).</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="idFCA9B812639741B6B0A96076706BFC39"><enum>(B)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/28">chapter 28</external-xref> of title 35, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id76F18DF7A48B45588483CF9954C669C5" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><toc changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><toc-entry bold="off" level="section">274. Non-disclosure defense to infringement of drug patent.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id7cdb2cae4e044d5e9fe6ae49df84edc4" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSHR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medication Affordability and Patent Integrity Act</short-title></quote>.</text></section><section id="idd3fe2489ecfb4efa88cd80a6e9e2b1f9" changed="added" reported-display-style="italic" committee-id="SSHR00"><enum>2.</enum><header>Disclosure of information</header><subsection id="id0091f46461b047e8a2db22bcad26d416"><enum>(a)</enum><header>In general</header><paragraph id="idc5d022c202554c419a88d8e0f4fb88ab"><enum>(1)</enum><header>In general</header><text>Section 505(b) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfcc1858cefd14ef4a960febd9bee4e53" changed="added" reported-display-style="italic" committee-id="SSHR00"><paragraph id="id75ff73c2fb764528b57e51709208e3e5" indent="up1"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id35836a9f54474184a37e5c4539db4b4b"><enum>(A)</enum><text>With respect to any application submitted under this subsection or approved under subsection (c), the sponsor of the application or holder of the approved application shall, for any applicable patent—</text><clause id="ide0c7485e716d4ecb9024dac4326b2db5" indent="up1"><enum>(i)</enum><text>certify to the Food and Drug Administration that the information described in subparagraph (B) that is submitted to the Secretary is, to the best knowledge of the sponsor or holder, consistent with the information such sponsor or holder provided to the United States Patent and Trademark Office and any communications such sponsor or holder had with the United States Patent and Trademark Office; and</text></clause><clause id="id7cb8277658af453b9f6273d3f0151f11" indent="up1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id443f4c95e61842b58ebff7f9bf5a1d97"><enum>(I)</enum><text>submit to the United States Patent and Trademark Office any information material to patentability, with respect to such applicable patent that the sponsor or holder submits to the Food and Drug Administration, and any information the Food and Drug Administration provided in response; and</text></subclause><subclause id="id614ab9143a48432d99f7aeaa4bae3e48" indent="up1"><enum>(II)</enum><text>certify to the United States Patent and Trademark Office that the submission under subclause (I), to the best knowledge of the sponsor or holder, includes all information material to patentability and is consistent with the information such sponsor or holder provided to the Food and Drug Administration and any communications such sponsor or holder had with the Food and Drug Administration.</text></subclause></clause></subparagraph><subparagraph id="id176552db53c543b1a1e8026b4f641e1d" indent="up1"><enum>(B)</enum><text>The information described in this subparagraph is limited to information that is material to patentability, as defined in regulations promulgated by the United States Patent and Trademark Office, and that is—</text><clause id="id359bf61ea6d542bfad74c1e4ead2012a"><enum>(i)</enum><text>any statement or characterization of analytical data set forth in the chemistry, manufacturing, and controls section of a new drug application disclosed by the sponsor of the application or holder of the approved application under this section to the United States Patent and Trademark Office that has been, or will be, submitted to the Food and Drug Administration to support the approval of an application under this section;</text></clause><clause id="id8ceb2a9965894e5588c1696166106a4f"><enum>(ii)</enum><text>any statement or characterization with respect to an applicable patent, including any statement or characterization of prior art, submitted by the sponsor of the application or holder of the approved application to the United States Patent and Trademark Office in support of patentability; or</text></clause><clause id="id98eef316d7594c028477e7a7b2a7e1dd"><enum>(iii)</enum><text>other information, as the Secretary or the Secretary of Commerce may by regulation require.</text></clause></subparagraph><subparagraph id="ida6205513980742ef8a6647792adafbea" indent="up1"><enum>(C)</enum><text>In this paragraph, the term <term>applicable patent</term> means—</text><clause id="idd9fee1bcf0ec4aaeb25643e0bae3a8c2"><enum>(i)</enum><text>a patent that—</text><subclause id="id222ce879615f4f9eb04949b0db9e7e9a"><enum>(I)</enum><text>claims a drug that is the subject of an application described in subparagraph (A), including any patent that claims, with respect to such a drug, a formulation or composition, method of use, or method of manufacturing; and</text></subclause><subclause id="ida2fe7a7973064a11846c2a7127911e0d"><enum>(II)</enum><text>is issued, assigned, or exclusively licensed to the sponsor of the application or holder of the approved application described in subparagraph (A);</text></subclause></clause><clause id="idac4e7c5db61e4d158636a4c48a4e0ffc"><enum>(ii)</enum><text>an application for a patent described in clause (i)(I) that is sought by the sponsor of the application or holder of the approved application described in subparagraph (A); or</text></clause><clause id="id02fa9e1b31fe492c89c7990815908017"><enum>(iii)</enum><text>such other patent or application for a patent as the Secretary or the Secretary of Commerce may by regulation require.</text></clause></subparagraph><subparagraph id="id595ac7aea9264db1bb5a6cba460dc1ca" indent="up1"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="idbb621f6a38af437492eba8fb34367ff1"><enum>(i)</enum><text>Except as provided in clause (ii), subparagraph (A) shall apply with respect to any original application submitted under this subsection on or after the date of enactment of the <short-title>Medication Affordability and Patent Integrity Act</short-title> and to any amendments or supplements to such original application.</text></clause><clause id="id99195bd8ba9a4929872c3129555e7fb9" indent="up1"><enum>(ii)</enum><text>In the case of an application submitted under this subsection before the date of enactment of the <short-title>Medication Affordability and Patent Integrity Act</short-title>, the requirements of subparagraph (A) apply only with respect to—</text><subclause id="idc98e801a0f724d1dbdeca1f521d7095f"><enum>(I)</enum><text>any applicable patent issued on or after such date of enactment; and</text></subclause><subclause id="id38e242961a6b461da250a299e4b8a9f5"><enum>(II)</enum><text>in the case of an applicable patent issued before such date of enactment, only to submissions and communications described in clauses (i) and (ii) of subparagraph (A) made on or after such date of enactment.</text></subclause></clause></subparagraph><subparagraph id="id356ed721a2004108b495ee98e261e086" indent="up1"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="id85868e41c3ef4638a10552b15a809c64"><enum>(i)</enum><text>Any information that the sponsor of the application or holder of the approved application has submitted to or received from the Food and Drug Administration that is submitted to the United States Patent and Trademark Office to fulfill the requirements of subparagraph (A), and that would not otherwise be submitted to the United States Patent and Trademark Office, shall remain subject to protections for trade secret or confidential information or financial information applicable to such application as if the information were held by the Food and Drug Administration, except that such protections shall not apply to information that the United States Patent and Trademark Office determines necessary for the public to understand the scope of patent claims granted.</text></clause><clause id="idd57cf96e42b844e9b3471807191288e9" indent="up1"><enum>(ii)</enum><text>The United States Patent and Trademark Office shall, as necessary, update its applicable regulations or establish new procedures to ensure compliance with clause (i) for information submitted under this paragraph.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id8b6c88ea1f9f48e0ad71a28edcbe6706"><enum>(2)</enum><header>Inclusion of certifications in application</header><text>Section 505(b)(1)(A) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355(b)(1)(A)</external-xref>) is amended—</text><subparagraph id="id1f8e74b995e140da822b711080bbd911"><enum>(A)</enum><text>in clause (vii), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="ide9cceae97917463e9fdfda4380abccca"><enum>(B)</enum><text>in clause (viii)(II), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id25dc3bbbb5b94366a6c8510c331f8974"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id06a9951e1861437db2a9ffe7f8a8ab8a" changed="added" reported-display-style="italic" committee-id="SSHR00"><clause id="ida730b34712554d97b3eeba972ca1ed02" indent="up2"><enum>(ix)</enum><text>with respect to each patent listed in the application pursuant to clause (viii) that is an applicable patent (as defined in paragraph (8)(C)), the certifications required under clauses (i) and (ii)(II) of paragraph (8)(A).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="idf18422caca884c81b1bb272c4a5bad96"><enum>(b)</enum><header>Biological product applications</header><text>Section 351(a)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262(a)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide24160b5a2874705adfef7796e7768d3" changed="added" reported-display-style="italic" committee-id="SSHR00"><subparagraph id="idaaa75561a2e1493db559a3b9d893cdbb" indent="up2"><enum>(F)</enum><clause commented="no" display-inline="yes-display-inline" id="id7612fae9497146cc93ab1b2d2be3f914"><enum>(i)</enum><text>With respect to any application submitted under this subsection or biological product licensed under this subsection, the sponsor of the application or holder of the license shall, for any applicable patent—</text><subclause id="id3423dbef79a34f21b8052069347d0372" indent="up1"><enum>(I)</enum><text>certify to the Food and Drug Administration that the information described in clause (ii) that is submitted to the Secretary is, to the best knowledge of the sponsor or holder, consistent with the information such sponsor or holder provided to the United States Patent and Trademark Office and any communications such sponsor or holder had with the United States Patent and Trademark Office; and</text></subclause><subclause id="id3324c289d562447196e63a7ea19d31c8" indent="up1"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="idc05403e7ca8b446192475503b7919adb"><enum>(aa)</enum><text>submit to the United States Patent and Trademark Office any information material to patentability with respect to such applicable patent that the sponsor or holder submits to the Food and Drug Administration, and any information the Food and Drug Administration provided in response; and</text></item><item indent="up1" commented="no" display-inline="no-display-inline" id="id1c768c7cc98b4fe4863efe8be548e908"><enum>(bb)</enum><text display-inline="yes-display-inline">certify to the United States Patent and Trademark Office that the submission under item (aa), to the best knowledge of the sponsor or holder, includes all information material to patentability and is consistent with the information such sponsor or holder provided to the Food and Drug Administration and any communications such sponsor or holder had with the Food and Drug Administration.</text></item></subclause></clause><clause id="id491a7e89c03043fd878330a0c9de13e8" indent="up1"><enum>(ii)</enum><text>The information described in this clause is limited to information that is material to patentability, as defined in regulations promulgated by the United States Patent and Trademark Office, and that is—</text><subclause id="ideee5c9bfc54e4c62834f49446f771a69"><enum>(I)</enum><text>any statement or characterization of analytical data set forth in the chemistry, manufacturing, and controls section of a biological product license application disclosed by the sponsor of the application or holder of the approved application under this section to the United States Patent and Trademark Office that has been, or will be, submitted to the Food and Drug Administration to support the approval of an application under this section;</text></subclause><subclause id="id8523cb7819ee4ce9bda05f2a0b5633cd"><enum>(II)</enum><text>any statement or characterization with respect to an applicable patent, including any statement or characterization of prior art, submitted by the sponsor of the application or holder of the approved application to the United States Patent and Trademark Office in support of patentability; or</text></subclause><subclause id="id59aff2ab681e493c91d777ae72ed172b"><enum>(III)</enum><text>other information, as the Secretary or the Secretary of Commerce may by regulation require.</text></subclause></clause><clause id="id098fa9d65f8b492cb190decc053f1c49" indent="up1"><enum>(iii)</enum><text>In this subparagraph, the term <term>applicable patent</term> means—</text><subclause id="idce30b44d4cef42ce9f16b06e06574004"><enum>(I)</enum><text>a patent that—</text><item id="id1882568757ba4e8fa6145d2addad1f3c"><enum>(aa)</enum><text>claims a biological product that is the subject of an application described in clause (i), including any patent that claims, with respect to such biological product, a formulation or composition, method of use, or method of manufacturing; and</text></item><item id="iddcaf561790b54f8d88941235371b5b78"><enum>(bb)</enum><text>is issued, assigned, or exclusively licensed to the sponsor of the application or holder of the license described in clause (i);</text></item></subclause><subclause id="idf9b6343725bb4ccdaf1b3b1b06feee51"><enum>(II)</enum><text>an application for a patent described in subclause (I)(aa) that is sought by the sponsor of the application or holder of the license described in clause (i); or</text></subclause><subclause id="idb104ec1c79564249b60d39286a9d6d10"><enum>(III)</enum><text>such other patent or application for a patent as the Secretary or Secretary of Commerce may by regulation require.</text></subclause></clause><clause id="id35520b3964ac48c9b666ca720c32c9d6" indent="up1"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="id2bb8cfaeb1714e71bdab6363a86f7867"><enum>(I)</enum><text>Except as provided in subclause (II), clause (i) shall apply with respect to any original application submitted under this subsection on or after the date of enactment of the <short-title>Medication Affordability and Patent Integrity Act</short-title> and to any amendments or supplements to such original application.</text></subclause><subclause id="idc626cc90437b42f9bb57a359bcd0bc06" indent="up1"><enum>(II)</enum><text>In the case of an application submitted under this subsection before the date of enactment of the <short-title>Medication Affordability and Patent Integrity Act</short-title>, the requirements of clause (i) apply only with respect to—</text><item id="id4a09b378dfbe44a9965f54d2be72f165"><enum>(aa)</enum><text>any applicable patent issued on or after such date of enactment; and</text></item><item id="id7d9712568a2642f5938fb4397a2a1c0a"><enum>(bb)</enum><text>in the case of an applicable patent issued before such date of enactment, only to submissions and communications described in subclauses (I) and (II) of clause (i) made on or after such date of enactment.</text></item></subclause></clause><clause id="idd22de5235cc5478dae2548b6153b0c0d" indent="up1"><enum>(v)</enum><subclause commented="no" display-inline="yes-display-inline" id="idfb6ba301cb3e402aad6326ce6c8d33c5"><enum>(I)</enum><text>Any information that the sponsor of the application or holder of the license has submitted to or received from the Food and Drug Administration that is submitted to the United States Patent and Trademark Office to fulfill the requirements of clause (i), and that would not otherwise be submitted to the United States Patent and Trademark Office, shall remain subject to protections for trade secret or confidential information or financial information applicable to such application or license as if the information were held by the Food and Drug Administration, except that such protections shall not apply to information that the United States Patent and Trademark Office determines necessary for the public to understand the scope of patent claims granted.</text></subclause><subclause id="id02b0f2df25e74496af5773aa96a99423" indent="up1"><enum>(II)</enum><text>The United States Patent and Trademark Office shall, as necessary, update its applicable regulations or establish new procedures to ensure compliance with subclause (I) for information submitted under this subparagraph.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idc08fb7790f0d4b8a92761530fab9c3dc"><enum>(c)</enum><header>Enforcement</header><paragraph id="idc04109d5fbb44e4c8c4a4b8388e40da0"><enum>(1)</enum><header>FDA enforcement</header><text>Section 301(q)(1) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331(q)(1)</external-xref>) is amended—</text><subparagraph id="idb971378a3ca6411d9bfcb89dce80b6cf"><enum>(A)</enum><text>in clause (B), by striking <quote>; or</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="idfc6cda9b91b042e4bc03628707fb48c1"><enum>(B)</enum><text>in clause (C), by striking the period and inserting <quote>; or</quote>;
