STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend title 18, United States Code, to prevent and mitigate the potential for conflicts of interest following government service, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="ida79c1fba-0e8a-4e85-a09b-dc32f561e115" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Conflict-free Leaving Employment and Activity Restrictions Path Act</short-title></quote> or the <quote><short-title>CLEAR Path Act</short-title></quote>.</text></section><section id="idd3f9ef0d-1a60-4421-8c70-592134f0a5d7" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id2e9f9551-0e45-40b4-9cb5-0986c8ba21c4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Congress and the executive branch have recognized the importance of preventing and mitigating the potential for conflicts of interest following Government service, including with respect to senior United States officials working on behalf of foreign governments; and</text></paragraph><paragraph id="id1c810a76-c6ff-488b-8202-252c08c7dc49" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">Congress and the executive branch should jointly evaluate the status and scope of post-employment restrictions.</text></paragraph></section><section id="id9c77611c-b99a-4a28-b92d-5dd6df29c677" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Post-employment restrictions on officials in positions subject to Senate confirmation</header><subsection commented="no" display-inline="no-display-inline" id="id3fe4ef61-b0db-4762-b209-47e227485171" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 207 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id45ebc94e-a105-4c72-ac63-d6553c9ccf12" changed="not-changed"><subsection id="id20e06b7c-b42d-4219-9d0e-a2f42ab1c269" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(m)</enum><header display-inline="yes-display-inline">Extended post-employment restrictions for officials in positions subject to Senate confirmation</header><paragraph id="id2bcb0c70-e9b8-41de-ae65-43fa2f975cd4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph id="id74bd2a14-844f-4e51-acd5-374a4979ebcb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Country of concern</header><text display-inline="yes-display-inline">The term <term>country of concern</term> has the meaning given the term in section 1(m) of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2651a">22 U.S.C. 2651a(m)</external-xref>), except that it does not include the country described in paragraph (1)(A)(vi) of that section, as in effect on the date of enactment of the <short-title>Conflict-free Leaving Employment and Activity Restrictions Path Act</short-title>.</text></subparagraph><subparagraph id="idcaa1a476-9ab2-4978-bcbb-6cfa3c63f3de" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Foreign governmental entity</header><text display-inline="yes-display-inline">The term <term>foreign governmental entity</term> has the meaning given the term in section 1(m) of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2651a">22 U.S.C. 2651a(m)</external-xref>).</text></subparagraph><subparagraph id="id50ac3b02-48a2-4549-a66c-7f210b23308b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Represent</header><text display-inline="yes-display-inline">The term <term>represent</term> does not include representation by an attorney, who is duly licensed and authorized to provide legal advice in a United States jurisdiction, of a person or entity in a legal capacity or for the purposes of rendering legal advice.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide601f5c9-c6e8-4e9a-84e2-d6967a56198a" changed="not-changed"><enum>(D)</enum><header display-inline="yes-display-inline">Senate-confirmed position</header><text display-inline="yes-display-inline">The term <term>Senate-confirmed position</term> means a position in a department or agency of the executive branch of the United States for which appointment is required to be made by the President, by and with the advice and consent of the Senate.</text></subparagraph></paragraph><paragraph id="id7c84159b-8943-4f82-9043-2f709da498de" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Agency heads, deputy heads, and other positions subject to Senate confirmation</header><text display-inline="yes-display-inline">Any person who serves in a position requiring appointment by the President as head or deputy head of, or serves in any other Senate-confirmed position in, a department or agency of the executive branch of the United States, and who, at any time after the termination of the person’s service in that position, knowingly represents, aids, or advises a foreign governmental entity of a country of concern before an officer or employee of the executive or legislative branch of the United States with the intent to influence a decision of the officer or employee in carrying out his or her official duties shall be punished as provided in section 216.</text></paragraph><paragraph id="id344df8c5-be13-4c99-a3c1-f9ffcc2dab76" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Notice of restrictions</header><text display-inline="yes-display-inline">Any person subject to the restrictions under this subsection shall be provided notice of these restrictions by the relevant department or agency—</text><subparagraph id="id714db4a4-32ed-469f-b3bb-e3ce276c1b00" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">upon appointment by the President; and</text></subparagraph><subparagraph id="idd5fd7e31-4eb8-43f1-93d5-6cd2a3adc855" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">upon termination of service with the relevant department or agency.</text></subparagraph></paragraph><paragraph id="id9d42713c-12bf-4a75-ae53-b26ddec2710b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Effective date</header><subparagraph commented="no" display-inline="no-display-inline" id="id5627ffa249f14b9e9cc8279196469475" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the restrictions under this subsection shall apply only to persons who are appointed by the President to the positions referenced in this subsection on or after the date of enactment of the <short-title>Conflict-free Leaving Employment and Activity Restrictions Path Act</short-title>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4e5d8c8df2cf48d1b6acca5a237354da" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Grace period for added countries of concern</header><text display-inline="yes-display-inline">If the definition of the term <quote>country of concern</quote> under subsection (m) of section 1 of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2651a">22 U.S.C. 2651a</external-xref>) is modified in accordance with paragraph (7) of that subsection by adding a country to the list of countries described in paragraph (1)(A) of that subsection, in the case of any person who is appointed by the President to a position referenced in this subsection on or after the date of enactment of the <short-title>Conflict-free Leaving Employment and Activity Restrictions Path Act</short-title> and who knowingly represents, aids, or advises a foreign governmental entity of a country added to the list of countries described in paragraph (1)(A) of such subsection (m), the restrictions under this subsection shall apply to such person on and after the date that is 30 days after the date of enactment of a relevant joint resolution of approval as described in paragraph (7)(C) of such subsection (m) adding that country to the list of countries described in paragraph (1)(A) of such subsection (m).</text></subparagraph></paragraph><paragraph id="id3d232742a4c941e0aa06d2814f8d543b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Sunset</header><subparagraph id="id41aabe36c6844fe48e46cb6c765e4599" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">On and after the date that is 5 years after the date of enactment of the <short-title>Conflict-free Leaving Employment and Activity Restrictions Path Act</short-title>, the restrictions under paragraph (2) shall not apply to any person appointed by the President, on or after such date of enactment, to a position referenced in this subsection, without regard to the date on which the service of such person in such position terminates.</text></subparagraph><subparagraph id="id8eefc95040c746cab3e4899b2bcffd9b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">No effect on conduct before sunset</header><text display-inline="yes-display-inline">Nothing in subparagraph (A) shall be construed to limit the applicability of paragraph (2) with respect to any conduct by a person appointed by the President to a position referenced in this subsection that occurred before the date that is 5 years after the date of enactment of the <short-title>Conflict-free Leaving Employment and Activity Restrictions Path Act</short-title>.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="id86104284-a19d-4d4c-9a9a-695b97d6a9e1" changed="not-changed" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 1(m) of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2651a">22 U.S.C. 2651a(m)</external-xref>) is amended—</text><paragraph commented="no" id="id41e39e17-9387-4177-bd3e-50a32df90ea7" changed="not-changed" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (6) and (7) as paragraphs (8) and (9), respectively; and</text></paragraph><paragraph commented="no" id="id1640513d-51d5-4755-bbfd-24c4e67891bd" changed="not-changed" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (5) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf972243f-1a71-4712-aa9d-7941b54a1583" changed="not-changed"><paragraph commented="no" id="id2c2c6385-c33d-4665-b086-6c4495d618fb" changed="not-changed" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Relation to government-wide restrictions</header><text display-inline="yes-display-inline">This subsection shall not apply to a person by reason of the person’s service in a position referenced in this subsection if the person is subject to the restrictions under section 207(m) of title 18, United States Code, by reason of the same service.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" id="idbd1fea6f-9b11-4b16-b475-10d716d08dff" changed="not-changed" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Mechanism to amend definition of <quote>country of concern</quote></header><text display-inline="no-display-inline">Section 1(m) of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2651a">22 U.S.C. 2651a(m)</external-xref>) is amended by inserting after paragraph (6), as added by section 3(b), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id86696269-a984-4e51-aedb-1c1b98d74063" changed="not-changed"><paragraph id="idcdbaca78-e24b-40a0-b152-24ed2498b9cb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Modification to definition of <quote>country of concern</quote></header><subparagraph id="id91da329e-971c-4320-b329-f27f2c692372" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of State may, in consultation with the Attorney General, propose the addition or deletion of countries described in paragraph (1)(A).</text></subparagraph><subparagraph id="id86824919-4cd3-4ec4-92f4-cc3b7bb32829" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Submission</header><text display-inline="yes-display-inline">Any proposal described in subparagraph (A) shall—</text><clause id="id9477d679-37b9-4085-9c97-60328fe9b8a2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">be submitted to the Chairman and Ranking Member of the Committee on Foreign Relations of the Senate and the Chairman and Ranking Member of the Committee on the Judiciary of the House of Representatives; and</text></clause><clause id="idf79d4ba8-5c53-42fa-ab9d-0a180716b249" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">become effective upon enactment of a joint resolution of approval as described in subparagraph (C).</text></clause></subparagraph><subparagraph id="id4bea73fb-59e1-459b-992f-fe1e410e3bba" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Joint resolution of approval</header><clause id="idb894d8b1-b70c-4595-84ab-f5d9fb4cdd65" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For purposes of subparagraph (B)(ii), the term <term>joint resolution of approval</term> means only a joint resolution—</text><subclause id="id0d6fba14-d242-471e-930e-97e9076f5a2d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">that does not have a preamble;</text></subclause><subclause id="id482c63bd-dd88-4e11-b8a5-e1de104bf0b2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">that includes in the matter after the resolving clause the following: <quote>That Congress approves the modification of the definition of <quote>country of concern</quote> under section 1(m) of the State Department Basic Authorities Act of 1956, as submitted by the Secretary of State on ____; and section 1(m)(1)(A) of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2651a">22 U.S.C. 2651a(m)(1)(A)</external-xref>) is amended by ______.</quote>, the blank spaces being appropriately filled in with the appropriate date and the amendatory language required to modify the list of countries in paragraph (1)(A) of this subsection by adding or deleting 1 or more countries; and</text></subclause><subclause id="idcb3505fd-3e5f-4d63-835a-32baaea2a989" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">the title of which is as follows: <quote>Joint resolution approving modifications to definition of <quote>country of concern</quote> under section 1(m) of the State Department Basic Authorities Act of 1956.</quote>.</text></subclause></clause><clause id="id9a00ad5d-8aad-4a88-b8dd-14b224ebcb81" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Referral</header><subclause id="id08d4943a-3fb9-46d3-a18e-6909b2cb44e7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><header display-inline="yes-display-inline">Senate</header><text display-inline="yes-display-inline">A resolution described in clause (i) that is introduced in the Senate shall be referred to the Committee on Foreign Relations of the Senate.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1a0335db-cabd-43cb-a1bd-fc8618b8dfd9" changed="not-changed"><enum>(II)</enum><header display-inline="yes-display-inline">House of Representatives</header><text display-inline="yes-display-inline">A resolution described in clause (i) that is introduced in the House of Representatives shall be referred to the Committee on the Judiciary of the House of Representatives.</text></subclause></clause></subparagraph></paragraph><after-quoted-block
