            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healthy Access for Learning Act</short-title></quote>.</text>
        </section>

            <enum>2.</enum>
            <header>Findings</header>
 <text display-inline="no-display-inline">Congress finds the following:</text> <paragraph id="H0703429BF2584A209DEE6B9B78822DC7"> <enum>(1)</enum> <text display-inline="yes-display-inline">According to the Centers for Disease Control and Prevention, in the years 2021–2023, 21 percent of American youth were obese.</text>
            </paragraph>
            <paragraph id="HB2BB91EC89094143BFE98F86313124DC">
                <enum>(2)</enum>
 <text>Twenty-five percent of children in the United States are sedentary.</text> </paragraph> <paragraph id="H0F743E88E4364280AF5000BCFD1AB845"> <enum>(3)</enum> <text display-inline="yes-display-inline">The Centers for Disease Control and Prevention recommends school-aged children and adolescents get at least 60 minutes of exercise every day.</text>
            </paragraph>
            <paragraph id="HDA1FB59E1F2643A3B2E48BB3AF09A184">
                <enum>(4)</enum>
 <text>Nearly half of type 2 diabetes cases in kids are caused by obesity.</text> </paragraph> <paragraph id="H70792430BD3749AEA03CA3EF3EB8AE0F"> <enum>(5)</enum> <text>Seventy percent of youth with obesity have at least one risk factor for cardiovascular disease.</text>
            </paragraph>

                <enum>(6)</enum>
 <text>Elementary and middle school recess has declined sharply over the past 2 decades, especially in lower-income school districts.</text>
            </paragraph>

                <enum>(7)</enum>
 <text>Regular physical activity and free play improve attention, behavior, memory, focus, and academic performance.</text>
            </paragraph>

                <enum>(8)</enum>
 <text display-inline="yes-display-inline">The findings of the Centers for Disease Control and Prevention and multiple studies show recess reduces disruptions and supports stronger learning without hurting instructional time.</text>
            </paragraph>
        </section><section id="efg_sjk_bkc">
            <enum>3.</enum>
            <header>Local educational agency plans</header>
 <text display-inline="no-display-inline">Section 1112(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6312">20 U.S.C. 6312(b)</external-xref>) is amended—</text>
            <paragraph id="H3445383AB9DE46A4ACF583D189573D1D">
                <enum>(1)</enum>
 <text>in paragraph (12), by striking <quote>and</quote> at the end;</text> </paragraph> <paragraph id="H4550CA6CF05942D7A98AE05182E715AD"> <enum>(2)</enum> <text>by redesignating paragraph (13) as paragraph (14); and</text>
            </paragraph>
            <paragraph id="H8B7B8C5AB14A4D169AFAEF7F7A7169A7">
                <enum>(3)</enum>
 <text>by inserting after paragraph (12) the following:</text> <quoted-block style="OLC" id="H7F4BD583A47443C4852FAC757E7AD226" display-inline="no-display-inline"> <paragraph id="H619C6CE2A2EC485B88BA12FF85F8725E"> <enum>(13)</enum> <text display-inline="yes-display-inline">if determined appropriate by the local educational agency, how the local educational agency will provide elementary and secondary school students with at least 60 minutes of physical activity time during each regular school day as described in section 8549D; and</text>
                    </paragraph>

            </paragraph>
 </section><section id="H5DB7287067A74186AE750B46DB2D8644"><enum>4.</enum><header>Activities to support safe and healthy students</header><text display-inline="no-display-inline">Section 4108(5) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7118">20 U.S.C. 7118(5)</external-xref>) is amended—</text><paragraph id="H358DE7EAAD4B4A129B11850886069829"><enum>(1)</enum><text>in subparagraph (H)(iii), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H4D85F0628FD64128B5072609C0CE54C7"><enum>(2)</enum><text>in subparagraph (I), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H0FF548296DE84DD7BC617F768B1F9683"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HB815299B38A84E328E3E84AFC725D66B" display-inline="no-display-inline"><subparagraph id="H3DEBBA87D4C64A5C8CE3D413597FA946"><enum>(J)</enum><text display-inline="yes-display-inline">programs or activities that provide students with not less than 60 minutes of daily recess or other periods of unstructured physical activity during the regular school day, consistent with the age and developmental needs of students.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H8041102012954940AC17F38A71E5606A"><enum>5.</enum><header>Physical activity time elementary and secondary school students</header><text display-inline="no-display-inline">Subpart 2 of part F of title VIII of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7901">20 U.S.C. 7901 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HADC6AD79388F4637930DBF723521C88A" display-inline="no-display-inline"><section id="H64D65893D6954EB1B2E3FE4F9B3BB886"><enum>8549D.</enum><header>Physical activity time for elementary and secondary school
                        students</header><subsection id="H2EBA0D262C5249CEBD53F2BB267E3746">
                        <enum>(a)</enum>
                        <header>Requirement</header>
 <text display-inline="yes-display-inline">Each local educational agency receiving funds under part A of title I is encouraged to establish and maintain a policy pursuant to which students of elementary and secondary schools under the jurisdiction of that agency are provided with at least 60 minutes of physical activity time during each regular school day.</text>
                    </subsection><subsection id="H23C5A38A1423461BA59D1DA0D7F8B4C8" commented="no">
                        <enum>(b)</enum>
                        <header>Physical activity time defined</header>
 <text display-inline="yes-display-inline">In this section, the term <term>physical activity time</term> means time during which a student is given an opportunity to engage in physical exercise, inclusive of time spent in designated periods of recess and physical education courses.</text>
