which was read twice and referred to the <committee-name committee-id="SSGA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20260914">September 14, 2026</action-date><action-desc>Reported by <sponsor name-id="S348">Mr. Paul</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To increase access to agency guidance documents.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="not-changed"><section section-type="section-one" changed="deleted" id="idd9e5291c-29ff-43f9-8930-82dbbbc31d91" reported-display-style="strikethrough" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guidance Out Of Darkness Act</short-title></quote> or the <quote><short-title>GOOD Act</short-title></quote>.</text></section><section changed="deleted" id="ida9a4c690-70e3-46db-a1e0-650b5e0fa11e" reported-display-style="strikethrough" committee-id="SSGA00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idff40def5-7293-482e-96d8-042161a36296"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 551 of title 5, United States Code.</text></paragraph><paragraph id="id27F7C9F0794B4F24B4D42141A6BF6F1B"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="idc032865d723048aab681e5c16e267a74"><enum>(3)</enum><header>Guidance document</header><subparagraph id="ide22a05bc5a454a63a66cd4e335c88595"><enum>(A)</enum><header>Definition</header><text>The term <term>guidance document</term>—</text><clause id="ida1150b9142154bf5af3323bc4f8fb969"><enum>(i)</enum><text>means an agency statement of general applicability (other than a rule that has the force and effect of law promulgated in accordance with the notice and comment procedures under section 553 of title 5, United States Code) that—</text><subclause id="id8ca9b0441e4b40f6b631006db83873a8"><enum>(I)</enum><text>does not have the force and effect of law; and</text></subclause><subclause id="id9739580420fe42b1bd0ccd28d0dac707"><enum>(II)</enum><text>is designated by an agency official as setting forth—</text><item id="idf52b1d780f8a41deaa9a34905321d995"><enum>(aa)</enum><text>a policy on a statutory, regulatory, or technical issue; or</text></item><item id="id73154cb6fefc41e3ad29488e8ebae239"><enum>(bb)</enum><text>an interpretation of a statutory or regulatory issue; and</text></item></subclause></clause><clause id="id8aa45c52dcf34fbca32f64fed4ae6d35"><enum>(ii)</enum><text>may include—</text><subclause id="id0d475bf893a1495fab3509a87a485676"><enum>(I)</enum><text>a memorandum;</text></subclause><subclause id="id4b02e6fa1e334a3087128a1831ec524d"><enum>(II)</enum><text>a notice;</text></subclause><subclause id="id05e882e977bb4d819871f8d1ec48a683"><enum>(III)</enum><text>a bulletin;</text></subclause><subclause id="id612efb985b8842c2aea4aa76b2a401e5"><enum>(IV)</enum><text>a directive;</text></subclause><subclause id="id423c21caaef24fe1bf1257d3caad2c5d"><enum>(V)</enum><text>a news release;</text></subclause><subclause id="idbd10cfe85355443f98962af326cc739f"><enum>(VI)</enum><text>a letter;</text></subclause><subclause id="idb2b3661f710d45549c73d1d08fd67505"><enum>(VII)</enum><text>a blog post;</text></subclause><subclause id="idbbabcc15060447f7a2445b57954a3141"><enum>(VIII)</enum><text>a no-action letter;</text></subclause><subclause id="id5bedc6f3006a4e3a8b88d7dff3c6f24c"><enum>(IX)</enum><text>a speech by an agency official; and</text></subclause><subclause id="idfedd138d3c654bca978cf3ce3c05da35"><enum>(X)</enum><text>any combination of the items described in subclauses (I) through (IX).</text></subclause></clause></subparagraph><subparagraph id="ida559903e6dd9430eb3729160b351b02f"><enum>(B)</enum><header>Rule of construction</header><text>The term <term>guidance document</term>—</text><clause id="idfff9ab2a85ed47aea1cd84e1fb561018"><enum>(i)</enum><text>shall be construed broadly to effectuate the purpose and intent of this Act; and</text></clause><clause id="idbe0ad5ca52814074a9ea5b557ec83eb6"><enum>(ii)</enum><text>shall not be limited to the items described in subparagraph (A)(ii).</text></clause></subparagraph></paragraph></section><section changed="deleted" id="idd167bcff-1787-4753-8b53-1b2c50b7b8a6" reported-display-style="strikethrough" committee-id="SSGA00"><enum>3.</enum><header>Publication of guidance documents on the internet</header><subsection id="id47a30f33-2161-4643-bcab-c7b7fb8502a3"><enum>(a)</enum><header>In general</header><text>Subject to subsection (d), on the date on which an agency issues a guidance document, the agency shall publish the guidance document in accordance with the requirements under subsection (c).</text></subsection><subsection id="id4fce4a96-0521-40fd-aeed-c9304c9c3850"><enum>(b)</enum><header>Previously issued guidance documents</header><text>Subject to subsection (d), not later than 180 days after the date of enactment of this Act, each agency shall publish, in accordance with the requirements under subsection (c), any guidance document issued by that agency that is in effect on that date.</text></subsection><subsection id="id337949c3-9e8f-4424-bdb6-0f5bf770a829"><enum>(c)</enum><header>Single location</header><paragraph id="id7255dbbc-32eb-4aad-a6a3-2d114e4ea550"><enum>(1)</enum><header>In general</header><text>All guidance documents published under subsections (a) and (b) by an agency shall be published in a single location on an internet website designated by the Director under paragraph (4).</text></paragraph><paragraph id="id88bf3985-7949-4b19-9f01-17a534197cd2"><enum>(2)</enum><header>Agency internet websites</header><text>Each agency shall, for guidance documents published by the agency under subsections (a) and (b), publish a hyperlink on the internet website of the agency that provides access to the guidance documents at the location described in paragraph (1).</text></paragraph><paragraph id="ida65eae26-6a7a-474c-b8ab-6f19930be20e"><enum>(3)</enum><header>Organization</header><subparagraph id="id9b9410b8-0d3b-4bff-947d-d840270f3cc3"><enum>(A)</enum><header>In general</header><text>The guidance documents described in paragraph (1) shall be—</text><clause id="idc190584c-8be9-4ba3-b886-0d0cb532a7e1"><enum>(i)</enum><text>categorized as guidance documents; and</text></clause><clause id="id2ba38057-9d3d-4799-ae6b-57a7cacc92fc"><enum>(ii)</enum><text>further divided into subcategories as appropriate.</text></clause></subparagraph><subparagraph id="idb23efa6f-68da-4e02-9383-629d144570df"><enum>(B)</enum><header>Agency internet websites</header><text>The hyperlinks described in paragraph (2) shall be prominently displayed on the internet website of the agency.</text></subparagraph></paragraph><paragraph id="id07c99e17-cb48-4443-8646-51304882a733"><enum>(4)</enum><header>Designation</header><text>Not later than 90 days after the date of enactment of this Act, the Director shall designate an internet website on which guidance documents shall be published under subsections (a) and (b).</text></paragraph></subsection><subsection id="id35EEAA2F450F41D9A91F7AAE49B56B39"><enum>(d)</enum><header>Documents and information exempt from disclosure under FOIA</header><text>If a guidance document issued by an agency is a document that is exempt from disclosure under section 552(b) of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>), or contains information that is exempt from disclosure under that section, that document or information, as the case may be, shall not be subject to the requirements under this Act.</text></subsection><subsection id="id1cdee2b0-fe7d-495b-ab76-03ca2cc1c6fb"><enum>(e)</enum><header>Rescinded guidance documents</header><text>On the date on which a guidance document issued by an agency is rescinded, or, in the case of a guidance document that is rescinded pursuant to a court order, not later than the date on which the order is entered, the agency shall, at the location described in subsection (c)(1)—</text><paragraph id="id11e880ac-3773-4ba0-8381-60fbd57f89cd"><enum>(1)</enum><text>maintain the rescinded guidance document; and</text></paragraph><paragraph id="idacf46983-2c7f-4485-b251-a693715a6417"><enum>(2)</enum><text>indicate—</text><subparagraph id="id3c3e71c8-cbd4-4da7-80f7-42052cd872ed"><enum>(A)</enum><text>that the guidance document is rescinded;</text></subparagraph><subparagraph id="idf847db6b-f8a4-4d67-ae45-90b287227048"><enum>(B)</enum><text>if the guidance document was rescinded pursuant to a court order, the case number of the case in which the order was entered; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id37fabc14-8efa-4616-81f0-f23c004a9d86"><enum>(C)</enum><text>the date on which the guidance document was rescinded.</text></subparagraph></paragraph></subsection></section></legis-body><legis-body style="OLC" display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="HDED275F2705E4E24BFCED07BE86BB183" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guidance Out Of Darkness Act</short-title></quote> or the <quote><short-title>GOOD Act</short-title></quote>.</text></section><section id="H71BA38E1473346F3B826B0FF2ABB3344" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H434CF25E193B41B98C8FC0EC37063955"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 551 of title 5, United States Code.</text></paragraph><paragraph id="HB16FEDC98EAB4E8C814F50F27847742C"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="HBBA5D905750749C691AE1F1E5548F99E"><enum>(3)</enum><header>Guidance document</header><subparagraph id="HFC72FF12AA2E4C0484E7778C203F9E86"><enum>(A)</enum><header>In general</header><text>The term <term>guidance document</term>—</text><clause id="HFF08F211283E43D7B92AD1D742905FF2"><enum>(i)</enum><text>means an agency statement of general applicability (other than a rule that has the force and effect of law that was promulgated in accordance with the notice and comment procedures under section 553 of title 5, United States Code, or a statutory exemption to such procedures) that—</text><subclause id="H92937032FD2F4A08AF83B7BDAF2AB718"><enum>(I)</enum><text>does not have the force and effect of law; and</text></subclause><subclause id="H2C108492D06E4EDC8260FF5874FF7C9E"><enum>(II)</enum><text>is designated by an agency official as setting forth—</text><item id="H5A61ED5787F2425CBC11BAA93F8DDFBE"><enum>(aa)</enum><text>a policy on a statutory, regulatory, or technical issue; or</text></item><item id="H04C8405F40B1407095019CF1A04A8739"><enum>(bb)</enum><text>an interpretation of a statutory or regulatory issue; and</text></item></subclause></clause><clause id="HB1DF050C8F1649C79D8BB939878CC764"><enum>(ii)</enum><text>may include—</text><subclause id="H797195F5B0C14DB3B487592654521B2C"><enum>(I)</enum><text>a memorandum;</text></subclause><subclause id="H573D1D0C263D4194ACFC0F9B49F58DA7"><enum>(II)</enum><text>a notice;</text></subclause><subclause id="H7F2203EF9A264DA780B37C82B57D5E17"><enum>(III)</enum><text>a bulletin;</text></subclause><subclause id="H5CB58936704749A58EB873A1CABBECA2"><enum>(IV)</enum><text>a directive;</text></subclause><subclause id="HDC0112D740544FC38C5242A58858FDAA"><enum>(V)</enum><text>a news release;</text></subclause><subclause id="H8EE9B80790F2498C9C09075961A37DD1"><enum>(VI)</enum><text>a letter;</text></subclause><subclause id="HB73E3DCD32FF4E5989BC25793E89B86E"><enum>(VII)</enum><text>a blog post;</text></subclause><subclause id="H3B750BB7DC74429CA047984CCB97383A"><enum>(VIII)</enum><text>a no-action letter;</text></subclause><subclause id="HCC4ACAB5855C472DBBC0C2A9EB5E6198"><enum>(IX)</enum><text>a speech by an agency official; and</text></subclause><subclause id="H6E04E1BD3764471DA2214FF0AC525944"><enum>(X)</enum><text>any combination of the items described in subclauses (I) through (IX).</text></subclause></clause></subparagraph><subparagraph id="H5FEA66B5BCC049229951504055BDCF8D"><enum>(B)</enum><header>Rule of construction</header><text>The term <term>guidance document</term>—</text><clause id="HF98ED5252BDA48DAAF5BFAAE97DD256C"><enum>(i)</enum><text>shall be construed broadly to effectuate the purpose and intent of this Act; and</text></clause><clause id="HFB25C14DFE8240FBBF4B1DA1934F93C5"><enum>(ii)</enum><text>shall not be limited to the items described in subparagraph (A)(ii).</text></clause></subparagraph></paragraph></section><section id="H0589A025AE10486CA763D5FF6AAA9C6A" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>3.</enum><header>Publication of guidance documents on the internet</header><subsection id="HDCDDB829665942CEAB20823BEAD9BA91"><enum>(a)</enum><header>In general</header><text>Subject to section 5, on the date on which an agency issues a guidance document, the agency shall publish the guidance document in accordance with the requirements under section 4.</text></subsection><subsection id="H54522085C0BE4E9DB984F3F90459F069"><enum>(b)</enum><header>Previously issued guidance documents</header><text>Subject to section 5, not later than 180 days after the date of enactment of this Act, each agency shall publish, in accordance with the requirements under section 4, any guidance document issued by that agency that is in effect on that date.</text></subsection></section><section id="HA39B32EDC3304CAB8A79C39F26125F7D" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>4.</enum><header>Single location</header><subsection id="HCF6BAF9FFC124BCA89EE642AFFD961AE"><enum>(a)</enum><header>In general</header><text>All guidance documents published under section 3 by an agency shall be published in a single location on an internet website designated by the Director under subsection (d) of this section.</text></subsection><subsection id="H976A6E2DE7EF473CB3C010A3BE099F6B"><enum>(b)</enum><header>Agency internet websites</header><text>Each agency shall, for guidance documents published by the agency under section 3, publish a hyperlink on the principal internet website of the agency that provides access to the guidance documents at the location described in subsection (a) of this section.</text></subsection><subsection id="H9E36CA7487A446F397EF45F35551F209"><enum>(c)</enum><header>Organization</header><paragraph id="H99CC017BB81B403EAE487C08811C2665"><enum>(1)</enum><header>In general</header><text>The guidance documents described in subsection (a) shall be—</text><subparagraph id="HF0EE0F529FAF4DB8A130FBBD0BACEC19"><enum>(A)</enum><text>categorized as guidance documents; and</text></subparagraph><subparagraph id="H877B194978FD4DBCB991CE9ABA1218FC"><enum>(B)</enum><text>further divided into subcategories as appropriate.</text></subparagraph></paragraph><paragraph id="H7BBCA194244E457DA44CC77BC1765C1F"><enum>(2)</enum><header>Agency internet websites</header><text>The hyperlinks described in subsection (b) shall be prominently displayed on the principal internet website of the agency.</text></paragraph></subsection><subsection id="id81f0ac2cbb00462bb92c7a064020d79f"><enum>(d)</enum><header>Format of guidance documents</header><text>Each guidance document published under section 3 shall be made available as an open Government data asset (as defined in section 3502 of title 44, United States Code) and, to the extent practicable, optimized for search engines.</text></subsection><subsection id="HF8940DDBC4854DFAA2EA8E8D237C7526"><enum>(e)</enum><header>Designation</header><text>Not later than 90 days after the date of enactment of this Act, the Director shall designate an internet website on which guidance documents shall be published under section 3.</text></subsection></section><section id="H7ABC562345AF43BA817620750B98D77A" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>5.</enum><header>Documents and information exempt from disclosure under FOIA</header><text display-inline="no-display-inline">If a guidance document issued by an agency is a document that is exempt from disclosure under section 552(b) of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>), or contains information that is exempt from disclosure under such section 552(b), that document or information, as the case may be, shall not be subject to the requirements under this Act.</text></section><section id="HF627997FC35F400CA06C924A5C99E929" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>6.</enum><header>Rescinded guidance documents</header><text display-inline="no-display-inline">On the date on which a guidance document issued by an agency is rescinded, or, in the case of a guidance document that is rescinded pursuant to a court order, not later than the date on which the order is entered, the agency shall, at the location described in section 4(a)—</text><paragraph id="H00823F7D3D30419DAB95448B017D6238"><enum>(1)</enum><text>maintain the rescinded guidance document; and</text></paragraph><paragraph id="H192ACAAC062441E6A70FBB15CDBBE9C8"><enum>(2)</enum><text>indicate—</text><subparagraph id="HE4B1FD6EBE4E4522A9BAF9D7463503BE"><enum>(A)</enum><text>that the guidance document is rescinded;</text></subparagraph><subparagraph id="H6ADD678F60B547CBA9589FAEE384D677"><enum>(B)</enum><text>if the guidance document was rescinded pursuant to a court order, the case number of the case in which the order was entered; and</text></subparagraph><subparagraph id="HAF14BFD424254EF0B1018A4DAF0ACEF5"><enum>(C)</enum><text>the date on which the guidance document was rescinded.</text></subparagraph></paragraph></section><section id="HDE3F7BF615E74280BFF1C1BEBF232870" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>7.</enum><header>Rules of construction</header><subsection id="H66BE04C909F948229ED53D510B01E3EA"><enum>(a)</enum><header>Validity of guidance documents</header><text>Nothing in this Act shall be construed to mean that noncompliance with any provision of this Act affects or otherwise impacts the validity of any guidance document.</text></subsection><subsection id="H267ABA8E15BC4C7CA3A98B0436D63D1D"><enum>(b)</enum><header>Congressional review of guidance documents</header><text>Nothing in this Act shall be construed to affect or otherwise impact whether a guidance document is subject to congressional review under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/8">chapter 8</external-xref> of title 5, United States Code.</text></subsection></section><section id="H554B248D380D4D9781DF9DA38DEBB5AB" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>8.</enum><header>Report on agency compliance</header><text display-inline="no-display-inline">Not later than 5 years after the date of enactment of this Act, the Comptroller General shall submit to the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the compliance of agencies with this Act.</text></section></legis-body><endorsement><action-date date="20260914">September 14, 2026</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
