which was read twice and referred to the <committee-name committee-id="SSEG00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20260723">July 23, 2026</action-date><action-desc>Reported by <sponsor name-id="S346">Mr. Lee</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Agriculture to convey to Brian Head Town, Utah, certain National Forest System land.</official-title></form><legis-body><section id="S1" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Brian Head Town Land Conveyance Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id0c7347bed4864c9aae2bd127703c5f5a" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>2.</enum><header>Conveyance of Federal land to Brian Head Town, Utah</header><subsection commented="no" display-inline="no-display-inline" id="id37627c9027654601ae06329354fa8655"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id28cf5bd68e744ae09b4d1538f35b8a75"><enum>(1)</enum><header>Federal land</header><text>The term <quote>Federal land</quote> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0f11db9d206b4167b4174af8cdb58934"><enum>(A)</enum><text display-inline="yes-display-inline">the parcel of approximately 24 acres of National Forest System land within the boundary of the Dixie National Forest, as generally depicted as <quote>NFS Lands Selected for Transfer</quote> on the map entitled <quote>Forest Service to Brian Head Land Transfer</quote> and dated April 28, 2025; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id260be4881f9b42d2bacecbd57aa32bcb"><enum>(B)</enum><text>any improvements to the National Forest System land described in subparagraph (A).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id86effe7434cc4f948da0998cac9454c9"><enum>(2)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2c5c5ce3278742658523896004add5ef"><enum>(3)</enum><header>Town</header><text>The term <quote>Town</quote> means Brian Head Town, Utah.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idcd73890b9e014b7f87c016cdfc3a00e5"><enum>(b)</enum><header display-inline="yes-display-inline">Conveyance</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall convey to the Town, without consideration and subject to any terms and conditions that the Secretary determines to be appropriate, all right, title, and interest of the United States in and to the Federal land, to be used by the Town for a public works facility or any other uses determined to be necessary by the Town.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idab7545b2f99c4cfbba6cf9253c01385f"><enum>(c)</enum><header>Boundary modification</header><text>On the conveyance of the Federal land to the Town under subsection (b), the Secretary shall modify the boundary of the Dixie National Forest to reflect the conveyance of the Federal land.</text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id01d30029-a616-42f6-87b8-1110e173582a" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Brian Head Town Land Conveyance Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id553c4351-fbcc-40b5-ae69-459ca136a331" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>2.</enum><header>Conveyance of Federal land to Brian Head Town, Utah</header><subsection commented="no" display-inline="no-display-inline" id="id8334c3e6-45ee-4450-88eb-c83048cb6cc7"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id59ab0a2c-0920-4c5e-9aef-3e1cbeab8b86"><enum>(1)</enum><header>Federal land</header><text>The term <quote>Federal land</quote> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idef8dd173-fdab-4823-8499-0cb1a1a7c599"><enum>(A)</enum><text display-inline="yes-display-inline">the parcel of approximately 24 acres of National Forest System land within the boundary of the Dixie National Forest, as generally depicted as <quote>NFS Lands Selected for Transfer</quote> on the map entitled <quote>Forest Service to Brian Head Land Transfer</quote> and dated April 28, 2025; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id17ff31af-70b7-4f31-b9f2-cebcd0f973cb"><enum>(B)</enum><text>any improvements to the National Forest System land described in subparagraph (A). </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide8d238b5-e726-4ca3-8299-d704721e0688"><enum>(2)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc3c962a5-5006-492c-9c75-fbcf463a0c66"><enum>(3)</enum><header>Town</header><text>The term <quote>Town</quote> means Brian Head Town, Utah.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id21049830-e9f8-42bb-bca3-aec0f89fdcd7"><enum>(b)</enum><header display-inline="yes-display-inline">Conveyance</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall convey to the Town, without consideration and subject to any terms and conditions that the Secretary determines to be appropriate, all right, title, and interest of the United States in and to the Federal land, to be used by the Town—</text><paragraph commented="no" display-inline="no-display-inline" id="id78ffaf0555e24377917b2738dc56b69d"><enum>(1)</enum><text display-inline="yes-display-inline">to develop and expand public safety infrastructure and a public works facility; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaefb57a426f24d1fa2eadd14a7dd7403"><enum>(2)</enum><text display-inline="yes-display-inline">to expand public recreational access and opportunities within the Town.</text></paragraph></subsection><subsection id="id558929dc-c3f6-4dae-a76b-fa8a3c6234a4" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Boundary modification</header><text>On the conveyance of the Federal land to the Town under subsection (b), the Secretary shall modify the boundary of the Dixie National Forest to reflect the conveyance of the Federal land.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id2f8a332a9811453f9a4a0071a88c0e8e"><enum>(d)</enum><header>Reversion</header><paragraph commented="no" display-inline="no-display-inline" id="id6895d563f5a149e1b461d30d2fa23e32"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>If the Secretary, after consultation with the State of Utah, determines that the Federal land conveyed under subsection (b) was used by the Town for a use not authorized under that subsection, all right, title, and interest in and to the Federal land shall revert to the United States, at the discretion of the Secretary.</text></paragraph><paragraph id="id2d52c2a9fabb4ca3b3dae9dd665a4eed"><enum>(2)</enum><header>Requirements</header><text>Prior to a determination under paragraph (1), the Secretary shall—</text><subparagraph id="idc124bb6130234f17bd8211a0d9e7b54a"><enum>(A)</enum><text>notify the Town of the nonconforming use;</text></subparagraph><subparagraph id="id2e46b0a3b2754d6cb9e56baadf1187f0"><enum>(B)</enum><text>provide an opportunity for a hearing, at the request of the Town;</text></subparagraph><subparagraph id="id777e7826274648d6bf5f94a6216c6265"><enum>(C)</enum><text>provide public notice and an opportunity for public comment; and</text></subparagraph><subparagraph id="id45739bb53e814eedb554e5dc5c9fdf50"><enum>(D)</enum><text>provide the Town a reasonable opportunity to correct any identified uses that could result in reversion of the title to the United States.</text></subparagraph></paragraph></subsection></section></legis-body><endorsement><action-date date="20260723">July 23, 2026</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
