which was read twice and referred to the <committee-name committee-id="SSCM00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20251016">October 16, 2025</action-date><action-desc>Reported by <sponsor name-id="S355">Mr. Cruz</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Commerce to conduct a study on the feasibility of manufacturing in the United States products for critical infrastructure sectors, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H229FC0F795F94BB2A38F47D283A483D8"><section section-type="section-one" id="HCC026F48739B47E6BE827A06E3A627F0" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Critical Infrastructure Manufacturing Feasibility Act</short-title></quote>.</text></section><section id="H3E1969600B6B42908AB99451A7CB1F2C" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>2.</enum><header>Study on critical infrastructure manufacturing in the United States</header><subsection id="H59B38E6D2C184CB7AE0E80174FDF52B6"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Commerce shall conduct a study to—</text><paragraph id="HE7D1113D29044364B6FD56533B55FBC2"><enum>(1)</enum><text>identify, within each critical infrastructure sector, any product that is in high demand and is being imported due to a manufacturing, material, or supply chain constraint in the United States;</text></paragraph><paragraph id="HFF1F7D3785774C168AD29D1AEFEC7A51"><enum>(2)</enum><text display-inline="yes-display-inline">analyze the costs and benefits of manufacturing in the United States any product identified under paragraph (1), including any effects on—</text><subparagraph id="HB72D5AA4BA3748C69FCB5A3448E4ED78"><enum>(A)</enum><text display-inline="yes-display-inline">jobs, employment rates, and labor conditions in the United States; and</text></subparagraph><subparagraph id="H7C0634F7EBE9499686129F097AC57240"><enum>(B)</enum><text>the cost of the product;</text></subparagraph></paragraph><paragraph id="HD25106BCA0964AAFBEA9EBD89BCCE9BB"><enum>(3)</enum><text>identify any product identified under paragraph (1) that feasibly may be manufactured in the United States; and</text></paragraph><paragraph id="H3BB8332E0E9F4DC786F6CFFED9656DAD"><enum>(4)</enum><text>analyze the feasibility of, and any impediments to, manufacturing any product identified under paragraph (3) in—</text><subparagraph id="H4B32246561384D028B00207126E7CEEC"><enum>(A)</enum><text>a rural area;</text></subparagraph><subparagraph id="H9AF25054292343C3BD40D22527B360BE"><enum>(B)</enum><text>an industrial park; or</text></subparagraph><subparagraph id="HAA6B90EE194B4E898C5363CD28A2BE16"><enum>(C)</enum><text>an industrial park in a rural area.</text></subparagraph></paragraph></subsection><subsection id="HE81E246D446240E9A2A5B42935FB5EB6"><enum>(b)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Secretary shall—</text><paragraph id="H9770A921231D4574A24590B15857F621"><enum>(1)</enum><text display-inline="yes-display-inline">submit to Congress a report containing the results of the study required by subsection (a), with recommendations relating to manufacturing in the United States products identified under subsection (a)(3); and</text></paragraph><paragraph id="HEE69FF8F087B4C8F86B432E763DE29F8"><enum>(2)</enum><text>make the report available to the public on the website of the Department of Commerce.</text></paragraph></subsection><subsection id="H52D60F6CCB744228B662BC27644C646A"><enum>(c)</enum><header>Limitation on authority</header><text display-inline="yes-display-inline">This section may not be construed to provide the Secretary of Commerce with authority to compel a person to provide information described in this section.</text></subsection><subsection id="H3E41C15E444F48A4A72E150FCA55C3B8"><enum>(d)</enum><header>Definition of critical infrastructure sector</header><text display-inline="yes-display-inline">In this section, the term <term>critical infrastructure sector</term> means each of the 16 designated critical infrastructure sectors identified in Presidential Policy Directive 21 of February 12, 2013 (Critical Infrastructure Security and Resilience).</text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="id14ac1c96-a988-4639-98cb-d6b7e0fa5d6c" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Critical Infrastructure Manufacturing Feasibility Act</short-title></quote>.</text></section><section id="id2f046fd1-8db8-4e33-8540-b92afd92ad61" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>2.</enum><header>Study on critical infrastructure manufacturing in the United States</header><subsection id="id685b1e900b804b1394f1c09436891b5d" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header>Definition of critical infrastructure sector</header><text display-inline="yes-display-inline">In this section, the term <term>critical infrastructure sector</term> means each of the 16 designated critical infrastructure sectors identified in Presidential Policy Directive 21 of February 12, 2013 entitled <quote>Critical Infrastructure Security and Resilience</quote>.</text></subsection><subsection id="id0c00b011-1a37-4ade-acdf-7b0a08db2db1"><enum>(b)</enum><header>Study</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Commerce shall conduct a study to—</text><paragraph id="idac706ba8-433e-4ba7-aad6-2fa41b82878f"><enum>(1)</enum><text>identify, within each critical infrastructure sector, any product—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddff5511307d04a179013d993b36e2235"><enum>(A)</enum><text display-inline="yes-display-inline">necessary for the construction, maintenance, operation, or restoration of the critical infrastructure sector; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5cd8ecd97e094e4d8ae94f464571afe9"><enum>(B)</enum><text display-inline="yes-display-inline">that is in high demand and is being imported due to a manufacturing, material, or supply chain constraint in the United States;</text></subparagraph></paragraph><paragraph id="idbdf4a02f-036f-4c34-80fd-8d051b71c065"><enum>(2)</enum><text display-inline="yes-display-inline">analyze the costs and benefits of manufacturing in the United States any product identified under paragraph (1), including any effects on—</text><subparagraph id="id0ff0394f-65db-48d0-8698-3f31fabe9d0a"><enum>(A)</enum><text display-inline="yes-display-inline">jobs, employment rates, and labor conditions in the United States; and</text></subparagraph><subparagraph id="idf33f676b-0480-46be-9746-eef378b1ae82"><enum>(B)</enum><text>the cost of the product;</text></subparagraph></paragraph><paragraph id="idd347fa7b-8f6f-4fc9-ae04-23eb815237dd"><enum>(3)</enum><text>identify any product identified under paragraph (1) that feasibly may be manufactured in the United States;</text></paragraph><paragraph id="idc29cd543-6e19-41a5-a395-e0d1cadec773"><enum>(4)</enum><text>analyze the feasibility of, and any impediments to, manufacturing any product identified under paragraph (3) in—</text><subparagraph id="id6e6307cc-7e55-42f9-9ec4-bd698a0f41b0"><enum>(A)</enum><text>a rural area;</text></subparagraph><subparagraph id="idc5b5b5ee-624e-41b1-87b8-fd7c8a67dacf"><enum>(B)</enum><text>an industrial park; or</text></subparagraph><subparagraph id="idaa71623c-7d8c-476c-bfd8-061c41aca522"><enum>(C)</enum><text>an industrial park in a rural area; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide9147639c5b44cbabbf7ed0c6ab5e51d"><enum>(5)</enum><text>identify any Federal policies, regulations, or guidance in effect that may inhibit, create barriers to, or increase the cost of manufacturing a product identified under paragraph (1) in the United States.</text></paragraph></subsection><subsection id="id7f8363fe-4858-4bc1-8e7f-72c3d4e361bd"><enum>(c)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Secretary of Commerce shall—</text><paragraph id="id4b95a618-d068-4e5a-bbc2-e9ffbbbf40ff"><enum>(1)</enum><text display-inline="yes-display-inline">submit to Congress an unclassified report, which may include a classified annex, containing the results of the study required by subsection (b), with recommendations relating to manufacturing in the United States products identified under subsection (b)(3); and</text></paragraph><paragraph id="id175bee3e-52aa-4ec1-826f-30f6ac9968ab"><enum>(2)</enum><text>make the unclassified report available to the public on the website of the Department of Commerce.</text></paragraph></subsection><subsection id="idf8953c08-746e-4b17-85c7-fe300a8485cc" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Limitation on authority</header><text display-inline="yes-display-inline">This section may not be construed to provide the Secretary of Commerce with authority to compel a person to provide information described in this section.</text></subsection></section></legis-body><endorsement><action-date date="20251016">October 16, 2025</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
