which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit Federal employees from organizing, joining, or participating in labor unions for purposes of collective bargaining or representation, and for other purposes.</official-title></form><legis-body><section id="idd29cd700db574c9dacb9c7d4d68827b9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Workforce Freedom Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id31cc4690135b4327865ae6af90f6a7d5" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id1b9e0d26690749bd986ce020bd17c08e"><enum>(1)</enum><header>Collective bargaining agreement</header><text>The term <term>collective bargaining agreement</term> means any written or oral agreement, memorandum of understanding, or contract between a Federal agency and a labor union that establishes terms or conditions of employment for Federal employees. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2958f06090734747ad8fecb27f8748b0"><enum>(2)</enum><header display-inline="yes-display-inline">Federal agency</header><text display-inline="yes-display-inline">The term <term>Federal agency</term> has the meaning given the term <term>agency</term> in section 551 of title 5, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94db721c32cd439eaff19e1af7b437c7"><enum>(3)</enum><header>Federal employee</header><text>The term <term>Federal employee</term> means an individual employed in or under a Federal agency.</text></paragraph><paragraph id="id46c228cb0b9c4e209a427153e228275b"><enum>(4)</enum><header>Labor union</header><text>The term <term>labor union</term> means any organization, association, agency, or Federal employee representation group that exists for the purpose, in whole or in part, of representing Federal employees in matters concerning grievances, labor disputes, wages, hours, benefits, or other terms and conditions of Federal employment. </text></paragraph></section><section id="S1"><enum>3.</enum><header>Prohibitions</header><subsection commented="no" display-inline="no-display-inline" id="id05e66b34db12468bab0e49bb5882280c"><enum>(a)</enum><header display-inline="yes-display-inline">Federal employees</header><text>No Federal employee may organize, join, or participate in a labor union for purposes of collective bargaining or representation. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id34392383129d4ef1bb2ac24ac9573e79"><enum>(b)</enum><header display-inline="yes-display-inline">Federal agencies</header><text>No Federal agency may recognize or engage in collective bargaining negotiations with a labor union.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="idb8cceadd08ef4e21882de2a11c8d1acb"><enum>4.</enum><header>Termination of collective bargaining agreements</header><subsection commented="no" display-inline="no-display-inline" id="id0cf3f5bc94c0404abb9eeb246b406626"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any collective bargaining agreement entered into before, on, or after the date of enactment of this Act is terminated.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id8cbeb87045344738a326540c64710d89"><enum>(b)</enum><header>Pending proceedings</header><text>Any arbitration, dispute resolution, or grievance proceeding filed before, on, or after the date of enactment of this Act that is based on an agreement described in subsection (a) shall be dismissed. </text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id476f9b7c6b8a44a7aca581e1af1033d2"><enum>5.</enum><header display-inline="yes-display-inline">Technical and conforming amendments</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/71">Chapter 71</external-xref> of title 5, United States Code, is repealed.</text></section></legis-body></bill>
