which was read twice and referred to the <committee-name committee-id="SSCM00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20260413">April 13, 2026</action-date><action-desc>Reported by <sponsor name-id="S355">Mr. Cruz</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To supplement existing lease authorities available to the Administrator of the National Aeronautics and Space Administration to support research, education, and training, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Space Exploration Research Act</short-title></quote>.</text></section><section id="id360b6e5456514afdb16ded37a82d2b4a" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>2.</enum><header>National Aeronautics and Space Administration supplemental lease authority</header><subsection id="id242b8a6cebeb48fa8137399d660d3ba5"><enum>(a)</enum><header>Supplemental lease authority</header><paragraph id="id0d60a704b199424ab4c441f26d44a3a2"><enum>(1)</enum><header>In general</header><text>The Administrator of the National Aeronautics and Space Administration (referred to in this Act as the <quote>Administrator</quote>) may, using existing lease authorities available to the Administrator and on such terms as the Administrator considers appropriate, lease, for a term not to exceed 99 years, real property under the jurisdiction of the Administrator to 1 or more entities described in subsection (c) for the purpose of the construction and operation on such real property of 1 or more facilities the purposes of which shall be—</text><subparagraph commented="no" display-inline="no-display-inline" id="id481e71b92abc48c595ea061dfb43fff9"><enum>(A)</enum><text display-inline="yes-display-inline">to conduct aeronautical and space research;</text></subparagraph><subparagraph id="id6228d890725a42a5b4be97440e77c585"><enum>(B)</enum><text>to educate and train individuals for careers in the space industry;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb229e696dfd548e8b8c44f545448e26d"><enum>(C)</enum><text display-inline="yes-display-inline">to carry out the transfer of aeronautical and space technology between the United States public and domestic private sectors;</text></subparagraph><subparagraph id="id13bca25c6645428f9b30d381fc7a79af"><enum>(D)</enum><text>to conduct scientific, engineering, medical, or academic activities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id03a281836110453bac9761729e3e6b48"><enum>(E)</enum><text>to conduct any other space-related activity.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id52f43843bd2d49a19aca14d59ed059c8"><enum>(2)</enum><header>Renewal</header><text>The Administrator may renew a lease under this subsection for 1 or more additional periods.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfd0fa7e4007b4e60931c76df56cf5586"><enum>(b)</enum><header>Administrative, maintenance, and instructional support</header><text>Subject to the availability of appropriations, the Administrator may—</text><paragraph id="idf4ba90959e84452eba6612477885738f"><enum>(1)</enum><text>enter into 1 or more agreements, on such terms as the Administrator considers appropriate, with 1 or more entities described in subsection (c) to lease back real property described in subsection (a), including such real property that has been—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7b7326a5ec984f56b5b481082c75b553"><enum>(A)</enum><text display-inline="yes-display-inline">leased to a private entity under other lease authority available to the Administrator; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcdbd023e2e564caba3dae85edcf9e9be"><enum>(B)</enum><text display-inline="yes-display-inline">subleased to an entity described in subsection (c);</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc2ae7c51a4a94ff28f43f2714ab0a482"><enum>(2)</enum><text>enter into 1 or more contracts, grant agreements, cooperative agreements, or other authorized transactions with an entity described in subsection (c) with respect to such property; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5fd950a6f07b4a8e8e01fa7b76e19f94"><enum>(3)</enum><text display-inline="yes-display-inline">provide administrative, maintenance, instructional, and other appropriate support, with or without reimbursement, to the 1 or more facilities described in subsection (a).</text></paragraph></subsection><subsection id="idc9bf921e5e494d60a2b6885e8a6e0869"><enum>(c)</enum><header>Entities described</header><text>An entity described in this subsection is—</text><paragraph id="id64058e4d48704f9f8172d888fa4b84d6"><enum>(1)</enum><text>the State in which the real property described in subsection (a) is located;</text></paragraph><paragraph id="id383ccd3bb88e447eb7df96c050c084f7"><enum>(2)</enum><text>a subdivision, agent, or agency of such a State;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbfe5be21c48e4e1db316e58945b6ef72"><enum>(3)</enum><text display-inline="yes-display-inline">a corporation or foundation organized exclusively for education or scientific purposes that is exempt from taxation under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/501">26 U.S.C. 501(c)(3)</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23484ec927c44651a40e4c3db9530154"><enum>(4)</enum><text>an institution of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8cd3e2b1dda6467b9a4f1cb3c02b84a4"><enum>(d)</enum><header>Delegation</header><text>The Administrator may delegate the authorities under subsections (a) and (b) to subordinate officers and employees of the National Aeronautics and Space Administration, as the Administrator considers appropriate.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id470de77939ab4a3abe7ccb44d69ad6f0"><enum>(e)</enum><header>Effect of other law</header><text>The authority provided by this section shall apply—</text><paragraph commented="no" display-inline="no-display-inline" id="idbf7bc65a74254db9b878f4765ee7f00e"><enum>(1)</enum><text display-inline="yes-display-inline">regardless of the existing authority used by the Administrator to lease the real property described in subsection (a); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd38f81fb5ef14f339d51ca7815ab66d2"><enum>(2)</enum><text display-inline="yes-display-inline">notwithstanding any provision of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2b6a561711d140f3a3a74bbc97ac86ba"><enum>(A)</enum><text>section 1302 of title 40, United States Code;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida7bb4e6fc01f4548b0b0998158ee0852"><enum>(B)</enum><text display-inline="yes-display-inline">section 20145 of title 51, United States Code; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id27a9d4ca694d481fafae69a0fe35af3d"><enum>(C)</enum><text display-inline="yes-display-inline">section 306121 of title 54, United States Code.</text></subparagraph></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="idfb613814-a7ef-4dd5-b5f1-b3fb1538bc1f" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Space Exploration Research Act</short-title></quote>.</text></section><section id="id544ca8a3-8f1e-4ec6-9014-3b64c8b6d52b" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>2.</enum><header>National Aeronautics and Space Administration supplemental lease authority</header><subsection id="id54a5342e-bdbd-45a8-b3bf-5ea1c5ae0164"><enum>(a)</enum><header>Supplemental lease authority</header><paragraph id="id4a9a6e2f-a901-44e2-8e13-d01590694bcf"><enum>(1)</enum><header>In general</header><text>The Administrator of the National Aeronautics and Space Administration (referred to in this Act as the <quote>Administrator</quote>) may, using existing lease authorities available to the Administrator and on such terms as the Administrator considers appropriate to protect the interests of the United States, lease, for a term not to exceed 50 years, real property under the jurisdiction of the Administrator to 1 or more entities described in subsection (c) for the purpose of the construction and operation on such real property of 1 or more facilities the purposes of which shall be—</text><subparagraph commented="no" display-inline="no-display-inline" id="id37322a91-26e5-4040-834f-d409be78d9c7"><enum>(A)</enum><text display-inline="yes-display-inline">to conduct aeronautical and space research;</text></subparagraph><subparagraph id="id3d769d79-e2f6-4f24-80aa-b30474178e91"><enum>(B)</enum><text>to educate and train individuals for careers in the space industry;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6619d4c7-8ed0-41a7-ad2e-846dcad2ce90"><enum>(C)</enum><text display-inline="yes-display-inline">to carry out the transfer of aeronautical and space technology between the United States public and domestic private sectors;</text></subparagraph><subparagraph id="id575ec168-8b9d-437c-a82e-b5baa224c314"><enum>(D)</enum><text>to conduct space-related and aeronautics-related scientific, engineering, medical, or academic activities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida05f8fc0-4698-441a-8392-6883439e6a5e"><enum>(E)</enum><text>to conduct any other space-related activity relevant to the mission of the National Aeronautics and Space Administration.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide430d203-b7c4-4a80-986d-220744365c8b"><enum>(2)</enum><header>Renewal</header><text>The Administrator may renew a lease under this subsection for 1 or more additional periods.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idcef4587d-a1ec-4d0f-b28e-6111e89e0a19"><enum>(b)</enum><header>Administrative, maintenance, and instructional support</header><text>Subject to the availability of appropriations, the Administrator may—</text><paragraph id="id8ed36d87-333a-4131-bb8c-3090f91277bd"><enum>(1)</enum><text>enter into 1 or more agreements, on such terms as the Administrator considers appropriate, with 1 or more entities described in subsection (c) to lease back real property described in subsection (a), including such real property that has been subleased to a third party by an entity described in subsection (c);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida21dd896-a656-45d7-84f1-36f9c03e8200"><enum>(2)</enum><text>enter into 1 or more contracts, grant agreements, cooperative agreements, or other authorized transactions with an entity described in subsection (c) with respect to such property; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida2d3fe9f-62d4-417f-be2a-0a93efcd58ef"><enum>(3)</enum><text display-inline="yes-display-inline">provide administrative, instructional, and other appropriate support, with or without reimbursement, to the 1 or more entities described in subsection (c) that are a party to such a contract, agreement, or transaction.</text></paragraph></subsection><subsection id="id960798fb-89ba-4346-a76d-63c326a8d4d0"><enum>(c)</enum><header>Entities described</header><text>An entity described in this subsection is—</text><paragraph id="id0a2221d5-07d7-47ef-b73f-3792863d268a"><enum>(1)</enum><text>the State in which the real property described in subsection (a) is located;</text></paragraph><paragraph id="idd58bf65b-7b84-4410-bda3-ce3c505f3192"><enum>(2)</enum><text>a subdivision, agent, or agency of such a State;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd1da7564-b946-4e00-86b2-c9257f574b7c"><enum>(3)</enum><text display-inline="yes-display-inline">a corporation or foundation organized exclusively for education or scientific purposes that is exempt from taxation under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/501">26 U.S.C. 501(c)(3)</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb8b7fdbd-9100-4216-be87-bdd7c2315908"><enum>(4)</enum><text>an institution of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5e321845-bc8d-42fd-9015-5a312cbfa721"><enum>(d)</enum><header>Delegation</header><text>The Administrator may delegate the authorities under subsections (a) and (b) to subordinate officers and employees of the National Aeronautics and Space Administration, as the Administrator considers appropriate.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id4967e2c0-a877-4d09-8450-325c6653ca9f"><enum>(e)</enum><header>Effect of other law</header><text>The authority provided by this section shall apply—</text><paragraph commented="no" display-inline="no-display-inline" id="id802849c6-c6ba-48cf-86aa-f0096a07fdbe"><enum>(1)</enum><text display-inline="yes-display-inline">regardless of the existing authority used by the Administrator to lease the real property described in subsection (a) to entities described in subsection (c); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd1976eea-bfcf-44cd-816b-678c4021a963"><enum>(2)</enum><text display-inline="yes-display-inline">notwithstanding—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7ceb659c-61a3-4b3a-8b94-ec911d43adda"><enum>(A)</enum><text>section 1302 of title 40, United States Code; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd8ab6f18-c7ba-4a42-9f27-5c63ff873e96"><enum>(B)</enum><text display-inline="yes-display-inline">subsection (b)(1) and (e)(1) of section 20145 of title 51, United States Code; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id46ed770995824b1ba5776d2fbb686722"><enum>(C)</enum><text>section 306121 of title 54, United States Code.</text></subparagraph></paragraph></subsection><subsection id="id4e5001747480455da906bf2986a6b727"><enum>(f)</enum><header>Annual report</header><text>Not later than January 31 each year, the Administrator shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives a report that includes the following:</text><paragraph id="id30463b9aca2b451eb6dc2a77b140207f"><enum>(1)</enum><header>Mission relevance</header><text>Information that explains the importance of each lease and leaseback agreement to the accomplishment of 1 or more mission requirements of the National Aeronautics and Space Administration.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id85f5b0a28e81483d82b33a98e73430c3"><enum>(2)</enum><header display-inline="yes-display-inline">Value of arrangements and expenditures of revenues</header><text>Information that identifies and quantifies the value of the arrangements and expenditures of revenues received under this section.</text></paragraph><paragraph id="id68bdd9c2549f429884b5cbd70efcf357"><enum>(3)</enum><header>Availability and use of funds for operating plan</header><text>The availability and use of funds received under this section for the Administration's operating plan.</text></paragraph><paragraph id="id69b1fef503974353bad64d61cae12f99"><enum>(4)</enum><header>Annual and cumulative number of leases</header><text>The annual and cumulative number of leases entered into under this section, by National Aeronautics and Space Administration center and facility.</text></paragraph><paragraph id="id352bcfd4176949b28a0e544a8af19bb7"><enum>(5)</enum><header>Estimated cost savings</header><text>For each active lease agreement under this section, the estimated cost savings to the National Aeronautics and Space Administration resulting from reduced maintenance, operating, and associated costs in the previous fiscal year.</text></paragraph><paragraph id="id4b5a96c519404d1e876437592b907d2b"><enum>(6)</enum><header>Other quantifiable benefits</header><text>Other quantifiable benefits, including additional cost savings not included under paragraph (4), to the National Aeronautics and Space Administration resulting from the use of leases under this section.</text></paragraph></subsection></section></legis-body><endorsement><action-date>April 13, 2026</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
