 impairments of older individuals</header><text display-inline="no-display-inline">Section 201(f) (<external-xref legal-doc="usc" parsable-cite="usc/42/3011">42 U.S.C. 3011(f)</external-xref>) is amended to read as follows:</text><quoted-block id="id1f432d10-15df-4948-9d33-1a5f66588a35" display-inline="no-display-inline" style="OLC" changed="not-changed"><subsection id="id3987eac2-b19e-4e28-ac62-c472805d004e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id7ad9b68e-4722-4a02-ba3b-560ba5de74ab" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">The Assistant Secretary may designate an officer or employee who shall be responsible for the administration of services for mental health and substance use disorders and cognitive impairments authorized under this Act and serve as an effective and visible advocate for the related needs of older individuals within the Department of Health and Human Services, including by ensuring that relevant information disseminated and research conducted or supported by the Department takes into consideration such services.</text></paragraph><paragraph id="idac02c200-a24b-46e9-9fc8-8dc776e83967" indent="up1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">It shall be the duty of the Assistant Secretary, acting through the individual designated under paragraph (1), and in consultation with the heads of relevant agencies within the Department of Health and Human Services, including the Substance Abuse and Mental Health Services Administration, to develop objectives, priorities, and a long-term plan for supporting State and local efforts under this Act involving education about, and prevention, detection, and treatment of, mental health and substance use disorders and cognitive impairments, including age-related dementia, depression, and Alzheimer’s disease and related neurological disorders with neurological and organic brain dysfunction.</text></paragraph><paragraph id="id9f18e9ec-fff6-48c6-9c2b-f463f435e93f" indent="up1" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of the <short-title>Older Americans Act Reauthorization Act of 2025</short-title>, the Assistant Secretary shall report to the Committee on Health, Education, Labor, and Pensions of the Senate, the Special Committee on Aging of the Senate, and the Committee on Education and Workforce of the House of Representatives on the activities of the officer or employee designated under paragraph (1) in carrying out the requirements under this subsection, including any activities to identify and reduce duplication and gaps across the Department in such information disseminated and research conducted or supported by the Department.</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section id="id427141b8-826a-4785-be71-3e51d762c5a7" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">List of national resource centers</header><text display-inline="no-display-inline">Section 202 (<external-xref legal-doc="usc" parsable-cite="usc/42/3012">42 U.S.C. 3012</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idc81566a5-79d1-4b6f-a0d0-b2fa9d11c733" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d)(4), by striking <quote>Resource Center on Elder Abuse</quote> and inserting <quote>Center</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5839f55f-e080-41a5-ab1e-3419bb365f74" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (h) and inserting the following:</text><quoted-block id="ida3870b30-00b1-480c-b4ac-c9cb2155ea8e" display-inline="no-display-inline" style="OLC" changed="not-changed"><subsection id="id16e27862-fc52-47b9-a9c4-5c991647cb4f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idf466224a-567b-40a6-b9f8-2a9ce570cd0a" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">The Assistant Secretary shall publish online in a publicly accessible format, on an annual basis, a list of national resource centers and demonstration projects authorized under, or administratively established through funds provided under, this Act. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34a8e7f3-005f-4013-9d17-729af8be49da" indent="up1" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">The Assistant Secretary shall ensure that the list published pursuant to paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id042cffff-b9aa-4aed-af1c-75a53a4c1259" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">includes—</text><clause commented="no" display-inline="no-display-inline" id="id4789a744-6d35-490f-9a74-2ee2de926071" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">a description of each such center and demonstration project, including the projected goals and activities of each such center and demonstration project;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0734ad61-329c-47f4-8e03-b7955cf58d67" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">a citation to the statutory authorization of each such center and demonstration project, or a citation to the statutory authority that the Assistant Secretary relies upon to administratively establish each such center and demonstration project; </text></clause><clause commented="no" display-inline="no-display-inline" id="iddac8c6ee-dfb4-4c97-8c0f-fdfa331e6947" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">the award amount for each such center and demonstration project; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id309efffb-262c-4438-9504-ff70db9831eb" changed="not-changed"><enum>(iv)</enum><text display-inline="yes-display-inline">a summary of any evaluations required under this Act for each such center, including a description of any measures of effectiveness; and</text></clause></subparagraph><subparagraph id="idde68b61e-4b30-47c2-9cf5-964a4e98ba07" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">is directly provided to State agencies, area agencies on aging, and the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate and the Committee on Education and Workforce of the House of Representatives.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section id="idc094255c-db0b-4b36-852b-fa9c9ff5bd2f" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Awareness of relevant Federal programs</header><text display-inline="no-display-inline">Title II (<external-xref legal-doc="usc" parsable-cite="usc/42/3011">42 U.S.C. 3011 et seq.</external-xref>) is amended by inserting after section 203A (<external-xref legal-doc="usc" parsable-cite="usc/42/3013a">42 U.S.C. 3013a</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id47e98422-fd1d-4289-8d47-40bf785b7889" changed="not-changed"><section id="id288d067a-e0d4-4020-85cb-e49638a2d29a" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>203B.</enum><header display-inline="yes-display-inline">Awareness of relevant Federal programs</header><text display-inline="no-display-inline">In carrying out section 203(a)(1), the Assistant Secretary shall coordinate with the heads of relevant Federal departments and agencies to ensure that the aging network and individuals served under this Act are aware of, and, subject to applicable eligibility criteria, have access to, Federal programs that may advance the objectives of this Act, including programs described in section 203(b) and other programs to meet housing, health care, and other supportive service needs to help such individuals age in place.</text></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id3cf60b7f-90f7-4685-8d73-0ec31aac683c" changed="not-changed"><enum>105.</enum><header display-inline="yes-display-inline">Evaluations and surveys</header><text display-inline="no-display-inline">Section 206 (<external-xref legal-doc="usc" parsable-cite="usc/42/3017">42 U.S.C. 3017</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id3a49ea06-497d-488e-b625-9766516608f7" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (d) and inserting the following:</text><quoted-block id="idd3bb6c02-9701-4cf2-b145-1613418108b5" display-inline="no-display-inline" style="OLC" changed="not-changed"><subsection commented="no" display-inline="no-display-inline" id="idf07404ab-8ae3-4afd-9d0a-169c4e436c7a" changed="not-changed"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="ide22f1774-97ab-4039-85ed-5970a14d22ea" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">In carrying out evaluations under this section, the Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id785b2913-8570-4933-a705-5d8eafa4c2ef" indent="up1" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">award grants to, or enter into contracts with, public or nonprofit private organizations or academic or research institutions to survey State agencies, area agencies on aging, and other program and project participants about the strengths and weaknesses of the programs and projects; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id0c284b4d-6fac-4df8-b93c-ee4a20c11eec" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">conduct, where appropriate, evaluations that compare the effectiveness of related programs in achieving common objectives. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id40dedce4-f049-4b01-acad-db335b2586a2" indent="up1" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">The surveys and evaluations under paragraph (1) shall include information on programs, services, use and sources of funding (including any transfer of funding between area agencies on aging), identified unmet need for services and related indicators, and any other challenges faced by State agencies and area agencies on aging in carrying out the activities of this Act. </text></paragraph><paragraph id="id32134c8e-59c8-43b7-8f8b-4c821d46716c" indent="up1" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary shall, in carrying out the evaluations under paragraph (1), consult with organizations concerned with older individuals, including organizations that represent minority individuals, older individuals residing in rural areas, and older individuals with disabilities.</text></paragraph></subsection><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idab43d65b-8740-46bd-a20c-9c9af3ad4a75" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (g), by striking <quote>him</quote> and inserting <quote>the Secretary</quote>.</text></paragraph></section><section id="id1b644eab-536d-4419-a440-60aa4b720aeb" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>106.</enum><header display-inline="yes-display-inline">Contracting</header><subsection commented="no" display-inline="no-display-inline" id="idfc138984-6370-4c2f-bac0-a61e6b033c87" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 212 (<external-xref legal-doc="usc" parsable-cite="usc/42/3020c">42 U.S.C. 3020c</external-xref>) is amended—</text><paragraph id="ida4f00586ee8a4b47abca78b287a95e4b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading, by striking <quote><header-in-text style="OLC" level="section">and grant authority</header-in-text></quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2e04ff6f-1f31-440c-8ab8-4a0ffe1833b9" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (a) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id42856e7d-b745-4a64-a471-a62528b6eb4b" changed="not-changed"><subsection commented="no" display-inline="no-display-inline" id="idd91edf21-205a-435c-96b7-2bbb1a2fa1ff" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subsection (b), this Act shall not be construed to prevent a recipient of a grant or a contract under this Act (other than title V) from entering into a contract, commercial relationship, or other business arrangement (referred to in this section as an <quote>agreement</quote>) with a profitmaking organization for the recipient to provide services to individuals or entities not otherwise receiving services under this Act, provided that—</text><paragraph commented="no" display-inline="no-display-inline" id="ide33bf080-de71-40e5-8ff4-5be99edabc1b" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">in the case funds provided under this Act are used in developing or carrying out the agreement—</text><subparagraph id="id80c8e991-75d0-4006-bb73-f6805513d1fd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">such agreement guarantees that the cost is reimbursed to the recipient;</text></subparagraph><subparagraph id="idfe8cdf31-c8cb-4f2a-9540-6405e0477d21" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">if such agreement provides for the provision of 1 or more services, of the type provided under this Act by or on behalf of such recipient, to an individual or entity seeking to receive such services—</text><clause id="id6dab2724-e5dc-4aef-ace4-18f639e1d3d8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the individuals and entities may only purchase such services at their fair market rate;</text></clause><clause id="idc474caef-135d-4f67-9035-0009719e3ee3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">all costs incurred by the recipient in providing such services (and not otherwise reimbursed under subparagraph (A)), are reimbursed to such recipient; and</text></clause><clause id="id6b9e6030-6d05-47b7-97f9-2d39c1eb9c43" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">except in the case of an agreement with a health plan or health care provider, the recipient reports the rates for providing such services under such agreement in accordance with subsection (c) and the rates are consistent with the prevailing market rate for provision of such services in the relevant geographic area as determined by the State agency or area agency on aging (as applicable); and</text></clause></subparagraph><subparagraph id="id68c2dec4-e40c-44d2-9dd3-a8de1d76d1e0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">any amount of payment to the recipient under the agreement that exceeds reimbursement under this subsection of the recipient's costs is used to provide, or support the provision of, services under this Act; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb59e7a88-3a9c-44fd-9d9a-d3b61db2c32c" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">subject to subsection (e), in the case no funds provided under this Act are used in developing or carrying out the agreement—</text><subparagraph id="id69bccba0-aefe-4760-b3ce-380d4a175270" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 45 days after the agreement first goes into effect, and annually thereafter until the termination of such agreement, the recipient of a grant or contract under this Act shall, in writing—</text><clause id="id4ec10bd0-02b2-4176-bea7-f6e054b99b80" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">notify the State agency of—</text><subclause id="id4a2661bb-2b79-4440-a6ec-b84a8df183d1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the existence of the agreement; and</text></subclause><subclause id="id0421f0fb-ba69-4bfd-afca-d696c4e9acb8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the services provided and populations served under the agreement; and</text></subclause></clause><clause id="id933d6c0f-7708-4232-8585-e1c35fce80f3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">provide assurances to the State agency that—</text><subclause id="id65c85d81-7324-42b2-9959-a0e4341d48b6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">nothing in the agreement—</text><item id="id5bbf4245-4d6c-453f-b709-01b25bf37be3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">undermines—</text><subitem id="ida382fda8-8fc8-4f6d-a179-5d750cd08c33" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(AA)</enum><text display-inline="yes-display-inline">the duties of the recipient under this Act; or</text></subitem><subitem id="id7a6e23f8-d706-4390-9722-0cd957474d2f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(BB)</enum><text display-inline="yes-display-inline">the provision of services in accordance with this Act; or</text></subitem></item><item id="id65ff75d9-8e61-4c60-9d4f-d0860d300491" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(bb)</enum><text display-inline="yes-display-inline">violates any other terms and conditions of an award received by the recipient under this Act; and</text></item></subclause><subclause id="id45502a00-8e38-4b1b-813c-c22f756cbfce" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">any potential real or perceived conflict of interest with respect to the agreement has been prevented, mitigated, or otherwise addressed, including providing a description of any such conflicts of interest and a description of the actions taken to mitigate such conflicts of interest; and</text></subclause></clause></subparagraph><subparagraph id="ide510dd1e-72fb-4658-97a5-86b681e63d9f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 45 days after the population or services under the agreement substantially change due to an amendment to the agreement, the recipient shall, in writing—</text><clause id="id8bcbf7d9-9a72-4cf7-9d89-6dd3e62f8811" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">notify the State agency of such change; and</text></clause><clause id="id0912197a-16ff-469e-8054-d9679dc60d5d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">provide the assurances described in subparagraph (A)(ii) with respect to such change.</text></clause></subparagraph></paragraph></subsection><after-quoted-block display="yes">;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddba0890f-7031-421d-b9d2-550de9454511" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddb750ef3-4bbe-4842-9488-41cc05668e07" changed="not-changed"><subsection commented="no" display-inline="no-display-inline" id="id89c1d1ae-ee8d-426b-99cc-fbca1bb98265" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Ensuring appropriate use of funds</header><text display-inline="yes-display-inline">An agreement—</text><paragraph commented="no" display-inline="no-display-inline" id="idb2550709-8407-4e44-94fe-bc3afd0190de" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">described in subsection (a)(1) may not—</text><subparagraph id="id8a24d2d1-18c5-486c-a50b-243a42682113" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">be made without the prior approval of the State agency (or, in the case of a grantee under title VI, without the prior recommendation of the Director of the Office for American Indian, Alaskan Native, and Native Hawaiian Aging and the prior approval of the Assistant Secretary), after timely submission of all relevant documents related to the agreement including information on all costs incurred; or</text></subparagraph><subparagraph id="ide77b8407e1444ad89a172a465b026b2f" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">directly or indirectly provide for, or have the effect of, paying, reimbursing, subsidizing, or otherwise compensating an individual or entity in an amount that exceeds the fair market value of the services subject to such agreement; and </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida2af7149-06dd-4cd1-b2af-192d2fb441fa" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">described in subsection (a) may not—</text><subparagraph id="id5c4199f6-d30e-4fec-a1d2-bb319526fcbc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">result in the displacement of services otherwise available to an older individual with greatest social need, an older individual with greatest economic need, or an older individual who is at risk for institutional placement; or</text></subparagraph><subparagraph id="idfc67b65e-1246-43e3-a550-2035c69b9e3c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in any other way compromise, undermine, or be inconsistent with the objective of serving the needs of older individuals, as determined by the Assistant Secretary.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">;</after-quoted-block></quoted-block></paragraph><paragraph id="idd9faf2dad4ae4c51bccc0076c1c22998" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">by striking subsection (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3F2DD78E573F496A96957A3E05238B12"><subsection id="id7741e78c28234944abee16ef6378a3b1" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Monitoring and reporting</header><text display-inline="yes-display-inline">To ensure that any agreement described in subsection (a)(1) complies with the requirements of this section and other applicable provisions of this Act, the Assistant Secretary shall develop and implement uniform monitoring procedures and reporting requirements consistent with the provisions of subparagraphs (A) through (E) of section 306(a)(13) in consultation with the State agencies and area agencies on aging. The Assistant Secretary shall conduct a review on the impact of such agreements on the provision of services under this Act, including the number of agreements per State, summaries of such agreements, and the impact of such agreements on access to services consistent with the goals of this Act. The Assistant Secretary shall annually prepare and submit to the Committee on Health, Education, Labor, and Pensions of the Senate, the Special Committee on Aging of the Senate, and the Committee on Education and Workforce of the House of Representatives the findings of such review.</text></subsection><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8a483ddf-9cdc-4424-b971-13cf87277130" changed="not-changed"><enum>(5)</enum><text display-inline="yes-display-inline">by striking subsection (e) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id90e3b4a4-bd30-46d3-8c80-d1a738f2623c" changed="not-changed"><subsection id="id922b7579-ac65-4f3a-b484-7ef92d1a7155" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Requesting additional information for certain non-OAA agreements</header><paragraph commented="no" display-inline="no-display-inline" id="ide8fbf7e5-b352-4015-86c9-f50afed852af" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In the case of an agreement described in subsection (a)(2), if the State agency has a reasonable belief that an agreement may violate the assurances provided under subsection (a)(2)(A)(ii), the State agency may request additional information from the recipient of funds under this Act that is a party to such agreement, which may include a request for a copy of such agreement. Such recipient shall make a good faith effort to address such request for additional information, except that such recipient shall not provide agreements or other data that are restricted under the terms of a non-disclosure agreement signed by such recipient. If such recipient declines to provide a copy of an agreement to a State agency, such recipient shall provide a justification to the State agency within 30 days of receiving such request. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23b8649a-497d-4ff4-b7fe-790e5c7d002a" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Confidentiality</header><text display-inline="yes-display-inline">A State agency shall keep confidential, as required by applicable Federal and State law, all information received under this subsection that is—</text><subparagraph commented="no" display-inline="no-display-inline" id="id445d3cb3-49a2-4f87-b8b0-d80809c0f58f" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">a trade secret;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide940fe7f-40ab-4343-b464-b2522b709233" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">commercial or financial information; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id33d9d15a-f394-4ee3-ab6b-ce6d6de63ad6" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">information obtained from an individual that is privileged and confidential.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5ddfc09dae5d4086b1272a8c08e69527" changed="not-changed"><enum>(f)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idbba6807fb7e8454bbe16228bec4dfe66" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Cost</header><text display-inline="yes-display-inline">The term <term>cost</term> means an expense, including an administrative expense, incurred by a recipient in developing or carrying out an agreement described in subsection (a), whether the recipient contributed funds, staff time, or other plant, equipment, or services to meet the expense.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddeddff6141a4443eab1ca7a019464818" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Recipient</header><text display-inline="yes-display-inline">The term <term>recipient</term> means an area agency on aging in a State with multiple planning and service areas.</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4d22af4c-8a89-40b9-bb43-395d75b3e2c6" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Area plans</header><text display-inline="yes-display-inline">Section 306 (<external-xref legal-doc="usc" parsable-cite="usc/42/3026">42 U.S.C. 3026</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id375808ba-a9ac-47ca-ac18-717fc02d3480" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(13)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id769e1b9d-f9e0-4ec9-8349-2658af4806e0" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (B)(i), by striking <quote>any service to older individuals</quote> and inserting <quote>any service under this Act to older individuals or caregivers</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc6db495a-c3eb-47a6-89d4-217738fc1525" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (g), by inserting <quote>, except as provided under section 212(a)(2),</quote> after <quote>Nothing in this Act</quote>.</text></paragraph></subsection></section><section id="id4b8874f0-2bd9-4fcc-a23f-aec05053ff94" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>107.</enum><header display-inline="yes-display-inline">Guidance on reallocation of funding between area agencies on aging</header><subsection id="idd4c8a0d6f21c490897354c80c8f3531d" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Assistant Secretary shall disseminate one-time guidance to State agencies (as defined in section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>)) and area agencies on aging on circumstances under which funds appropriated pursuant to part B and subparts 1 and 2 of part C of title III of the Older Americans Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3030d">42 U.S.C. 3030d et seq.</external-xref>, <external-xref legal-doc="usc" parsable-cite="usc/42/3030e">42 U.S.C. 3030e et seq.</external-xref>, <external-xref legal-doc="usc" parsable-cite="usc/42/3030f">42 U.S.C. 3030f et seq.</external-xref>) may be appropriate to reallocate between area agencies on aging within a single State, with the approval of the State agency and the concurrence of any involved area agencies on aging, within a budget year.</text></subsection><subsection id="id609c758b5293446a8a4b58ffd104df3a" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">In disseminating the guidance under subsection (a), the Assistant Secretary may consider circumstances that affect the expenditure of the funds described in such subsection.</text></subsection></section><section id="id72faad59-0aa1-4d79-a657-d634396844c1" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>108.</enum><header display-inline="yes-display-inline">Right to first refusal</header><text display-inline="no-display-inline">Section 305(b)(5)(B) (<external-xref legal-doc="usc" parsable-cite="usc/42/3025">42 U.S.C. 3025(b)(5)(B)</external-xref>) is amended to read as follows:</text><quoted-block id="id6a3d89f6-efc1-4ca9-a3ed-da404ecb41b1" display-inline="no-display-inline" style="OLC" changed="not-changed"><subparagraph id="id09fa2dae-5686-48c5-82c6-0b277dac3898" indent="up2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">Whenever a State agency designates a new area agency on aging after the date of enactment of the <short-title>Older Americans Act Reauthorization Act of 2025</short-title>, the State agency shall give the right to first refusal to a unit of general purpose local government if—</text><clause id="id22fbae1d-302b-4120-a05e-96451a77c264" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">such unit can meet the requirements of subsection (c);</text></clause><clause id="id127ba231-ace6-4490-9d11-5ff8d8a91a85" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id5f458f75-1a3e-41ef-ba5f-43667ef09491" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">such unit has demonstrated experience administering services for older individuals; or</text></subclause><subclause id="id61339c7f-172d-40c8-9bd4-ab06fb11498f" indent="up1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the State agency determines that there is not another entity eligible under subsection (c)(1) within the planning and service area with such demonstrated experience; and</text></subclause></clause><clause id="id60ecc28b-8254-4732-89eb-de1b217d0ca1" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">the boundaries of such unit and the boundaries of the planning and service area are reasonably contiguous.</text></clause></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section id="id1ffe43ae-95cf-4f7b-985f-f08ac549dedf" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>109.</enum><header display-inline="yes-display-inline">Area agency on aging capabilities</header><subsection commented="no" display-inline="no-display-inline" id="id98cd5244-fed4-4fc0-bdb8-1e17a99cff1e" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Organization</header><text display-inline="yes-display-inline">Section 305(c) (<external-xref legal-doc="usc" parsable-cite="usc/42/3025">42 U.S.C. 3025(c)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id9796761a-5686-4224-8919-37b36da786ae" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (5) as subparagraphs (A) through (E), respectively, and moving such subparagraphs 2 ems to the right;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idefe3488c-03fc-4ed6-a5b2-29f2bb636047" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>shall be</quote> and inserting the following: “shall—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7adfb2fd-6275-49e7-8121-1846116de091" changed="not-changed"><paragraph commented="no" display-inline="no-display-inline" id="id8b9ef869-370b-431b-8a21-0ac18b74957d" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">be—</text></paragraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></paragraph><paragraph id="id5dfbe0d5-5ed3-4427-b374-e36e61361732" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (E), as so redesignated—</text><subparagraph commented="no" display-inline="no-display-inline" id="id81b604ce-9732-40e3-8586-a885a45a4b86" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>(b)(5)</quote> and inserting <quote>(b)(5)(A)</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb6e87632-06a2-4306-9f4a-cf4d2a3b1dae" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">by striking <quote>and shall provide assurance,</quote> and all that follows through <quote>the area plan.</quote> and inserting the following:</text><quoted-block id="id1C8BCFDD4C2C4BE68EE6D8FC8A12D047" display-inline="no-display-inline" style="OLC"><paragraph id="id272f6ceb-7e69-46e5-a28d-86a362edee8a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">provide assurance, determined adequate by the State agency, that the area agency on aging will have the ability, and maintain the capabilities necessary, to develop an area plan as required under section 306(a), and carry out, directly or through contractual or other arrangements, and oversee activities in accordance with—</text><subparagraph commented="no" display-inline="no-display-inline" id="idafdb0cb8-82c4-4d48-be8b-accf0944a1a1" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the plan within the planning and service area;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0528439e-e3eb-41af-ae4b-2b007735c21b" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">any other relevant requirements of this Act;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4263bf5b-03bf-4a3a-a636-495bb3195bc0" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">other applicable Federal and State laws; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id29be6272-6f9e-4d4d-829d-681b9b72c953" changed="not-changed"><enum>(D)</enum><text display-inline="yes-display-inline">other terms and conditions of awards received under this Act.</text></subparagraph></paragraph><quoted-block-continuation-text commented="no" quoted-block-continuation-text-level="subsection"> In designating an
                                area agency on aging within the planning and service area or within
                                any unit of general purpose local government designated as a
                                planning and service area, the State shall give preference to an
                                established office on aging, unless the State agency finds that no
                                such office within the planning and service area will have the
                                capacity to carry out the area
 plan.</quoted-block-continuation-text><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id101b2c84-8cc2-412c-81d3-cd56d1c4bcee" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Plans</header><text display-inline="yes-display-inline">Section 306(f)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/3026">42 U.S.C. 3026(f)(1)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id6e2b6da8-c13a-4b01-8bff-4301e83c3f4a" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>the assurances required under section 305(c)(2),</quote> after <quote>of this section,</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id736bf7cb-3a36-4a34-bffb-a458a7e19f1e" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">by striking the period at the end and inserting <quote>, and if the State agency determines, in the discretion of the State agency, that an area agency on aging failed in 2 successive years to comply with the requirements under this title, then the State agency may require the area agency on aging to submit a plan for a 1-year period that meets such requirements, for subsequent years until the State agency determines that the area agency on aging is in compliance with such requirements.</quote>.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id6ff1b249-87b3-47f9-9aff-a5a9377e2ae1" changed="not-changed" section-type="subsequent-section"><enum>110.</enum><header display-inline="yes-display-inline">Supporting older individuals with disabilities through improved
 coordination</header><subsection id="id627b5d5f-bab7-4cf1-b817-53089475718f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Area plans</header><text display-inline="yes-display-inline">Section 306(a)(5) (<external-xref legal-doc="usc" parsable-cite="usc/42/3026">42 U.S.C. 3026(a)(5)</external-xref>) is amended by striking <quote>with agencies that develop or provide services for individuals with disabilities</quote> and inserting <quote>with entities that develop or provide services for individuals with disabilities, which may include centers for independent living, relevant service providers, and other community-based organizations, as appropriate</quote>.</text></subsection><subsection id="id23a07d8c-9fc4-45c1-837e-cd1e424a0a0f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Supporting older individuals with disabilities through improved
 coordination</header><paragraph id="idd4565b23-a8f4-4c6c-b48e-672cc6356b46" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator of the Administration for Community Living of the Department of Health and Human Services (referred to in this section as the <quote>Administrator</quote>) shall identify—</text><subparagraph id="idb5132237-7fa7-4077-9358-8bdfc26b861d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">opportunities to improve coordination between the aging and disability networks, which may include the formation of partnerships to serve individuals eligible for programs under the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3001">42 U.S.C. 3001 et seq.</external-xref>);</text></subparagraph><subparagraph id="id2cb935e4-f918-4836-836e-176e95836f87" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">lessons learned from disability networks, including centers for independent living, State developmental disabilities councils, university centers for excellence in developmental disabilities education, research, and service, and State protection and advocacy agencies that could improve operations and service delivery within the aging network; and</text></subparagraph><subparagraph id="id8a336a28-0934-4188-84fe-940eeff3af7e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">any technical assistance needs related to subparagraphs (A) and (B).</text></subparagraph></paragraph><paragraph id="id518bd962-6c42-4db5-978a-323ef38036e5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Guidance</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Administrator shall issue guidance to State agencies and area agencies on aging on strategies to leverage disability networks, including centers for independent living, State developmental disabilities councils, university centers for excellence in developmental disabilities, education, research, and service, and State protection and advocacy agencies, as appropriate, to strengthen the provision of services under the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3001">42 U.S.C. 3001 et seq.</external-xref>).</text></paragraph><paragraph id="idb6bd1390-5594-4c73-8203-d84b76e298cd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Technical assistance</header><text display-inline="yes-display-inline">The Administrator shall coordinate across the Administration for Community Living to address any technical assistance needs identified under paragraph (1)(C) in a manner that does not unnecessarily duplicate other technical assistance activities carried out prior to the date of enactment of this Act.</text></paragraph></subsection><subsection id="id1f3b2c2ffc1545a78cce8b2a23a3650b" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">Section 102 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>) is amended—</text><paragraph id="id46e055e5e29542e4ba1356a6db7cebe9" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>(as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>))</quote>;</text></paragraph><paragraph id="idf4784ff83cff4a71876cdacfdaf95ee2" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (13), by striking <quote>The term</quote> and all that follows through <quote>adjustment.</quote> and inserting <quote>The term <term>disability</term> has the meaning given such term in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</quote>; and</text></paragraph><paragraph id="id90c1ca31c0c04320895049f1d5f73969" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (49)(B), by striking <quote>of the major life activities specified in subparagraphs (A) through (G) of paragraph (8)</quote> and inserting <quote>major life activities specified in section 3(2) of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102(2)</external-xref>).</quote>.</text></paragraph></subsection></section><section id="id67b51bac-4b86-4ae7-8325-0526e126a589" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>111.</enum><header display-inline="yes-display-inline">Business acumen, fiscal training, and technical assistance</header><text display-inline="no-display-inline">Section 307(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/3027">42 U.S.C. 3027(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id226765eafc7a44bfa18e164f4282282d"><paragraph id="idd1c5df3fa1b1467c968f36f7d8ea72c3" commented="no" display-inline="no-display-inline"><enum>(31)</enum><text display-inline="yes-display-inline">The plan shall provide assurances that the State agency, to the extent feasible and when applicable and appropriate, provides technical assistance for area agencies on aging related to the development of business acumen, sound fiscal practices, capacity building, organizational development, innovation, and other methods of growing and sustaining the capacity of the aging network to carry out activities funded under this Act to serve older individuals and caregivers most effectively.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section id="id3a426fd6-5861-4dae-adf8-0590074af3d2" commented="no" changed="not-changed" display-inline="no-display-inline" section-type="subsequent-section"><enum>112.</enum><header display-inline="yes-display-inline">Enhancing access to assistive technology</header><text display-inline="no-display-inline">Section 307(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/3027">42 U.S.C. 3027(a)</external-xref>), as amended by section 111 of this Act, is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida6284a5f-00e3-4101-a3ec-af53d1141c32" changed="not-changed"><paragraph commented="no" display-inline="no-display-inline" id="id124f1e79-f8b0-4bba-bcbe-e26e5ff0d430" changed="not-changed"><enum>(32)</enum><text display-inline="yes-display-inline">The plan shall provide assurances that the State will coordinate services, to the extent feasible, with lead agencies designated to carry out State assistive technology programs under the Assistive Technology Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/3001">29 U.S.C. 3001 et seq.</external-xref>) and with area agencies on aging to assist eligible older individuals, including older individuals with disabilities, in accessing and acquiring assistive technology.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section id="id6e61ccf1-16b3-4df9-88e6-d8f157ed817c" commented="no" changed="not-changed" display-inline="no-display-inline" section-type="subsequent-section"><enum>113.</enum><header display-inline="yes-display-inline">White House Conference on Aging</header><text display-inline="no-display-inline">The Older Americans Act Amendments of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3001">42 U.S.C. 3001</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/100/175">Public Law 100–175</external-xref>) is amended by striking title II and inserting the following:</text><quoted-block id="id4baf9821-bc5d-4a10-8005-af3f4fa63d41" display-inline="no-display-inline" style="OLC" changed="not-changed"><title id="idf5108d7c-2c1b-452d-bf06-3ff21a67b7bf" style="OLC" changed="not-changed" commented="no" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">White House Conference on Aging</header><section id="id2fdb6e2d-65ca-4337-b72f-96d3f83a11d0" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Authorization of the Conference</header><subsection id="idd51e1d39-4cb3-4dc5-8bf9-b830a2af5776" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Authority To call conference</header><text display-inline="yes-display-inline">Not earlier than January 21, 2025 and not later than December 31, 2025, the President shall convene the White House Conference on Aging in order to fulfill the purpose set forth in subsection (c) and to make fundamental policy recommendations regarding programs that are important to older individuals and to the families and communities of such individuals.</text></subsection><subsection id="id6107dfca-7eda-41ef-bc25-093f96c400f9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Planning and direction</header><text display-inline="yes-display-inline">The Conference described in subsection (a) shall be planned and conducted under the direction of the Secretary, in cooperation with the Assistant Secretary for Aging, the Director of the National Institute on Aging, the Administrator of the Centers for Medicare &amp; Medicaid Services, the Social Security Administrator, and the heads of such other Federal agencies serving older individuals as are appropriate. Planning and conducting the Conference includes the assignment of personnel.</text></subsection><subsection id="id9c740f69-9a99-4df9-acb5-e6f39a7e4bcd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of the Conference described in subsection (a) shall be to gather individuals representing the spectrum of thought and experience in the field of aging to—</text><paragraph id="id345d301f-6be5-47d1-aa38-d25fac21d1b0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">evaluate the manner in which the objectives of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3001">42 U.S.C. 3001 et seq.</external-xref>) can be met by using the resources and talents of older individuals, of families and communities of such individuals, and of individuals from the public and private sectors;</text></paragraph><paragraph id="id24eba609-1c46-4fc2-98fa-3a3189c58b5f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">evaluate the manner in which Federal policies, programs, and activities meet and respond to the needs of older individuals, including an examination of innovative and fiscally responsible strategies relating to retirement security, caregiving, nutrition and supportive services, health care, elder justice, and long-term services and supports;</text></paragraph><paragraph id="idfac9d9de4ec74dcc899a616dffe55201" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">be informed by the work and recommendations of the Interagency Coordinating Committee on Healthy Aging and Age-Friendly Communities, evaluate the recommendations of the Committee, and, as appropriate, suggest implementation strategies for such recommendations; and</text></paragraph><paragraph id="id5f57a617-a07d-4508-a7e1-30fb9abdc21a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">develop recommendations to guide the President, Congress, and Federal agencies in improving Federal programs that serve older individuals, which may relate to the prevention and mitigation of disease, injury, abuse, social isolation, loneliness, and economic insecurity, including food insecurity, and promotion of healthy aging in place.</text></paragraph></subsection><subsection id="idc1c6dd94-823d-4bbf-b380-21372cc61a2d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Conference participants and delegates</header><paragraph id="idad21a4b9-92c1-4158-ad6d-7969f1c38fa7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Participants</header><text display-inline="yes-display-inline">In order to carry out the purposes of this section, the Conference shall bring together—</text><subparagraph id="id2faace49-e439-4ecb-be67-6245729ee09e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">representatives of Federal, State, Tribal, and local governments;</text></subparagraph><subparagraph id="id89c70d2a-e1f9-46f1-aeb8-f0831a3dda09" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">professionals and volunteers who are working in the field of aging; and</text></subparagraph><subparagraph id="ida18b9943-55e9-47ad-9e1e-61f92c03010f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">representatives of the general public, particularly older individuals.</text></subparagraph></paragraph><paragraph id="idf94d439f-ef76-4961-9bf5-94478497fd51" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Selection of delegates</header><text display-inline="yes-display-inline">The delegates shall be selected without regard to political affiliation or past partisan activity and shall, to the best of the appointing authority's ability, be representative of the spectrum of thought in the field of aging. Delegates shall include older individuals, individuals who are professionals in the field of aging, individuals who are community leaders, minority individuals, individuals from rural areas, low-income individuals, and representatives of Federal, State, Tribal, and local governments.</text></paragraph></subsection></section><section id="idb12297f4-7fd9-4923-aecf-06614960f0db" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Conference administration</header><subsection id="id854ca72c-6b49-4680-a260-2b880b1c3892" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">In administering this section, the Secretary shall—</text><paragraph id="id91cb3d6f-3ca5-4d07-b160-cce012b7239c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">consult with relevant State, Tribal, and local officials, stakeholders, and subject matter experts in planning the Conference;</text></paragraph><paragraph id="id4f2fbd2e-59ad-40d5-9bdb-f05d55d4f204" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">request the cooperation and assistance of the heads of such other Federal departments and agencies, including such officials of the Interagency Coordinating Committee on Healthy Aging and Age-Friendly Communities, as may be appropriate in the carrying out of this section;</text></paragraph><paragraph id="ide5ed86bf-0fd1-4d33-99d0-87b3faf89455" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">make available for public comment a proposed agenda for the Conference, which will reflect to the greatest extent possible the major issues facing older individuals, consistent with the provisions of section 201(c);</text></paragraph><paragraph id="ida3e50d90-d45c-4805-8615-a2fe217db587" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">prepare and make available such background materials for the use of delegates to the Conference as the Secretary deems necessary; and</text></paragraph><paragraph id="id868567cf-c09c-42cf-a4bf-1b7c8adad7e1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">engage such additional personnel as may be necessary to carry out the provisions of this section without regard to provisions of title 5, United States Code, governing appointments in the competitive service, and without regard to chapter 51 and subchapter III of chapter 53 of such title, relating to classification and General Schedule pay rates.</text></paragraph></subsection><subsection id="id5099bc38-a834-469b-bcf4-f66c54b679c0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Secretary shall, in carrying out the Secretary's responsibilities and functions under this section, and as part of the White House Conference on Aging, ensure that—</text><paragraph id="id84ea36da-76de-42d8-8deb-673f4b986449" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the agenda prepared under subsection (a)(3) for the Conference is published in the Federal Register not later than 30 days after such agenda is approved by the Secretary; </text></paragraph><paragraph id="idbf5e1681-2867-44af-937f-f2ab06645c48" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the personnel engaged under subsection (a)(5) shall be fairly balanced in terms of points of views represented and shall be appointed without regard to political affiliation or previous partisan activities; </text></paragraph><paragraph id="idf754cfb7-5cab-4340-b443-0cd0b2951685" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">the recommendations of the Conference are not inappropriately influenced by any appointing authority or by any special interest, but will instead be the result of the independent judgment of the Conference; and</text></paragraph><paragraph id="id4fc78859-f0b6-4c22-a2d2-b2f9e3563dfb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">current and adequate statistical data, including decennial census data, and other information on the well-being of older individuals in the United States, are readily available, in advance of the Conference, to the delegates of the Conference, together with such information as may be necessary to evaluate Federal programs and policies relating to aging. In carrying out this subparagraph, the Secretary is authorized to make grants to, and enter into cooperative agreements with, public agencies and nonprofit private organizations.</text></paragraph></subsection><subsection id="id8bf48267-ec1e-4fb4-bacb-820a22f48021" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Gifts</header><text display-inline="yes-display-inline">The Secretary may accept, on behalf of the United States, gifts (in cash or in kind, including voluntary and uncompensated services) that shall be available to carry out this title. Gifts of cash shall be available in addition to amounts appropriated to carry out this title. Gifts may be earmarked by the donor for a specific purpose.</text></subsection><subsection id="id620778bd-0d33-4aaf-9a91-670719d7c24e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Records</header><text display-inline="yes-display-inline">The Secretary shall maintain records regarding—</text><paragraph id="id82f4c20c-de21-4000-9717-1d43f9cae73d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the sources, amounts, and uses of gifts accepted under subsection (c); and</text></paragraph><paragraph id="id56866ecb-39b0-43ad-9866-4dc1ce710c77" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the identity of each person receiving assistance to carry out this title, and the amount of such assistance received by each such person.</text></paragraph></subsection></section><section id="id121b8a1a-6b34-45d2-82f2-33a3c508f053" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>203.</enum><header display-inline="yes-display-inline">Report of the Conference</header><subsection id="id4159dbbf-5292-4e6c-9cad-2cd909ad1d2a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Preliminary report</header><text display-inline="yes-display-inline">Not later than 100 days after the date on which the Conference adjourns, the Secretary shall publish and deliver to the States a preliminary report on the Conference. does not unnecessarily duplicate other Federal assistance available) weatherization projects, designed to enable older individuals to maintain their homes in conformity with minimum housing and (as applicable and appropriate) other relevant standards, in order to support such older individuals in aging in place and maintaining their health;</quote>.</text></subsection></section><section id="idf0ca10d0e17945e0ace2a5884b3e19ff" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>206.</enum><header display-inline="yes-display-inline">National resource center for engaging older adults</header><text display-inline="no-display-inline">Section 411(a)(18) (<external-xref legal-doc="usc" parsable-cite="usc/42/3032">42 U.S.C. 3032(a)(18)</external-xref>) is amended by inserting <quote>, such as providing appropriate training, resources, and best practices to the aging network</quote> after <quote>older individuals</quote>.</text></section><section id="idca759d8c-7c02-4dc4-9e45-c85a215b0814" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>207.</enum><header display-inline="yes-display-inline">Multigenerational and civic engagement activities</header><text display-inline="no-display-inline">Section 417 (<external-xref legal-doc="usc" parsable-cite="usc/42/3032f">42 U.S.C. 3032f</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id3c3af3fc-82f3-442b-8620-cfc0bc819ede" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="id40543ed2f0d745c782be3f89ae06229b" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">by striking paragraph id="id3aba83b8-82e1-46eb-b7c7-879fbe56aff6" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>208.</enum><header display-inline="yes-display-inline">Report relating to health outcomes for older individuals living with or near
 family members</header><subsection id="idd9cdb21f-c8ba-4639-8e6a-a843fe2b38d0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall prepare a report that assesses—</text><paragraph id="id75556097-dccc-4881-81af-f0e291ed545c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the health outcomes for older individuals who live with, on the same property as, or otherwise in the community in close geographic proximity, relative to the area, to family members; and</text></paragraph><paragraph id="id4efa92bc-0017-4c08-988b-778cdcac0cc2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the degree to which programs under the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3001">42 U.S.C. 3001 et seq.</external-xref>) promote living in the settings described in paragraph (1), as appropriate.</text></paragraph></subsection><subsection id="id6ccba0b3-8be7-400d-bebe-b4a8ce8f98c9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Inclusion</header><text display-inline="yes-display-inline">The report described under subsection (a) shall include—</text><paragraph id="idfcef90f0-3aac-4f26-a034-42529e71c8cf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment of physical and mental health outcomes of older individuals who live in the settings described in subsection (a)(1) in comparison to physical and mental health outcomes of older individuals who do not live in such settings;</text></paragraph><paragraph id="id5bc2ec03-fbe9-4f59-aa2c-b9dd106d8f47" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">an assessment of the extent to which living in such settings mitigates social isolation and loneliness in older individuals; and</text></paragraph><paragraph id="id51b0f731-f059-4a8a-9688-b2b4c7caebd8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">a description of the different types of such settings and whether, and to what extent, findings under paragraphs (1) and (2) vary across such different types.</text></paragraph></subsection><subsection id="idae08ad44-ed59-4936-95bf-4eaef7602aa2" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Submission</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Secretary shall submit to the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate and the Committee on Education and Workforce of the House of Representatives the report required by subsection (a).</text></subsection></section><section id="idc2575a8d-fa66-44ee-8c1a-1bd4085771a6" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>209.</enum><header display-inline="yes-display-inline">Improving broadband coordination and reducing social isolation</header><subsection id="ide6d2d2fe-6276-46bb-8fd9-ed4ba4a8a5a5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Assistant Secretary shall, as appropriate, coordinate with the Assistant Secretary of Commerce for Communications and Information of the National Telecommunications and Information Administration to ensure that the aging network (as defined in section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>)) and other relevant stakeholders are aware of, and, subject to applicable eligibility criteria, have access to, Federal programs relating to digital literacy and the adoption of broadband that may support healthy aging and aging in place for older individuals.</text></subsection><subsection id="id865f0d37-affe-4c88-bf82-c4bb8dfa2a62" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Assistant Secretary shall prepare, and submit to the Committee on Health, Education, Labor, and Pensions, the Special Committee on Aging, and the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Education and Workforce of the House of Representatives, a report regarding any coordination efforts carried out pursuant to subsection (a).</text></subsection></section></title><title id="idd80663eb-1987-421f-8215-5d2655d9f820" style="OLC" changed="not-changed" commented="no" level-type="subsequent"><enum>III</enum><header display-inline="yes-display-inline">Enhancing Innovation and Flexibility in Nutrition Services</header><section id="id6de27688-0e00-46cd-82c5-b344b7d82385" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Medically tailored meals</header><subsection id="idc4c1766c-4b8d-4d24-ae78-a5d457a17ff5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">Section 102(14) (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002(14)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ida4e566f4-26f9-49ca-ab2a-3cc337c0671b" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (C), by inserting <quote>, which may include counseling related to the provision of medically tailored meals,</quote> after <quote>counseling</quote>; and</text></paragraph><paragraph id="id2c124fa6-28cb-4cec-bae3-9c95b05db277" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (viii), by inserting <quote>and innovative interventions</quote> after <quote>including strategies</quote>.</text></paragraph></subsection><subsection id="id17cc43a4-e2b7-4601-aa97-84acb71a2efa" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Nutrition education</header><text display-inline="yes-display-inline">Section 214(2)(C) (<external-xref legal-doc="usc" parsable-cite="usc/42/3020e">42 U.S.C. 3020e(2)(C)</external-xref>) is amended by inserting <quote>, including interventions,</quote> after <quote>other activities</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id12fe0e2f-9a6c-4bbf-81b6-dab404640a43" changed="not-changed"><enum>(d)</enum><header display-inline="yes-display-inline">Nutrition services purposes</header><text display-inline="yes-display-inline">Section 330(3) (<external-xref legal-doc="usc" parsable-cite="usc/42/3030d-21">42 U.S.C. 3030d–21(3)</external-xref>) is amended by inserting <quote>, tailored to their individual medical and nutritional needs to the extent feasible,</quote> after <quote>services</quote>.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="idf4040ffd-2a3e-4fb0-8e41-dd5a9d89e7f2" changed="not-changed" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Grab-and-go meals</header><text display-inline="no-display-inline">Section 308(b)(4) (<external-xref legal-doc="usc" parsable-cite="usc/42/3028">42 U.S.C. 3028(b)(4)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="idafc41ecb-c779-456b-ad9e-d571dc208ef0" display-inline="no-display-inline" style="OLC" changed="not-changed"><subparagraph commented="no" display-inline="no-display-inline" id="ida9af67a5-feef-4b96-af9a-551e476931dc" indent="up2" changed="not-changed"><enum>(E)</enum><text display-inline="yes-display-inline">A State may elect in its plan under section 307 to allow use of not more than 25 percent of the funds received by such State under subpart 1 of part C, calculated after any transfers under subparagraphs (A) and (B) are completed, to make meals available at congregate meal sites or other community locations for consumption by older individuals outside such sites and locations, such as carry-out or similar meals. A State electing to allow use of funds under the preceding sentence shall—</text><clause commented="no" display-inline="no-display-inline" id="idf6f9352a-7c8e-446a-9ad3-8e1bb7821c5b" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">ensure that such allowable use complements the delivery of services through the congregate meals program under section 331; and</text></clause><clause id="id0dedc8d7-7157-49f7-827d-356832db557b" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">notify the Assistant Secretary of such election, including a description of the amount and percentage of funds received by such State under subpart 1 of part C to be used for such purposes.</text></clause></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section id="id6063ad51-bc7f-4b08-bf8c-a31ed0fd6eec" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">GAO study on Nutrition Services Incentive Program</header><subsection commented="no" display-inline="no-display-inline" id="id9f2c486a-455a-48f9-aeba-2058136972d5" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study to evaluate the Nutrition Services Incentive Program under section 311 (<external-xref legal-doc="usc" parsable-cite="usc/42/3030a">42 U.S.C. 3030a</external-xref>) (referred to in this section as the <term>Program</term>).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9b6765cc-a23f-47d5-a189-91a29c79aed4" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The study under this section—</text><paragraph commented="no" display-inline="no-display-inline" id="id5fee5532-de14-48fa-89e8-a8adfa4df370" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id659df21a-49e3-4d6b-8ee4-33d4609520bd" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">include an assessment of how States and Tribal organizations use funding provided under the Program, including the degree to which States and Tribal organizations use such funding to procure food products from local or regional producers for meals supported under the Program; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb22b5cfe-e49a-4113-87f9-34c788bb6338" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">identify any challenges or barriers to increasing the use of local and regional producers under the Program; and</text></subparagraph></paragraph><paragraph id="idb67bbd91-25cf-4a4e-88a7-566557a8c0cc" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">may make recommendations related to improving the effectiveness of the Program, including with respect to the use of local and regional producers.</text></paragraph></subsection><subsection id="id4cda133694e54be8b9b2ed58725db274" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate and the Committee on Education and Workforce of the House of Representatives a report on the results of the study under this section.</text></subsection></section><section id="id3edcd2cb-4698-4e77-8283-f80af9b3ac1a" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>304.</enum><header display-inline="yes-display-inline">Innovations in nutrition programs and services</header><text display-inline="no-display-inline">Subpart 3 of part C of title III (<external-xref legal-doc="usc" parsable-cite="usc/42/3030g-21">42 U.S.C. 3030g–21 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="id1070734d-b15d-4d25-add1-30b38e8f889c" display-inline="no-display-inline" style="OLC" changed="not-changed"><section id="iddbb87626-02fd-4b16-af4c-b545b3b7dca4" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>340.</enum><header display-inline="yes-display-inline">Innovations in nutrition programs and services</header><subsection id="id24284191225b4dcab61e2a13c9247df4" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Demonstration To reduce hunger, food insecurity, and
 malnutrition</header><paragraph id="id282c1883916a476f9442f9c51d3de9f5" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">From funds available under paragraph (5), the Assistant Secretary shall make grants, on a competitive basis, to eligible entities, to achieve the purposes of section 330(1) by developing, testing, implementing, and evaluating innovative local or regional approaches to improve the quality, effectiveness, efficiency, and outcomes of nutrition projects and services described in sections 311, 331, and 336.</text></paragraph><paragraph id="idf62dc0fb946a4b5094bc01090bb7dc8b" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Eligibility</header><text display-inline="yes-display-inline">In order to be eligible for a grant under paragraph (1), an entity shall—</text><subparagraph id="idcd92ef26a4a14f029fe24545e615bf66" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">be—</text><clause id="id0c4f93d22a7f470882bbb193fde36f2f" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">a State agency, an area agency on aging, an Indian Tribe, a Tribal organization, or another public or nonprofit private entity, including a nutrition service provider, a multipurpose senior center, a health care entity, or an institution of higher education; or</text></clause><clause id="idb17aaf9249dc483a910e29d655b5951f" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a partnership between any entities described in clause (i); and</text></clause></subparagraph><subparagraph id="id04bd8953757640468b05db0598c7a005" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">submit an application at such time and in such manner as the Assistant Secretary may require, including—</text><clause id="id2c10ff4d10b84fcd96207367caad86ea" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">a description of an innovative approach referred to in paragraph (1) that the entity proposes to implement under the grant;</text></clause><clause id="idcb41b56719f64848906287b8a92ddea9" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a plan for evaluating the effectiveness, including cost-effectiveness, of the innovative approach proposed; and</text></clause><clause id="idc59e3470ea1144efb83c10b2bc5afc4d" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">a plan for the publication of the results of such evaluation.</text></clause></subparagraph></paragraph><paragraph id="id3f58bf14fe114cddae856f0a375bc764" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Priority</header><text display-inline="yes-display-inline">In selecting eligible entities for grants under this subsection, the Assistant Secretary shall give priority to eligible entities proposing to carry out a grant in 1 or more rural areas.</text></paragraph><paragraph id="idb178ad158647410f9e21d9f5a2a81992" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Older Americans Act Reauthorization Act of 2025</short-title>, and annually thereafter, the Assistant Secretary shall submit a report to the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate and the Committee on Education and Workforce of the House of Representatives describing any activities carried out under paragraph (1), an assessment of the outcomes of such activities using rigorous methodologies, and recommendations for inclusion of any successful innovative approaches within nutrition programs established under this Act.</text></paragraph><paragraph id="ide993a02e25424566a9805b5e256b30b1" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Reservation</header><text display-inline="yes-display-inline">From the total of the amounts made available for a fiscal year under paragraphs (1) and (2) of section 303(b) and in section 311(e), the Assistant Secretary shall reserve an amount equal to not more than 1 percent to carry out activities described in paragraph (1) of this subsection.</text></paragraph></subsection><subsection id="id7b23b11114d24166a98679cf163c27aa" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Innovative approaches To reduce hunger, food insecurity, and
 malnutrition</header><paragraph id="id87b430689ecf40799ced1df4aa5b4144" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (6), in carrying out nutrition projects established under this Act, a State agency or title VI grantee may implement innovative approaches, including any applicable approaches implemented previously by the Assistant Secretary or pursuant to subsection (a), that are demonstrated to be effective, to achieve the purposes described in section 330(1) by improving—</text><subparagraph id="id19def3eb6c904a559b9d2e507e08393b" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the quality, composition, preparation, modality, delivery, or location of meals provided to older individuals under this Act; or</text></subparagraph><subparagraph id="id876f7c59023d4e3c93f0c652d1eabace" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the efficiency and effectiveness of distributing, delivering, or otherwise making meals available to older individuals under this Act.</text></subparagraph></paragraph><paragraph id="id8e4696a125cc4215aef485d1f07dbeb9" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">At the request of a State agency implementing an approach under paragraph (1), the Assistant Secretary may waive any requirements of subpart 1 or 2 with respect to such State agency if such requirements impede the ability of such State agency to successfully implement such an approach.</text></paragraph><paragraph id="ide1b9591293b34c7fb3239121a695cc0b" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Flexibility</header><text display-inline="yes-display-inline">The Secretary shall provide maximum flexibility to a title VI grantee implementing an approach under paragraph (1) in the same manner as the Secretary provides maximum flexibility in accordance with section 614(c)(3).</text></paragraph><paragraph id="id34fa52581202413584f4d4b411466e90" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">The authority to carry out activities described in paragraph (1) shall expire on October 1, 2030.</text></paragraph><paragraph id="id4c06022e2f11482eb511f33e3a1fc0cf" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than September 30, 2029, the Assistant Secretary shall submit a report to the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate and the Committee on Education and Workforce of the House of Representatives describing any activities carried out by State agencies or title VI grantees under paragraph (1), an assessment of the outcomes of such activities using rigorous methodologies, and recommendations for inclusion of any successful innovative approaches within nutrition programs established under this Act.</text></paragraph><paragraph id="id9b98914d1a2743318d3f9c86bc748024" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Use of allotment</header><text display-inline="yes-display-inline">If the amount appropriated to carry out section 311 for a fiscal year exceeds the amount appropriated to carry out section 311 for the prior fiscal year or fiscal year 2024, whichever is greater, a State agency and title VI grantee in receipt of an allotment under section 311(b) may elect to use the difference between the allotment received for the fiscal year and the allotment received for the prior fiscal year or fiscal year 2024, whichever is greater, for activities described in paragraph (1).</text></paragraph><paragraph id="id7d9a7f29d2eb4bbfb7153fd01cf29f10" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed as limiting or prohibiting the requirements described in section 339 from applying to nutrition projects utilizing an innovative approach under this subsection.</text></paragraph></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section></title><title id="idcfbf61bd-460e-4bf8-930e-617127332ae0" style="OLC" changed="not-changed" commented="no" level-type="subsequent"><enum>IV</enum><header display-inline="yes-display-inline">Supporting Family Caregivers</header><section id="ide7ba21b5-5b4a-4153-9822-695c97607652" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>401.</enum><header display-inline="yes-display-inline">Improving the National Family Caregiver Support Program</header><subsection id="id35996b06-855c-4af9-9ec5-7d189c1c06c0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">State requirements for State and community programs on aging

132 Stat. 1511), shall provide ongoing technical assistance</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5744c27f-7b82-4ba7-968a-b6dc4ad10b39" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0e7230fb-1714-4838-a72e-1474c39f3598" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">by redesignating paragraph (3) as paragraph (4); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id08201075-b5d2-4cbf-a2a2-a3cc41880dc4" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">how the programs described in subparagraph (A) serve older individuals in seeking and obtaining community service employment;</text></subparagraph></paragraph><paragraph id="idd2e0976ef56443e28c82b74b05d07e0a" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">analyzes the expected levels of performance described in section 513(a) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3056k">42 U.S.C. 3056k(a)</external-xref>), the efficacy and impacts of the indicators of performance described in section 513(b) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3056k">42 U.S.C. 3056k(b)</external-xref>), and corrective measures described in section 513(d) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3056k">42 U.S.C. 3056k(d)</external-xref>) for the older American community service employment program, compared with the expected levels of performance, efficacy and impacts of the indicators of performance, and corrective measures described in section 116 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141</external-xref>) for programs authorized under title I of such Act, including the efficacy of the indicators of performance described in section 513(b) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3056k">42 U.S.C. 3056k(b)</external-xref>) for individuals described in subsection (a)(3)(B)(ii) or subsection (b) of section 518 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3056p">42 U.S.C. 3056p</external-xref>);</text></paragraph><paragraph id="idb779ebccda934a4abdcb9b6f77a3081c" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">develops recommendations for any alternative measures that may better measure the efficacy of the older American community service employment program as authorized under title V of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3056">42 U.S.C. 3056 et seq.</external-xref>) for individuals described in subsection (a)(3)(B)(ii) or subsection (b) of section 518 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3056p">42 U.S.C. 3056p</external-xref>) to achieve the objectives described in section 101 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3001">42 U.S.C. 3001</external-xref>); and</text></paragraph><paragraph id="id91e52ad0fa1a4495bc87ef68b1e73ada" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">evaluates how the Department of Labor coordinates delivery of services with State and national grantees under title V of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3056">42 U.S.C. 3056 et seq.</external-xref>) and with States and local workforce development areas under title I of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3111">29 U.S.C. 3111 et seq.</external-xref>) to serve older individuals.</text></paragraph></subsection><subsection id="id69d240647785461ab58617a6ddc786c7" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Report to congress</header><text display-inline="yes-display-inline">Not later than 180 days after the review required under this section is completed, the Comptroller General shall submit to the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate and the Committee on Education and Workforce of the House of Representatives a report on the results of such review.</text></subsection></section></title><title id="id066518d3-3fad-4973-a0f4-fb01a3d9d3be" style="OLC" changed="not-changed" commented="no" level-type="subsequent"><enum>VI</enum><header display-inline="yes-display-inline">Improving Services for Native Elders</header><section id="id82fd0caa-2f03-4ce2-b257-1d5fe9da8863" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>601.</enum><header display-inline="yes-display-inline">Older Americans Tribal Advisory Committee</header><text display-inline="no-display-inline">Section 201(c) (<external-xref legal-doc="usc" parsable-cite="usc/42/3011">42 U.S.C. 3011(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3d6e2306-938d-48bd-bc80-fa834ac86dc8" changed="not-changed"><paragraph id="id89668412-b2c6-41a8-a1cc-92157871c612" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idc7e95658-5dcb-4777-bd7f-34bbf384080a" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">In addition to other methods of government-to-government consultation between the Administration and Indian Tribes and conferring with organizations representing Native Hawaiians, the Assistant Secretary shall establish an advisory committee, to be known as the <quote>Older Americans Tribal Advisory Committee</quote> (referred to in this paragraph as the <quote>Committee</quote>) to provide advice and guidance to the Assistant Secretary on matters relating to the needs of older individuals who are Native Americans and implementation of related programs and activities under this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id659599a9-8edd-444a-8606-c5dffaf2031d" indent="up1" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">The Committee shall be composed of 11 voting, non-Federal members, including—</text><clause commented="no" display-inline="no-display-inline" id="id268443cc-7326-4ca5-a114-7d396ecacbf7" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">geographically diverse individuals with expertise on the range of issues affecting Indian Tribes, organizations representing Native Hawaiians, and older individuals who are Native Americans;</text></clause><clause commented="no" display-inline="no-display-inline" id="idafff87c2-e0fa-4019-8add-71c3b0a785e9" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">not less than 1 member who is an Alaska Native; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idde2033b8-67c4-4fdb-ab1e-9388a7ca358b" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">not less than 1 member who is a Native Hawaiian.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id6fcad37a-609b-42ee-aa1a-51bd7eb92cfe" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">The Committee shall include non-voting, ex officio representatives of relevant Federal departments and agencies, including—</text><clause commented="no" display-inline="no-display-inline" id="id80e30837-a4f4-4c24-a27b-51f916382160" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">the Administration;</text></clause><clause commented="no" display-inline="no-display-inline" id="ida510a888-6cde-4044-bf18-56111162bb81" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">the Indian Health Service;</text></clause><clause commented="no" display-inline="no-display-inline" id="idc5507048-c765-4bd0-8e02-72170dc66279" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">the Centers for Medicare &amp; Medicaid Services;</text></clause><clause commented="no" display-inline="no-display-inline" id="idedb046bb-a37b-4cc6-8402-5298df7402ae" changed="not-changed"><enum>(iv)</enum><text display-inline="yes-display-inline">the Department of the Interior;</text></clause><clause commented="no" display-inline="no-display-inline" id="id39dbe768-6ad6-4c59-950c-837a81945113" changed="not-changed"><enum>(v)</enum><text display-inline="yes-display-inline">the Department of Labor; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd7b76061-a266-4283-8183-b62e9394721b" changed="not-changed"><enum>(vi)</enum><text display-inline="yes-display-inline">any other agency or office with subject matter expertise that the Assistant Secretary determines appropriate.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idc8e8b4ba-6784-4689-a091-3c29923ef418" changed="not-changed"><enum>(D)</enum><text display-inline="yes-display-inline">The Committee shall meet in person not less frequently than twice each year.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idea0edcf5-038f-409b-a3af-8b5b602db8f0" changed="not-changed"><enum>(E)</enum><text display-inline="yes-display-inline">The Committee shall coordinate, as appropriate, with the Secretary’s Tribal Advisory Committee of the Department of Health and Human Services.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id09fd1576-2fa0-48e6-ad24-86f3d2844e78" changed="not-changed"><enum>(F)</enum><clause commented="no" display-inline="yes-display-inline" id="id19bb1159-4854-4780-b460-192a11385f22" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">Not less frequently than once each year, the Committee shall submit to the Assistant Secretary and make publicly available a report that describes—</text><subclause commented="no" display-inline="no-display-inline" indent="up1" id="id0e9159cb-d72a-4801-8d8b-49e9603d192c" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">the activities of the Committee during the previous year; and</text></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="idd82d036b-7df7-4a44-965f-f478b2ddfee0" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">recommendations for administrative action, including the identification of any statutory barriers to carrying out such recommendations, for the following year.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id64277d76-835b-4917-8c7d-d899ec25ade6" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">Not later than 60 days after the date on which the Assistant Secretary receives a report under clause (i), the Assistant Secretary shall submit to the Committee a written response to such report.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up2" id="id3e7b5a76-7cd7-4b43-9c4d-a05167db98d4" changed="not-changed"><enum>(G)</enum><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code, shall not apply to the Committee.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up2" id="id48aca012-3f5c-48c7-938a-7d0c96e7cf50" changed="not-changed"><enum>(H)</enum><text display-inline="yes-display-inline">In establishing, developing procedures for, and operating the Committee, the Assistant Secretary shall—</text><clause commented="no" display-inline="no-display-inline" id="idc18f2455-df71-4d2a-b4cb-e0577ee512c7" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">consult with Indian Tribes and confer with organizations representing Native Hawaiians; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idae32a731-b6e3-4f09-9b13-4809c5f41945" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">take into consideration best practices of other Tribal advisory committees operated by the Department of Health and Human Services before the date of enactment of the <short-title>Older Americans Act Reauthorization Act of 2025</short-title>.</text></clause></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section id="id672b6f88-9643-41c9-9562-8e8d17a1152a" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>602.</enum><header display-inline="yes-display-inline">Supportive services; and </text></paragraph><paragraph id="id6273fd38-3783-48a1-82c2-c417da89f497" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">a summary of supportive services for healthy aging and independence provided under part D.</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idffac661d-c41e-46e5-9967-aaf18453f6b1" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>603.</enum><header display-inline="yes-display-inline">GAO report on Tribal services</header><text display-inline="no-display-inline">Not later than 18 months after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report that—</text><paragraph id="id0b3eb23a-77d7-479d-9f8c-8483498884a7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">evaluates and identifies barriers to Indian Tribes (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)) and organizations serving Native Hawaiians accessing programs under title VI of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3057">42 U.S.C. 3057 et seq.</external-xref>), and coordination of such programs under such title VI with programs funded under titles III and IV of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3021">42 U.S.C. 3021 et seq.</external-xref>, <external-xref legal-doc="usc" parsable-cite="usc/42/3031">42 U.S.C. 3031 et seq.</external-xref>), including by—</text><subparagraph id="id90ce6265-b7e6-4767-b407-4a0905c21a92" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">estimating the number of Native Americans unserved by programs under such title VI;</text></subparagraph><subparagraph id="id9cd99bca-9388-41aa-a695-f00b9367cb39" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">identifying States and area agencies on aging making grants to Indian Tribes under such title III; and</text></subparagraph><subparagraph id="id97527708-ed94-466b-b0b4-69dea894f7a8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">providing estimates of funding necessary to support programs under such title VI for all Tribal organizations (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)) and organizations serving Native Hawaiians that are not eligible under such title VI (as in effect on the date of enactment of this Act); and</text></paragraph><paragraph id="id0cfeb95b-6d0d-47eb-9d69-9e65eda07754" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">provides a summary of the findings of such reports.</text></paragraph></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section id="id422165e1-bb59-4554-be7a-392bab7939dd" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>705.</enum><header display-inline="yes-display-inline">Study on State Long-Term Care Ombudsman Programs</header><subsection id="id5e128b42-9395-4d61-b517-f65658c5f2a5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Assistant Secretary shall seek to enter into a contract with the National Academies of Sciences, Engineering, and Medicine (referred to in this section as the <quote>National Academies</quote>) to conduct a study on the State Long-Term Care Ombudsman programs carried out under the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3001">42 U.S.C. 3001 et seq.</external-xref>), including an assessment of the effectiveness of such programs and any related challenges and recommendations.
