<congress display="yes">119th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 1890</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To establish a grant program for certain State and local forensic activities, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="ide8058d6c-dd05-430d-820b-be7bee8cc733" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Carla Walker Act</short-title></quote>.</text></section><section id="id5fe07401-9e18-46b2-bdd3-c68e82449bf0" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Grants to improve forensic activities</header><text display-inline="no-display-inline">Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10101">34 U.S.C. 10101 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id89ef19d4-91ff-406a-84e3-5f22d33e1164" changed="not-changed"><part id="id6c02dabb-03ba-4d91-9a53-133ca2a5a2aa" style="OLC" changed="not-changed" commented="no" level-type="subsequent"><enum>PP</enum><header display-inline="yes-display-inline">Grants to improve forensic activities</header><section id="idda48df57-4e51-447c-a298-b0a4a1c4a8b3" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3061.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this part:</text><paragraph commented="no" display-inline="no-display-inline" id="idf59e4f65-1983-49dc-883a-bc197b5ba30f" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Accredited forensic laboratory</header><text display-inline="yes-display-inline">The term <term>accredited forensic laboratory</term> means a forensic laboratory that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1b2415e976c64cd19e0f55bcd3ab63ca" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">is accredited by an accrediting body that is a signatory to an internationally recognized arrangement and that offers accreditation to forensic science conformity assessment bodies using an accreditation standard that is recognized by that internationally recognized arrangement; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id563b78e741f44cbbb3143715d2e71863" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">attests, in a legally binding and enforceable manner, to prepare and apply for an accreditation described in subparagraph (A) not later than 2 years after date on which the forensic laboratory—</text><clause commented="no" display-inline="no-display-inline" id="id9c47e3be3d4743deafa0f0571d4a0ba8" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">first receives a grant under this part; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id9c3ae76d62e146e6bdbbbf11b12d4a60" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">first receives a request for analysis from an eligible entity receiving a grant under this part.</text></clause></subparagraph></paragraph><paragraph id="idecd28704bc9a4306997c3e2a6d7ac0ac" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">FGG DNA analysis and searching</header><text display-inline="yes-display-inline">The term <term>FGG DNA analysis and searching</term> means—</text><subparagraph id="id4931bb6713794c06b8ba21f141617ec3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">forensic genetic genealogical DNA analysis of a forensic or reference sample of biological material by an accredited forensic laboratory to develop a forensic genetic genealogy profile; and</text></subparagraph><subparagraph id="ida6f6ccf12b1647f7a4e08920b0b33cf6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the subsequent search of that genetic genealogy profile in a genetic genealogy service.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id991b7ef63c98479aba4676e4cb5e54ea" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Forensic analysis</header><text display-inline="yes-display-inline">The term <term>forensic analysis</term> means an expert examination, interpretation, or test—</text><subparagraph commented="no" display-inline="no-display-inline" id="id31e0dd9c-7e5a-47f9-8f75-572799431a5d" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">requested by a law enforcement agency, a coroner or medical examiner’s office, a prosecutor, a criminal suspect or defendant, or a court; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1a6505bf-ffa8-46e9-b7eb-98278b7f26f7" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">performed on physical or biological evidence for—</text><clause commented="no" display-inline="no-display-inline" id="id1637ccf355b846ecb561731de562ef7c" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">investigative purposes, including to determine the identity of unidentified human remains; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id4e6afe6394fd434ca713532cb2dc17ce" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">prosecutorial, defense, or court-ordered judicial purposes.</text></clause></subparagraph></paragraph><paragraph id="ide07d9c0a12d740b9ad47c6d231492753" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Forensic genetic genealogy profile</header><text display-inline="yes-display-inline">The term <term>forensic genetic genealogy profile</term> means a single nucleotide polymorphisms-based genetic profile generated from a forensic or reference sample by an accredited forensic laboratory for the purpose of conducting FGG DNA analysis and searching.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3d44a095116b4ff29872c8716ca42404" changed="not-changed"><enum>(5)</enum><header display-inline="yes-display-inline">Forensic laboratory</header><text display-inline="yes-display-inline">The term <term>forensic laboratory</term> means a facility, entity, or site that—</text><subparagraph id="id96b22e36cf2443e0816074bf3611b47d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">offers or performs forensic analysis; and</text></subparagraph><subparagraph id="id1c461755ad564062a923ecc86cf65a8e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">follows appropriate evidentiary, documentation, and quality assurance requirements for use in judicial proceedings.</text></subparagraph></paragraph><paragraph id="id2c72bc2ce0b24b1aae02e808eb78e1b3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Genetic genealogy service</header><text display-inline="yes-display-inline">The term <term>genetic genealogy service</term> means a repository of genetic data containing genetic profiles submitted by individuals that permits search by a law enforcement agency for forensic genetic genealogy purposes.</text></paragraph><paragraph id="ida1017e3df324462faf27baf877a46bfd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Interim policy</header><text display-inline="yes-display-inline">The term <term>Interim Policy</term> means the <quote>Interim Policy on Forensic Genetic Genealogical DNA Analysis and Searching</quote> of the Department of Justice dated November 1, 2019, or any successor policy.</text></paragraph><paragraph id="id4d64db3cfe57404399baa4e0a0f89ec9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">Law enforcement agency</header><text display-inline="yes-display-inline">The term <term>law enforcement agency</term> means an agency of the United States, a State, a political subdivision of a State, or an Indian Tribe authorized by law or by a government agency to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of criminal law.</text></paragraph></section><section id="idb8ae1af7-e551-487e-9a16-535550c15eba" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3062.</enum><header display-inline="yes-display-inline">DNA analysis grants</header><subsection commented="no" display-inline="no-display-inline" id="id36d64063-a370-4f3c-b068-ec1734f5d3cc" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Eligible entity defined</header><text display-inline="yes-display-inline">In this section, the term <term>eligible entity</term> means—</text><paragraph id="id9afd92ef-a75c-4f51-a4c2-99a07eec6ff5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">a State;</text></paragraph><paragraph id="ida5dafb3aaa8146a58c02724c85bdb1cb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">a Tribal, county, or local law enforcement agency;</text></paragraph><paragraph id="id5ab0ca660779499dafbadb551057895b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">a publicly funded accredited forensic laboratory;</text></paragraph><paragraph id="id84ce9f3ee4cd40fdb165867f3b927e07" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">a State, Tribal, county, or local prosecutor’s office with a forensic laboratory capability;</text></paragraph><paragraph id="idd5a95e273f0a4a999b47be133dea104f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">a medical examiner’s office; and</text></paragraph><paragraph id="id38dabbe4ce0d4557ab3002418682c681" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">a coroner’s office.</text></paragraph></subsection><subsection id="idc13fbd54-d25f-4f18-a01d-5627edc4bb6a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization of grants</header><text display-inline="yes-display-inline">The Attorney General may award a competitive grant to an eligible entity for the purpose of using any technology used in a forensic laboratory—</text><paragraph commented="no" display-inline="no-display-inline" id="id97f499a9-58ea-4a57-82fd-1f1f783755a9" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">to conduct whole genome sequencing technology to assess not less than 100,000 genetic markers; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1a2043c8-719e-4fd4-ad70-1601f42d625e" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">that is compatible with genealogical databases.</text></paragraph></subsection><subsection id="ide157a6dc-3c4a-4d36-b318-5a28fd608d57" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Applications</header><text display-inline="yes-display-inline">An eligible entity seeking a grant under this section shall submit to the Attorney General an application at such time and in such form as the Attorney General may require.</text></subsection><subsection id="id3b73afae-32c7-4228-bd33-66050db352aa" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Use of grant</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section shall use funds from the grant for any of the following purposes:</text><paragraph id="id5297366de1f540e8ab86e7b1fbd433bf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">To carry out DNA analyses of physical evidence collected under applicable legal authority using the technology described in subsection (b) if the submission of such physical evidence to the Combined DNA Index System has failed to produce an investigative lead.</text></paragraph><paragraph id="idfb2bac15197e402998743ee67c5df754" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">To carry out DNA analyses of unidentified human remains using the technology described in subsection (b) if submission of such samples to the Combined DNA Index System has failed to produce an investigative lead.</text></paragraph><paragraph id="id0f84f7aba5954bc093063df4c96114f4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">To outsource an activity described in paragraph (1) or (2) for the use of technology described in subsection (b) and searching to—</text><subparagraph id="idda49771201bf4d8daa324391f3580d36" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">an accredited publicly funded forensic laboratory;</text></subparagraph><subparagraph id="idb06bfd79af4f42cfb7fa61d523912473" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a medical examiner or coroner’s office;</text></subparagraph><subparagraph id="id5319555836df44639addc3e02dbbfd7c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">a State, Tribal, county, or local prosecutor’s office with a forensic laboratory capability; or</text></subparagraph><subparagraph id="id4c0496e22bf64b12a4212dadd869fcc1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">a nongovernmental accredited forensic laboratory.</text></subparagraph></paragraph></subsection><subsection id="idcabf662f40c74ecd867f768acb1810fb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Requirements and limitations with respect to genetic genealogy</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section—</text><paragraph id="idbd2c47703be94fa8b01e71546281d98c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to a forensic profile derived from a candidate forensic sample for which a sufficient quantity of DNA exists and which meets the eligibility requirements of the Combined DNA Index System, before attempting to use FGG DNA analysis and searching with respect to the forensic profile—</text><subparagraph id="idec2ea82e2d904ffbb085d919a8bf5bfc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">shall upload the forensic profile to the Combined DNA Index System; and</text></subparagraph><subparagraph id="id5a38e8b9daa14a2ba5b3da565c356a5b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">may only proceed with FGG DNA analysis and searching if a search of the uploaded forensic profile in the Combined DNA Index System fails to produce a probative and confirmed DNA match;</text></subparagraph></paragraph><paragraph id="idc99550c142304bc099398f3c6bcc6dcc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to an eligible entity that is a law enforcement agency, may not arrest a suspect based solely on a genetic association generated by a genetic genealogy service;</text></paragraph><paragraph id="id855d10b034da4b2eaf33ee44dbecf839" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">with respect to an eligible entity that is a law enforcement agency or an entity conducting genetic genealogical research on behalf of a law enforcement agency or to inform a criminal investigation, shall—</text><subparagraph id="ide4bed479342443589523c90f60ba0a40" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">identify as a law enforcement agency to any genetic genealogy service; and</text></subparagraph><subparagraph id="ida60121b8d2bc4f24ac8993ff4d8ba171" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">enter and search forensic genetic genealogy profiles only in a genetic genealogy service that provides explicit notice to users of the genetic genealogy service and the public that law enforcement may use the genetic genealogy service to investigate crimes or identify unidentified human remains;</text></subparagraph></paragraph><paragraph id="idaf44e51dc5d149319b96cccea23a516c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">shall seek informed consent from third parties before collecting reference samples directly from an individual that will be used for FGG DNA analysis and searching, unless case-specific circumstances provide reasonable grounds to believe that this requirement would compromise the integrity of an investigation;</text></paragraph><paragraph id="id28ad954eebbc46a790a2e293864e1e8f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">shall treat all forensic genetic genealogy profiles and genetic genealogy service account information and data as confidential government information consistent with any applicable laws, regulations, policies, and procedures;</text></paragraph><paragraph id="id526db18f17d24a8087da1d8956ada505" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">shall use biological samples and forensic genetic genealogy profiles only for law enforcement identification purposes;</text></paragraph><paragraph id="id350e53686055421583d25650b725affa" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">shall take all reasonable and necessary steps and precautions to ensure that others who have authorized access to biological samples and forensic genetic genealogy profiles follow the same limitation of use of those samples required under paragraph (6);</text></paragraph><paragraph id="id8fd96f52fc4f498fa791d006f05a0358" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text display-inline="yes-display-inline">whenever possible, shall use only genetic genealogy services that configure service site user settings that control access to forensic genetic genealogy profile data and associated account information in a manner that will prevent that data and information from being viewed by other service users;</text></paragraph><paragraph id="idd1a397c497704d29a562ead7d627f9a1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(9)</enum><text display-inline="yes-display-inline">shall conduct covert collection of a DNA sample for the purpose of performing FGG DNA analysis and searching in accordance with applicable State and Federal law; and</text></paragraph><paragraph id="ide8aa57269b774db9bbbb95da6e2e5619" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(10)</enum><text display-inline="yes-display-inline">may not use a biological sample or a forensic genetic genealogy profile to determine the genetic predisposition for disease or any other medical condition or psychological trait of the donor of the sample or profile.</text></paragraph></subsection><subsection id="idc0d15a8173f94bffbc32f5690afe044b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Attorney General shall promulgate regulations to promote the reasoned exercise of investigative, scientific, and prosecutorial discretion in cases that involve forensic genetic genealogical DNA analysis and searching. Such regulations shall incorporate the requirements and limitations set forth under subsection (e).</text></subsection><subsection id="id45216500c5b141679bfc504648df4a83" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><paragraph id="id03e43f1507434824bd8e974ea236a969" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Attorney General to carry out this section $5,000,000 for each of fiscal years 2027 through 2031.</text></paragraph><paragraph id="id75cc65fa225c4b2aba9b288ce7bf42bf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Limitations on use</header><subparagraph id="ide0819869610a48b68dc2ef80c97deda6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Amounts appropriated to carry out this section—</text><clause id="idd650630e4a0447aaaed282d0ba0f8333" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">subject to subparagraph (B), shall only be made available to carry out forensic genetic genealogical analysis; and</text></clause><clause id="idca40d2932e224488ad769258a479fdcb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">shall not be made available for staffing, training, travel, or equipment.</text></clause></subparagraph><subparagraph id="id95755968845e4384981ec8ef5891a09b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Administrative costs</header><text display-inline="yes-display-inline">The Attorney General may use not more than 10 percent of amounts appropriated to carry out this section for administrative costs.</text></subparagraph></paragraph></subsection></section><section id="idf0505150-b8ac-4212-b4e7-cc333cd24ecc" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3063.</enum><header display-inline="yes-display-inline">Grants for forensic equipment and database searching</header><subsection commented="no" display-inline="no-display-inline" id="id01beeb3a-a57d-492a-abe9-f2925c482342" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Eligible entity defined</header><text display-inline="yes-display-inline">In this section, the term <term>eligible entity</term> means—</text><paragraph commented="no" display-inline="no-display-inline" id="id1d6740a4-4550-495c-90c0-ad464c636aba" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">a publicly funded accredited forensic laboratory;</text></paragraph><paragraph id="idb2a69806e8b642319d0c1103b3426d53" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">a State, county, local, or Tribal prosecutor’s office with a forensic laboratory capability;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id268d0e47-52ce-4754-a05b-83a02b1fc576" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">a medical examiner's office; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2eb2e931-301c-4b60-b186-5ef699df5e6c" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">a coroner's office.</text></paragraph></subsection><subsection commented="no" id="ideef740ae-077b-4c97-9c9b-48c5e760985d" changed="not-changed" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization of grants</header><text display-inline="yes-display-inline">The Attorney General may award a grant to an eligible entity for the purpose of—</text><paragraph commented="no" display-inline="no-display-inline" id="idc4497a803c8e4047b1b9831a2f154f64" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">purchasing equipment for FGG DNA analysis and searching; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide424db68704240cf902320e4bc185704" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">funding searches to generate investigative leads for criminal investigations or unidentified human remains.</text></paragraph></subsection><subsection commented="no" id="idb1e6f3d0-2901-41e2-a696-b2a23644ec66" changed="not-changed" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Applications</header><text display-inline="yes-display-inline">An eligible entity seeking a grant under this section shall submit to the Attorney General an application at such time and in such form as the Attorney General may require.</text></subsection><subsection id="id616f9dec0ed9457ea55d0783d255cd54" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section shall use funds from the grant—</text><paragraph commented="no" display-inline="no-display-inline" id="id2ea5f46649fc4b74b202ce23e02fa253" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">to purchase forensic equipment, including supplies, reagents, consumables, and validation expenses, for genetic genealogy techniques to generate investigative leads for criminal investigations or unidentified human remains; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id545bf4e2a36d473680d65c2916e78d38" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">for genealogical database searching.</text></paragraph></subsection><subsection id="idc7bdbe79046242bebeac3bdb5ec5d551" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Department of Justice policy</header><text display-inline="yes-display-inline">Other than an activity involving unidentified human remains, an activity carried out using funding from a grant under this section shall be carried out in compliance with—</text><paragraph commented="no" display-inline="no-display-inline" id="id27292f11b5bc497cb271c73bc42791fe" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the Interim Policy; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id74de0316026744e0913c2319763f429e" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">the regulations promulgated under section 3062(f).</text></paragraph></subsection><subsection commented="no" id="id7dc3826d-1195-4557-857c-8d1ecde8fe5a" changed="not-changed" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Attorney General to carry out this section $5,000,000 for each of fiscal years 2027 through 2031.</text></subsection></section><section id="ida9dd50b5-e4e5-46df-b075-74bc771bab77" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3064.</enum><header display-inline="yes-display-inline">Administrative provisions</header><subsection id="idee60fcbc-f305-419e-b82c-951840807b3a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Attorney General may promulgate guidelines, regulations, and procedures to carry out this part, including guidelines, regulations, and procedures relating to the submission and review of applications for grants under sections 3062 and 3063.</text></subsection><subsection id="id4c257158-0a29-419f-89b7-1e32a8a943ec" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Accountability</header><paragraph id="id270aa208-297f-463e-91fc-7f1525b7e3b4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Records</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this part shall maintain such records as the Attorney General may require to facilitate an effective audit relating to the receipt of the grant, the use of amounts from the grant, outsourcing activities, and compliance with—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida795bd7498b946d4b38c998c6fb836cb" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">section VIII, entitled <quote>Sample and Data Control and Disposition</quote>, of the Interim Policy; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id58cb3650394849e7abb6ed7e669380f2" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">the regulations promulgated under section 3062(f).</text></subparagraph></paragraph><paragraph commented="no" id="id3fe694df-58a5-4c37-ab4f-c024339ac880" changed="not-changed" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Access</header><text display-inline="yes-display-inline">For the purpose of conducting audits and examinations, the Attorney General shall have access to any book, document, or record of an eligible entity that receives a grant under this part, a State or unit of local government within which the eligible entity operates, and any entity to which the eligible entity outsources work using amounts from the grant if the Attorney General determines that the book, document, or record relates to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0f9413a9-77d5-4fa5-9c05-b9cc470f7a09" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the receipt of the grant;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaeda8303-2392-4458-9e15-b95cf0b9ba1a" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">the use of funds from the grant; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id98e03aed-07ed-47d2-9764-4e03c6323567" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">compliance with—</text><clause commented="no" display-inline="no-display-inline" id="id8ae789476fe94448a2b628b13e5ff835" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">section VIII, entitled <quote>Sample and Data Control and Disposition</quote>, of the Interim Policy; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id95b922b189d94406b329cc01df139341" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">the regulations promulgated under section 3062(f).</text></clause></subparagraph></paragraph><paragraph id="id04263dfa-3e76-4e91-94c7-8d6d043dc2d7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Suspension and debarment</header><text display-inline="yes-display-inline">In carrying out this part, the Attorney General shall comply with part 180 of title 2, Code of Federal Regulations, or any successor regulation.</text></paragraph></subsection></section><section id="id6f4a1108-a030-4532-8119-cc6d0e603964" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3065.</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="no-display-inline">Not later than1 year after the date on which an eligible entity receives the final disbursement of funds from a grant under section 3062 or 3063, the eligible entity shall submit to the Attorney General a report that includes—</text><paragraph id="id506e59d3fc2c43ac93824f3a9824521f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the amount of funding the eligible entity received from the grant for each fiscal year for which the grant was awarded;</text></paragraph><paragraph id="id5ca9e87ded6745fea328c11db3160a0e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the number of cases for which the eligible entity submitted for testing using FGG DNA analysis and searching during the previous year;</text></paragraph><paragraph id="id562ce48e327b4397b63681ccb5d74332" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">the number of cases for which the eligible entity performed testing using FGG DNA analysis and searching during the previous year;</text></paragraph><paragraph id="ide312380e4a2743e0b2cb1ee5b0753c13" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">the type of testing relating to FGG DNA analysis and searching performed by the eligible entity during each year for which the grant was awarded, including—</text><subparagraph id="idf1a22337beaf45fe864d9056646bbe7d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the name of any laboratory to which the eligible entity outsourced the testing;</text></subparagraph><subparagraph id="id1d2314b6dd8b41a4ac4090fff74d3fd1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the type of sequencing equipment and method used for the testing; and</text></subparagraph><subparagraph id="ide79b05be39564b1da9a51be0f1cec7c7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the results of the testing, such as whether the testing resulted in successful victim or perpetrator identification, no identification, ongoing analysis, or incomplete analysis, and the time it took to obtain a result;</text></subparagraph></paragraph><paragraph commented="no" id="id1d761165-069e-4ad1-9d9a-6791ce03ce5f" changed="not-changed" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">during each year for which the grant was awarded, the number of cases in which FGG DNA analysis and searching—</text><subparagraph commented="no" id="idd16f0827-a030-4ef9-aeca-9b40bb1842e4" changed="not-changed" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">resulted in a searchable profile in a publicly available genetic genealogy service;</text></subparagraph><subparagraph id="ide5014822bd8f46f8ae7396bbdb227beb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">generated a lead resulting in a victim or perpetrator identification;</text></subparagraph><subparagraph id="id30d8788de67d4fad9ae998b9b6797832" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">generated a lead but did not generate a victim or perpetrator identification; and</text></subparagraph><subparagraph id="id311dd4500ed343c5992c03988153e707" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">did generate a lead and resulted in a victim or perpetrator identification by the end of the grant period directly resulting in an arrest; and</text></subparagraph></paragraph><paragraph id="id1002045ce1054b6b807a3a7db19146c9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">during each year for which the grant was awarded, the average number of days it took to make any identification between the date of sample submission for FGG DNA analysis and searching and the date of delivery of test results to the requesting office or agency.</text></paragraph></section><section id="idae5e7a4f8185477086d8b1a47c6d4c17" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3066.</enum><header display-inline="yes-display-inline">No preemption</header><text display-inline="no-display-inline">Nothing in this part shall be construed to preempt any law (including a regulation) of a State, or a political subdivision of a State, containing requirements that provide equivalent or greater protection than the requirements of this part.</text></section></part><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="ida43e687c-5d17-411f-872d-2f94cc26b9cd" changed="not-changed" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Department of Justice report</header><text display-inline="no-display-inline">Not later than 3 years after the date of enactment of this Act, the Attorney General, in consultation with the Forensic Laboratory Needs Working Group of the National Institute of Justice, shall submit to Congress a report—</text><paragraph commented="no" display-inline="no-display-inline" id="id8fc2da6e-9bcf-421b-b370-320dc29aedeb" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">on the awards and practices reported to the Attorney General under section 3065 of title I of the Omnibus Crime Control and Safe Streets Act of 1968, as added by this Act;</text></paragraph><paragraph id="idedfc35a566a14b8dafcc8f3c853d70d2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">on forensic genetic genealogy analysis technologies and how best to implement forensic genetic genealogy analysis for eligible entities (as defined in section 3063(a) of title I of the Omnibus Crime Control and Safe Streets Act of 1968, as added by this Act); and</text></paragraph><paragraph id="id3bfeed68b8884867b91d425b74c88828" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">that includes any recommendations relating to—</text><subparagraph id="idb12a189f3cb3498ab4c8ce1f095cbb39" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">expected funding needs;
