<section id="HCFBD2F6C601940C598B93890C8450EEF" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Postal Executive Responsibility, Fiscal Oversight, and Results-based Management Act</short-title></quote> or the <quote><short-title>PERFORM Act</short-title></quote>.</text></section> 
<section id="H3F5E247275B64FD4A71223F724657DFC"><enum>2.</enum><header>Limitation on bonuses and other compensation to Postmaster General</header><text display-inline="no-display-inline">Section 3686 of title 39, United States Code, is amended—</text> <paragraph id="H59AE5E29DD524F09BA3701F5257D29C6"><enum>(1)</enum><text>by redesignating subsection (e) as subsection (f); and</text></paragraph> 
<paragraph id="HE9FD27035E5B4AF49109D7BCCAA08BD4"><enum>(2)</enum><text>by inserting after subsection (d) the following:</text> <quoted-block style="USC" id="H1D4A4AF2DAA84482A9A53F2F8871F62B" display-inline="no-display-inline"> <subsection id="H19EA56CC61004D449D27AD1D5209C3BD"><enum>(e)</enum><header>Limitation on bonuses</header> <paragraph id="H024DE71FB5934C32B00237F5436990F7"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of this title, during any fiscal year, a bonus, incentive award, retention payment, or other performance-based compensation may not be paid to the Postmaster General if, during the preceding fiscal year—</text> 
<subparagraph id="HA06B591C4CAF4A67989B8B7221C07947"><enum>(A)</enum><text display-inline="yes-display-inline">total costs of the Postal Service exceeded total revenue; or</text></subparagraph> <subparagraph id="HFE8D3DC2C59C493F878B2EBD8B21CEC9"><enum>(B)</enum><text display-inline="yes-display-inline">the Postal Service—</text> 
<clause id="HF610850C60C74650AE39A752B8B0EDC4"><enum>(i)</enum><text>failed to meet established nationwide service performance targets;</text></clause> <clause id="H39AE90E6017A43B2BF5A3090E7B2B801"><enum>(ii)</enum><text>received a material weakness, adverse opinion, or disclaimer in its financial audit; or</text></clause> 
<clause id="HD144C9880746401CBF46557395CF8686"><enum>(iii)</enum><text>failed to submit the report to Congress required under paragraph (2).</text></clause></subparagraph></paragraph> <paragraph id="H923B586500D7469B92FC6BA43BA2B809"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 30 days after the end of each fiscal year, the Postmaster General shall submit an annual report to Congress detailing—</text> 
<subparagraph id="HF208F85C7E874DD5BC696268BD9AEFF5"><enum>(A)</enum><text display-inline="yes-display-inline">any bonus, incentive award, retention payment, or other performance-based compensation paid to any officer or employee of the Postal Service in senior executive or equivalent positions;</text></subparagraph> <subparagraph id="HE949BFDE760C48BD9B92B18C03AABBBF"><enum>(B)</enum><text display-inline="yes-display-inline">the performance metrics used to justify each bonus, incentive award, retention payment, or other performance-based compensation;</text></subparagraph> 
<subparagraph id="HE1FD8BC5086E4CCDAF8432B963B42301"><enum>(C)</enum><text>the financial performance of the Postal Service for the preceding fiscal year; and</text></subparagraph> <subparagraph id="H0544A0E96B054813B5FBAF4E43894EA1"><enum>(D)</enum><text>national and district-level service performance data.</text></subparagraph> </paragraph> 
<paragraph id="HD1AFE145C16F42F6BFFEA66D0BF58969"><enum>(3)</enum><header>Inspector General review</header><text display-inline="yes-display-inline">The Inspector General of the Postal Service shall review the report submitted under paragraph (2) and determine whether the Postal Service complied with the requirements of the subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section> </legis-body></bill>
