reported-display-style="strikethrough" committee-id="SSHR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Living Donor Protection Act of 2025</short-title></quote>.</text></section><section section-type="subsequent-section" id="H6DCE7458A9F94B44BDA8789572377306" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><enum>2.</enum><header>Prohibition on denial of coverage or increase in premiums of life or disability insurance for living organ donors</header><subsection id="H28857AD902104ADBA09D015EDF310853"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, an insurer shall not deny coverage, cancel coverage, refuse to issue, determine the price or premium for, or otherwise vary any term or condition of a life insurance policy, disability insurance policy, or long-term care insurance policy for a person based solely, and without any actual, unique, and material actuarial risks, on the status of such person as a living organ donor.</text></subsection><subsection id="HF16385C314B94EB0B20693B48BAF5D27"><enum>(b)</enum><header>Enforcement</header><text>A State insurance regulator may take such actions to enforce subsection (a) as are specifically authorized under the laws of such State.</text></subsection><subsection id="H01A6D585AEA249F8A6FE7F6085EA2F15"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HC537A52BD5DA40E5B7757264FB4ED095"><enum>(1)</enum><header>Disability insurance policy</header><text>The term <term>disability insurance policy</term> means a contract under which an entity promises to pay a person a sum of money in the event that an illness or injury resulting in a disability prevents such person from working.</text></paragraph><paragraph id="HAE307D434ECF4A8A8627BA66CEB6553A"><enum>(2)</enum><header>Life insurance policy</header><text display-inline="yes-display-inline">The term <term>life insurance policy</term> means a contract under which an entity promises to pay a designated beneficiary a sum of money upon the death of the insured.</text></paragraph><paragraph id="H676BBCB9F8CC492D9437874BC826FA66"><enum>(3)</enum><header>Living organ donor</header><text>The term <term>living organ donor</term> means an individual who has donated all or part of an organ and is not deceased.</text></paragraph><paragraph id="H43267B915C654382A77522BAE34F58A7"><enum>(4)</enum><header>Long-term care insurance policy</header><text display-inline="yes-display-inline">The term <term>long-term care insurance policy</term> means a contract for which the only insurance protection provided under the contract is coverage of qualified long-term care services (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/7702B">section 7702B(c)</external-xref> of the Internal Revenue Code of 1986).</text></paragraph></subsection></section><section section-type="subsequent-section" id="H74E538ADD3154BBAB6D5BF24B60A8A80" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><enum>3.</enum><header>Clarification of organ donation surgery as qualifying as a serious health condition under FMLA</header><subsection id="HC718F59E88E64437B56B7AB0188763E7"><enum>(a)</enum><header>Private sector employees</header><text display-inline="yes-display-inline">Section 101(11) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(11)</external-xref>) is amended, in the matter preceding subparagraph (A), by inserting <quote>(including recovery from surgery related to organ donation)</quote> after <quote>physical or mental condition</quote>.</text></subsection><subsection id="H42CB54AC88114D379C2C49EDCE0F6192"><enum>(b)</enum><header>Federal civil service employees</header><paragraph id="H55BF61FE2F1C49FCAE3B0F87D1799D58"><enum>(1)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 6381(5) of title 5, United States Code, is amended, in the matter preceding subparagraph (A), by inserting <quote>(including recovery from surgery related to organ donation)</quote> after <quote>physical or mental condition</quote>.</text></paragraph><paragraph id="H95FA6D30DFC24796A1AFF4CF37C2AD46" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Relationship to organ donor leave</header><text display-inline="yes-display-inline">Section 6382(d)(1) of title 5, United States Code, is amended by adding at the end the following: <quote>An employee who takes any part of the 12-week period of leave under subsection (a)(1) to serve as an organ donor (including recovery from surgery related to organ donation) may elect to substitute, for as much of that part as possible, any leave available to the employee under section 6327.</quote>. </text></paragraph></subsection></section><section id="HA0577201B180436F962BD5CDEB346572" changed="deleted" reported-display-style="strikethrough" committee-id="SSHR00"><enum>4.</enum><header>Updating of educational materials on the benefits and risks of living organ donation</header><subsection id="H94B68922273849BDB83AF90009378C79"><enum>(a)</enum><header>Educational materials</header><paragraph id="HDC93D013AE0E4AA08E4B00E97620B9FB"><enum>(1)</enum><header>Review and updating</header><text>Not later than 6 months after the date of enactment of this Act, the Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>) shall review and update materials related to living organ donation in order to educate the public on—</text><subparagraph id="H0BEE2216A6A3418A8ECC6AA6BA2F95C3"><enum>(A)</enum><text>the benefits and risks of living organ donation; and</text></subparagraph><subparagraph id="HAE562895EF2C438FB7362D993C6D9570"><enum>(B)</enum><text>the impact of living organ donation on the access of a living organ donor to insurance.</text></subparagraph></paragraph><paragraph id="HB20AABE0F44F439EB9A9F19FD950A553"><enum>(2)</enum><header>Information on statutory changes</header><text>Such updating shall include information regarding the requirements under section 2 and the amendments made by section 3.</text></paragraph></subsection><subsection id="H344CD3C8968641D283C797865A7A55CD"><enum>(b)</enum><header>Methods of updating</header><text>In carrying out subsection (a), the Secretary shall update, as appropriate—</text><paragraph id="HAAAF1924A3FD435986C8FF7415742C40"><enum>(1)</enum><text>public service announcements previously provided by the Secretary;</text></paragraph><paragraph id="H5ECADE9603304947B72C1538EEB8CF39"><enum>(2)</enum><text>publicly accessible websites (such as organdonor.gov, or a successor website) that are maintained by the Secretary and that contain information and resources regarding living organ donation; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H890714A0E9E34C719DC8C26E3308046E"><enum>(3)</enum><text>other media, as the Secretary determines appropriate. </text></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="id9f282d63-f6b1-4603-b094-a5af1ed719b1" changed="added" reported-display-style="italic" committee-id="SSHR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Living Donor Protection Act of 2025</short-title></quote>.</text></section><section section-type="subsequent-section" id="id5c2cc2e8-236b-4811-a0bb-f6f4a5afdb96" changed="added" reported-display-style="italic" committee-id="SSHR00"><enum>2.</enum><header>Prohibition on denial of coverage or increase in premiums of life or disability insurance for living organ donors</header><subsection id="id2997b544-0558-4e5e-acc8-ac5b12bc3b52"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, an insurer shall not deny coverage, cancel coverage, refuse to issue, determine the price or premium for, or otherwise vary any term or condition of a life insurance policy, disability insurance policy, or long-term care insurance policy for a person based solely, and without any actual, unique, and material actuarial risks, on the status of such person as a living organ donor.</text></subsection><subsection promises to pay a person a sum of money in the event that an illness or injury resulting in a disability prevents such person from working.</text></paragraph><paragraph id="id6c502fa5-fb78-4a0e-a264-01f89ba7099f"><enum>(2)</enum><header>Life insurance policy</header><text display-inline="yes-display-inline">The term <term>life insurance policy</term> means a contract under which an entity promises to pay a designated beneficiary a sum of money upon the death of the insured.</text></paragraph><paragraph id="ide564d8dc-c9b6-4b01-b35b-a1ab2e1ac2e9"><enum>(3)</enum><header>Living organ donor</header><text>The term <term>living organ donor</term> means an individual who has donated all or part of a human organ (as defined in section 301(c)(1) of the National Organ Transplant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/274e">42 U.S.C. 274e(c)(1)</external-xref>)) or bone marrow (as defined in section 379A–1(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/274l-1">42 U.S.C. 274l–1(2)</external-xref>)) and is not deceased.</text></paragraph><paragraph id="idf646ebfb-9f70-4d85-93fd-21f124ca445b"><enum>(4)</enum><header>Long-term care insurance policy</header><text display-inline="yes-display-inline">The term <term>long-term care insurance policy</term> means a contract for which the only insurance protection provided under the contract is coverage of qualified long-term care services (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/7702B">section 7702B(c)</external-xref> of the Internal Revenue Code of 1986).</text></paragraph></subsection></section><section 6 months after the date of enactment of this Act, the Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>), in coordination with the Secretary of Labor, as appropriate, shall review the educational activities and materials pursuant to section 377A of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/274f-1">42 U.S.C. 274f–1</external-xref>), and update such activities and materials to include information regarding the requirements under section 2 and the amendments made by section 3.</text></subsection><subsection id="id983a92d1-db6f-4dc4-85ad-8010f2a70568"><enum>(b)</enum><header>Outreach</header><text>In carrying out subsection (a), the Secretary may, as appropriate, issue public service announcements or update any publicly accessible websites or other media maintained by the Secretary that contain information and resources regarding living organ
