<section id="HBB4F479262B348F3BB6F2B14867C22D9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No AI Data Centers on Federal Lands Act</short-title></quote>.</text></section> <section id="HA53C2B754A80455499F7C5470C781E11"><enum>2.</enum><header>Federal lands AI Data Center prohibition</header> <subsection id="H39D6AB0BF2B0460FBD54ACE0913FC303"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law—</text> 
<paragraph id="H9C9420FFB7FF4483A0199D153AE74848"><enum>(1)</enum><text>the construction or operation of an Artificial Intelligence Data Center or associated infrastructure on Federal land is prohibited; and</text></paragraph> <paragraph id="H0DC59E4A44FD40D2BE88B1A115E04BAD"><enum>(2)</enum><text>each agency that operates, leases, has constructed, or is in the process of constructing an Artificial Intelligence Data Center shall remove (including by demolition or deconstruction) or order its lessee to remove such Artificial Intelligence Data Center and associated infrastructure from Federal land.</text></paragraph></subsection> 
<subsection id="H04719D65DBB94CEBAB16004CD7A53AAA"><enum>(b)</enum><header>Removal</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, each agency described in subsection (a)(2) shall—</text> <paragraph id="HC098C91F31A2457F9C6BE92EA386ABA6"><enum>(1)</enum><text>cease, or order its lessee to cease, operations or construction of each Artificial Intelligence Data Center and associated infrastructure on Federal land, as applicable; and</text></paragraph> 
<paragraph id="HF9B531BC45D44E2A92ADD5437D862E2C"><enum>(2)</enum><text>begin the removal, or order removal by the applicable lessee, of each such Artificial Intelligence Data Center and associated infrastructure in accordance with such subsection.</text></paragraph></subsection> <subsection id="H856A5FD258E341F2A501FB892B96989A"><enum>(c)</enum><header>Remediation and restoration of site</header><text display-inline="yes-display-inline">Removal of an Artificial Intelligence Data Center and associated infrastructure from a site under this Act shall be carried out in a manner consistent with the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>) and any other applicable provision of law, including with respect to any natural resource restoration, or remedial action or other response, required at such site pursuant to such Act.</text></subsection> 
<subsection id="H93A9E4B4692D4450A1ACFD2D74263406"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HDFF40ACCB9034CF5BAFD42E32FDF3833"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given such term in section 551 of title 5, United States Code.</text></paragraph> 
<paragraph id="H0B2BE9EC56A74899A9658D8D5BD454B3"><enum>(2)</enum><header>Artificial Intelligence Data Center</header><text display-inline="yes-display-inline">The term <term>Artificial Intelligence Data Center</term> means buildings, equipment, structures, and other stationary items, such as server racks, that—</text> <subparagraph id="H1EDEADCE434246CC9C6E3588A1889353"><enum>(A)</enum><text>are located on a single site or on contiguous, adjacent, or otherwise connected sites;</text></subparagraph> 
<subparagraph id="H53B861108D784CDA842037BDFEDF0B58"><enum>(B)</enum><text>are owned or operated by the same entity or by any entity that controls, is controlled by, or is under the common control of that entity, regardless of whether the site is a single-occupant or multi-occupant facility; and</text></subparagraph> <subparagraph id="H6AA46EB625CB4797929FBA5A2AD10041"><enum>(C)</enum> <clause id="HBAEEFD5874A5464D8170662F6720AC21" display-inline="yes-display-inline"><enum>(i)</enum><text>are used for the development or operation of artificial intelligence models at scale; or</text></clause> 
<clause id="H09F239E4FF19441AB22CC1CA42D58F85" indent="up1"><enum>(ii)</enum> 
<subclause id="H3461F41F17694B5EA524A13D6DFAF6F7" display-inline="yes-display-inline"><enum>(I)</enum><text>have a maximum rated power capacity or total peak power load in excess of 20 megawatts; and</text></subclause> <subclause id="H1AC1AA0E50784033B75D75E06B7D70DD" indent="up1"><enum>(II)</enum><text>are designed or equipped to—</text> 
<item id="H81A703638F39446782D865ECE8218D55"><enum>(aa)</enum><text>deliver 20 kilowatts or more of electrical power to a single server rack; or</text></item> <item id="H10F3B2C4AD7C44A6B02486F1440E6279"><enum>(bb)</enum><text>utilize cooling systems that circulate liquid to individual hardware components or submerge electronic hardware in liquid.</text></item></subclause></clause></subparagraph></paragraph> 
<paragraph id="HE3CD9C55417F4A4FB2635FDD8EC5ADCE"><enum>(3)</enum><header>Associated infrastructure</header><text display-inline="yes-display-inline">The term <term>associated infrastructure</term> means any physical infrastructure built to serve an Artificial Intelligence Data Center, including but not limited to transmission lines, power substations, natural gas plants, natural gas pipelines, backup generation facilities, and water pipelines and cooling infrastructure.</text></paragraph> <paragraph id="HA9C376EB6AE34E78B6DC5AD5821511B0"><enum>(4)</enum><header>Federal land</header><text>The term <term>Federal land</term>—</text> 
<subparagraph id="H5DCE722EB17A4856BAABFB7A1C0719E3"><enum>(A)</enum><text>means all land owned or managed by the United States, including land under the jurisdiction of the Department of Defense; and</text></subparagraph> <subparagraph id="H1728DD942CA4496280AFAAE47D846DDE"><enum>(B)</enum><text>does not include land held in trust by the United States for the benefit of an Indian Tribe or member of an Indian Tribe.</text></subparagraph></paragraph> 
<paragraph id="HE90B98782AE2482490FF91EBDCCFF3B8"><enum>(5)</enum><header>Remedial action; response</header><text display-inline="yes-display-inline">The terms <term>remedial action</term> and <term>response</term> have the meanings given such terms in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>).</text> </paragraph></subsection></section> </legis-body></bill>
