<section id="HB7D54A4929994BE09CC6AF86422A3CC1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Campaign Funded Cover-Ups Act</short-title></quote>.</text></section> 
<section id="H3D812A460F7044F4BB831BFB917F8382"><enum>2.</enum><header>Limitations on use of certain contributions with respect to sexual assault and sexual harassment claims</header> 
<subsection id="HE28290C2817A46F48786FE1724674AA7"><enum>(a)</enum><header>Prohibition on payment of legal fees</header> 
<paragraph id="H9886436C2DD74E6DAC70AB7601644CC6"><enum>(1)</enum><header>Prohibition</header><text display-inline="yes-display-inline">A covered individual may not use funds from a legal expense fund established for the benefit of the covered individual or contributions to an authorized committee of the individual to pay a legal fee related to defending the covered individual against a claim of sexual assault, sexual abuse, or sexual harassment.</text></paragraph> <paragraph id="HD16E4F9E9DF749C8A0C51A33A90C5E80"><enum>(2)</enum><header>Reimbursement permitted if held not liable</header><text display-inline="yes-display-inline">If a covered individual is held not liable for such a claim, the covered individual may be reimbursed from such fund or committee in an amount equal to the amount of such legal fees paid by the covered individual.</text></paragraph></subsection> 
<subsection id="HF19AD12264DF41FDA2A521B6F6546545"><enum>(b)</enum><header>Prohibition on payment of settlements and judgments</header> 
<paragraph id="HE20F7C10FE4B44DEA13794398E047F9A"><enum>(1)</enum><header>Prohibition on use of campaign contributions</header><text display-inline="yes-display-inline">Section 313(b) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30114">52 U.S.C. 30114(b)</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="HC43EA5A0FEA44A60B517C0EB9B769B8E" display-inline="no-display-inline"> <paragraph id="HF6CFB10E2CB5403A96A191F83ABF6003"><enum>(3)</enum><header>Use for certain legal fees</header><text display-inline="yes-display-inline">For the purposes of paragraph (1), a contribution or donation shall be considered to be converted to personal use if the contribution or amount is used to pay a settlement or court-ordered judgment related to a claim of sexual assault, sexual abuse, or sexual harassment against the candidate or individual.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H773EAECD7A2B4E248D81983527CFA13C"><enum>(2)</enum><header>Prohibition on use of legal expense funds</header><text display-inline="yes-display-inline">A contribution or other payment to a legal expense fund established for the benefit of a covered individual may not be used to pay a settlement or court-ordered judgment related to a claim of sexual assault, sexual abuse, or sexual harassment against the candidate or individual.</text></paragraph></subsection> <subsection id="H79208A568402464D9FB102499A964B36" commented="no"><enum>(c)</enum><header>Prohibition on payments for certain private investigators and research</header> <paragraph id="H534A67EDE28C4DCCB57383CBBA878251" commented="no"><enum>(1)</enum><header>Prohibition on use of campaign contributions</header><text display-inline="yes-display-inline">Section 313(b) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30114">52 U.S.C. 30114(b)</external-xref>), as amended by <internal-xref idref="HF19AD12264DF41FDA2A521B6F6546545" legis-path="1.(b)">subsection (b)</internal-xref>, is further amended by adding at the end the following:</text>

<paragraph id="H58B0B52CD41C43BCBA8483FB57B40946" commented="no"><enum>(4)</enum><header>Use for private investigators and opposition research</header><text display-inline="yes-display-inline">For the purposes of paragraph (1), a contribution or donation shall be considered to be converted to personal use if the contribution or amount is used to pay—</text> <subparagraph id="H1B8980B2FD8E45388FDDF8878DE41688" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">a private investigator to investigate a person who has brought a claim of sexual assault, sexual abuse, or sexual harassment against the candidate or individual; or</text></subparagraph> 
<subparagraph id="H5F3B7ECB7AE2463996156CF09BA2E679" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">for research for the purpose of discovering embarrassing or negative information about a person who has brought a claim of sexual assault, sexual abuse, or sexual harassment against the candidate or individual.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H73CE7D0C6C2E4F30BA6E61DEE59169F6" commented="no"><enum>(2)</enum><header>Prohibition on use of legal expenses</header><text>A contribution or other payment to a legal expense fund established for the benefit of a covered individual may not be used to pay—</text> 
<subparagraph id="H1239B6E4CD294D4FBC9E6E9CBE02A315" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">a private investigator to investigate a person who has brought a claim of sexual assault, sexual abuse, or sexual harassment against the candidate or individual; or</text></subparagraph> <subparagraph id="HC768DFCDEBBD4955A944AD6B5522BDCF" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">for research for the purpose of discovering embarrassing or negative information about a person who has brought a claim of sexual assault, sexual abuse, or sexual harassment against the candidate or individual.</text></subparagraph></paragraph></subsection> 
<subsection id="HCB796012E36D49A2809331AEC893343F" commented="no"><enum>(d)</enum><header>Retroactive application</header><text display-inline="yes-display-inline">The provisions of this section shall apply retroactively to any payment occurring after the date that is 2 years prior to the date of the enactment of this Act.</text></subsection> <subsection id="HACBAAF301F1046A8936006E55070E355"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HD40BCF1E719B401F8865C164D6E8D511" commented="no"><enum>(1)</enum><header>Authorized committee; candidate; contribution; Federal office</header><text display-inline="yes-display-inline">In this section, the terms <term>authorized committee</term>, <term>candidate</term>, <term>contribution</term>, and <term>Federal office</term> have the meanings given such terms in section 301 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101</external-xref>).</text></paragraph> <paragraph id="H229551D2AA424A3EBF5AA8EAAE36523C"><enum>(2)</enum><header>Covered individual</header><text display-inline="yes-display-inline">The term <term>covered individual</term> means a candidate for Federal office or an individual who holds a Federal office.</text></paragraph></subsection></section> 
<section id="HA89A3B027B8C4F1CBEF742E737FC4EB7"><enum>3.</enum><header>Reporting requirements for legal expenses</header><text display-inline="no-display-inline">Section 304(b) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30104">52 U.S.C. 30104(b)</external-xref>) is amended—</text> <paragraph id="HA46F18A1B31E42E88327E8650F32B7DE"><enum>(1)</enum><text>in paragraph (7), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H28203FF34A2841C0A2AE8453D3054314"><enum>(2)</enum><text>in paragraph (8), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> <paragraph id="HEF545FA95CC7477DA9667AD4ADEF0312"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H9A22D4805E754C6EB32DCAEF29A885A4" display-inline="no-display-inline"> 
<paragraph id="HF27CE349AEE04BAA9C1E5A39B6A8BA52"><enum>(9)</enum><text display-inline="yes-display-inline">for any disbursement for a legal fee, legal service, or other legal expense—</text> <subparagraph id="HAABD2187F1D54982B09D2D5AF7BA7AA2"><enum>(A)</enum><text display-inline="yes-display-inline">the name of the individual or entity receiving the disbursement;</text></subparagraph> 
<subparagraph id="HCB7DFA5E2DBE44CEBD63ACCCFD89EB52"><enum>(B)</enum><text>the date and amount of the disbursement;</text></subparagraph> <subparagraph id="HAA502DA8768741A5A09DE8F996660B0F"><enum>(C)</enum><text>a brief description of the general nature and purpose of the legal matter for which the disbursement was made;</text></subparagraph> 
<subparagraph id="HDBAF0DF6045D462380EA8979C6E50C76"><enum>(D)</enum><text display-inline="yes-display-inline">whether the disbursement was for legal representation, reimbursement of legal expenses, settlement of a claim, satisfaction of a judgment, or another specified purpose; and</text></subparagraph> <subparagraph id="H46FC02E184AC484184BD65312BE72E79"><enum>(E)</enum><text display-inline="yes-display-inline">the name of any person whose legal expenses were paid or reimbursed through the disbursement, if such person is not the individual or entity receiving the disbursement.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
