BILL</legis-type><official-title>To amend title 54, United States Code, to reauthorize the National Parks and Public Land Legacy Restoration Fund, and for other reported-display-style="strikethrough" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>America the Beautiful Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id3c03bab0acd24886aa25ce6eca3fcab4" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>2.</enum><header>Reuauthorization of the National Parks and Public Land Legacy Restoration Fund</header><subsection commented="no" display-inline="no-display-inline" id="idffbea3d11bbc4e8d99b97fe0fb83b33c"><enum>(a)</enum><header display-inline="yes-display-inline">Deposits</header><text display-inline="yes-display-inline">Section 200402(b) of title 54, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id8c4cedb1e78042beb8d0f734c6c1b7e5"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>2025</quote> and inserting <quote>2033</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idba1ead0b6e254259a253ad023d322d51"><enum>(2)</enum><text>in paragraph (2), by striking <quote>$1,900,000,000</quote> and inserting <quote>$2,000,000,000</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id357c2a666c1e41d6ae56762ded90eec7"><enum>(b)</enum><header>Use of funds</header><text>Section 200402(e) of title 54, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id35329c982f9345e0bd305ee29d2571de"><enum>(1)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>in the National Wildlife Refuge System</quote> and inserting <quote>on land administered by the United States Fish and Wildlife Service</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd295f72be8a149c7bedf5b7465d8c8f8"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id63174B2747064CB0AC1572D8508DBCEC" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><paragraph commented="no" display-inline="no-display-inline" id="idc76d5b7f3f664b9aae270a343b06ec4b"><enum>(3)</enum><header>Project prioritization</header><text>The Secretary and the Secretary of Agriculture shall prioritize the use of amounts allocated from the Fund for projects that receive donations under subsection (j) of not less than 15 percent of the total costs of the applicable project.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0604d326f65e49999dc0b09a05a7c96a"><enum>(c)</enum><header>Submission of annual list of projects to Congress</header><text>Section 200402(h) of title 54, United States Code, is amended by inserting <quote>and the subsequent fiscal year</quote> before the period at the end.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id457b57f2177f4adc817bdd2c4b8b3192"><enum>(d)</enum><header>Alternate allocation</header><text>Section 200402(i) of title 54, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id76da87e68f4f43169f6177a105e281d7"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>for the applicable fiscal year and subsequent fiscal year</quote> after <quote>under this section</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71d95e582d98413d80979d250fe560e8"><enum>(2)</enum><text>in paragraph (2), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id64F604F1F41D460F8EDFE65DDBDEC404" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><subparagraph id="id909b853adf4245b2b89db0b9496c85e1"><enum>(C)</enum><header>No full-year appropriations enacted</header><text>If Congress has not enacted full-year appropriations for the Department of the Interior, Environment, and Related Agencies for the applicable fiscal year by the end of the previous fiscal year, amounts made available under subsection (c) shall be allocated by the President, if that allocation had previously been approved under paragraph (1) as an allocation for the subsequent fiscal year.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="iddbf48e76c9224f2c9226a4490fe94a8c"><enum>(e)</enum><header>Public donations</header><text>Section 200402(j) of title 54, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idf92ba44574594731a975dddb7f5e09c9"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Public</header-in-text></quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1da806b498b24071b35896fba0c15cee"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>public</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida86a08ca626b407e8b7ee1305b7236b7"><enum>(3)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd69b258ddab2473ead3156a505394095"><enum>(4)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB074D53895C94E4882C5AD59902C454E" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><paragraph id="idf23e05d5d53a47a7851534747f66b324"><enum>(2)</enum><header>Solicitation of Donations</header><text>The Secretary and the Secretary of Agriculture shall provide to the public information on the ability of the Secretary and the Secretary of Agriculture to accept donations under paragraph (1), including through—</text><subparagraph id="id5cd55d6c1a2d424db50f81cba91e3a4f"><enum>(A)</enum><text>public awareness campaigns;</text></subparagraph><subparagraph id="iddee71d3f67814d6cb45f3bc74e42e001"><enum>(B)</enum><text>physical or digital donation locations at project sites; and</text></subparagraph><subparagraph id="id0c47262af8fc4ec4842b738f9ea047c0"><enum>(C)</enum><text>during the checkout process for the purchase of a physical or digital pass to access a Federal recreational site or an interagency pass, such as the America the Beautiful—the National Parks and Federal Recreational Lands Pass.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3504c667ab124e84810e7a0bdb039898"><enum>(5)</enum><text>by striking paragraph (3) (as so redesignated) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id08EACCAEC6524C8CA46E164215539B79" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><paragraph id="id4eb35fbc0323428a8dab0e6f87439da4"><enum>(3)</enum><header>Credits to fund</header><text>Any cash donations accepted under paragraph (1)—</text><subparagraph id="idbf1196cc69804d67b862b6f1750d4219"><enum>(A)</enum><text>shall be—</text><clause id="ide8213e0520f3473d8ce2adf9e4dc3e5a"><enum>(i)</enum><text>credited to, and form a part of, the Fund; and</text></clause><clause id="id319343701ef247eab90c4b3d528637f2"><enum>(ii)</enum><text>allocated to the covered agency for which the donation was made; and</text></clause></subparagraph><subparagraph id="id8444fb18ad95462695b0554fd3c71549"><enum>(B)</enum><text>may be allocated to specific projects included on a list submitted under subsection (h).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide9be701a0b754c4a8f7af8c961577d7d"><enum>(6)</enum><text>in paragraph (4) (as so redesignated), by striking <quote>paragraph (2)(B)</quote> and inserting <quote>paragraph (3)(A)(ii)</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5869560639bc4719aea9480d6f1369e2"><enum>(f)</enum><header>Disposal of assets; report to congress</header><text>Section 200402 of title 54, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCC3CF2A564D14E0EB8A9DED85D88FA3F" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><subsection id="id0d62e20c86a14d9b9b6aa3fd45691df9"><enum>(l)</enum><header>Disposal of assets</header><text>The Secretary and the Secretary of Agriculture shall provide for the disposal of constructed assets included on a deferred maintenance list submitted under subsection (h) that no longer serve the public interest or advance the mission of the applicable unit to which the asset belongs.</text></subsection><subsection id="id59326ffb7cd84c5682f1b513485d2450"><enum>(m)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of enactment of this subsection, the Secretary and the Secretary of Agriculture shall submit to the appropriate committees of Congress a report that—</text><paragraph id="id4b36b078706540c4a83e00d51c546f90"><enum>(1)</enum><text>describes actions taken by the covered agencies without using amounts from the Fund to reduce deferred maintenance in the System, on land administered by the United States Fish and Wildlife Service, on public land administered by the Bureau of Land Management, for the Bureau of Indian Education schools, and in the National Forest System; and </text></paragraph><paragraph id="idb73403eed7a54b0b8d496484b63a8ffb"><enum>(2)</enum><text>includes a plan from the covered agencies to increase preventative annual and cyclic maintenance activities by covered agencies to a level that properly maintains the assets of the covered agencies and prevents the addition of assets to a deferred maintenance list under subsection (h).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="S1" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>America the Beautiful Act</short-title></quote>.</text></section><section id="id23945ec73f134002b4a28d5f39bbc657" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>2.</enum><header>National Parks and Public Land Legacy Restoration Fund</header><subsection id="id5d1905178df14b4ebdbb970487610390"><enum>(a)</enum><header>Definition of deferred maintenance</header><text>Section 200401 of title 54, United States Code, is amended—</text><paragraph id="id824a39cfd5d6495b8381ce1b095c0cc6"><enum>(1)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (4) and (5), respectively; and</text></paragraph><paragraph id="id8b32b624cd3f4564af419bfb7f38467d"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3afca42ae584479c985127e155dd41d3" changed="added" reported-display-style="italic" committee-id="SSEG00"><paragraph id="idebaeafadbedc42188a92322332d03a69"><enum>(3)</enum><header>Deferred maintenance</header><subparagraph commented="no" display-inline="no-display-inline" id="idab6ff15df95f4a92b5ae6a8c48466522"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The term <term>deferred maintenance</term> means maintenance or a repair of an asset that—</text><clause id="id2027349222704fb4a15ba9fdbf1617c0"><enum>(i)</enum><text>was not performed when the maintenance or repair should have been, or was scheduled to be, performed; and</text></clause><clause id="ide10fb7dae8994485ae525b194798d4f7"><enum>(ii)</enum><text>is put off or delayed for a future period.</text></clause></subparagraph><subparagraph id="id08520493e59949c3b4621acd5f75f534"><enum>(B)</enum><header>Inclusion</header><text>The term <term>deferred maintenance</term> includes the reconstruction of an asset that was demolished or removed during the 10-year period ending on the date of enactment of the <short-title>America the Beautiful Act</short-title> and during the term of the authorization of the deposits into the Fund, if—</text><clause id="id29790808ffca4bb48406adb610dcdad7"><enum>(i)</enum><text>the asset was demolished or removed because its deterioration posed a risk—</text><subclause commented="no" display-inline="no-display-inline" id="iddc5e53d707f54158ae649bf609c39754"><enum>(I)</enum><text display-inline="yes-display-inline">to human health or safety; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id509ec3b786f345229f3c17f2610c124f"><enum>(II)</enum><text display-inline="yes-display-inline">to natural or cultural resources;</text></subclause></clause><clause id="id08771abf635e48c393e3901c22b222c9"><enum>(ii)</enum><text>the asset was not intended to be temporary at the time of its construction;</text></clause><clause id="idb91e004eafa74c348e5f5b3b6ca085c9"><enum>(iii)</enum><text>the reconstructed asset is comparable in function and capacity to the original asset; and</text></clause><clause id="idc1c69b842e914df78a546fb9f1526cc1"><enum>(iv)</enum><text>the total cost of the reconstruction is less than $5,000,000.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id5dc6b0c3fd854dfaa0b123e88ce81b2d"><enum>(b)</enum><header>Deposits</header><text>Section 200402(b)(1) of title 54, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id9d49490aa804412a8fce263b22b8acc9"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>2021 through 2025</quote> and inserting <quote>2027 through 2031</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf1b8c7df27f64100a22d01b8104722a4"><enum>(2)</enum><text>by striking <quote>Federal land and water</quote> and inserting <quote>Federal onshore land</quote>.</text></paragraph></subsection><subsection id="ided803c981418475099e910144a5acff9"><enum>(c)</enum><header>Maximum amount</header><text>Section 200402(b)(2) of title 54, United States Code, is amended—</text><paragraph id="ide25c306f2db241fea31a579916412327"><enum>(1)</enum><text>by inserting <quote>total</quote> before <quote>amount</quote>; and</text></paragraph><paragraph id="ida0ba0ee8a55342d68880f0ee8bd6e157"><enum>(2)</enum><text>by inserting <quote>, section 803 of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802</external-xref>), and section 4(e)(2)(B) of the <short-title>America the Beautiful Act</short-title></quote> after <quote>paragraph (1)</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc9b524e3d6634d1c8645780ae39d6584"><enum>(d)</enum><header>Order of deposits</header><text>Section 200402(b) of title 54, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id4f1b9b5e4a734e0195c47315bc636726"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (3) as paragraph (4); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55a8896a2f2a4bacb4d6d85f8528e626"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida9f4f1966c6b49caa883f6f7769d353d" changed="added" reported-display-style="italic" committee-id="SSEG00"><paragraph commented="no" display-inline="no-display-inline" id="id932432a7d9ee42688b737b65a10a33fb"><enum>(3)</enum><header>Order of deposits</header><text display-inline="yes-display-inline">Amounts required to be deposited in the Fund shall be deposited in the following order of priority:</text><subparagraph commented="no" display-inline="no-display-inline" id="idd1a732b4800543a1bdd7e4c96512f017"><enum>(A)</enum><text>Amounts required to be deposited in the Fund under paragraph (3)(I) of section 803(e) of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802(e)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc37a82d897af49bbbd163e06bf3d5c9d"><enum>(B)</enum><text>Amounts required to be deposited in the Fund under section 4(e)(2)(B) of the <short-title>America the Beautiful Act</short-title>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2e854026b0bf4d8ea4cdc54c4b9c10ab"><enum>(C)</enum><text>Amounts required to be deposited in the Fund under paragraph (1).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id276e1277177f41698d2fc544d96ebef4"><enum>(e)</enum><header>Use of funds</header><text>Section 200402(e) of title 54, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idf4aaf40b97714009892ab01fe59d02bb"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>in the National Wildlife Refuge System</quote> and inserting <quote>on land administered by the United States Fish and Wildlife Service</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbb9ef45377504f40974e8cf9d0a037c5"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id1d0269d3597c402e80e97adbdf599194" changed="added" reported-display-style="italic" committee-id="SSEG00"><paragraph commented="no" display-inline="no-display-inline" id="id294fbbf552a640d897db7910a54c8433"><enum>(2)</enum><header>Limitations</header><subparagraph id="id94b73ec241db4283a1f12031e57cdba6" commented="no"><enum>(A)</enum><header>Nontransportation projects</header><text>Over the term of the Fund—</text><clause id="id8b5b438101d34f96aad4335118b8161e" commented="no"><enum>(i)</enum><text>within the Service, not less than 65 percent of amounts from the Fund shall be allocated for deferred maintenance nontransportation projects; </text></clause><clause id="id6477621fda654342b66c2d13fce05038" commented="no"><enum>(ii)</enum><text>within the United States Fish and Wildlife Service, not less than 65 percent of amounts from the Fund shall be allocated for deferred maintenance nontransportation projects;</text></clause><clause commented="no" display-inline="no-display-inline" id="idd0e9edaf27584cde8bd739dff622f287"><enum>(iii)</enum><text>within the Forest Service, not less than 32 percent of amounts from the Fund shall be allocated for deferred maintenance nontransportation projects; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida79281e1cc4644369fc26f4bd8274e76"><enum>(iv)</enum><text>within the Bureau of Land Management, not less than 15 percent of amounts from the Fund shall be allocated for deferred maintenance nontransportation projects.</text></clause></subparagraph><subparagraph id="id8a35c050215348b38223bb1fbe8d7779"><enum>(B)</enum><header>Transportation projects</header><text>The amounts remaining in the Fund after the allocations required under subparagraph (A) may be allocated for deferred maintenance transportation projects of the covered agencies, including paved and unpaved roads, bridges, tunnels, and paved parking areas.</text></subparagraph><subparagraph id="id8c2f4caf8cc445e5a9154dfa4e5eef45"><enum>(C)</enum><header>Plan</header><text>A priority deferred maintenance project funded under this section shall be consistent with an applicable transportation, deferred maintenance, or capital improvement plan developed by the applicable covered agency.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id1fc962e8e5ad44df97ab2b619c3b447a"><enum>(f)</enum><header>Prohibitions on use</header><text>Section 200402 of title 54, United States Code, is amended by striking subsection (f) and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idc6490f80469e48eaae7d801b0a581891" changed="added" reported-display-style="italic" committee-id="SSEG00"><subsection id="idaf1714baa4174d9daa95c1baef7168d7"><enum>(f)</enum><header>Prohibitions on use</header><text>No amounts in the Fund shall be used—</text><paragraph id="id04d4371432e54108bd217596cd7db498"><enum>(1)</enum><text>for the acquisition of land or any interest in land;</text></paragraph><paragraph id="id69fd9d6ede174f8285371c1f00a45e64"><enum>(2)</enum><text>to supplant discretionary funding made available for annually recurring facility operations, maintenance, or construction needs; </text></paragraph><paragraph id="id6f8f68bc2c0449f2bbc22cb2d60b5994"><enum>(3)</enum><text>for a bonus for an employee of the Federal Government; or</text></paragraph><paragraph id="id04c3a30f4f7a428d882acc5862b891fe"><enum>(4)</enum><text>to decommission a road on National Forest System land or public land administered by the Bureau of Land Management.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id55c6294784a647e5955d7401b5ab5043"><enum>(g)</enum><header>Project selection</header><text>Section 200402 of title 54, United States Code, is amended by striking subsection (h) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0c43c3d4e1f147888a1ca99466d80f1a" changed="added" reported-display-style="italic" committee-id="SSEG00"><subsection id="idcbb613883dc94e49b0353d18da0011f5"><enum>(h)</enum><header>Submission of annual list of projects to congress</header><paragraph id="idf16cc990904140389a256fd7e4f5e34c"><enum>(1)</enum><header>Definitions</header><text>In this subsection and subsection (i):</text><subparagraph id="id44d236a140644a1c8928707127421d38"><enum>(A)</enum><header>Applicable fiscal year</header><text>The term <quote>applicable fiscal year</quote>, with respect to a session of Congress, means the fiscal year of the United States Government that starts on October 1 of the calendar year in which that session begins.</text></subparagraph><subparagraph id="id3b122a125b474c319a334ef1447351de"><enum>(B)</enum><header>Subsequent fiscal year</header><text>The term <quote>subsequent fiscal year</quote> means a fiscal year 1 year after the applicable fiscal year.</text></subparagraph></paragraph><paragraph id="idf6cbadc425d947fc96b8ada2382bc2b1"><enum>(2)</enum><header>Annual list</header><subparagraph id="idb86d5fa6bfa04df58eb6fd2be2065585"><enum>(A)</enum><header>In general</header><text>Until the date on which all amounts in the Fund are allocated, the President shall annually submit to Congress, together with the annual budget of the United States, a list of projects to be funded from the Fund for the applicable fiscal year and the subsequent fiscal year that includes a detailed description of each such project, including the estimated expenditures from the Fund for the project.</text></subparagraph><subparagraph id="id7566dd13b9ce45198ba7f7265bc6de5b"><enum>(B)</enum><header>Project data sheets</header><clause commented="no" display-inline="no-display-inline" id="id157126efb4574cabb8fb3dc26e3ef5a7"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The list of projects transmitted with the annual budget of the United States under subparagraph (A) shall be accompanied by a project data sheet for each such project in the same format and containing the same level of detailed information as on previous project data sheets submitted to Congress.</text></clause><clause commented="no" display-inline="no-display-inline" id="id75b82848a9294287b133c1cbef2daeda"><enum>(ii)</enum><header>Inclusions</header><text display-inline="yes-display-inline">Each project data sheet under clause (i) shall include—</text><subclause commented="no" display-inline="no-display-inline" id="id05d13f24a346494ea7f9be232336aa03"><enum>(I)</enum><text display-inline="yes-display-inline">a list of each asset addressed;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0a67c0716de540e5818a53140b289f33"><enum>(II)</enum><text display-inline="yes-display-inline">a description of the scope of benefits; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id147ed24b0663438ebbbc53252f4230ad"><enum>(III)</enum><text display-inline="yes-display-inline">a description of the consequences of failure to act.</text></subclause></clause></subparagraph></paragraph><paragraph id="idc33ca765c58a423880206a4a5cc1097b"><enum>(3)</enum><header>No List, No Allocation</header><subparagraph commented="no" display-inline="no-display-inline" id="id368b74a8ee914b638f3f56e54d0b0750"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subsection (i)(2)(A) and subject to subparagraph (B), if the list of projects under paragraph (2)(A) and the accompanying project data sheets under paragraph (2)(B) for an applicable fiscal year have not been submitted to Congress by April 30 of the preceding fiscal year, no allocation under subsection (c) for that applicable fiscal year may be made until the date on which the Act making full-year appropriations for the Department of the Interior, Environment, and Related Agencies for the subsequent fiscal year is enacted into law. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idadf0f4f09c434424b6e6ff3df9d437c2"><enum>(B)</enum><header>Applicability</header><text display-inline="yes-display-inline">Subparagraph (A) shall only apply to the enactment of full-year appropriations for fiscal year 2028 or any fiscal year thereafter.</text></subparagraph></paragraph><paragraph id="id2c6242f5faf547a5bf046f436e6c6252"><enum>(4)</enum><header>Submission of list of projects and project data sheets to congress for fiscal year 2027 and fiscal year 2028</header><subparagraph id="id818c138cd2e443e4914883901d2abe7b"><enum>(A)</enum><header>Deadlines</header><text>The Secretary and the Secretary of Agriculture shall submit to the Committees on Energy and Natural Resources and Appropriations of the Senate and the Committees on Natural Resources and Appropriations of the House of Representatives—</text><clause commented="no" display-inline="no-display-inline" id="id13494024e49d4a4bb4ab245a4cff49ad"><enum>(i)</enum><text display-inline="yes-display-inline">by not later than November 15, 2026, a list of projects under paragraph (2)(A) to be funded for fiscal year 2027 and fiscal year 2028 under that paragraph; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3a3f7c3da8f6465a8b2a2005026ff5d2"><enum>(ii)</enum><text display-inline="yes-display-inline">by not later than November 30, 2026, the accompanying project data sheets under paragraph (2)(B). </text></clause></subparagraph><subparagraph id="id23fdb8f19b0c434a80ec53fa49abed9c"><enum>(B)</enum><header>Failure to submit</header><text>Notwithstanding subsection (i)(2)(A), if the list of projects for fiscal year 2027 under subparagraph (2)(A) and accompanying project data sheets under paragraph (2)(B) have not been submitted to Congress pursuant to subparagraph (A), no allocation under subsection (c) for fiscal year 2027 may be made until the date on which the Act making full-year appropriations for the Department of the Interior, Environment, and Related Agencies for fiscal year 2028 is enacted into law.</text></subparagraph></paragraph><paragraph id="id1f6d008e0fd043eea8df4b8db0a26e57"><enum>(5)</enum><header>Recommendations</header><text>The Secretary and the Secretary of Agriculture shall annually solicit from the Governors of all States, the governors of all territories of the United States, and Indian Tribes (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)) recommendations for projects to be funded from the Fund under paragraph (2).</text></paragraph><paragraph id="idbc1a3360eb264ba2939b4e39290038b2"><enum>(6)</enum><header>Priority</header><text>In selecting projects for the list (other than projects for the Bureau of Indian Education) to be funded from the Fund under paragraph (2), the Secretary and the Secretary of Agriculture shall ensure that, for each covered agency—</text><subparagraph id="id7a8528086c5e438aa692f9933eda6dd9"><enum>(A)</enum><text>funds are prioritized for projects that—</text><clause commented="no" display-inline="no-display-inline" id="idf29def1815c9421ebddbc42a1f9ad86c"><enum>(i)</enum><text display-inline="yes-display-inline">address deferred maintenance of assets the failure of which would result in—</text><subclause id="id1d5d8b0277474e25a2867ce645fde56b"><enum>(I)</enum><text>an imminent threat to public health or safety; or</text></subclause><subclause id="idda644087d9284ab7bc04d2be3e88f3cc"><enum>(II)</enum><text>the closure or material impairment of public access or core operational functions;</text></subclause></clause><clause id="id4dc95a9e848f49dd981f4ae0ac890d0c"><enum>(ii)</enum><text>are necessary to prevent the further deterioration of an asset that would result in a substantially higher future repair or replacement cost;</text></clause><clause id="id0efb1031d35648cf94dc8854e1f82a17"><enum>(iii)</enum><text>maximize the reduction of the deferred maintenance backlog relative to the amount of funds expended;</text></clause><clause id="id4ce3b72deadd47e08096c461156cbe04"><enum>(iv)</enum><text>address mission-critical assets, including water, wastewater, site maintenance, employee housing, and public use facilities;</text></clause><clause id="id1aaf1403849b40d9abbe86e5da238d2e"><enum>(v)</enum><text>can be completed in a timely manner and in accordance with applicable cost and schedule estimates; or</text></clause><clause id="idc2ccfb76dee245ec91a2c60f07c05884"><enum>(vi)</enum><text>positively impact a visitor-facing asset; and</text></clause></subparagraph><subparagraph id="ide98a0f63a9a74e2888b6a5823bc6af65"><enum>(B)</enum><text>a reasonable balance is achieved between projects at higher- and lower-visitation units or areas administered by the covered agency.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id9d9fed29c1f84a3592b9899f6abde2c5"><enum>(h)</enum><header>Alternate allocation</header><text>Section 200402 of title 54, United States Code, is amended by striking subsection (i) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1ecebff98a354af3a22d5701c7a1d6bf" changed="added" reported-display-style="italic" committee-id="SSEG00"><subsection id="idda647ae27769466bab6db42a4fef5f23"><enum>(i)</enum><header>Alternate Allocation</header><paragraph id="idc0f660cebabc40e0b1cbab37b50fbabb"><enum>(1)</enum><header>In general</header><text>Appropriations Acts may provide for alternate allocation of amounts made available under this section for the applicable fiscal year and the subsequent fiscal year, consistent with the allocations to covered agencies under subsection (e)(1).</text></paragraph><paragraph id="idddf062d9ee374359acf597722aeee379"><enum>(2)</enum><header>Allocation by president</header><subparagraph id="idfaf94ffeba034a70814dab0ba20f8f35"><enum>(A)</enum><header>No alternate allocations</header><text>If Congress has not enacted legislation establishing alternate allocations by the date on which the Act making full-year appropriations for the Department of the Interior, Environment, and Related Agencies for the applicable fiscal year is enacted into law, amounts made available under subsection (c) shall be allocated by the President.</text></subparagraph><subparagraph id="id38695478f610463d8f731e99fa4751b1"><enum>(B)</enum><header>Insufficient alternate allocation</header><text>If Congress enacts legislation establishing alternate allocations for amounts made available under subsection (c) that are less than the full amount appropriated under that subsection, the difference between the amount appropriated and the alternate allocation shall be allocated by the President.</text></subparagraph><subparagraph id="id8c4b9271814a47558dc8eb8ec4178233"><enum>(C)</enum><header>No full-year appropriations enacted by end of previous fiscal year</header><clause commented="no" display-inline="no-display-inline" id="id68c3e983bd124966acb3d7fd9a07dcda"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to clause (ii), if an allocation has been made by Congress for a subsequent fiscal year under paragraph (1) and Congress has not enacted full-year appropriations for the Department of the Interior, Environment, and Related Agencies by October 1 of the year in which that subsequent fiscal year becomes the applicable fiscal year, amounts made available under subsection (c) may be implemented by the President on October 1 of such applicable fiscal year, in accordance with the congressional allocation. </text></clause><clause commented="no" display-inline="no-display-inline" id="id275378f548c342578fcf28d1e864b066"><enum>(ii)</enum><header>Applicability</header><text display-inline="yes-display-inline">Clause (i) shall only apply to the enactment of full-year appropriations for fiscal year 2028 or any fiscal year thereafter.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idb52fba4e490e4bee92c38bea92b012c1"><enum>(i)</enum><header>Public donations</header><text>Section 200402(j) of title 54, United States Code, is amended—</text><paragraph id="id0eb31b1b9b3a49d985512fa15261ba41"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text style="USC" level="subsection">Public</header-in-text></quote>;</text></paragraph><paragraph id="iddaf814dc9f25459582eb114066022aea"><enum>(2)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>public</quote>;</text></paragraph><paragraph id="id083cc22ebc7a4002a198a8fc3656de43"><enum>(3)</enum><text>by redesignating paragraph (3) as paragraph (4);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida95b1aa2fb84436eb827c09fd25ef847"><enum>(4)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id75c749320c11450684940a8b552e3512" changed="added" reported-display-style="italic" committee-id="SSEG00"><paragraph id="id4aa943a654914875bca165ccc8eafac4"><enum>(2)</enum><header>Solicitation of donations</header><text>The Secretary and the Secretary of Agriculture shall provide to the public information on the ability of the Secretary and the Secretary of Agriculture to accept donations under paragraph (1), including through—</text><subparagraph id="id44a9a5fa191b471ba4aeae03a5c52ec7"><enum>(A)</enum><text>public awareness campaigns;</text></subparagraph><subparagraph id="ida59d1b9dce6b4131b257906d3c64b3e2"><enum>(B)</enum><text>physical or digital donation locations at project sites; and</text></subparagraph><subparagraph id="id39902b69d1294675a68bb23198323a14"><enum>(C)</enum><text>during the checkout process for the purchase of a physical or digital pass to access a Federal recreational site or an interagency pass.</text></subparagraph></paragraph><paragraph id="id475f01c7cc0b4468ae92232191261c98"><enum>(3)</enum><header>Credits to fund</header><subparagraph commented="no" display-inline="no-display-inline" id="id6139ab026ce940e384db84fe34afa2c7"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">100 percent of any cash donations accepted under paragraph (1) shall be credited to, and form a part of, the Fund.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9298fc1d26db452384093e180f1d2eac"><enum>(B)</enum><header>Allocation</header><text>Amounts credited to the Fund under subparagraph (A) shall be allocated to the covered agency for which the donation was made.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9910a7b2b7a94b3eafdf75a59b35704a"><enum>(C)</enum><header>Exclusion from maximum amount</header><text display-inline="yes-display-inline">Amounts credited to the Fund under subparagraph (A) shall not be considered for purposes of the limitation on amounts deposited under subsection (b)(2).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1da706e165ca43a3b58b11e8a64d3288"><enum>(5)</enum><text>in paragraph (4) (as so redesignated), by striking <quote>paragraph (2)(B)</quote> and inserting <quote>paragraph (3)(B)</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6ac982acbf734889a7b29235b98d0b6d"><enum>(j)</enum><header>Additional provisions</header><text>Section 200402 of title 54, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id92ecba747ad946bf97ecdee6fb5d1761" changed="added" reported-display-style="italic" committee-id="SSEG00"><subsection id="id414d34138b4647099a1c1423305814d3"><enum>(l)</enum><header>Streamlining</header><paragraph id="id573f28cf88a944878716dc3be3bf2230" commented="no"><enum>(1)</enum><header>Categorical exclusions</header><subparagraph commented="no" display-inline="no-display-inline" id="idb3aa72537e6e46c99dbdd05dcebec02f"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>In carrying out a project using funds authorized by this section, the Secretary shall, in accordance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>)—</text><clause commented="no" display-inline="no-display-inline" id="idca0a678c132f4fb0ba544dc6a38a470a"><enum>(i)</enum><text display-inline="yes-display-inline">adopt any applicable categorical exclusion (as defined in section 111 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4336e">42 U.S.C. 4336e</external-xref>)) established by another Federal agency under section 109 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4336c">42 U.S.C. 4336c</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="id5394e6186db146c2a66098ed1fbc1e43"><enum>(ii)</enum><text>use all other available procedures to expedite environmental review of the project, including—</text><subclause commented="no" display-inline="no-display-inline" id="id055b191ad9a64a9fb940d5dcfedc2bd2"><enum>(I)</enum><text display-inline="yes-display-inline">determinations of NEPA adequacy; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6d4a3713b39e4c30a5861d37b6215a54"><enum>(II)</enum><text>reliance on previously completed environmental reviews; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id1e54e9d6b35049cb8dae0c68022a9ea7"><enum>(iii)</enum><text>establish additional categorical exclusions (as so defined) as determined necessary to expedite the completion of deferred maintenance projects using funds authorized by this section.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4b494aedcacf4e80b2e94e888f7d681a"><enum>(B)</enum><header>Administration</header><text display-inline="yes-display-inline">In adopting, developing, and administering a categorical exclusion described in clause (i) or (iii) of subparagraph (A), the Secretary and the Secretary of Agriculture shall apply the extraordinary circumstances procedures under section 46.215 of title 43, Code of Federal Regulations (or a successor regulation).</text></subparagraph></paragraph><paragraph id="id0bee6e1605e346599613078fc1b474b2" commented="no"><enum>(2)</enum><header>Program comment and exempted categories</header><text>Not later than 180 days after the date of enactment of this subsection, the Advisory Council on Historic Preservation, in consultation with the Secretary and the Secretary of Agriculture, shall develop and issue a consolidated program comment (as described in subsection (e) of section 800.14 of title 36, Code of Federal Regulations (as in effect on that date of enactment)) and develop an approved applicable exempted categories of undertakings (as described in subsection (c) of that section (as so in effect)) for projects using funds authorized by this section to eliminate or reduce deferred maintenance on land under the jurisdiction of the Secretary or the Secretary of Agriculture.</text></paragraph></subsection><subsection id="id359601dc18d0462da4307e6ae6dec32a"><enum>(m)</enum><header>Timeline</header><text>Not later than 180 days after the date on which the final design of a project funded under this section has been approved for which 1 or more responsive bids from a responsible bidder have been received, the Secretary or the Secretary of Agriculture, as applicable, shall award a construction contract for the project unless the Secretary or Secretary of Agriculture determines, in writing, that there is a compelling reason to reject all bids received.</text></subsection><subsection id="id325a7857907f4bd59a62eebbd72f29bf"><enum>(n)</enum><header>State, local, Tribal, nonprofit organization, and concessioner noncompetitive contracts</header><paragraph id="ide4bd08d7d0f54a5b938b6bbc287469e1"><enum>(1)</enum><header>In general</header><text>Notwithstanding <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/33">chapter 33</external-xref> of title 41, or any other provision of law relating to the use of competitive procedures for the procurement of services, supplies, or construction materials and services, on making a determination described in paragraph (2), the Secretary or the Secretary of Agriculture may enter into 1 or more contracts, on a noncompetitive basis, for any priority deferred maintenance project with—</text><subparagraph commented="no" display-inline="no-display-inline" id="id041e9f46d7ca474897d26536a66def99"><enum>(A)</enum><text display-inline="yes-display-inline">a State, local government, or Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)), including any Native village, Village Corporation, or Regional Corporation, as those terms are defined in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3e41675209154e2792077f171637a913"><enum>(B)</enum><text display-inline="yes-display-inline">a congressionally chartered nonprofit organization;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id065d235712f2481cbc4956edc5b567cc"><enum>(C)</enum><text display-inline="yes-display-inline">a nonprofit organization affiliated with a specific unit or area of a covered agency for a project within that unit or area; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc95f1cb0ea0d41c2a667622a9d91f5cf"><enum>(D)</enum><text display-inline="yes-display-inline">a lessee or concessioner currently holding a valid lease or concession contract with the specific unit of a covered agency where the priority deferred maintenance project is located.</text></subparagraph></paragraph><paragraph id="id2e6e445f8b1e43a18ac88f8d2206032d"><enum>(2)</enum><header>Determination</header><text>A determination referred to in paragraph (1) is a determination by the Secretary or the Secretary of Agriculture, as applicable, in writing, that the applicable entity described in that paragraph is uniquely positioned to execute 1 or more procurement contracts described in that paragraph.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id830d0fe7364340e98135f33b62c6cb43"><enum>(3)</enum><header>Notice to Congress</header><text>Not later than 1 year after the date on which the initial contract is entered into by the Secretary or the Secretary of Agriculture pursuant to paragraph (1), and annually thereafter, the Secretary and the Secretary of Agriculture shall notify the appropriate committees of Congress regarding all contracts entered into pursuant to that paragraph during the preceding year.</text></paragraph><paragraph id="id3c93eece4d66454c8f346bdb67399fb1"><enum>(4)</enum><header>Matching contributions for certain nonprofit organizations</header><subparagraph commented="no" display-inline="no-display-inline" id="id41ba88e771b44f0fb8a3c70ecb740ddf"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>A contract under paragraph (1) with an entity described in subparagraph (B) of that paragraph shall require the entity to provide, from non-Federal sources, funds equal to not less than the amount provided from the Fund for the project.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide8b01780283a466cbde8d1e862e3409d"><enum>(B)</enum><header>Obligation limitation</header><clause commented="no" display-inline="no-display-inline" id="ide71d9dafec1246fa82938c39b034c79c"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), the Secretary or the Secretary of Agriculture may not obligate, pursuant to a contract described in subparagraph (A), amounts from the Fund equal to more than the amount of non-Federal funds contributed or irrevocably committed to the applicable project by an entity described in that subparagraph.</text></clause><clause commented="no" display-inline="no-display-inline" id="id6aa14aa6efcd4e9ab905537b8ba0c556"><enum>(ii)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Subject to clause (iii), if an entity described in subparagraph (A) fails to provide the matching contribution described in clause (i), the Secretary or the Secretary of Agriculture, as applicable, may reduce the scope, extend the time to provide funding for, or waive or reduce the matching funds requirement applicable to, the relevant project, as the Secretary or the Secretary of Agriculture, as applicable, determines to be necessary—</text><subclause commented="no" display-inline="no-display-inline" id="id07aa2c3720d049a5896462fba1319a57"><enum>(I)</enum><text display-inline="yes-display-inline">to complete a commenced project; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id02866c85d17b44dd84c7efad4ad76803"><enum>(II)</enum><text display-inline="yes-display-inline">to protect—</text><item commented="no" display-inline="no-display-inline" id="id100e1ffde21f4b19bd5bf5299087955f"><enum>(aa)</enum><text display-inline="yes-display-inline">public health or safety;</text></item><item commented="no" display-inline="no-display-inline" id="id582c029cae84462abd87fa669c1b4d9d"><enum>(bb)</enum><text display-inline="yes-display-inline">System resources; or</text></item><item commented="no" display-inline="no-display-inline" id="id0ac4fe7ca8b8487387e4d33833477bc7"><enum>(cc)</enum><text display-inline="yes-display-inline">essential services.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf445485d0e0b4962acf77034b74853ec"><enum>(iii)</enum><header>Notice to Congress</header><text>Not later than 30 days after the date on which the Secretary or the Secretary of Agriculture waives or reduces a matching funds requirement pursuant to clause (ii), the applicable Secretary shall submit to the appropriate committees of Congress a notice of that waiver or reduction.</text></clause></subparagraph></paragraph><paragraph id="id0f761e06aaa84f0485f74c07be7c325c"><enum>(5)</enum><header>Relationship to existing concession contracts</header><text>A procurement action conducted or contract awarded under this subsection shall be considered to be separate from, and shall not modify, amend, or extend the duration of, or provide any leasehold surrender interest or other benefit under, a concession contract issued under section 101913 (or a related authority).</text></paragraph><paragraph id="idfb3a14513ce34179b1b390c889ec12d2"><enum>(6)</enum><header>Effect of subsection</header><text>Nothing in this subsection—</text><subparagraph id="id2ed5a55b71ce483a9a9460f76bf2f751"><enum>(A)</enum><text>authorizes the award of any concession contract or lease without full compliance with applicable concession contracting law; or</text></subparagraph><subparagraph id="id3957c80f2b9a4e029da8e55b988bf529"><enum>(B)</enum><text>prevents the Secretary or the Secretary of Agriculture from using competitive procedures, if the applicable Secretary determines those procedures to be in the best interest of the United States.</text></subparagraph></paragraph></subsection><subsection id="id6faacae98b85478584324e2fc41c8e97"><enum>(o)</enum><header>Micro-purchase threshold</header><paragraph id="idf96030e802d84ada91cc51563f4c836d"><enum>(1)</enum><header>In general</header><text>Subject to adjustment under paragraph (2), the micro-purchase threshold for goods, services, and construction for any project funded under this section shall be the following:</text><subparagraph id="idad0fe3af5fc143ed91736cccf1a4ff6a"><enum>(A)</enum><text>$35,000 for the standard micro-purchase threshold.</text></subparagraph><subparagraph id="id1895e6a6c0bb4ee2b7714e19a79460a3"><enum>(B)</enum><text>$25,000 for the acquisition of construction subject to subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40.</text></subparagraph><subparagraph id="ida588e8da3f054fa1a053ad45b17a5ad5"><enum>(C)</enum><text>$30,000 for the acquisition of services subject to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/67">chapter 67</external-xref> of title 41.</text></subparagraph></paragraph><paragraph id="id86cdb22be9f541eba2a11815338fdc50"><enum>(2)</enum><header>Adjustment</header><text>Each of the amounts described in subparagraphs (A) through (C) of paragraph (1) shall be adjusted by the Secretary beginning on January 1, 2027, and annually thereafter, to reflect the percentage changes in the Consumer Price Index For All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor over the previous year.</text></paragraph></subsection><subsection id="id8932de4106dd4bf89762cd02578350a4"><enum>(p)</enum><header>Disposal of constructed assets</header><text>The Secretary and the Secretary of Agriculture shall provide for the disposal of constructed assets included on a deferred maintenance list submitted under subsection (h) that no longer—</text><paragraph commented="no" display-inline="no-display-inline" id="ide1cd5d4a8726406c91c1678eeea363f3"><enum>(1)</enum><text display-inline="yes-display-inline">serve the public interest; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2ed189897e2742c8b8128a982924848c"><enum>(2)</enum><text display-inline="yes-display-inline">advance the mission of the applicable unit to which the asset belongs.</text></paragraph></subsection><subsection id="id15f63953906643298f5899cc3666dc27"><enum>(q)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of enactment of this subsection, the Secretary and the Secretary of Agriculture shall submit to the appropriate committees of Congress a report that—</text><paragraph id="idd79a2c07d4a34ca48ed38d3410b60988"><enum>(1)</enum><text>describes actions taken by the covered agencies without using amounts from the Fund to reduce deferred maintenance in the System, on land administered by the United States Fish and Wildlife Service, on public land administered by the Bureau of Land Management, for Bureau of Indian Education schools, and in the National Forest System; and</text></paragraph><paragraph id="idad802511f9b447c1825e994b1bf906ce"><enum>(2)</enum><text>includes a plan from the covered agencies to increase preventative annual and cyclic maintenance activities by covered agencies to a level that properly maintains the assets of the covered agencies and prevents the addition of assets to a deferred maintenance list under subsection (h).</text></paragraph></subsection><subsection id="id8d2b30057abc41e089ae98e71ca944db"><enum>(r)</enum><header>Administrative expenses</header><text>Not more than 3 percent of the amounts deposited in the Fund under subsection (b) for a fiscal year, and none of the amounts credited to the Fund under subsection (d)(3) for a fiscal year, may be used for administrative expenses to carry out this section.</text></subsection><subsection id="idad5285572ea54c6983f439fde381ec33"><enum>(s)</enum><header>Transparency and accountability</header><text>Not later than 2 years after the date of enactment of this subsection, the Secretary and the Secretary of Agriculture shall establish clear, quantifiable, and standardized metrics across each covered agency for—</text><paragraph id="id61473eafb2bb4f828be103de1a7525dd"><enum>(1)</enum><text>calculating and determining deferred maintenance, ensuring that the metrics—</text><subparagraph id="id475b0124da7a4047a4b307980a6a7c9d"><enum>(A)</enum><text>adhere to established standards for transportation assets and nontransportation assets; and</text></subparagraph><subparagraph id="idd47e3ccb5e2547038f7be4640290e7db"><enum>(B)</enum><text>rely on standardized condition assessment methodologies;</text></subparagraph></paragraph><paragraph id="id911b50ff03694741a8ced0667143bea9"><enum>(2)</enum><text>delineating between cyclic maintenance and deferred maintenance; and</text></paragraph><paragraph id="id8e3ab01baa6c4aef879a09bbfa58cd66"><enum>(3)</enum><text>providing for the timely addition or removal of an asset from the deferred maintenance list.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="iddd3a2bf36a7d4e4292cb001401f4f0c7" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>3.</enum><header>Surcharge for nonresident visitors to units of National Park System</header><text display-inline="no-display-inline">Section 803(e) of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802(e)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id84e946240e23493cb506ecc9685e829e" changed="added" reported-display-style="italic" committee-id="SSEG00"><paragraph id="idd14203fcb6a8476aaa074fc85d448899"><enum>(3)</enum><header>Entrance fee surcharge for nonresident visitors</header><subparagraph id="idd82b250e47ed4358bff1b8a150127944"><enum>(A)</enum><header>Definition of nonresident visitor</header><text>In this paragraph, the term <term>nonresident visitor</term> means an individual who is not—</text><clause commented="no" display-inline="no-display-inline" id="id70f5f613d259439da76d4984ce9a83c6"><enum>(i)</enum><text display-inline="yes-display-inline">a citizen or national of the United States; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id9f04e8f2a7fb48c2a4f80f8337e7d296"><enum>(ii)</enum><text>an individual lawfully admitted for permanent residence in the United States.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddab1cc043b594aeb9d98a2190267b9eb"><enum>(B)</enum><header display-inline="yes-display-inline">Establishment</header><text>For any unit of the National Park System for which an entrance fee is charged, the Secretary shall establish a surcharge for any nonresident visitors.</text></subparagraph><subparagraph id="id11b0066b4f004313a19f842af1654e2e"><enum>(C)</enum><header>Determination of surcharge amount; public participation</header><text>In establishing the amount of a surcharge under subparagraph (B), the Secretary shall—</text><clause commented="no" display-inline="no-display-inline" id="ida89733040086439f8335ee274f7e4212"><enum>(i)</enum><text display-inline="yes-display-inline">ensure that the amount maximizes revenue for the applicable unit of the National Park System while retaining nonresident visitation at the applicable unit of the National Park System; and</text></clause><clause id="ide8cd63066e0947ffabc2aaf68089ed51"><enum>(ii)</enum><text>provide opportunities for public participation for gateway communities and local stakeholders in accordance with subsections (a) through (c) of section 804.</text></clause></subparagraph><subparagraph id="id898e312d9ced411ab6f160bf0c7a27ed"><enum>(D)</enum><header>Per-vehicle fee</header><text>In a case in which an entrance fee to a unit of the National Park System subject to a surcharge under subparagraph (B) is a per-vehicle charge, the Secretary shall establish a process for the superintendent of the applicable unit of the National Park System to proportionately levy and collect the surcharge from nonresident visitors under that subparagraph.</text></subparagraph><subparagraph id="id6f801b092c7b4a359b77ebcb7b0d43d4"><enum>(E)</enum><header>Methods of collection</header><text>A surcharge established under subparagraph (B) shall be collected—</text><clause id="idd24d8827ef6c448fb00208a9e2fe8e97"><enum>(i)</enum><text>by the Secretary, using the standard methods by which entrance fees may be collected for a unit of the National Park System under this section; and</text></clause><clause id="id4bbdef2251ae4e6a9e94defe95b23db0"><enum>(ii)</enum><text>if the Secretary enters into an agreement with a third-party travel vendor to provide for the collection of the surcharge, by the applicable third-party travel vendor, in accordance with the agreement.</text></clause></subparagraph><subparagraph id="ida51a9724cc1942b881d5e8c0feed5022"><enum>(F)</enum><header>Suspension or modification; increase</header><clause id="idff53e43e05ff47d194d523901e20c511"><enum>(i)</enum><header>Suspension or modification</header><text>The Secretary may suspend the collection of, or otherwise modify, the surcharge for the applicable unit of the National Park System, including providing for tiered pricing of the surcharge based on visitation levels at the unit of the National Park System, as determined appropriate by the Secretary.</text></clause><clause id="idd0a3299ec0c64adda35c479d0160e03c"><enum>(ii)</enum><header>Increase</header><text>The Secretary may establish a minimum percentage increase that shall apply to a surcharge within an applicable timeframe established by the Secretary.</text></clause><clause commented="no" display-inline="no-display-inline" id="idaa84d0e70a7045e88fc22dd4475ab47c"><enum>(iii)</enum><header>Public participation</header><text display-inline="yes-display-inline">In determining any modifications to the surcharge under clauses (i) and (ii), the Secretary shall provide opportunities for public participation for gateway communities and local stakeholders in accordance with subsections (a) through (c) of section 804.</text></clause></subparagraph><subparagraph id="ide27c67debf71425c814ad3ac462a633f"><enum>(G)</enum><header>Visa fees; administration</header><text>A surcharge established under subparagraph (B)—</text><clause id="idd07b571f1f7e4c36baffc144c7373dea"><enum>(i)</enum><text>shall be in addition to, and separate from, any statutory immigrant visa fee charged to a nonresident visitor; and</text></clause><clause id="idea1dcaf6821d464381434a606d918d9a"><enum>(ii)</enum><text>shall not be subject to administration by the Secretary of State or the Secretary of Homeland Security.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61d5c884e51044659cf447f05526676b"><enum>(H)</enum><header>Exemption for international peace parks</header><text>In the case of a unit of the National Park System that has been designated as an international peace park by an Act of Congress and is subject to a memorandum of understanding with the government of a foreign country relating to management or stewardship of the unit of the National Park System, no surcharge may be applied to the entrance fee of a national of that foreign country for entry to that unit of the National Park System from an entry point within the United States.</text></subparagraph><subparagraph id="ida3ba98af71294c6f9f60dce48a6670ba"><enum>(I)</enum><header>Disposition of proceeds</header><clause id="id47572f754a884c7fb14707a810db665b"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), any proceeds from a surcharge on nonresident visitors collected under this paragraph for each fiscal year shall be deposited in the National Parks and Public Land Legacy Restoration Fund established by section 200402(a) of title 54, United States Code.</text></clause><clause id="id8fe24ee97c1f49578c3e799834751f3a"><enum>(ii)</enum><header>Limitation</header><text>If the Secretary determines that the maximum amount described in section 200402(b)(2) of that title has been deposited in the National Parks and Public Land Legacy Restoration Fund for the applicable fiscal year, any proceeds from a surcharge on nonresident visitors collected under this paragraph for the remainder of the fiscal year shall be retained by the unit of the National Park System at which the surcharge was collected.</text></clause></subparagraph><subparagraph id="id4fd0edcc85fc49978765c3f92671e2ae"><enum>(J)</enum><header>Administrative costs</header><text>Amounts collected as recreation fees under other provisions of this title may be used to pay the administrative costs of carrying out this paragraph.</text></subparagraph><subparagraph id="id92d19523a38245ce96aaf888eff35812"><enum>(K)</enum><header>Effect</header><clause id="id7b9e8215cf3047f3bf4b5e46a58ab719"><enum>(i)</enum><header>In general</header><text>A surcharge established under subparagraph (B) shall be in addition to the applicable entrance fee charged at the unit of the National Park System.</text></clause><clause id="id6360bf46969044228931a8a71406d509"><enum>(ii)</enum><header>Requirement</header><text>Any nonresident visitor charged a surcharge under subparagraph (B) shall also be charged the applicable entrance fee charged at the unit of the National Park System.</text></clause></subparagraph><subparagraph id="idbfd67ace1f9e4303b3f20ef35f16a543"><enum>(L)</enum><header>Expiration</header><text>Any surcharge established under subparagraph (B) shall expire on September 30, 2031.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id156b5b1cf4194d4b9846881ccec1fa00" commented="no" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>4.</enum><header>Licensing intellectual property</header><subsection id="idf67f9893d4a34df6bc881c49b14630ab" commented="no"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idae3c79cb72c543c59f9d347795994ced" commented="no"><enum>(1)</enum><header>Department</header><text>The term <term>Department</term> means the Department of the Interior, including any bureau, office, and agency of the Department of the Interior.</text></paragraph><paragraph id="id0cc7a4c2e77e48bea38ef702a6e52625" commented="no"><enum>(2)</enum><header>Intellectual property</header><text>The term <term>intellectual property</term> means—</text><subparagraph id="id8572c0180d28460f86c9da86d0da1a8c" commented="no"><enum>(A)</enum><text>any trademark, service mark, certification mark, or collective mark (as those terms are defined in section 45 of the Act entitled <quote>An Act to provide for the registration and protection of trademarks used in commerce, to carry out the provisions of certain international conventions, and for other purposes</quote>, approved July 5, 1946 (commonly known as the <quote>Trademark Act of 1946</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/15/1127">15 U.S.C. 1127</external-xref>));</text></subparagraph><subparagraph id="id80678f5423e844fe90313c8c9ab9cb38" commented="no"><enum>(B)</enum><text>any work of authorship in which copyright subsists, as described in section 102 of title 17, United States Code;</text></subparagraph><subparagraph id="ide9d346d853e645109a3b38dedf6253bf" commented="no"><enum>(C)</enum><text>any trade secret (as defined in section 1839 of title 18, United States Code); and</text></subparagraph><subparagraph id="id0a27b4190b5147339aef654b9dcccfa0" commented="no"><enum>(D)</enum><text>any other similar intellectual property rights owned or controlled by the Secretary.</text></subparagraph></paragraph><paragraph id="ida5613912d7ad4398abd428407bd1e8c8" commented="no"><enum>(3)</enum><header>Qualifying entity</header><text>The term <term>qualifying entity</term> means any Federal agency, State, local government, or Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)), public or private agency, organization, institution, corporation, individual, or other entity that is determined by the Secretary to be qualified in accordance with criteria developed by the Secretary.</text></paragraph><paragraph id="ida74c9d03ff38436f8de2202a62ae2dbd" commented="no"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></subsection><subsection id="idf36f3008f70b450cb6eff47f6fcba912" commented="no"><enum>(b)</enum><header>Authority</header><text>The Secretary may—</text><paragraph id="id2a3d1702bca444bdbb9c9eb35873eda8" commented="no"><enum>(1)</enum><text>enter into an agreement to license to any qualifying entity any intellectual property owned or controlled by the Secretary; and</text></paragraph><paragraph id="id1558e49a791c4015bc88d51717d47b2c" commented="no"><enum>(2)</enum><text>retain and expend fees received from licensing under paragraph (1) in accordance with this section.</text></paragraph></subsection><subsection id="idcefe6aff8871473d8346ef21e4084d76" commented="no"><enum>(c)</enum><header>Designated marks</header><text>The Secretary shall designate any trademarks, service marks, certification marks, or collective marks with respect to which the Secretary shall exercise the authority under this section.</text></subsection><subsection id="idcb4f7b68093941a6937efe395025fd38" commented="no"><enum>(d)</enum><header>Licenses for qualifying entities</header><paragraph id="id37c193d923dc4f458ba3f3221e479d04" commented="no"><enum>(1)</enum><header>Fees</header><text>The fee for a license subject to an agreement entered into under this section, as determined by the Secretary, shall be not less than the amount needed to recover all costs incurred by the Secretary in processing and issuing the license.</text></paragraph><paragraph id="id0c12c788771f473d9e163f13a33e87e7" commented="no"><enum>(2)</enum><header>Limitation</header><text>A license subject to an agreement with a qualifying entity entered into under this section shall provide that the license may not be transferred, sold, or relicensed by the qualifying entity, unless otherwise authorized by the Secretary.</text></paragraph></subsection><subsection id="idb11e31d624aa4926bc56d9b7d3634487" commented="no"><enum>(e)</enum><header>Use of fees</header><paragraph id="id2f4805ca863c4915929de963ab1d9b74" commented="no"><enum>(1)</enum><header>Availability</header><text>Notwithstanding any other provision of law, the Secretary shall use fees retained through an agreement under this section without further appropriation for a fiscal year.</text></paragraph><paragraph id="idd24c471d9ee5454cabaa1251a937bde8" commented="no"><enum>(2)</enum><header>Use; deposit</header><text>The proceeds collected under this section for each fiscal year shall be used in the following order of priority:</text><subparagraph id="ida9e2234dcfdd4b03a948e1fa7a042f79"><enum>(A)</enum><text>For the payment of the following costs incurred by the Secretary:</text><clause id="idd1a49f0f55b844fcaa18f1671665e1d8" commented="no"><enum>(i)</enum><text>The costs associated with the development, protection, enforcement, licensing, marketing, and management of intellectual property registrations under this section.</text></clause><clause id="idc7f6c3201c7e488aaa3384468833144a" commented="no"><enum>(ii)</enum><text>The costs of operating activities and programs under this section.</text></clause></subparagraph><subparagraph id="id8a88cd83ff194b1b9374986c12945ba5"><enum>(B)</enum><text>For deposit in the National Parks and Public Land Legacy Restoration Fund established by section 200402(a) of title 54, United States Code, subject to paragraph (3).</text></subparagraph></paragraph><paragraph id="id59f74b2618b347debec213ec858e948d" commented="no"><enum>(3)</enum><header>Limitation</header><text>If the Secretary determines that the maximum amount described in section 200402(b)(2) of title 54, United States Code, has been deposited in the National Parks and Public Land Legacy Restoration Fund for the applicable fiscal year, the amounts that would otherwise be deposited in the National Parks and Public Land Legacy Restoration Fund under subparagraph (B) of paragraph (2) shall be used for the purposes described in subparagraph (A) of that paragraph for the remainder of that fiscal year.</text></paragraph></subsection><subsection id="id722ce487763040748aa5d3aebc15ff4b" commented="no"><enum>(f)</enum><header>Effect on other agreements</header><paragraph id="id5651517c101c423382311e948c27252c" commented="no"><enum>(1)</enum><header>In general</header><text>Nothing in this section restricts the Secretary from incorporating licenses of intellectual property into agreements (including contracts, concessions, or cooperative arrangements) not covered by this section, as appropriate and consistent with applicable laws.</text></paragraph><paragraph id="id2891ef60c03e4612853408b1de4f5fff" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Licenses and fee structures</header><text>The requirements of this section shall not
