<section id="HB467909F13B04A5FAB4162F24F8320D6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Congress Leads by Example Act of 2026</short-title></quote>.</text></section> <section id="H21BE612F7BDD44C298978A1F08C18772"><enum>2.</enum><header>Enhanced enforcement of protections of Occupational Safety and Health Act applicable to legislative branch</header> <subsection id="H29630ABA963C4C5AABEDBF3A8090EB4B"><enum>(a)</enum><header>Subpoena authority for Office of Congressional Workplace Rights</header><text display-inline="yes-display-inline">Section 215(c)(1) of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1341">2 U.S.C. 1341(c)(1)</external-xref>) is amended—</text> 
<paragraph id="H7346C4504E704E85B508FC95897662EE"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>subsections (a),</quote> and inserting <quote>subsections (a), (b),</quote>; and</text></paragraph> <paragraph id="HECE06D7E1CF44B6BBD52021EF69A05EF"><enum>(2)</enum><text>by striking <quote>657(a),</quote> and inserting <quote>657(a), (b),</quote>.</text></paragraph></subsection> 
<subsection id="H0149C7FE57374D9E90655BAAF5715C86"><enum>(b)</enum><header>Recordkeeping requirements for employing offices</header><text>Section 215(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1341">2 U.S.C. 1341(c)</external-xref>) is amended—</text> <paragraph id="HB1AB21DFD12D469C8950EEBE9BBCB377"><enum>(1)</enum><text>by redesignating paragraphs (3) through (6) as paragraphs (4) through (7);</text></paragraph> 
<paragraph id="H40AE7DC54EB2473F99B373931B5DA9C4"><enum>(2)</enum><text>in paragraph (6), as so redesignated, by striking <quote>paragraph (3) or (4)</quote> and inserting <quote>paragraph (4) or (5)</quote>; and</text></paragraph> <paragraph id="H69C71FAA9814491181C7289818A991C2"><enum>(3)</enum><text>by inserting after paragraph (2) the following new paragraph:</text> 
<quoted-block style="OLC" id="H7FC6BA67876D42FD9E583ADF2CEE62F1" display-inline="no-display-inline"> 
<paragraph id="H7C6FD519510F44CF9077D0A44A8F9216"><enum>(3)</enum><header>Recordkeeping requirements</header><text display-inline="yes-display-inline">Each employing office shall be subject to the requirements of subsection (c) of section 8 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/657">29 U.S.C. 657(c)</external-xref>) that are applicable to employers under such section, and the General Counsel shall exercise the authorities granted to the Secretary of Labor under such subsection.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H6B32B3B2D56845D0AAAA018EEF4070C3"><enum>(c)</enum><header>Prohibiting retaliation</header><text>Section 208(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1317">2 U.S.C. 1317(a)</external-xref>) is amended—</text> 
<paragraph id="H61B27E5CF1254066A2916260E9B2845C"><enum>(1)</enum><text>by striking <quote>It shall be</quote> and inserting <quote>(1) It shall be</quote>; and</text></paragraph> <paragraph id="H650EE44030AE4ECC91253FD2EA02F2D0"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block style="traditional" id="H7F4DC1498A6C49D5B5AAE1DBCDDDC991" display-inline="no-display-inline"> 
<paragraph id="HCC81C52B222F4BD78E084304C7BE6A5B" indent="up1"><enum>(2)</enum><text>It shall be a violation of this subsection for an employing office to discharge or in any manner discriminate against any covered employee because such employee has requested the General Counsel to take any action authorized under section 215 (relating to occupational safety and health protections), or has instituted or caused to be instituted, or has testified or is about to testify in, any proceeding that arises from the application of section 215 to the employing office, or because of the exercise by such employee on behalf of himself or others of any right provided under section 215.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HDB8A8F9EB68F4A70B36C600661F05AF3"><enum>(d)</enum><header>Effective date</header> <paragraph id="H37C5A1365A564D0B82185017AEA43CB6"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the amendments made by this section shall take effect upon the adoption of regulations promulgated by the Board of Directors of the Office of Congressional Workplace Rights to implement the amendments in accordance with section 304 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1384">2 U.S.C. 1384</external-xref>).</text></paragraph> 
<paragraph id="HF87E03E3800541A0AF61C034F63FF275"><enum>(2)</enum><header>Interim applicability</header><text>During the period that begins on the date of the enactment of this Act and ends on the effective date of the regulations referred to in paragraph (1), the amendments made by this section shall be implemented by the Board of Directors of the Office of Congressional Workplace Rights, the General Counsel of the Office of Congressional Workplace Rights, or a hearing officer or court under the Congressional Accountability Act of 1995 (as the case may be) by applying (to the extent necessary and appropriate) the most relevant substantive executive agency regulations promulgated to implement the provisions of law that are made applicable to employing offices and covered employees (as such terms are defined in the Congressional Accountability Act of 1995) by such amendments.</text></paragraph></subsection></section> <section id="H6F9C8B7569B1448F808B70EFEADE8A61"><enum>3.</enum><header>Application to legislative branch employees of whistleblower protection rules, restrictions on discharge by reason of garnishment, discriminatory treatment by reason of bankruptcy, and availability of parental bereavement leave</header> <subsection id="HBB4B7A667D0646F8AF789B78455D0C7D"><enum>(a)</enum><header>In general</header><text>Part A of title II of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1311">2 U.S.C. 1311 et seq.</external-xref>) is amended—</text> 
<paragraph id="H625A1B766EEF4CDEA7EB5DB65F0E3A38"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text>fair labor standards,</header-in-text></quote> and all that follows and inserting <quote><header-in-text>and other protections and benefits</header-in-text></quote>;</text></paragraph> <paragraph id="HB80E5359BBD24156A3F05B07AF9C0A57"><enum>(2)</enum><text>by redesignating section 208 as section 209B; and</text></paragraph> 
<paragraph id="HC021CB2602174FFB9D911F5084665FD8"><enum>(3)</enum><text>by inserting after section 207 the following new sections:</text> <quoted-block style="OLC" id="HB16C2D5D7A5B40E493E2B964001B8EA0"> <section id="HB2A035F895224399AA88FD938BA1C2FA"><enum>208.</enum><header>Rights and protections under whistleblower protection rules</header> <subsection id="H09B76B0CE8D14F3DA7AC628C34C3F2F1"><enum>(a)</enum><header>Rights and Protections Described</header> <paragraph id="H08D222124223423E8E3AB1040C979203"><enum>(1)</enum><header>In general</header><text>No employing office may take or fail to take, or threaten to take or fail to take, a personnel action (within the meaning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/23">chapter 23</external-xref> of title 5, United States Code) with respect to any covered employee or applicant for employment because of—</text> 
<subparagraph id="H97931D55C8B2492BA708AA00E5E2DC79"><enum>(A)</enum><text>any disclosure of information by a covered employee or applicant which the employee or applicant reasonably believes evidences—</text> <clause id="H6D04AE41ACA24AF5AE41EC6D98CF758C"><enum>(i)</enum><text>a violation of any law, rule, or regulation, or</text></clause> 
<clause id="HAB0859DB62EC42379D256CC17AF73D65"><enum>(ii)</enum><text>gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger to public health or safety,</text></clause><continuation-text continuation-text-level="subparagraph">if such disclosure is not specifically prohibited by law and if such information is not specifically required by Executive order or the rules of the House of Representatives or Senate to be kept secret in the interest of national defense or the conduct of foreign affairs; or</continuation-text></subparagraph> <subparagraph id="HE338CC5102B547BCBE4C48453F200F04"><enum>(B)</enum><text>any disclosure to the General Counsel, or to the Inspector General of an executive agency or office of the legislative branch or another employee designated by the head of the agency or office to receive such disclosures, of information which the employee or applicant reasonably believes evidences—</text> 
<clause id="H3A5BB7FD90574B6CA4640813228DF1F7"><enum>(i)</enum><text>a violation of any law, rule, or regulation, or</text></clause> <clause id="HE3DBE3A3CACC48268ADC5640B4D3C737"><enum>(ii)</enum><text>gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger to public health or safety.</text></clause></subparagraph></paragraph> 
<paragraph id="HD8F36019D38D46A39DE481B58196C7C4"><enum>(2)</enum><header>Definitions</header><text>For purposes of this section and for purposes of applying the procedures established under title IV for the consideration of alleged violations of this section—</text> <subparagraph id="H630E3E2355EB4258A0DC2C2F25A3EC87"><enum>(A)</enum><text>the term <term>covered employee</term> includes an employee of the Government Accountability Office or Library of Congress; and</text></subparagraph> 
<subparagraph id="H1EF2669350D14C46915F555568C73CDD"><enum>(B)</enum><text>the term <term>employing office</term> includes the Government Accountability Office and the Library of Congress.</text></subparagraph></paragraph></subsection> <subsection id="HD614EFA6D4B3427195319343DF288A5E"><enum>(b)</enum><header>Remedy</header><text>The remedy for a violation of subsection (a) shall be such remedy as would be appropriate if awarded under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/12">chapter 12</external-xref> of title 5, United States Code, with respect to a prohibited personnel practice described in section 2302(b)(8) of such title.</text></subsection> 
<subsection id="H2CA78A8ECBDA4386B2D5D681F8002CCE"><enum>(c)</enum><header>Regulations To Implement Section</header> 
<paragraph id="HC8617FAE83554FD584726C7DED8AF8D5"><enum>(1)</enum><header>In general</header><text>The Board shall, pursuant to section 304, issue regulations to implement this section.</text></paragraph> <paragraph id="HF6C45351346D4E2190EBD5F8970C84B0"><enum>(2)</enum><header>Agency regulations</header><text>The regulations issued under paragraph (1) shall be the same as the substantive regulations promulgated by the Merit Systems Protection Board to implement chapters 12 and 23 of title 5, United States Code, except to the extent that the Board of Directors of the Office of Congressional Workplace Rights may determine, for good cause shown and stated together with the regulation, that a modification of such regulations would be more effective for the implementation of the rights and protections under this section.</text></paragraph></subsection></section> 
<section id="H78DEC033A8D5468F8C5A04021BE9EBAB"><enum>209.</enum><header>Restriction on discharge from employment by reason of garnishment or discriminatory treatment by reason of bankruptcy</header> 
<subsection id="HD04E073747EF4840902F288F2D1EB864"><enum>(a)</enum><header>Garnishment</header> 
<paragraph id="H1078C3DC5D8F4BF4A349A271B9F963E1"><enum>(1)</enum><header>Rights and protections described</header><text>No employing office may discharge any covered employee by reason of the fact that the employee’s earnings have been subjected to garnishment for any one indebtedness.</text></paragraph> <paragraph id="HB785AA47A130418793DA87014B91C300"><enum>(2)</enum><header>Remedy</header><text>The remedy for a violation of paragraph (1) shall be such remedy as would be appropriate if awarded under section 304(b) of the <act-name parsable-cite="CCPA">Consumer Credit Protection Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/1674">15 U.S.C. 1674(b)</external-xref>).</text></paragraph></subsection> 
<subsection id="HBBACAEE39C6047488E08BD460C5EABAD"><enum>(b)</enum><header>Bankruptcy</header> 
<paragraph id="H5C2184651B424CCE97D7EEED3D2D174C"><enum>(1)</enum><header>Rights and protections described</header><text>No employing office may deny employment to, terminate the employment of, or discriminate with respect to employment against, a covered employee who is or has been a debtor under title 11, United States Code, or a bankrupt or a debtor under the Bankruptcy Act, or another covered employee with whom such bankrupt or debtor has been associated, solely because such bankrupt or debtor—</text> <subparagraph id="H55C7FDE4CE0542C49501E5083D7E55EE"><enum>(A)</enum><text>is or has been a debtor under such title or a debtor or bankrupt under such Act;</text></subparagraph> 
<subparagraph id="H29E2E474D4884A70A22104FDA7002999"><enum>(B)</enum><text>has been insolvent before the commencement of a case under such title or during the case but before the grant or denial of a discharge; or</text></subparagraph> <subparagraph id="HAAC4B1D38235465A816674B908AD75C7"><enum>(C)</enum><text>has not paid a debt that is dischargeable in a case under such title or that was discharged under such Act.</text></subparagraph></paragraph> 
<paragraph id="HB5A14937293748EABAF60B0B9FE9C960"><enum>(2)</enum><header>Remedy</header><text>The remedy for a violation of paragraph (1) would be such remedy as would be appropriate if awarded with respect to a violation of section 525(a) or (b) of title 11, United States Code.</text></paragraph></subsection> <subsection id="H17EE1139181643CFAEE8F0B9A6AE4CBB"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section and for purposes of applying the procedures established under title IV for the consideration of alleged violations of this section—</text> 
<paragraph id="H853A73F4A31043FA9DC75EE30A678500"><enum>(1)</enum><text>the term <term>covered employee</term> includes an employee of the Government Accountability Office or the Library of Congress; and</text></paragraph> <paragraph id="HC7728ECA88E44853A7CDEBB573A2775F"><enum>(2)</enum><text>the term <term>employing office</term> includes the Government Accountability Office and the Library of Congress.</text></paragraph></subsection>

<section id="H860540CAD5884E21A525C8905C454341"><enum>209A.</enum><header>Parental bereavement leave</header> 
<subsection id="HE4651889D6314855B1A2C66BB34DD7E2"><enum>(a)</enum><header>Availability of leave</header><text display-inline="yes-display-inline">The rights and protections established by section 6329d of title 5, United States Code, shall apply to covered employees.</text></subsection> <subsection id="H527AD08400E246BDAD104B46F0778CE3"><enum>(b)</enum><header>Application to Government Accountability Office and Library of Congress</header><text>For purposes of this section and for purposes of applying the procedures established under title IV for the consideration of alleged violations of this section—</text> 
<paragraph id="H9AB2AD78BE564105A5ACB4870DB5B6DA"><enum>(1)</enum><text>the term <term>covered employee</term> includes an employee of the Government Accountability Office or the Library of Congress; and</text></paragraph> <paragraph id="H84836B8DD62C4085B223F74711EF536E"><enum>(2)</enum><text>the term <term>employing office</term> includes the Government Accountability Office and the Library of Congress.</text></paragraph></subsection>

              </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6ED9A5FFDEDA4B69BA7E2EDDFD870A5B"><enum>(b)</enum><header>Conforming amendment to Bankruptcy Code</header><text>Section 525 of title 11, United States Code, is amended by adding at the end the following new subsection:</text> <quoted-block style="OLC" id="H0364D006E27F406D825C1303928E5864"> <subsection id="H801A936D72734D3B8CE3031DDD69C8EB"><enum>(d)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="H663F0709AFA5438FB4766B69C24AA166"><enum>(1)</enum><text>In the case of an alleged violation of subsection (a) or (b) by a governmental unit which is a legislative branch employing office with respect to an employee of such office who is a legislative branch covered employee, the procedures for consideration of the alleged violation shall consist of the procedures applicable under title IV of the Congressional Accountability Act of 1995.</text></paragraph> 
<paragraph indent="up1" id="H7978F4603BBA424C928182B6A04ADBFA"><enum>(2)</enum><text>In this subsection—</text> <subparagraph id="H6C8BFB7675D94B57A5955B482297CFBD"><enum>(A)</enum><text>the term <term>legislative branch employing office</term> means an employing office described in section 101(9) of the Congressional Accountability Act of 1995, and includes the Government Accountability Office and the Library of Congress; and</text></subparagraph> 
<subparagraph id="H1AF7E1897C8E44AB83202C368D6B2097"><enum>(B)</enum><text>the term <term>legislative branch covered employee</term> means a covered employee described in section 101(3) of the Congressional Accountability Act of 1995, and includes an employee of the Government Accountability Office or the Library of Congress.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H8E3BD36DB05E4AFCB3E6EADDBC68451C"> <enum>(c)</enum> <header>Conforming amendment to list of laws made applicable</header> <text display-inline="yes-display-inline">Section 102(a) of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1302">2 U.S.C. 1302(a)</external-xref>) is amended by adding at the end the following new paragraphs:</text>

<paragraph id="H5DE2018064AA427F84AE852FA41ADF72"><enum>(1)</enum><header>Requiring employing offices to retain records necessary to administer rights and protections</header><text display-inline="yes-display-inline">To the extent that the following provisions of law require the keeping of records necessary or appropriate for the administration of this section, such provisions of law shall apply to employing offices:</text> <subparagraph id="H9BB6399A65314AFB8E4BF4ECEF7A4A14"><enum>(A)</enum><text>Section 709(c) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-8">42 U.S.C. 2000e–8(c)</external-xref>).</text></subparagraph> 
<subparagraph id="H27C6A581D4264A1A95E79ED8EF64376A"><enum>(B)</enum><text>Section 7(a) of the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/626">29 U.S.C. 626(a)</external-xref>).</text></subparagraph> <subparagraph id="HA0EC20E49F8F433799753EAC25AF6607"><enum>(C)</enum><text>Section 107(a) of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12117">42 U.S.C. 12117(a)</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="H5D4AA0A682664FB08BF796DF0683369A"><enum>(2)</enum><header>Effective date</header><text>This subsection shall apply with respect to records generated on or after the expiration of the 60-day period that begins on the date of the enactment of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H0FC011BC4D6B4083A270C27B80880D2F"><enum>(b)</enum><header>Family and Medical Leave Act of 1993</header> <paragraph id="H50946CC2A2454E2BADB9F38D59C7BEB0"><enum>(1)</enum><header>In general</header><text>Section 202(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1312">2 U.S.C. 1312(a)(1)</external-xref>) is amended by striking <quote>sections 101 through 105</quote> and inserting <quote>sections 101 through 105 and section 106(b)</quote>.</text></paragraph> 
<paragraph id="H2F8626ED2CD04D4D86C1F65778AFB244"><enum>(2)</enum><header>Effective date</header> 
<subparagraph id="H3AE5FC67B7A348FD823569F935614952"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the amendment made by paragraph (1) shall take effect upon the adoption of regulations promulgated by the Board of Directors of the Office of Congressional Workplace Rights to implement the amendment.</text></subparagraph> <subparagraph id="H04274D45028E40209522C297B82CFE74"><enum>(B)</enum><header>Interim applicability</header><text display-inline="yes-display-inline">During the period that begins on the date of the enactment of this Act and ends on the effective date of the regulations referred to in subparagraph (A), the amendment made by paragraph (1) shall be implemented by the Board of Directors of the Office of Congressional Workplace Rights or a hearing officer or court under the Congressional Accountability Act of 1995 (as the case may be) by applying (to the extent necessary and appropriate) the most relevant substantive executive agency regulations promulgated to implement the provision of law that is made applicable to employing offices and covered employees (as such terms are defined in the Congressional Accountability Act of 1995) by such amendment.</text></subparagraph></paragraph></subsection>

<paragraph indent="up1" id="H5927364D68234680BD1EBE9BA45BFCDC"><enum>(2)</enum><text>In this section—</text> <subparagraph id="H39627A7A03C241D6A095EA962B702A77"><enum>(A)</enum><text>the term <term>employer</term> includes an employing office under section 101(9) of the Congressional Accountability Act of 1995, the Government Accountability Office, the Government Publishing Office, and the Library of Congress; and</text></subparagraph> 
<subparagraph id="HCBCB462E4AF343298AB1CE75E69F1C71"><enum>(B)</enum><text>the term <term>permanent employee</term> includes any covered employee under section 101(3) of the Congressional Accountability Act of 1995 and any employee of the Government Accountability Office, the Government Publishing Office, and the Library of Congress, without regard to whether the employee’s term of service or appointment is permanent.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H40DD1C9530FC41EB9B8EC2C49CDA33BD"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) apply with respect to individuals summoned for juror service or serving on juries on or after the date of the enactment of this Act.</text></subsection></section> 
<section id="H7810FF48BE8F4755AD3D3341A5C9AA32"><enum>6.</enum><header>Providing Board of Office of Congressional Workplace Rights with authority to seek temporary relief in cases of unfair labor practices</header> 
<subsection id="H5B65821EAB2F4BB3A42E33857FF34FCA"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">Section 220(c)(1) of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1351">2 U.S.C. 1351(c)(1)</external-xref>) is amended by striking <quote>and 7122</quote> and inserting <quote>7122, and 7123(d)</quote>.</text></subsection> <subsection id="H4220AB7C2B54496385F68CC8D806E7A4"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply with respect to petitions or other submissions described in section 220(c) of such Act which are submitted on or after the date of the enactment of this Act.</text></subsection></section> 
<section id="H98152E6FB5164A62B27BF0D9FD71660E"><enum>7.</enum><header>Making hearings and deliberations in cases relating to public services and accommodations under Americans With Disabilities Act and cases relating to labor-management relations open to public</header> 
<subsection id="H1FAD3E38FA934921970548F021D9EAE9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 416(b) of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1416">2 U.S.C. 1416(b)</external-xref>) is amended by amending the second sentence to read as follows: <quote>This subsection shall not apply to proceedings under section 210, section 215, or section 220, but shall apply to the deliberations of hearing officers and the Board under each such section.</quote>.</text></subsection> <subsection id="HE48FF513275B42818C455E3A47617FE0"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply with respect to hearings and deliberations occurring on or after the date of the enactment of this Act.</text></subsection></section> 
<section id="H141E7BD2D2A046FCB8E74A81235C4A9E"><enum>8.</enum><header>Mandatory mediation of claims at request of covered employee</header> 
<subsection id="H8FA14108BB984314A7A4812A4F4FFAD2"><enum>(a)</enum><header>Mandatory mediation</header><text display-inline="yes-display-inline">Section 404(a)(2) of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1404">2 U.S.C. 1404(a)(2)</external-xref>) is amended—</text> <paragraph id="HD1FEBE12A9134D10A12655B304023F9B"><enum>(1)</enum><text>in subparagraph (A), by striking the second sentence; and</text></paragraph> 
<paragraph id="H92420EA01FB24D81A5AC6E398F27155C"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" id="HF1C7885079E64F36939D548E612C0A7E" display-inline="no-display-inline"> <subparagraph id="HA44B871BA796497D86ED33409B565B3C"><enum>(C)</enum><header>Conduct of mediation</header><text display-inline="yes-display-inline">The Office shall promptly assign a mediator to the claim, and conduct mediation under this section, if—</text> 
<clause id="HD9930127E797494DB3A5434176999FCA"><enum>(i)</enum><text>the employing office files a request for mediation and the covered employee agrees to the request; or</text></clause> <clause id="HFCD32E7DCD6F46DF9582E7EB1BAC9BEB"><enum>(ii)</enum><text>the covered employee files a request for mediation.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H2492A47F3A204B2089A594DE17E83ADE"><enum>(b)</enum><header>Conforming amendment relating to commencement of mediation period</header><text>Section 404(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1404">2 U.S.C. 1404(c)</external-xref>) is amended by striking <quote>beginning on the first day after the second party agrees to the request for the mediation</quote> and inserting the following: <quote>beginning on the first day after the covered employee files the request for the mediation or, if the employing office files the request for the mediation, beginning on the first day after the covered employee agrees to the request</quote>.</text></subsection> <subsection id="H077AE258E3CF422FAED95E2ECF223296"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to claims filed under title IV of the Congressional Accountability Act of 1995 on or after the date of the enactment of this Act.</text></subsection></section>
