RES. 539</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250624">June 24, 2025</action-date><action-desc><sponsor name-id="H001077">Mr. Higgins of Louisiana</sponsor> submitted the following resolution; which was referred to the <committee-name committee-id="HSO00">Committee on Ethics</committee-name></action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Censuring Representative LaMonica McIver and removing her from the Committee on Homeland Security.</official-title></form><preamble><whereas><text>Whereas, on May 9, 2025, Representative McIver took part in an incident at the Delaney Hall Federal Immigration Facility located in Newark, New Jersey;</text></whereas><whereas><text>Whereas Representative LaMonica McIver of New Jersey, as a result of her actions on May 9, 2025, has been charged in a three-count indictment by a Federal grand jury for assaulting, resisting, impeding, and interfering with Federal officers;</text></whereas><whereas><text>Whereas Representative McIver is alleged to have challenged guidance from a Federal officer regarding access to the secure immigration detention facility;</text></whereas><whereas><text>Whereas Representative McIver is alleged to have interfered with Homeland Security Investigations (HSI) officials from making an arrest of an unauthorized visitor;</text></whereas><whereas><text>Whereas Representative McIver is alleged to have <quote>slammed her forearm into the body</quote> and <quote>restrain</quote> an HSI officer by <quote>forcibly grabbing him</quote>;</text></whereas><whereas><text>Whereas Representative McIver is alleged to have further interfered with an Immigration and Customs Enforcement Deportation Officer engaged in the performance of his official duties;</text></whereas><whereas><text>Whereas body camera and other video evidence support the allegations made within the Federal indictment;</text></whereas><whereas><text>Whereas such actions constitute a violation of section 111(a)(1) of title 18, United States Code, relating to assaulting, resisting, impeding, and interfering with a Federal officer;</text></whereas><whereas><text>Whereas clause 1 of rule XXIII of the Rules of the House of Representatives provides, <quote>A Member, Delegate, Resident Commissioner, officer, or employee of the House shall behave at all times in a manner that shall reflect creditably on the House.</quote>;</text></whereas><whereas><text>Whereas such actions of a Member of the House of Representatives do not reflect creditably on the House; and</text></whereas><whereas><text>Whereas Representative McIver’s continued service on the Committee on Homeland Security, which is charged with oversight of Federal immigration enforcement and other national security matters, would represent a significant conflict of interest: Now, therefore, be it</text></whereas></preamble><resolution-body style="OLC" id="H7297D264B0A045499F69E429551D03C6"><section display-inline="no-display-inline" section-type="section-one" id="H4B1455EE0D254B778FD5064FD953CA81"><enum>1.</enum><header>Censure of Representative LaMonica McIver</header><text display-inline="no-display-inline">Representative LaMonica McIver—</text><paragraph id="H666899AD95934E3C8FC27386FADE11AB"><enum>(1)</enum><text>is censured;</text></paragraph><paragraph id="H9F94E360B2014C848CBB75AA54C74CFD"><enum>(2)</enum><text display-inline="yes-display-inline">shall forthwith present herself in the well of the House of Representatives for the pronouncement of censure; and</text></paragraph><paragraph id="H3ECE3278F8D94F6395EC7A2D9E694913"><enum>(3)</enum><text display-inline="yes-display-inline">is censured with the public reading of this resolution by the Speaker.</text></paragraph></section><section id="H20B51E15DFE344909B0955E27558E403"><enum>2.</enum><header>Removal from Committee on Homeland Security</header><text display-inline="no-display-inline">The following named Member be, and is hereby, removed from the following standing committee of the House of Representatives:</text><committee-appointment-paragraph><header>Committee on Homeland Security:</header><text>Mrs. McIver.</text></committee-appointment-paragraph></section></resolution-body></resolution>
