<section id="HEE7E783552994B99952E13F848BED9FF" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reimbursing Emergency Services for Critical Urgent Encounters Act of 2026</short-title></quote> or <quote><short-title>RESCUE Act of 2026</short-title></quote>.</text></section> 
<section id="H4D56CCF287E146BE807595D85374F869"><enum>2.</enum><header>Ambulance services payments</header><text display-inline="no-display-inline">Section 1834(l) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(l)</external-xref>) is amended—</text> <paragraph id="H4B1004C75CBE45E2ADC3C99991174841"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="HDA7C7D94F6B8420CA2FDE9B13174DF78"><enum>(A)</enum><text>by inserting <quote>, for years before 2027,</quote> after <quote>under this part through</quote>; and</text></subparagraph> <subparagraph id="H42557E77F9C14D01BFE67495F05D428F"><enum>(B)</enum><text>by inserting <quote>(and for each year, beginning with 2027, by regulation)</quote> after <quote>title 5, United States Code,</quote>;</text></subparagraph></paragraph> 
<paragraph id="H884920BDA89D4E9A831C930E200787A7"><enum>(2)</enum><text>in paragraph (2)(D), by inserting <quote>and, beginning for 2028, in accordance with paragraph (18), determine and apply updated payment amounts (as defined in subparagraph (A)(ii) of such paragraph) and the adjustments described in such paragraph</quote> after <quote>and other relevant factors</quote>;</text></paragraph> <paragraph id="HB57C92DB18334CB7889A54A0C4ADDC55"><enum>(3)</enum><text>in paragraph (3)—</text> 
<subparagraph id="H589E897E2C184EC0979C586961729547"><enum>(A)</enum><text>in subparagraph (B)—</text> <clause id="HAC13C4B2149245F5B9AD6EDFE2F67971"><enum>(i)</enum><text>by inserting <quote>(before 2028)</quote> after <quote>each subsequent year</quote>; and</text></clause> 
<clause id="HA1CA297B78A94EA9BBF319175C4CF3DB"><enum>(ii)</enum><text>by striking <quote>and</quote> after the semicolon;</text></clause></subparagraph> <subparagraph id="H1F523822C16246998D6528D357AA4F17"><enum>(B)</enum><text>in subparagraph (C)—</text> 
<clause id="H3242F950E8304DE49AD32E1469DF1C08"><enum>(i)</enum><text>by inserting <quote>(before 2028)</quote> after <quote>each subsequent year</quote>; and</text></clause> <clause id="H7B140A9736924C0B84D1ECEC4FCA6962"><enum>(ii)</enum><text>by striking the period at the end and inserting a semicolon; and</text></clause></subparagraph> 
<subparagraph id="H0FDF102995CA49209403E8D9FB86F7F8"><enum>(C)</enum><text>by inserting at the end the following:</text> <quoted-block id="HFEE0C91059AC48E1A3F6F3CA50EA6AFA" style="OLC"> <subparagraph id="HF08DBF96641E49DF9143F74D803BAF78"><enum>(D)</enum><text>for services furnished in 2028, substitute the updated payment amounts (as defined in paragraph (18)(A)(ii)) for such services as the payment amounts provided under the fee schedule for such services; and</text></subparagraph> 
<subparagraph id="H3067F347E65948699BF7E682E49B950C"><enum>(E)</enum><text>set the payment amounts provided under the fee schedule for services furnished in 2029 and each subsequent year at amounts equal to the payment amounts under the fee schedule for services furnished during the previous year, updated by the adjustments or increase applicable to such year in accordance with clause (ii) or (iii), respectively, of paragraph (18)(B).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H12613BFF53874B16A05C34883C9E591F"><enum>(4)</enum><text>in paragraph (4), by inserting <quote>including for purposes of carrying out the provisions of paragraph (18),</quote> after <quote>under this subsection,</quote>;</text></paragraph> 
<paragraph id="H4605E9C7C39D4CD69DD3DCD6EC213CBC"><enum>(5)</enum><text>in paragraph (15), by striking <quote>the preceding provisions of</quote> after <quote>amount otherwise applicable under</quote>;</text></paragraph> <paragraph id="HD932920B34E44C40BDC54BFC31B31E89"><enum>(6)</enum><text display-inline="yes-display-inline">in paragraph (17)—</text>
<subparagraph id="HABFE1340A48D41EAA47BBA48C4819E9A"><enum>(A)</enum><text>in subparagraph (D)—</text> <clause id="H126B902E327A4D79B70A55129BDB60C7"><enum>(i)</enum><text>in clause (i)—</text>
<subclause id="HB2DE4FA324BD498BA9EF7AF3CCA2C1C5"><enum>(I)</enum><text>by inserting <quote>(or, in the case of a provider or supplier of air ambulance services, beginning January 1 of the year subsequent to the first year for which such providers and suppliers are required to submit information pursuant to subparagraph (E)(ii)(II)),</quote> after <quote>Beginning January 1, 2022,</quote>;</text></subclause> <subclause id="H022D8F6AD9F248C4AF47AA7CEA8F6DF0"><enum>(II)</enum><text>by redesignating subclauses (I) and (II) as items (aa) and (bb), respectively, and moving the margin of each such item, as redesignated, 2 ems to the right;</text></subclause>
<subclause id="H5F74C18AAD1C41019DA637C82F003D3A"><enum>(III)</enum><text>by striking <quote>(as defined in clause (ii)) to a provider or supplier of ground ambulance services</quote> and inserting</text> <quoted-block id="HE63CFCB1319E4AACA0A66FD6FE3BB912" style="OLC" display-inline="yes-display-inline"><text display-inline="yes-display-inline">(as defined in clause (ii))—</text>
<subparagraph id="H69EFAB93D3114AA69AB1A28395A331AB"><enum>(I)</enum><text>to a provider or supplier of ground ambulance services</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause> <subclause id="H3EDCAFC6C225450F9FCCC232D14B11BF"><enum>(IV)</enum><text>by striking at the end the period and inserting <quote>; and</quote>; and</text></subclause>
<subclause id="H6DD9734D2A0B4E298389E8FE76DC1FA1"><enum>(V)</enum><text>by adding at the end the following new subclause:</text> <quoted-block id="H867211CB5C9E4F4D85A07C85F7A8D1B0" style="OLC"> <subclause id="H528622986BF14A2A82EC07FCDD3D3E6E"><enum>(II)</enum><text>to a provider or supplier of air ambulance services that—</text>
<item id="H980C0B975F784552827C84EA9A7F2EA4"><enum>(aa)</enum><text>is required to submit information for a year determined by the Secretary under subparagraph (E)(ii)(II); and</text></item> <item id="H47AD04BF45DD497B80709A0D767DC5B7"><enum>(bb)</enum><text>does not sufficiently submit such information, as determined by the Secretary.</text></item></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause>
<clause id="H09B09FD004FB41C8BFF7E1E601DE6445"><enum>(ii)</enum><text>in clause (ii)—</text> <subclause id="HD40012A132C34F21998CACA08A96CF86"><enum>(I)</enum><text>by inserting <quote>or a provider or supplier of air ambulance services</quote> after <quote>with respect to a provider or supplier of ground ambulance services</quote>;</text></subclause>
<subclause id="HB33DE46F06044197BC64B17A3CE55D21"><enum>(II)</enum><text>by striking <quote>made a determination under clause (i)(II)</quote> and inserting</text> <quoted-block id="HD949869FBA1F442ABC4E3C7A24AEE70F" style="OLC" display-inline="yes-display-inline"><text display-inline="yes-display-inline">made—</text>
<subparagraph id="H4E9A742A4B8B4C559475BE0CCF4F73FE"><enum>(I)</enum><text>in the case of a provider or supplier of ground ambulance services, a determination under clause (i)(I)(bb)</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause> <subclause id="H412798BF5B2245BCBB84F3F8687D6643"><enum>(III)</enum><text>by striking at the end the period and inserting <quote>; or</quote>; and</text></subclause>
<subclause id="HC93F3D4FFFB84802BA13B303BDA0BACB"><enum>(IV)</enum><text>by adding at the end the following new subclause:</text> <quoted-block id="H63397D4C1BA34AAB832DE63E509E5DAA" style="OLC"> <subclause id="HF47F433E80F94EB9A5616AD6BE8E5EE2"><enum>(II)</enum><text>in the case of a provider or supplier of air ambulance services, a determination under clause (i)(II)(bb) that the provider or supplier of air ambulance services failed to sufficiently submit information as described in clause (i)(II)(aa).</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause>
<clause id="H133CE9A08FFF4F56913B08B5F301C129"><enum>(iii)</enum><text>in clause (iii)—</text> <subclause id="HA34F2A02838A4750A5B29E34FEDB7F60"><enum>(I)</enum><text>by inserting <quote>of ground ambulance services or a provider or supplier of air ambulance services</quote> after <quote>may exempt a provider or supplier</quote>; and</text></subclause>
<subclause id="H5FA0A748A4504DF2B855DD5457E714A5"><enum>(II)</enum><text>by inserting <quote>or provider or supplier of air ambulance services, respectively,</quote> after <quote>ability of the provider or supplier of ground ambulance services</quote>; and</text></subclause></clause> <clause id="H7F745D8C959A4206A78AC89A5C6E51F0"><enum>(iv)</enum><text>in clause (iv), by inserting <quote>or air ambulance services</quote> after <quote>ground ambulance services</quote>;</text></clause></subparagraph>
<subparagraph id="HC15EDE1C174C47978DE37E40608FB279"><enum>(B)</enum><text>in subparagraph (E)—</text> <clause id="HDC665E3C42D4430792AF84DEB463F17B"><enum>(i)</enum><text>in clause (ii)—</text>
<subclause id="H7B3178CC5E9949C88C3305B1378DBD62"><enum>(I)</enum><text>by striking <quote>shall require</quote> and inserting</text> <quoted-block id="H01A19C20B18C477BAE0FC278C5B49AFB" style="OLC" display-inline="yes-display-inline"><text display-inline="yes-display-inline">shall—</text>
<subparagraph id="HFFABF6FACF37404FAF4D0A031BC7CA5A"><enum>(I)</enum><text>require</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause> <subclause id="HEE9872D64F364C319B4787D40D1D03D1"><enum>(II)</enum><text>by striking at the end the period and inserting <quote>; and</quote>; and</text></subclause>
<subclause id="HF59AFCAD469744DF898B2AF16935AC30"><enum>(III)</enum><text>by adding at the end the following new subclause:</text> <quoted-block id="H4F9939C060844FA79168A97CFE78018D" style="OLC"> <subclause id="H38D411CA037C4DEA98EEDD860A185230"><enum>(II)</enum><text>require providers and suppliers of air ambulance services to submit, in such form and manner and at such time as specified by the Secretary in accordance with clause (iii), information described in section 106(a)(2) of the No Surprises Act for years after the last NSA reporting year (as defined in clause (iv)) as the Secretary determines appropriate, but in no case less often than once every 3 years.</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause>
<clause id="HF7F8A750D6BC4A278D4595E9B5A5FDF8"><enum>(ii)</enum><text>by adding at the end the following new clauses:</text> <quoted-block id="H6764B299C5AE436F90232A0E0C352736" style="OLC"> <clause id="H3466DE05A2BA4E4184A25E0275BAA886"><enum>(iii)</enum><header>Application to air ambulance services</header><text>In carrying out clause (ii)(II), the Secretary—</text>
<subclause id="H324097FAF8AE4E85BAE6871502210FDA"><enum>(I)</enum><text>may, as the Secretary determines appropriate, use the data collection system under subparagraph (A) to provide for a single process for the submission of information under this paragraph, including information described in such clause with respect to providers and suppliers of air ambulance services; and</text></subclause> <subclause id="H54ADACEE0D444F45B2224665CA09106C"><enum>(II)</enum><text>shall, to the greatest extent practicable, align the years for which information is required to be submitted under such clause with the years for which information is required to be submitted under clause (ii)(I).</text></subclause></clause>
<clause id="H30457A6970874763BE97FCACEE77F7EC"><enum>(iv)</enum><header>Last NSA reporting year</header><text>For purposes of clause (ii)(II), the term <quote>last NSA reporting year</quote> means the year with respect to which information is required to be submitted under section 106(a)(1)(B) of the No Surprises Act.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="HD143CD5CDE074CF0AB0CB4A6A254D319"><enum>(C)</enum><text>in subparagraph (F)(i), by striking <quote>thereafter,, such</quote> and inserting <quote>thereafter, such</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H85BEA4FE23FE49E49B7B7350DE45BCC7"><enum>(7)</enum><text>by adding at the end the following:</text> <quoted-block id="HBC40A50B941B4E2695F2AAF2951F8358" style="OLC"> <paragraph id="H8647634F474D4435AC590F67435AC00E"><enum>(18)</enum><header>Updating fee schedule to reflect most recently available data</header> <subparagraph id="HB45901C7326B4BC0B77F9E1B978BD0CF"><enum>(A)</enum><header>Initial review and revisions</header> <clause id="HA358653CDF8F44FA95A8C5F58524E92F"><enum>(i)</enum><header>In general</header><text>To improve the valuation of ground ambulance services and air ambulance services under this subsection the Secretary shall review the relative value units, conversion factor, air ambulance base rates, and the mileage rates applied under the fee schedule under this subsection and shall, by regulation and taking into account the information required under subparagraph (C), make such adjustments as are necessary to ensure that such relative value units, conversion factor, base rates, and mileage rates that are applied under the fee schedule for 2028 with respect to ground ambulance services and with respect to air ambulance services, as applicable, reflect the costs (including labor-related costs and costs related to uncompensated care), expenses, and resources used in furnishing the respective ambulance service.</text></clause> 
<clause id="HDA55A78D2AD8414C96BD52048C7B3C40"><enum>(ii)</enum><header>Updated payment amounts defined</header><text>For purposes of this subsection, the term <term>updated payment amounts</term> means the payment amounts determined, with application of the adjustments pursuant to clause (i), under the fee schedule under this subsection for 2028.</text></clause></subparagraph> <subparagraph id="H12088143083B4AED98CDAB5E0834F36F"><enum>(B)</enum><header>Ongoing review and adjustments</header> <clause id="H43575A44B9EF46C4947DB8821051D91D"><enum>(i)</enum><header>Triennial review</header><text>For each data-based adjustment year (as defined in clause (iv)), with respect to ground ambulance services and with respect to air ambulance services, the Secretary shall review the relative value units, conversion factor, air ambulance base rates, and the mileage rates (or any successor to or replacement for such units, factor, or rates, including under any payment methodology developed pursuant to this subsection that is different from the methodology in effect as of the date of enactment of this paragraph), as applicable to the respective services, established under the fee schedule under this subsection.</text></clause> 
<clause id="HAB835FBAA6EE45B49ABDC1E2E02AA0E1"><enum>(ii)</enum><header>Triennial adjustments based on updated factors and data</header><text>For determining payment amounts under the fee schedule under this subsection for ground ambulance services and air ambulance services furnished during a data-based adjustment year, the Secretary shall, based on the review under clause (i) with respect to such year and taking into account the information required under subparagraph (C), by regulation adjust the number of relative value units, conversion factor, air ambulance base rates, mileage rates (or any successor to or replacement for such units, factor, or rates, including under any payment methodology developed pursuant to this subsection that is different from the methodology in effect as of the date of enactment of this paragraph), or any combination thereof, as applicable to the respective services, to take into account changes in medical practice, changes in technology, the addition of new services, new data on relative value components, new cost data (including on labor-related costs and costs related to uncompensated care), and other relevant information and factors. The Secretary shall publish in the Federal Register an explanation of the basis for such adjustments made for a data-based adjustment year.</text></clause> <clause id="HF2270488BBCC4C3FA0F80B58C23FC839"><enum>(iii)</enum><header>Adjustments for years that are not data-based adjustment years</header><text>Beginning with 2029, with respect to a year that is not a data-based adjustment year, for determining the payment amounts under the fee schedule under this subsection for ground ambulance services and air ambulance services furnished during such year, such payment amounts for such services furnished during such year shall be computed by increasing the payment amounts determined under this subsection for such services furnished during the previous year by the percentage increase in the consumer price index for all urban consumers (U.S. city average) for the 12-month period ending with June of the previous year.</text></clause> 
<clause id="H2BFA2BCE2FDF4A5B8B7B698D3499DDFF"><enum>(iv)</enum><header>Data-based adjustment year defined</header><text>For purposes of this subparagraph, the term <term>data-based adjustment year</term> means 2031 and each third year thereafter.</text></clause></subparagraph> <subparagraph id="HD6481D908B024B27BFCFB7777AB1A959"><enum>(C)</enum><header>Use of information</header><text>For purposes of subparagraph (A) and clauses (i) and (ii) of subparagraph (B), the Secretary shall use the most recently available data related to ground ambulance services and air ambulance services for which payment is made under the fee schedule under this subsection, including (as applicable to the respective services) information collected or obtained pursuant to paragraph (17), information collected or obtained pursuant to section 106 of the No Surprises Act, and such other information specified by the Secretary on costs (including labor-related costs and costs related to uncompensated care), expenses, and resources directly or indirectly related to furnishing such respective services. In applying the previous sentence with respect to air ambulance services, in the case that information collected or obtained pursuant to section 106 of the No Surprises Act is not available, the Secretary shall instead use such other comparable information (as identified by the Secretary in consultation with the organizations described in paragraph (4)) on such costs, expenses, and resources related to furnishing air ambulance services.</text></subparagraph></paragraph> 
<paragraph id="HCDD63CBB6AC741039500B1070AD74D39"><enum>(19)</enum><header>Stakeholder consultation for continued assessment for modifications to improve fee schedule</header><text>Not later than December 31, 2028, the Secretary shall convene experts and stakeholders, including organizations described in paragraph (4), to assess the fee schedule applied under this subsection for ground ambulance services and for air ambulance services and the adequacy of payments for such respective services under such fee schedule and to submit, not later than July 1, 2029, to the Secretary and Congress recommendations for modifications to such fee schedule, including the payment methodology under the fee schedule, to improve the valuation of such respective services under this subsection.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
