<section id="HF14AC4C9C6F5412C81BE4D46CC2677DC" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>AI Kill Switch Act</short-title></quote>.</text></section> 
<section id="HD71254D00ADF4C27A882C8AC2FC83659"><enum>2.</enum><header>Shutdown-capability standard and graduated deployment-corrections framework with respect to certain technology</header> 
<subsection id="H8AF6738A36864E56865BE5822C8ABA8C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle A of title XXII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/651">6 U.S.C. 651 et seq.</external-xref>) is amended by adding at the end the following new section:</text> <quoted-block style="OLC" id="H1C26070A39AF4FE68723FB7C4E25C180" display-inline="no-display-inline"> <section id="HA0E5A7792C544CB5BF064CEBB3903C01"><enum>2220F.</enum><header>Shutdown-capability standard and graduated deployment-corrections framework with respect to certain technology</header> <subsection id="H1B39849560FA441AA914120B6E3BC35D" display-inline="no-display-inline"><enum>(a)</enum><header>Rulemaking</header> <paragraph id="HF50CCD37BC7A4181A80AD107B919458D"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (3), not later than 90 days after the date of the enactment of this section and annually thereafter, the Secretary, acting through the Director, shall update by rule the definitions for the terms <term>covered entity</term> and <term>covered technology</term> in this section.</text></paragraph> 
<paragraph id="H0A29EEF8DD1546EC98955BC20833B142"><enum>(2)</enum><header>Factors</header><text>In making a determination under paragraph (1), the Secretary shall consider the following factors:</text> <subparagraph id="H8438D73EC24D4386AB9906E50D95D8EE"><enum>(A)</enum><text>The extent to which the costs to comply with this section might unduly burden a small business concern.</text></subparagraph> 
<subparagraph id="H7A817396DE1A4FBCA49DBDB520E3AF12"><enum>(B)</enum><text>The need to cover entities the activities of which have the potential to advance artificial intelligence capabilities in national security, including with respect to cybersecurity and chemical, biological, radiological, or nuclear capabilities.</text></subparagraph> <subparagraph id="HA01852FF6BED4FFC8D64D275F07660B4"><enum>(C)</enum><text>The capabilities of covered technology, the deployment of such technology, and the manner in which the model weights of such technology are made available.</text></subparagraph> 
<subparagraph id="HA32F9DAE50664387B16AF03CE0281F94"><enum>(D)</enum><text>Such other factors as the Secretary determines relevant.</text></subparagraph></paragraph> <paragraph id="HCDB9794C2E8145C5AA1513EC20EA238A"><enum>(3)</enum><header>Exemption</header><text>An entity is not a covered entity if such entity operates or makes available to a third party a covered technology for personal, academic, or non-commercial utilization only.</text></paragraph></subsection> 
<subsection id="H066F6DF4643B4C1F9DEC6F57FF1EB5BA" display-inline="no-display-inline"><enum>(b)</enum><header>Shutdown capability</header> 
<paragraph id="H5BFF4A1B176D40069DE9B4B9A8F60D22"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this section and annually thereafter, the Secretary, acting through the Director, shall by rule require a covered entity to carry out the following:</text> <subparagraph id="H34217A0AC0364F838D2AB8F5DD4A2CFC"><enum>(A)</enum><text>Maintain a technical capability to carry out the following actions:</text> 
<clause id="H9B04C9D1AF304CC9A9F16B131B5CCCBE"><enum>(i)</enum><text>Stop inference of a covered technology of such covered entity.</text></clause> <clause id="HEED42BD93F2648F594CC01760C3BFACC"><enum>(ii)</enum><text>Terminate user access to such technology.</text></clause> 
<clause id="HAFC9CB1EFE7A4E35983F31674F3A31CF"><enum>(iii)</enum><text>Suspend access to such technology with respect to an account, user, or use pattern identified by such covered entity or the Secretary as posing a risk of any of the following:</text> <subclause id="HD955CC66FF27482FB1E2FEA88B1E7AB4"><enum>(I)</enum><text>A covered incident.</text></subclause> 
<subclause id="H57C89AE5D8234E489B2BDA04CD471EC6"><enum>(II)</enum><text>A violation of law or the terms of service of such technology.</text></subclause></clause> <clause id="H59C99C4E187F4AD8A9C727404D90C2DE"><enum>(iv)</enum><text>Shut down such technology.</text></clause></subparagraph> 
<subparagraph id="H4A83A19F303D440894DC4B3908B30FE2"><enum>(B)</enum><text display-inline="yes-display-inline">Not later than 15 days after such covered entity becomes aware of a covered incident relating to such technology, submit to the Secretary a report regarding such incident.</text></subparagraph></paragraph> <paragraph id="H8CB1BD89D4BA43309E7807A39153703E"><enum>(2)</enum><header>Consideration</header><text>In carrying out paragraph (1), the Secretary shall consider the following:</text> 
<subparagraph id="HBA6C7882CEE0478498EEEFB3A8CBC030"><enum>(A)</enum><text>Requiring a technical capability based on a graduated deployment-corrections framework that applies when there is evidence of a credible risk of a covered incident and includes measures that are calibrated to the severity and immediacy of such risk, including the following measures:</text> <clause id="HFAF4B714853B409EB09CF37011C23DAA"><enum>(i)</enum><text>Throttling or otherwise altering any of the following:</text> 
<subclause id="HBFFF21EF1A2F4729881EEA75FE976687"><enum>(I)</enum><text>The inference rate of a covered technology.</text></subclause> <subclause id="HD827B86EB1F74B248CDDD207FC04C3E1"><enum>(II)</enum><text>User access to such technology.</text></subclause> 
<subclause id="H5EE7A0812CA84C139D0164F5F451DD88"><enum>(III)</enum><text>Compute allocation with respect to such technology.</text></subclause></clause> <clause id="H1CD1FA5460E04725A75750D6F6E89AC9"><enum>(ii)</enum><text>Disabling or restricting a capability of such technology.</text></clause> 
<clause id="HD531949C47674A6ABB4A38AB96C6A60D"><enum>(iii)</enum><text>Suspending such technology.</text></clause> <clause id="H7E27AAFF672648CF81CA9EEAA92BFCE0"><enum>(iv)</enum><text>Shutting down such technology.</text></clause> 
<clause id="H19CF7527B17740D9A33E3443C003B809"><enum>(v)</enum><text>Transitioning an operation dependent on such technology to a backup system or an earlier version of such technology.</text></clause> </subparagraph> <subparagraph id="HB6AD73AA0E494E4AB56A7FCDFC76B406"><enum>(B)</enum><text>The risk that such a measure could disrupt critical infrastructure.</text></subparagraph></paragraph> 
<paragraph id="HE4872FBA400D4FDA99DD3E481C4CB33B"><enum>(3)</enum><header>Voluntary standards</header><text>Not later than 180 days after the date of the enactment of this section, the Secretary, acting through the Director, shall publish on a publicly available website of the Agency voluntary standards for shutting down a covered technology.</text></paragraph> </subsection> <subsection id="HF945DFE1EC0049169E165F97EC9C5DD6"><enum>(c)</enum><header>Emergency authority</header> <paragraph id="H6E21E2A5CF254C28BC0D63F2D3988421" display-inline="no-display-inline"><enum>(1)</enum><header>Order</header><text>If the Secretary, acting through the Director and in consultation with the Secretary of Commerce and the Director of National Intelligence, determines that a covered incident has occurred, the Secretary may order the covered entity at issue to take action proportionate to the nature and immediacy of such incident, which may include any of the actions described in subsection (b)(1)(A).</text></paragraph> 
<paragraph id="H8FD4C8F999A2496CB5F638016CA48452"><enum>(2)</enum><header>Covered entity</header><text>Upon an order under paragraph (1), the covered entity subject to such order shall as soon as practicable carry out the following:</text> <subparagraph id="H2E6120223D8C4E5EA97114D42AD9ECCA"><enum>(A)</enum><text>Preserve the model weights and telemetry of such technology.</text></subparagraph> 
<subparagraph id="H03540BC98D474516BC897F849B6D1B4B" commented="no"><enum>(B)</enum><text>Notify to the extent practicable each operator or user of such technology, of the following:</text> <clause id="H983D92DDD2FB4E0AA867846D88ED3D15" commented="no"><enum>(i)</enum><text>Such order.</text></clause> 
<clause id="HB227ECC1FF2442CEA102C44354735443" commented="no"><enum>(ii)</enum><text>The extent to which such operator or user, as the case may be, might be affected by such order.</text></clause></subparagraph> <subparagraph id="H3C4B8B231A284A4382A81905B063EF65"><enum>(C)</enum><text>Confirm to the Secretary that such order has been carried out.</text></subparagraph></paragraph> 
<paragraph id="HD094BC1171E5477CB426DEB4A567FBB6"><enum>(3)</enum><header>Audit</header><text>Upon a confirmation under paragraph (2)(C), the Secretary, acting through the Director, shall through audit, telemetry, on-site inspection, or other forensic review verify compliance with the order that prompted such confirmation.</text></paragraph> <paragraph id="H5011EA2848124704B3556280D937DC0A"><enum>(4)</enum><header>Congressional report</header><text>Upon an order under paragraph (1), the Secretary shall submit to Congress a report regarding the covered incident at issue that includes information relating to the following:</text> 
<subparagraph id="H3D0899F46BA740319D993CBE3CABD3AE"><enum>(A)</enum><text>The determination under such paragraph that prompted such order.</text></subparagraph> <subparagraph id="HA4392802355E4FA1BF34B7D55E0AB8EC"><enum>(B)</enum><text>Each action so ordered.</text></subparagraph> 
<subparagraph id="HA1C89E6821174E11AF3586D0C75BAD14"><enum>(C)</enum><text>The covered entity subject to such order.</text></subparagraph></paragraph> <paragraph id="H2235D5E80CEB434D9988CFA6214459E6"><enum>(5)</enum><header>Appeal</header> <subparagraph id="H35B06B3BBAFE4FA0A8F848406575B667"><enum>(A)</enum><header>In general</header><text>Not later than 48 hours after an order under paragraph (1), the covered entity subject to such order may petition the Secretary for reconsideration of such order, but such petition does not stay such order.</text></subparagraph> 
<subparagraph id="H25233220660A4628B05F672A27676085"><enum>(B)</enum><header>Determination</header><text>Not later than five days after a covered entity petitions pursuant to subparagraph (A), the Secretary, acting through the Director, shall make a determination with respect to such petition, but if the Secretary fails to so make such determination, such failure is deemed to be a determination in the negative.</text></subparagraph> <subparagraph id="H209F612B2EDB47748F0864330583A487"><enum>(C)</enum><header>Judicial review</header><text display-inline="yes-display-inline">A covered entity for which there is an order under paragraph (1) may request review of such order in the United States Court of Appeals for the District of Columbia Circuit on petition filed not later than 60 days after such order.</text></subparagraph></paragraph></subsection> 
<subsection id="H727120FAEA314C7F8E2C9D34B5FC7BEC" display-inline="no-display-inline"><enum>(d)</enum><header>Authority</header> 
<paragraph id="HEB6A3552172643CE89E2BC5E52D434DE"><enum>(1)</enum><header>In general</header><text>With respect to this section, the Secretary, acting through the Director, may carry out any of the following:</text> <subparagraph id="H4FEED4F6874C4787A0FFD862EF1A75DE"><enum>(A)</enum><text>Administer oaths and, by subpoena, require testimony and the production of documents.</text></subparagraph> 
<subparagraph id="HBF81C72F35D7483FBE930CB628C4987D"><enum>(B)</enum><text>Conduct an investigation within the United States and, consistent with applicable law, outside the United States.</text></subparagraph> </paragraph> <paragraph id="H13588C646FF54DAD927C6BF87AC75E01" commented="no"><enum>(2)</enum><header>Civil penalties</header> <subparagraph id="H29792A6D6A1D42C99E2233859AD9026A" commented="no"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), if the Secretary, acting through the Director, determines after reasonable notice and opportunity for a hearing that a covered entity has violated this section, the Secretary may assess on such covered entity a civil penalty of not more than $2,000,000 for each day on which such violation occurs.</text></subparagraph> 
<subparagraph id="H271283A64B754335A899601A307466C0" commented="no"><enum>(B)</enum><header>Order</header><text>If the Secretary, acting through the Director, determines after reasonable notice and opportunity for a hearing that a covered entity has violated subsection (c), the Secretary may assess on such covered entity a civil penalty of not more than $20,000,000 for each day on which such violation occurs.</text></subparagraph> <subparagraph id="HD24DE3F1C58F4DAEA124606442161AA1" commented="no"><enum>(C)</enum><header>Factors</header><text>In determining the amount of a civil penalty to be assessed under subparagraph (A) or (B), the Secretary shall consider the following factors:</text> 
<clause id="H3FF44F5070314129ADD6EFB67711A1C9" commented="no"><enum>(i)</enum><text>The nature, circumstances, extent, gravity, and duration of the violation at issue.</text></clause> <clause id="HCD040C1657C44601AA27D2A1E43A1706" commented="no"><enum>(ii)</enum><text>The degree of culpability of the covered entity at issue.</text></clause> 
<clause id="H38D03991E5E340FAA82876A4EA8AE824" commented="no"><enum>(iii)</enum><text>Previous violations, if any, of this section by such covered entity.</text></clause> <clause id="H509751D8CBDC48B9A89E9943BAEEFDF9" commented="no"><enum>(iv)</enum><text>Good-faith efforts, if any, by such covered entity to comply with this section.</text></clause> 
<clause id="HD365AD29A76C4B3E8F3E9F30615AD004" commented="no"><enum>(v)</enum><text>Whether such covered entity voluntarily disclosed to the Secretary such violation.</text></clause> <clause id="HBBE185A107DB41AFAE12810716FB3F01" commented="no"><enum>(vi)</enum><text>Any other factor that justice may require.</text></clause></subparagraph></paragraph> 
<paragraph id="H62F91DA6669C43C098CEAEE861F0EB6D" commented="no"><enum>(3)</enum><header>Civil action</header><text>If the Secretary, acting through the Director, believes that a violation of this section has occurred, is occurring, or is about to occur, the Secretary may refer the matter to the Attorney General to bring in an appropriate district court of the United States a civil action for appropriate relief.</text></paragraph> </subsection> <subsection id="HDAA26DB7F0B34093AB8C73964F42FCD1"><enum>(e)</enum><header>Compliance</header><text>A de minimis violation of this section, or a technical defect that results in a violation of this section, that is corrected not later than 30 days after discovery of such violation or defect, as the case may be, is not considered a violation of this section.</text></subsection> 
<subsection id="H24F0DF92AAB64B3298944CF0B0B41413">
              <enum>(f)</enum>
              <header>Non-Disclosure</header>
 <text display-inline="yes-display-inline">Nonpublic information submitted under this section to the Secretary by a covered entity is exempt from disclosure under section 552(b)(3) of title 5, United States Code, and from any provision of State, local, or Tribal freedom of information law, open government law, open records law, or similar law relating to the disclosure of information or records.</text>
            </subsection> 
<subsection id="HF1EE141631BB4C73BDC7EB673BD41609"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H2A2F31D1BA6B4A769D0A378308057DA3" commented="no"><enum>(1)</enum><header>Affiliate</header><text>The term <term>affiliate</term> means an entity that controls, is controlled by, or is under common control with, another entity.</text></paragraph> 
<paragraph id="H65F52092671A46D283415F049536DA03"><enum>(2)</enum><header>Artificial intelligence</header><text display-inline="yes-display-inline">The term <term>artificial intelligence</term> has the meaning given such term in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>).</text></paragraph> <paragraph id="H5189FF092E084FE3A61BF9C19C15D28E"><enum>(3)</enum><header>Artificial intelligence system</header><text display-inline="yes-display-inline">The term <term>artificial intelligence system</term> means any of the following:</text> 
<subparagraph id="H23543BD3F7D543A48EC10C33E148E2EC"><enum>(A)</enum><text>Artificial intelligence.</text></subparagraph> <subparagraph id="HEE6FE74BFD9E4067B4F3EB1FCC08BCF6"><enum>(B)</enum><text>A system, software, hardware, tool, or other utility that operates autonomously through the utilization of such artificial intelligence.</text></subparagraph></paragraph> 
<paragraph id="H64EDA60F10FD4D0DB51E9E947BCA1668"><enum>(4)</enum><header>Covered entity</header><text>Except as otherwise provided in this section, the term <term>covered entity</term> means an entity that satisfies the following requirements:</text> <subparagraph id="H326779F000304BADBF2083DDC7B1C188"><enum>(A)</enum><text>Operates a covered technology or operates a system that incorporates such technology.</text></subparagraph> 
<subparagraph id="HFB59C46F2E4E46758A72C51D317F506B"><enum>(B)</enum><text>Makes such technology available to a third party through a programmatic interface, hosted service, or other similar mechanism.</text></subparagraph> <subparagraph id="H1019F31ADD234B63B10D8F4EFB18DCD3"><enum>(C)</enum><text>Derives together with the affiliates, if any, of such person not less than $500,000,000 in gross revenue from such technology in the calendar year preceding the calendar year at issue.</text></subparagraph> </paragraph> 
<paragraph id="HA7EF6342E1F641F29A13C47B59628CD1"><enum>(5)</enum><header>Covered incident</header><text>The term <term>covered incident</term> means an occurrence of any of the following outside of red-teaming or other structured testing:</text> <subparagraph id="H3DD458A4BBBA4A9099773A8080713D66"><enum>(A)</enum><text>Sabotage of, or interference with, a lawful instruction to shut down a covered technology.</text></subparagraph> 
<subparagraph id="H5655AFDA1F9E4D6BADEB6EEA6F78B4AE"><enum>(B)</enum><text>Conduct of such technology that is unintended by a developer or operator of such technology and causes the death of not fewer than 10 individuals or economic damages of not less than $100,000,000.</text></subparagraph> <subparagraph id="HD1A502860E58417196B2C697415ECD67"><enum>(C)</enum><text>Concealment of a capability, intention, or action of such technology, by such technology, from a monitoring or shutdown mechanism.</text></subparagraph> 
<subparagraph id="HA3CD4D1F873543FA8D6D84E5D9F29978"><enum>(D)</enum><text>A loss-of-control scenario.</text></subparagraph></paragraph> <paragraph id="H33C57735D09F4D4E80DC586275B62EA8"><enum>(6)</enum><header>Covered technology</header><text display-inline="yes-display-inline">Except as otherwise provided in this section, the term <term>covered technology</term> means an artificial intelligence system developed utilizing a quantity of computing power the cost of which would exceed $100,000,000 at the prevailing market price of cloud computing in the United States, as determined by the Secretary.</text> </paragraph> 
<paragraph id="HC824EDA1824749F68CBBB2EBD334B568"><enum>(7)</enum><header>Loss-of-control scenario</header><text display-inline="yes-display-inline">The term <term>loss-of-control scenario</term> means a scenario in which a covered technology pursues outside of red-teaming or other structured testing a goal that is not a goal intended by the developer or operator of such technology, including with respect to any of the following:</text> <subparagraph id="H4F38BDCCE01E45F6BA48B5170F0D32F6"><enum>(A)</enum><text>Such technology behaving contrary to the instruction of such developer or operator, as the case may be, in a context relating to critical infrastructure or another high-stakes context.</text></subparagraph> 
<subparagraph id="H9D957FFB437C4FCB918E90B24BAD1556"><enum>(B)</enum><text>Such technology altering operational rules or safety restrictions without the authorization of such developer or operator, as the case may be.</text></subparagraph> <subparagraph id="H94A87F68DC244476B742236B572C8EF6"><enum>(C)</enum><text>Such technology subverting a monitoring or shutdown mechanism.</text></subparagraph> 
<subparagraph id="H6EEDB48A532B4D80A2159E6FB45EFBF9"><enum>(D)</enum><text>Such technology attaining without such authorization access to the model weights of such technology.</text></subparagraph></paragraph> <paragraph id="H5490FE3D53984B23B19955F3E3A049DA"><enum>(8)</enum><header>Red-teaming</header><text>The term <term>red-teaming</term> means structured testing that satisfies the following requirements:</text> 
<subparagraph id="HE512FB97019E4D1ABF80245EBAACC601"><enum>(A)</enum><text>Is in a controlled environment.</text></subparagraph> <subparagraph id="HD79CEF4B748A45BEB8810908FF4D971E"><enum>(B)</enum><text>Simulates real-world conditions.</text></subparagraph> 
<subparagraph id="HB64B2932CDC8446E8DAB29FBB4BA59AC"><enum>(C)</enum><text>Utilizes an adversarial method to identify limitations, risks, flaws and vulnerabilities with respect to an artificial intelligence system, such as any of the following:</text> <clause id="H6C4AE664C6104249A2CF3660F5282AFA"><enum>(i)</enum><text>A harmful output of such system.</text></clause> 
<clause id="HD7B0F7C5C7E34889ABA47EB177155246"><enum>(ii)</enum><text>An unforeseen or undesirable behavior of such system.</text></clause> <clause id="H73D9C2873E9446F0885166AE563123EA"><enum>(iii)</enum><text>A risk associated with the misutilization of such system.</text></clause></subparagraph></paragraph> 
<paragraph id="H68A43146F944451DBFDBF7791CDD315A"><enum>(9)</enum><header>Small business concern</header><text>The term <term>small business concern</term> has the meaning given such term in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></paragraph></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H5FDD357963474FCDBC33189125107DD1"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 2220E the following new item:</text>
