<section id="HD98EE10A8B19489B9350DB29B230220C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Businessowner Immigration Rights and Responsibilities Information Act of 2026</short-title></quote>.</text></section> <section id="H20215994B96443A585CD9C6A8C065D41"><enum>2.</enum><header>Educational information about immigration rights and responsibilities for small business concerns</header> <subsection id="H48AF486CBD234536824AAA133CD7221A"><enum>(a)</enum><header>In general</header><text>The Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>) is amended—</text> 
<paragraph id="HBB859EEF501943E5A6E98B1B7A3E02EA"><enum>(1)</enum><text>by redesignating section 49 as section 50; and</text></paragraph> <paragraph id="H915D0BE66AB7428A8186370D234109A4"><enum>(2)</enum><text>by inserting after section 48 the following new section:</text>

<section id="HA0200216BDFC4BAF86F07236126F4EC6"><enum>49.</enum><header>Educational information about immigration rights and responsibilities for small business concerns</header> 
<subsection id="H3BBD1D6075DC4D7CAA12AF480750E8B1"><enum>(a)</enum><header>In general</header><text>The Administrator shall—</text> <paragraph id="HDB9724523E58487F9F2F5E6F782F3BF3"><enum>(1)</enum><text display-inline="yes-display-inline">establish and maintain educational resources and modules for small business concerns that contain the information on the rights and responsibilities of individuals during or after an attempted or anticipated immigration enforcement action described in subsection (b)(1);</text></paragraph> 
<paragraph id="H0085BA41562A4BA9950AF0A44931441F"><enum>(2)</enum><text>create and disseminate a card (in electronic and printed form) with the information described in subsection (b)(2) for owners and employees of small business concerns; and</text></paragraph> <paragraph id="HA2C25C891A054E3A8B2149C3EB4EEC28"><enum>(3)</enum><text display-inline="yes-display-inline">establish and maintain compliance and planning materials (in electronic and printed form) for owners and employees of small business concerns to prepare for a potential immigration enforcement action.</text></paragraph></subsection> 
<subsection id="H7DC0EB7250AB44B49DA34B583C8DAF10"><enum>(b)</enum><header>Required contents</header> 
<paragraph id="H46DD2C85C0804B5E9BDDA67537273444"><enum>(1)</enum><header>Educational resources and modules</header><text>The educational resources and modules described in subsection (a)(1) shall include the following:</text> <subparagraph id="H042E6AA287F846EDB7CA827F4CC2A52F"><enum>(A)</enum><text>Information on how to respond to an attempted or anticipated immigration enforcement action on the premises of a small business concern, including—</text> 
<clause id="HB80806865516499BBD387BC4EE50C011"><enum>(i)</enum><text>directions to remain calm;</text></clause> <clause id="H5673DA3C5C974CC7876DF082A7B2A716"><enum>(ii)</enum><text>information on the constitutional right of owners and employees of the concern to remain silent, refuse to answer questions, and refuse to sign documents;</text></clause> 
<clause id="H624FDEA521B34FA4ADFC5E6BC86F9571"><enum>(iii)</enum><text display-inline="yes-display-inline">information on the constitutional right of such owners and employees to see a signed judicial search warrant for searches of any private areas of the premises; and</text></clause> <clause id="H0F24093B2BF04079872BCACCCAF20CE8"><enum>(iv)</enum><text display-inline="yes-display-inline">how to respond to unconstitutional or unlawful searches and seizures of persons, or of property of such owners or employees, by any Federal law enforcement agent engaged in the enforcement of the immigration laws (as such term is defined in section 101(a) of the Immigration and Nationality Act), during and after such actions.</text></clause></subparagraph> 
<subparagraph id="HC8FF1BC1FCBD4F359FF38EE50920C264"><enum>(B)</enum><text display-inline="yes-display-inline">Information on how to respond to the arrest or detention of an owner or employee of a small business concern, including—</text> <clause id="H0EC8387F2FE84EFC9B114C0F55919459"><enum>(i)</enum><text display-inline="yes-display-inline">information on the constitutional right of such owners and employees to speak to a lawyer immediately;</text></clause> 
<clause id="HD4F068058DBC4104A5B49DB4B7F50481"><enum>(ii)</enum><text display-inline="yes-display-inline">information on the constitutional right of such owners and employees to remain silent, refuse to answer questions, and refuse to sign documents; and</text></clause> <clause id="H70ED5199B02748D8857D8C5614E94B02"><enum>(iii)</enum><text>information on the ability of such owners and employees to contact the offices of the Members of Congress that represent such owners and employees to seek casework assistance and help with connections to legal representation.</text></clause></subparagraph> 
<subparagraph id="HD30B7722B2024A30B8E1BA6E290F469F"><enum>(C)</enum><text display-inline="yes-display-inline">Best practices for owners of small business concerns in planning for responses to encounters with such enforcement agents on the premises of a small business concern, including—</text> <clause id="H40D4A6649CE1423D8E94859C628F315C"><enum>(i)</enum><text>ensuring at least one trusted individual off the premises has a copy of such response plans;</text></clause> 
<clause id="H1C1FD7BDEA2F46469FB34EA0EB5E050B"><enum>(ii)</enum><text>practicing response plans with employees; and</text></clause> <clause id="HE4F687C3BDCB444E8396CC0B9166C259"><enum>(iii)</enum><text>clearly marking private areas, such as back rooms, break rooms, storerooms, offices, and kitchens, with appropriate signage.</text></clause></subparagraph> 
<subparagraph id="H1943FAABFE50476C83C4872D98BF199E"><enum>(D)</enum><text display-inline="yes-display-inline">The responsibilities of owners of small business concerns to comply with applicable immigration and work authorization regulations when vetting candidates for employment, including best practices for owners of small business concerns in remaining updated on, and complying with, such regulations.</text></subparagraph> <subparagraph id="H15A1CD2EC9A84BE89876CA01AC4B857C"><enum>(E)</enum><text display-inline="yes-display-inline">Information on how to prepare for, and respond to, I–9 audits, notices of immigration enforcement inspection, and immigration enforcement employer sanctions, including information on the constitutional right of owners of small business concerns to acquire a lawyer when accused of employing individuals without work authorization.</text></subparagraph></paragraph> 
<paragraph id="H8DAE6936F31E48F8B53A9315E1F4CCD1"><enum>(2)</enum><header>Card</header><text display-inline="yes-display-inline">The card described in subsection (a)(2) shall include the information described in subparagraphs (A) and (B) of paragraph (1).</text></paragraph> <paragraph id="H503A383786C143C2B6C2D731CE384878"><enum>(3)</enum><header>Compliance and planning materials</header><text display-inline="yes-display-inline">The compliance and planning materials described in subsection (a)(3) shall include the information described in subparagraphs (C), (D), and (E) of paragraph (1).</text></paragraph> 
<paragraph id="H63B84EA62EDC4DF7B89C738C469DF0E2"><enum>(4)</enum><header>Disclaimer</header><text display-inline="yes-display-inline">The educational resources and modules, card, and compliance and planning materials described in subsection (a) shall each include a disclaimer stating such item is for general informational purposes only, and not legal advice, and directing individuals in need of legal advice to contact an attorney.</text></paragraph> </subsection> <subsection id="H6EF090619E0E46999C29B72A85405FBD"><enum>(c)</enum><header>Dissemination</header><text display-inline="yes-display-inline">The Administrator shall—</text> 
<paragraph id="HECB54E5EF03B45E8A8FFC42559ABCA89"><enum>(1)</enum><text display-inline="yes-display-inline">make the educational resources and modules described in subsection (a)(1) publicly available on an existing online learning platform of the Administration;</text></paragraph> <paragraph id="HB96EA2D4D113462790203E74D5FB6872"><enum>(2)</enum><text display-inline="yes-display-inline">make the electronic version of the card described in subsection (a)(2) and the compliance and planning materials described in subsection (a)(3) publicly available on the website of each regional and district office of the Administration and authorize such offices to distribute a physical version of such card and such materials.</text></paragraph></subsection> 
<subsection id="H42843F9E563F4498B73F572F70FC7C0D"><enum>(d)</enum><header>Prohibited contents</header><text display-inline="yes-display-inline">The educational resources and modules, card, and compliance and planning materials described in subsection (a) shall not include any statement—</text> <paragraph id="HF26E9711BAC94A398E5E652AFDCB1919"><enum>(1)</enum><text>blaming owners or employees of small business concerns for any errors made in efforts to comply with immigration laws;</text></paragraph> 
<paragraph id="HA94B24C542FE45A08E67582004652DE1"><enum>(2)</enum><text>disagreeing with the information required by subsection (b);</text></paragraph> <paragraph id="H2496E0469D50429295EBCEECC6AA1789"><enum>(3)</enum><text>making normative judgements about the legality of the presence of a person in the United States;</text></paragraph> 
<paragraph id="HD71E824D12884473BCAE242710CEDB6C"><enum>(4)</enum><text>discouraging the use by a small business concern of services and resources provided by the Administration based on the perceived immigration status of any of its owners or employees; or</text></paragraph> <paragraph id="HD74D39A1BAE54D2488A38A602073B85A"><enum>(5)</enum><text>disagreeing with the requirements or intent of this section.</text></paragraph></subsection> 
<subsection id="H0AFECD77DCAE41B5AACDA88735626A47"><enum>(e)</enum><header>Accuracy and maintenance</header> 
<paragraph id="H5FDDD681DB4B4EF8A474AE4EA31D1957"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To the extent practicable, the Administrator shall ensure that the information contained in the educational resources and modules, card, and compliance and planning materials described in subsection (a) is factually accurate and current, including by consulting with—</text> <subparagraph id="H3D2399C3395A4F6B9EDF3B61AEEDDC16"><enum>(A)</enum><text>the Secretary of the Department of Homeland Security;</text></subparagraph> 
<subparagraph id="HFC2A927BBD03448C8514F39B79929BD2"><enum>(B)</enum><text>the Director of the Executive Office for Immigration Review of the Department of Justice;</text></subparagraph> <subparagraph id="H940570C2750A4105A7546F9535A2CE82"><enum>(C)</enum><text>other Federal departments and agencies as appropriate; and</text></subparagraph> 
<subparagraph id="H1F673D047D114B9C9AE8B949299DAEBF"><enum>(D)</enum><text>relevant policy or legal experts from—</text> <clause id="H159789207C524D20A0E9B0B817F53377"><enum>(i)</enum><text>resource partners;</text></clause> 
<clause id="H332CA435D5F54BB098CEFB0AAADF4A4C"><enum>(ii)</enum><text>organizations with demonstrated expertise in civil rights and liberties; and</text></clause> <clause id="H7D83C1E176144EB58EDF81551E0AB1F1"><enum>(iii)</enum><text>organizations with demonstrated expertise in immigration law or policy.</text></clause></subparagraph></paragraph> 
<paragraph id="H68C75B548A7841E0A353DCE9F07162C0"><enum>(2)</enum><header>Incorporation of information in educational resources and modules</header><text display-inline="yes-display-inline">In establishing and maintaining such educational resources and modules, card, and compliance and planning materials, the Administrator—</text> <subparagraph id="HF15D1CFBECF742FBBA9A0EC49A28B9B1"><enum>(A)</enum><text>shall consider relevant, existing information developed by—</text> 
<clause id="HF2A4625778BB4EC7AB969782E93CC156"><enum>(i)</enum><text>resource partners;</text></clause> <clause id="H1238FCF9F32D4C85AE34BB1583E20EB8"><enum>(ii)</enum><text>the Chair or the Ranking Member of the Committee on Small Business of the United States House of Representatives; and</text></clause> 
<clause id="HDCF7FAB7AC1C4BDDBC6A0E1AD60B667B"><enum>(iii)</enum><text>the Chair or the Ranking Member of the Committee on Small Business and Entrepreneurship of the United States Senate;</text></clause> </subparagraph> <subparagraph id="HEA52E27B5032425596BD0B5074E373BC"><enum>(B)</enum><text>may consider relevant, existing information developed by private and nonprofit entities; and</text></subparagraph> 
<subparagraph id="HBB9F07F0ED3C4E13890DC7119913944D"><enum>(C)</enum><text>may incorporate information described in subparagraphs (A) and (B) into such educational resources and modules.</text></subparagraph></paragraph> <paragraph id="H86F78E40926946BB96335A809ECCAFCB"><enum>(3)</enum><header>Updates</header><text display-inline="yes-display-inline">In maintaining such educational resources and modules, card, and compliance and planning materials, the Administrator shall make updates to such educational resources and modules, card, and materials in response to relevant changes to immigration laws.</text></paragraph></subsection> 
<subsection id="H39EBF806FA7F4FF18F2AAF990A4E3A7C"><enum>(f)</enum><header>Resource partner involvement</header> 
<paragraph id="H781E2DBF77774158BEF18A5B1D98867F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall coordinate with resource partners to disseminate information to raise the awareness of small business concerns about availability of the educational resources and modules, card, and compliance and planning materials described in subsection (a), including by distributing physical copies of such card and materials to resource partners.</text></paragraph> <paragraph id="H731F8479406648409E24631B8DB1B5D9"><enum>(2)</enum><header>State and local information</header><text>In disseminating the information developed under subsection (a), resource partners may incorporate information on immigration protections and resources provided by State and local governments, and provide related webinars and in-person training.</text></paragraph></subsection> 
<subsection id="HDDB457C45C574C628B0A5962816ECE19"><enum>(g)</enum><header>Translated materials</header><text display-inline="yes-display-inline">The Administrator shall ensure that the information in the educational resources and modules, card, and compliance and planning materials described in subsection (a) is available in the 15 most commonly spoken languages in the United States other than English, including Spanish and Chinese, as well as American Sign Language.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HE2CAD14EA0FE4F9D9835E5A399860ABB"><enum>(b)</enum><header>Deadline</header><text display-inline="yes-display-inline">The Administrator of the Small Business Administration shall establish the educational resources and modules, card, and planning materials required by section 49 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>), as added by this Act, not later than 180 days after the date of the enactment of this Act.</text></subsection></section>
