display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Historic Greenwood District—Black Wall Street National Monument Establishment Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id53ba8ba3-eb35-4519-8f08-bfcb589b46f4" changed="not-changed"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idac97be09-9953-487c-a4ae-fb404d788538" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Historic Greenwood District—Black Wall Street National Monument Advisory Commission established by section 5(a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcf88891a-aa66-4c7f-bd50-34acecac2539" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Map</header><text display-inline="yes-display-inline">The term <term>Map</term> means the map entitled <quote>Greenwood Historic District—Black Wall Street National Monument, Proposed Boundary</quote>, numbered 196/188,275, and dated August 2024.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95c3245e-c5a0-4395-a05f-7c9b1d8bb900" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">National monument</header><text display-inline="yes-display-inline">The term <term>National Monument</term> means the Historic Greenwood District—Black Wall Street National Monument established by section 3(a). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3674fe4d-9ddf-4dea-b611-639a76c68ba7" changed="not-changed"><enum>(4)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id7d31778f-c520-4f66-9a94-b1b3d89f325e" changed="not-changed"><enum>3.</enum><header display-inline="yes-display-inline">Establishment of Historic Greenwood District—Black Wall Street National Monument</header><subsection commented="no" display-inline="no-display-inline" id="ide6f89796-e556-412c-a547-89afa2eb4d4c" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><paragraph commented="no" display-inline="no-display-inline" id="id7a85ec02a254494d86dfc09b62b5faf2" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), there is established the Historic Greenwood District—Black Wall Street National Monument in the State of Oklahoma as a unit of the National Park System to preserve, protect, and interpret for the benefit of present and future generations resources associated with the Historic Greenwood District, Black Wall Street, and the Tulsa Race Massacre of 1921 and the role of each in the history of the State of Oklahoma and the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida2e7e5848ca749b3a58dde8d70c0190e" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Conditions of establishment</header><subparagraph commented="no" display-inline="no-display-inline" id="id308ae4647377420f87480ff6cec4fdff" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">Determination by the secretary</header><text display-inline="yes-display-inline">The National Monument shall be established on the date the Secretary determines that a sufficient quantity of land or interests in land has been acquired to constitute a manageable park unit.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4be5650b718a491ca429214444c516e1" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Notice</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which the Secretary makes a determination under subparagraph (A), the Secretary shall publish in the Federal Register notice of the establishment of the National Monument. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id81beb293-6339-4c1c-9a60-71bed9739490" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Boundary</header><text display-inline="yes-display-inline">The boundary of the National Monument shall be as generally depicted on the Map.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id36bd53568fec450ebbcd6f9d2ae72fab" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Map</header><text display-inline="yes-display-inline">The Map shall be on file and available for public inspection in the appropriate offices of the National Park Service.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id16163334e56f4b3abb9b07a78b2277ef" changed="not-changed"><enum>(d)</enum><header display-inline="yes-display-inline">Acquisition authority</header><text display-inline="yes-display-inline">The Secretary may acquire any land or interest in land located within the boundary of the National Monument by—</text><paragraph commented="no" display-inline="no-display-inline" id="id3d15e743479b4cc6b4d1f3786ec42461" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">donation;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id29e4c0173b2a4a549d6a505110f88f6f" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">purchase from a willing seller with donated or appropriated funds; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida00732acc23646679a36ceb59aec7489" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">exchange.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id40608951ee084cb9991df5887e938d22" changed="not-changed"><enum>(e)</enum><header display-inline="yes-display-inline">Agreements</header><paragraph commented="no" display-inline="no-display-inline" id="idfaf1ac31db9e45f89cfd6e7c322d0eb2" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may enter into cooperative agreements, as appropriate, with public or private entities to provide and facilitate, within or outside the boundary of the National Monument, interpretive and educational services, administrative support, and technical assistance relating to the National Monument.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id99574ecb92e5436e94f0e7abd5e3b702" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Marking and interpretation of significant historic or cultural resources</header><text display-inline="yes-display-inline">The Secretary may enter into agreements to mark or interpret significant historic or cultural resources or locations on land within the boundary of the National Monument.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb420408f83024996aac56004a68fbbaf" changed="not-changed"><enum>(f)</enum><header display-inline="yes-display-inline">Private property</header><text display-inline="yes-display-inline">Nothing in this Act affects the rights of an owner of private property within or adjacent to the National Monument.</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id16b45e6c73c04047be44f1ace3e4943d" changed="not-changed"><enum>4.</enum><header display-inline="yes-display-inline">Administration</header><subsection commented="no" display-inline="no-display-inline" id="id5ed09fb12a6540e0b55300e43b1ef8e8" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Administration by Secretary</header><text display-inline="yes-display-inline">The Secretary shall administer the National Monument in accordance with—</text><paragraph commented="no" display-inline="no-display-inline" id="id984dcf636f264c5f98c1452414e54739" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaa841815d7dc426a818d6db80113c787" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">the laws generally applicable to units of the National Park System.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3410e034de4a44c78003d485c0f087f3" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Management plan</header><paragraph commented="no" display-inline="no-display-inline" id="idadcdec404432444198cea798bc2533ae" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date on which funds are first made available to carry out this Act, the Secretary shall prepare a management plan for the National Monument in accordance with section 100502 of title 54, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida76e706ed6554831b55ce35ae5304eba" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The Secretary shall consult with the Commission on the preparation of the management plan under paragraph (1).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ida9b7b488cddb411ebc55d1438b9cb0db" changed="not-changed"><enum>5.</enum><header display-inline="yes-display-inline">Establishment of Historic Greenwood District—Black Wall Street National Monument Advisory Commission</header><subsection commented="no" display-inline="no-display-inline" id="id1f346a5a5ba54e7387c9fea08e65b5e2" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established an advisory commission, to be known as the <quote>Historic Greenwood District—Black Wall Street National Monument Advisory Commission</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id15c9950c78e04068a33adc1e2829a6a1" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Duty</header><text display-inline="yes-display-inline">The Commission shall advise the Secretary on matters relating to the development and management of the National Monument, including the construction of visitor service facilities and infrastructure.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9b2adc09fa7e4857bee90e69db1f5136" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Membership</header><paragraph commented="no" display-inline="no-display-inline" id="idfbb55b0c8f2e4a878ab7511c5c242255" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The Commission shall be composed of 11 members, to be appointed by the Secretary, of whom—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida308f50ffb994dee8ddf335b46f8d129" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">7 members shall be descendants of individuals who lived or worked in the Greenwood District of Tulsa in 1921, to be appointed after consideration of recommendations from interested organizations or individuals;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf961718e62574a1b8f41aebfa657ef24" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">3 members shall have experience in the field of historic preservation or the purposes for which the National Monument was established; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7cd00e86914840dfb8244942d1bd770b" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">1 member shall be appointed after consideration of recommendations submitted by the Mayor of Tulsa.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfaa4aae766fd44e99f825f46b2b63b1a" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Terms</header><text display-inline="yes-display-inline">A member of the Commission shall be appointed for a term of 5 years.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd7da7e1b608841d9b7ba5aa8fe9d4bca" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Vacancies</header><text display-inline="yes-display-inline">Any vacancy on the Commission shall be filled in the same manner in which the original appointment was made.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddd0ed089dc8d4e2aa258ca3c251a0b1e" changed="not-changed"><enum>(4)</enum><header display-inline="yes-display-inline">Successors</header><text display-inline="yes-display-inline">Notwithstanding the expiration of a 5-year term of a member of the Commission, a member of the Commission may continue to serve on the Commission until the date on which—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2210bd6b7b7542feaae56e672a53bf00" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the member is reappointed by the Secretary; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5206c2e325754c74b69ee56468bdcca9" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">a successor is appointed by the Secretary.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id24cb6c6214754088bf9774a1fbb2f845" changed="not-changed"><enum>(d)</enum><header display-inline="yes-display-inline">Chair; bylaws</header><text display-inline="yes-display-inline">The Commission shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idf548941c94ca46e3befbbb1cc7c1b0dd" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">have a Chair, who shall be elected by the members of the Commission; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2745f5c3530b4121a55943ab0876f147" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">adopt such bylaws as the Commission considers necessary to carry out the functions of the Commission under this Act.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida4dba849f1e5446c934a69b812e52324" changed="not-changed"><enum>(e)</enum><header display-inline="yes-display-inline">Meetings</header><text display-inline="yes-display-inline">The Commission shall meet at the call of—</text><paragraph commented="no" display-inline="no-display-inline" id="id180c7738615d46baa2c734b4b17e1852" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the Chair; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9d8d25022ea1408da8a191eaf703a5c4" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">a majority of the members of the Commission.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0748e1bbfdb84c4dbc41c056c6201016" changed="not-changed"><enum>(f)</enum><header display-inline="yes-display-inline">Quorum</header><text display-inline="yes-display-inline">A majority of the members of the Commission shall constitute a quorum.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id086ca64b5b9c4ff199915a24e06fa1df" changed="not-changed"><enum>(g)</enum><header display-inline="yes-display-inline">Compensation</header><paragraph commented="no" display-inline="no-display-inline" id="id09e2c9387cb340699186ef90009cee47" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Members of the Commission shall serve without compensation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04abc3c73aaf41419e9074fe2ade7d93" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Travel expenses</header><text display-inline="yes-display-inline">Members of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from the home or regular place of business of the member in the performance of the duties of the Commission.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb698376afe0d4e7094fbd1595863169c" changed="not-changed"><enum>(h)</enum><header display-inline="yes-display-inline">Faca nonapplicability</header><text display-inline="yes-display-inline">Section 1013(b) of title 5, United States Code, shall not apply to the Commission.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id1417c9356032411fafc333d7d0a067bb" changed="not-changed"><enum>(i)</enum><header display-inline="yes-display-inline">Termination</header><text display-inline="yes-display-inline">The Commission shall terminate 10 years after the date on which the National Monument is established. </text></subsection></section></legis-body></bill>
