<section id="H1FC659E8BC474299BA032429608D1F2C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food Allergy Safety, Treatment, Education, and Research Act of 2026</short-title></quote> or the <quote><short-title>FASTER Act of 2026</short-title></quote>.</text></section> <section id="HD3912720229E4EB9894FC87D78AD09F7"><enum>2.</enum><header>Inclusion of barley, rye, and oats as major food allergens</header> <subsection id="HFA97D2AC84FD4B7DA454CDDFB3D4DA0A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>) is amended—</text> 
<paragraph id="H777AEB204FFB4CA898C479C46E61DF30"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (qq)(1), by striking <quote>wheat</quote> and inserting <quote>gluten-containing grain</quote>; and</text></paragraph> <paragraph id="H874C2C0EB5A84F8F9AB5700AA2E3A0E8"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="H7D776CD9A78345E9ACA548EC5EE411B8"><enum>(tt)</enum><text>The term <term>gluten-containing grain</term> means one of the following grains, or a crossbred hybrid of such grains, such as triticale:</text> <paragraph id="H53D868B760834ABBBA4A63330527C019"><enum>(1)</enum><text>Wheat, including any species in the genus Triticum.</text></paragraph> 
<paragraph id="HF194F85DBDE64842B69FAA37097BB712"><enum>(2)</enum><text display-inline="yes-display-inline">Rye, including any species in the genus Secale.</text></paragraph> <paragraph id="H960026B7C4134EA7A31A0BAF1D7AD667"><enum>(3)</enum><text display-inline="yes-display-inline">Barley, including any species in the genus Hordeum.</text></paragraph> 
<paragraph id="H26F72B7F5B6F4540817556B6582ED04A"><enum>(4)</enum><text display-inline="yes-display-inline">Oats, including any species in the genus Avena sativa.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H15DF9F98CAE940D88EA45E941F56593C"><enum>(b)</enum><header>Revision of Manual of Compliance Policy Guides</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator of Food and Drugs shall revise each section related to major food allergens (as defined in section 201(qq) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321(qq)</external-xref>)) in the Manual of Compliance Policy Guides issued by the Food and Drug Administration for purposes of implementing the amendments made by this section.</text></subsection> 
<subsection id="H6156DEDBAC66479FAA1E523CC784F56C"><enum>(c)</enum><header>Applicability</header><text>The amendments made by this section shall apply to any food that is introduced or delivered for introduction into interstate commerce on or after the date that is 1 year after the date of enactment of this Act.</text></subsection></section> <section id="H1A7B0B0683974EEC91EBDCF98280D6B7"><enum>3.</enum><header>Report on Celiac disease</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report on—</text> 
<paragraph id="HB48FAA0291774B8C87C6658EA2077D3F"><enum>(1)</enum><text>surveillance of and collection of data on—</text> <subparagraph id="HD12F9E5ED3F8435AB523D97D44F6DACD"><enum>(A)</enum><text>the prevalence of Celiac disease in the United States; and</text></subparagraph> 
<subparagraph id="HA25681CA10914BAABEBD508E1E2AE181"><enum>(B)</enum><text>the severity of any allergic reaction with respect to a specific food or food ingredient in an individual with Celiac disease;</text></subparagraph></paragraph> <paragraph id="HEEABFC429C5C418FB2C25688C43B4BFF"><enum>(2)</enum><text display-inline="yes-display-inline">any gap in such surveillance or collection of data;</text></paragraph> 
<paragraph id="H5D45B1E533BB47EB8FFDD2C5F933C53B"><enum>(3)</enum><text>development of effective diagnostics for Celiac disease;</text></paragraph> <paragraph id="H5B3DFED8159E4A39B496324DCE5E6454"><enum>(4)</enum><text>any method for preventing the onset of Celiac disease;</text></paragraph> 
<paragraph id="H8C8625E7F26D4D38B3DDDF3AE19320B2"><enum>(5)</enum><text>any method for reducing any risk related to living with Celiac disease; and</text></paragraph> <paragraph id="HF6885BBD955E461C946B4CF28C6E76E7"><enum>(6)</enum><text>development of new therapeutics to prevent, treat, cure, or manage Celiac disease.</text> </paragraph></section>
