purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="idbd99e624-0fbe-462f-b45d-05314a254f81" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wastewater Infrastructure Pollution Prevention and Environmental Safety Act</short-title></quote> or the <quote><short-title>WIPPES Act</short-title></quote>.</text></section><section id="id4de505f7-1fe3-4bb9-95bf-458bc8434981" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline"><quote>Do not flush</quote> labeling</header><subsection id="idaf31eceb-33bf-4690-8a91-16b563baa048" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A covered entity shall label a covered product with the label notice and symbol, in accordance with subsections (b) and (c).</text></subsection><subsection id="idf7b21d9d-26e0-44d4-8078-001e2aecd413" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><paragraph id="id416d1591-f4ee-4889-a28f-b49b1a589ceb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Cylindrical packaging</header><text display-inline="yes-display-inline">In the case of a covered product sold in cylindrical or near-cylindrical packaging, and intended to dispense individual wipes—</text><subparagraph id="id418acada-ae6c-4a1f-b38a-1f2d351b2b33" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the symbol and label notice shall be displayed on the principal display panel in a clear and conspicuous location reasonably visible to the user each time a wipe is dispensed; or</text></subparagraph><subparagraph id="id69818cf0-c965-4029-8393-e72bbe23b671" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the symbol shall be displayed on the principal display panel and the label notice, or a combination of the label notice and symbol, shall be displayed on a flip lid in a manner that covers at least 8 percent of the surface area of the flip lid.</text></subparagraph></paragraph><paragraph id="idb0f008fc-2d37-4f83-90d1-c0fb69f5d707" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Flexible film packaging</header><text display-inline="yes-display-inline">In the case of a covered product sold in flexible film packaging, and intended to dispense individual wipes—</text><subparagraph id="ida7524def-1e37-44fa-a60c-ff195ce4b775" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the symbol shall be displayed on the principal display panel and, if the principal display panel is not on the dispensing side of the packaging, on the dispensing side panel; and</text></subparagraph><subparagraph id="idf330861d-22f4-40b3-abb3-f64e51f3becb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the label notice shall be displayed on either the principal display panel or the dispensing side panel, in a clear and conspicuous location reasonably visible to the user each time a wipe is dispensed.</text></subparagraph></paragraph><paragraph id="id07f5c101-dffe-425e-b1b5-ff4368a3924a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Rigid packaging</header><text display-inline="yes-display-inline">In the case of a covered product sold in a refillable tub or other rigid packaging that may be reused by a customer, and that is intended to dispense individual wipes, the symbol and label notice shall be displayed on the principal display panel in a clear and conspicuous location reasonably visible to the user each time a wipe is dispensed.</text></paragraph><paragraph id="id5094e5c7-a2af-49c9-9f84-7fcc5324fcdd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Packaging not intended to dispense individual wipes</header><text display-inline="yes-display-inline">In the case of a covered product sold in packaging that is not intended to dispense individual wipes, the symbol and label notice shall be displayed on the principal display panel in a clear and conspicuous location reasonably visible to the user of the covered product.</text></paragraph><paragraph id="id89d6ad49-4b7b-40b8-8467-f0ef87b639e0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Bulk packaging</header><subparagraph id="id639a7b16-4002-4f76-a79e-bbd358b6d9b0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In the case of a covered product sold in bulk at retail, the symbol and label notice shall be displayed on both the outer packaging visible at retail and the individual packaging contained within the outer packaging.</text></subparagraph><subparagraph id="id22fd145b-af0f-4023-a12a-8e9d0b46f551" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Exemption</header><text display-inline="yes-display-inline">The following shall be exempt from the requirements of subparagraph (A):</text><clause id="iddea22091-f53b-4fec-99a4-7c2f359dfaf1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">Individually packaged covered products that are contained within outer packaging, are not intended to dispense individual wipes, and have no retail labeling.</text></clause><clause id="ida2684b47-84ff-4d3a-8ba0-e7e00912dfce" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">Outer packaging that does not obscure the symbol and label notice on individually packaged covered products contained within.</text></clause></subparagraph></paragraph><paragraph id="id1fc83c48-1450-45ed-bfcd-7b128beec5ce" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Packaging of combined products</header><subparagraph id="id9b375b3a-685b-4843-8f47-902f3eb7c5e3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Outer packaging</header><text display-inline="yes-display-inline">The outer packaging of combined products shall be exempt from the symbol and label notice requirements of subsection (a).</text></subparagraph><subparagraph id="id37cc3650-4ce0-40bc-bcad-8be464b387cf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Packages less than 3 by 3 inches</header><text display-inline="yes-display-inline">In the case of a covered product in packaging smaller than 3 inches by 3 inches (such as an individually packaged wipe in tear-top packaging) and sold as part of a combined product, if a symbol and label notice are placed in a prominent location reasonably visible to the user of the covered product, such covered product shall be considered to be labeled clearly and conspicuously.</text></subparagraph></paragraph></subsection><subsection id="id72bcdedd-070a-4666-ab2d-a9c9c6404c69" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Reasonable visibility of symbol and label notice</header><paragraph id="id8fab7435-6ffb-4a65-a45b-08939efec346" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A covered entity shall ensure that—</text><subparagraph display-inline="no-display-inline" id="idac1e4460-a474-4f86-aa9e-cbe0770f370e" changed="not-changed" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">packaging seams or folds or other packaging design elements do not obscure the symbol or label notice;</text></subparagraph><subparagraph id="id518c7505-a766-4437-8511-679f44f0b773" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the symbol and label notice are each equal in size to at least 2 percent of the surface area of the principal display panel; and</text></subparagraph><subparagraph id="ide9af8b3d-278f-4df0-b7d3-25a0b269ca82" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the symbol and label notice have high contrast with the immediate background of the packaging so that such symbol and label notice may be seen and read by an ordinary individual under customary conditions of purchase and use.</text></subparagraph></paragraph><paragraph id="idc2ad04b2-988e-412e-af61-5fac76d330b5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Proximity of symbol and label notice</header><text display-inline="yes-display-inline">A covered entity may display a symbol and label notice either adjacent to or on separate areas of the principal display panel.</text></paragraph><paragraph id="iddd4cfae7-48db-43fc-902d-3f7600bd74c7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">Paragraph (1)(C) does not apply to an embossed symbol or label notice on the flip lid of a covered product sold in cylindrical or near-cylindrical packaging.</text></paragraph></subsection><subsection id="id82b8d782-e9ef-4ab7-a403-af8e57cb2897" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Representations of flushability</header><text display-inline="yes-display-inline">With respect to a covered product, a covered entity may not make any express or implied representation that such covered product can or should be flushed.</text></subsection><subsection id="id465ac4d5-00be-465d-aff1-f490e49fa5b8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Enforcement by Federal Trade Commission</header><paragraph id="idbb7d137a-8d93-4df9-8ea4-2178b220e668" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Unfair or deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of this section shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>). </text></paragraph><paragraph id="id645d794a-3146-4cb2-8422-530d55b5a695" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Powers of Commission</header><text display-inline="yes-display-inline">The Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id89207d94d3eb47fd8dd5145f41dcd510" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Privileges and immunities</header><text display-inline="yes-display-inline">Any person who violates this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (15 U.S.C. et seq.).</text></paragraph><paragraph id="id28991cb7-3f17-4243-abe3-c682d7a81fcd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Authority preserved</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to limit the authority of the Commission under any other provision of law.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id37eeffd68c2941de8a08ef716ab4a980" changed="not-changed"><enum>(f)</enum><header display-inline="yes-display-inline">Commission guidance</header><text display-inline="yes-display-inline"> Not later than 180 days after the date of enactment of this Act, the Commission, in consultation with the Administrator of the Environmental Protection Agency, the Commissioner of Food and Drugs, the Consumer Product Safety Commission, and any other agency determined appropriate by the Commission, shall issue guidance to assist covered entities in complying with the requirements of this section. </text></subsection><subsection id="id6285b055dc444798b7a972e9538a4f56" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">Limitation on Commission guidance</header><paragraph commented="no" display-inline="no-display-inline" id="id3e66d73fdd834be68987805539f73bb3" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">No guidance issued by the Commission with respect to this section shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf0e8bb2722054d119fc6e5e9231fc1d5" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">confer any rights on any person, State, or locality; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida06a6c5b1df64c79b5e46dca9928cab4" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">bind the Commission or any person to the approach recommended in such guidance. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id021ee1d4950d415c8605b10a17c7f748" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Specific violations</header><text display-inline="yes-display-inline">In any enforcement action brought under this section, the Commission shall allege a specific violation of a provision of this section. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc15fa6656f9740feab3e41997bca0b70" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">No enforcement actions based on guidance</header><text display-inline="yes-display-inline">The Commission may not base an enforcement action on, or execute a consent order based on, practices that are alleged to be inconsistent with any guidance issued under this Act, unless the practices allegedly violate this section. </text></paragraph></subsection><subsection id="id52f57703-3f51-4eaa-918b-db9be3d73b03" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(h)</enum><header display-inline="yes-display-inline">Preemption of State laws</header><text display-inline="yes-display-inline">No State or political subdivision of a State may directly or indirectly establish or continue in effect, under any authority, requirements with respect to the <quote>Do Not Flush</quote> labeling of covered products that are not identical to the requirements of this section.</text></subsection><subsection id="id29cb2a24-124a-4843-a4f8-f1503f4f67a8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id40157724-96e4-42f9-bd8a-ba23f4cb7e1a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Combined product</header><text display-inline="yes-display-inline">The term <quote>combined product</quote> means two or more products sold in shared retail packaging, of which—</text><subparagraph id="ided17cc98-a757-4a59-b4d0-bc73cf837eeb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">at least one of the products is a covered product; and</text></subparagraph><subparagraph id="id99b04c4a-e397-4712-9a2c-dce2f55b4606" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">at least one of the products is another consumer product intended to be used in combination with such covered product.</text></subparagraph></paragraph><paragraph id="idebfba35d-b852-440c-90ef-e79be9822785" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Commission</header><text display-inline="yes-display-inline">The term <quote>Commission</quote> means the Federal Trade Commission.</text></paragraph><paragraph id="id87373960-7957-4637-955a-290aee56f46c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Covered entity</header><text display-inline="yes-display-inline">The term <quote>covered entity</quote> means a manufacturer, wholesaler, supplier, individual or group of individuals, or retailer that is responsible for the labeling or retail packaging of a covered product that is sold or offered for retail sale within the United States.</text></paragraph><paragraph id="id141da5e3-0191-4217-bf9f-0f39a17c0b81" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Covered product</header><subparagraph id="id26fd935a-48fa-4fda-b9e9-2e2fc3f7b0be" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <quote>covered product</quote> means a premoistened, nonwoven disposable wipe sold or offered for retail sale—</text><clause id="idf892c161-9143-4b97-889b-808ba2f30ed0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">that is marketed as a baby wipe or diapering wipe; or</text></clause><clause id="id8365e1c8-a272-42ef-9781-69f9125d7b79" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">that is a household or personal care wipe (including a wipe described in subparagraph (B)) that—</text><subclause id="id419e4cbb-ea7b-4b61-98ea-7ef90b507a7e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">is composed entirely, or in part, of petrochemical-derived fibers; and</text></subclause><subclause id="idb5d7f590-8dbf-45ae-b3fe-e74176492693" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">has significant potential to be flushed.</text></subclause></clause></subparagraph><subparagraph id="idaf49600c-e79d-49f9-865d-4fd773826097" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The wipes described in this subparagraph are—</text><clause id="id81f447f9-5142-4aa3-9e40-23c43157ebc4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">antibacterial wipes and disinfecting wipes;</text></clause><clause id="id9f53e8e2-4adc-47f8-af94-fcc5beaea44b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">wipes intended for general purpose cleaning or bathroom cleaning, including toilet cleaning and hard surface cleaning; and</text></clause><clause id="idce2e1d27-7ede-4c30-a839-3f82a5c80d7c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">wipes intended for personal care use on the body, including hand sanitizing, makeup removal, feminine hygiene, adult hygiene (including incontinence hygiene), and body cleansing.</text></clause></subparagraph></paragraph><paragraph id="ida6c87cf5-54b0-45c4-9317-7816fe01e41e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">High contrast</header><text display-inline="yes-display-inline">The term <quote>high contrast</quote> means, with respect to the symbol or label notice, that such symbol or label notice—</text><subparagraph id="id1af5bb1a-a85a-4725-8c66-f50eb0b7ff83" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">is either light on a solid dark background or dark on a solid light background; and</text></subparagraph><subparagraph id="id204ed6be-b223-45a1-8758-8bd3a9db5970" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">has a contrast percentage of at least 70 percent between such symbol or label notice and the background, using the formula (B1–B2)/B1 * 100 = contrast percentage, where B1 is the light reflectance value of the lighter area and B2 is the light reflectance value of the darker area.</text></subparagraph></paragraph><paragraph id="idf76f6508-7962-4298-950b-f46368090820" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Label notice</header><text display-inline="yes-display-inline">The term <quote>label notice</quote> means the written phrase <quote>Do Not Flush</quote>.</text></paragraph><paragraph id="id69c9dca5-f1ce-46b2-a9c4-1aa1b96f7c57" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Principal display panel</header><text display-inline="yes-display-inline">The term <quote>principal display panel</quote> means the side of a product package that is most likely to be displayed, presented, or shown under customary conditions of display for retail sale, and—</text><subparagraph id="id201f23ed-473b-4945-91bd-406aae52c527" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of a cylindrical or near-cylindrical package, the surface area of which constitutes at least 40 percent of the product package, as measured by multiplying the height by the circumference of the package; or</text></subparagraph><subparagraph id="ida34d1eee-81e1-49d3-b839-bf0645372ad1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a flexible film package in which a rectangular prism or near-rectangular prism stack of wipes is housed within the film, the surface area of which is measured by multiplying the length by the width of the side of the package when the flexible packaging film is pressed flat against the stack of wipes on all sides of the stack.</text></subparagraph></paragraph><paragraph commented="no" id="idf9edd356-f722-4c28-beb8-27da050d8833" changed="not-changed" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means each State of the United States, the District of Columbia, and each commonwealth, territory, or possession of the United States.</text></paragraph><paragraph id="id2a22097a-a3fd-4893-8106-b564aef52c30"
