<congress display="yes">119th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 1199</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To extend the statute of limitations for fraud under certain pandemic programs, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section id="H0F71182CFF2E4CE8AE78FF4DFBD43656" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>SBA Fraud Enforcement Extension Act</short-title></quote>.</text></section><section id="H91BC95A10163440595343EF6CC977F95"><enum>2.</enum><header>Statute of limitations for certain programs</header><subsection commented="no" display-inline="no-display-inline" id="H6CC7C1EB14E944D4ACBB704F5C9F96D8"><enum>(a)</enum><header>Shuttered venue operators</header><text>Section 324 of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1EC7EC66A7F54133B95582EBFF355B51"><subsection id="H56B4AEB95EC34D42BCC2484FEAFD96A2"><enum>(g)</enum><header>Statute of limitations</header><text>Notwithstanding any other provision of law, any criminal prosecution or civil enforcement action for a violation of, or conspiracy to violate, section 371, 641, 1001, 1028A, 1029, 1341, 1343, 1349, 1956, or 1957 of title 18, United States Code, or section 3729 or 3802 of title 31, United States Code, with respect to any grant for shuttered venue operators under this section shall be filed not later than 10 years after the date of the violation or conspiracy.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H7EAE0EE090B04AA49A5F4E508676061F"><enum>(b)</enum><header>Restaurant revitalization</header><text>Section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9538BCEF07AD41D59EFEFABD45074A53"><subsection id="HC0590BBDC20541E4A6887A3E3ABBAB6C"><enum>(d)</enum><header>Statute of limitations</header><text>Notwithstanding any other provision of law, any criminal prosecution or civil enforcement action for a violation of, or conspiracy to violate, section 371, 641, 1001, 1028A, 1029, 1341, 1343, 1349, 1956, or 1957 of title 18, United States Code, or section 3729 or 3802 of title 31, United States Code, with respect to any restaurant revitalization grant under this section shall be filed not later than 10 years after the date of the violation or conspiracy.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id0349d32586644163b1d67757d956ed9b"><enum>(c)</enum><header>Requirement</header><text>Not later than 90 days after the date of enactment of this Act, and every 90 days thereafter until the date that is 5 years after the date of enactment of this Act, the Attorney General shall submit to Congress a report on activities of the Department of Justice relating to the shuttered venue operators program under section 324 of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>) and the restaurant revitalization program under section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>), which shall include—</text><paragraph id="id8e53aa48a49c4510b36ed81b4d055304"><enum>(1)</enum><text>the total number of investigations initiated, the total number of prosecutions initiated, the total dollar amount recovered by prosecutions, and the total number of referrals and source of such referrals; and</text></paragraph><paragraph id="idab9f61619e0e47c8a6c0f39f83c38d78"><enum>(2)</enum><text>with respect to such programs—</text><subparagraph id="ida735a06d910d4a5db78eaa1fa63ca737"><enum>(A)</enum><text>the number of investigations initiated, the number of prosecutions initiated, and the disposition of each prosecution;</text></subparagraph><subparagraph id="idc5d78c27c15045a29fa2f6f268e70b73"><enum>(B)</enum><text>the number of prosecutions and the number of investigations of applicants of such programs in each State and territory based on the address listed on the application of the entity that is the subject of an investigation or prosecution;</text></subparagraph><subparagraph id="id661142f5051746e9b167a9f1c729023d"><enum>(C)</enum><text>the number of referrals—</text><clause id="id28033b01bc9c4df0ab96ce414b7f4cb5"><enum>(i)</enum><text>from the Department of Justice; and</text></clause><clause id="idec1b73117da445729c68a40296f2fc4b"><enum>(ii)</enum><text>from sources other than the Department of Justice, such as the Inspector General of another agency; and</text></clause></subparagraph><subparagraph id="idb7b333ecf5974cd8827ba14fd8acce4b"><enum>(D)</enum><text>the disposition of each referral described in subparagraph (C), specifically whether the referral resulted in prosecution or declination.</text></subparagraph></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20260429" chamber="Senate">Passed the Senate April 29, 2026.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
