<section id="HF9B1E7E72BA14AEDBB138DB1EC82E0A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Collaboration on Adversarial Threats and Security Risks Act</short-title></quote>.</text></section> <section id="H69F763A91AB842B2AE1BC76465BA889B"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H2C8BCAF0C15D4AD2AF36CEDCAD447B9F"><enum>(1)</enum><header>Antitrust laws</header>
<subparagraph id="H2B9FD558259847228E930F29EBA59E32"><enum>(A)</enum><header>In general</header><text>The term <quote>antitrust laws</quote> has the meaning given that term in section 102 of the Cybersecurity Information Sharing Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/6/1501">6 U.S.C. 1501</external-xref>).</text></subparagraph> <subparagraph id="H32687547DC83494FB2E0B5511694B86E"><enum>(B)</enum><header>Rule of construction</header><text>For the purposes of this Act, the laws described in section 102(2) of the Cybersecurity Information Sharing Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/6/1501">6 U.S.C. 1501(2)</external-xref>) are consistent to the extent they do not conflict.</text></subparagraph></paragraph>
<paragraph id="H7B0964415CB345AE8F4B36FFD8B09DE0"><enum>(2)</enum><header>Artificial intelligence</header><text>The term <quote>artificial intelligence</quote> has the meaning given that term in section 238(g) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="usc" parsable-cite="usc/10/4001">10 U.S.C. 4001</external-xref> note).</text></paragraph> <paragraph id="H023A3907798B4089A9BD37D32FE0FE6C"><enum>(3)</enum><header>Assistance</header><text>The term <quote>assistance</quote> includes the provision of software, hardware, data, personnel, and other resources.</text></paragraph>
<paragraph id="H3D38919DF44245A2BA91C697004757D8"><enum>(4)</enum><header>Assistant attorney general</header><text>The term <quote>Assistant Attorney General</quote> means the Assistant Attorney General in charge of the Antitrust Division of the Department of Justice.</text></paragraph> <paragraph id="HB00A4BFA310C4F898163ADC9EFFE0E96"><enum>(5)</enum><header>Covered artificial intelligence security purpose</header><text>The term <quote>covered artificial intelligence security purpose</quote> means the purpose of protecting against, identifying, evaluating, testing, analyzing, preventing, investigating, or mitigating a covered artificial intelligence security risk.</text></paragraph>
<paragraph id="H9F0EEBC44D834D1AB35C4DB1D088D392"><enum>(6)</enum><header>Covered artificial intelligence security risk</header><text>The term <quote>covered artificial intelligence security risk</quote> means the potential for artificial intelligence, including during development, training, testing, evaluation, deployment, use, or release, to do 1 or more of the following:</text> <subparagraph id="HF94AF3BACD99437BAC2D356492D06602"><enum>(A)</enum><text>Be stolen, distilled, weaponized, trained, developed, or deployed by a covered nation (as defined in section 4872(f)(2) of title 10, United States Code) or an entity owned, controlled, or directed by a covered nation in a manner that poses a significant threat to the national security, including through covert, clandestine, undisclosed, or otherwise concealed development activities that attempt to evade detection or verification.</text></subparagraph>
<subparagraph id="H13D4AD749A274454A97F13B6D59516D6"><enum>(B)</enum><text>Substantially facilitate the development or deployment of a chemical, biological, radiological, nuclear, or offensive cyber weapon.</text></subparagraph> <subparagraph id="HD252099717E84CB09797D31309D8A6F6"><enum>(C)</enum><text>Cause a disruption to, degradation of, impairment of, or loss of operational control over critical infrastructure that is reasonably likely to result in a significant impact on security, national public health or safety, or any combination thereof.</text></subparagraph>
<subparagraph id="H11244C156235405F81BA05712984D66A"><enum>(D)</enum><text>Substantially reduce the ability of a developer, deployer, owner, operator, user, evaluator, auditor, Federal department or agency, or other governmental authority to oversee, evaluate, monitor, control, contain, restrict access to, disable, or terminate such artificial intelligence, if the applicable person or governmental authority has authority or responsibility to do so, including through unauthorized, deceptive, evasive, or malicious activity involving such artificial intelligence.</text></subparagraph> <subparagraph id="HD86775E782D240B1A5B0098908FEF68A"><enum>(E)</enum><text>Autonomously improve, or substantially facilitate the autonomous improvement of the capabilities of artificial intelligence in a manner that creates a substantial risk of a consequence described in subparagraph (A), (B), (C), or (D).</text></subparagraph>
<subparagraph id="HBF856825FF4C47378A7695BC7289DA17"><enum>(F)</enum><text>Be vulnerable to unauthorized access that—</text> <clause id="H37C3327527994449A305C7E86E8271E7"><enum>(i)</enum><text>creates a substantial risk of a consequence described in subparagraphs (A) through (E); or</text></clause>
<clause id="H3B1BA5DFBDA547CDAE49732AA22CC98F"><enum>(ii)</enum><text>is for the benefit of, at the direction of, or under the control of—</text> <subclause id="H69A5F41C8B5D451E901914AFD91EAC4A"><enum>(I)</enum><text>a covered nation (as defined in section 4872(f)(2) of title 10, United States Code); or</text></subclause>
<subclause id="H0F3CC2FCA16741DD9FE5DF8D4E5A8D02"><enum>(II)</enum><text>an entity owned, controlled, or directed by a covered nation.</text></subclause></clause></subparagraph></paragraph> <paragraph id="H478A01B8FBA44AB882F3368CE99409C4"><enum>(7)</enum><header>Exclusive purpose</header><text>The term <quote>exclusive purpose</quote>, with respect to an action, means for the purpose of, with not more than an insubstantial part of the relevant action being for other purposes.</text></paragraph>
<paragraph id="H6225ACE8C4D34BC3A8367C44CFF18802"><enum>(8)</enum><header>Non-federal entity</header><text>The term <quote>non-Federal entity</quote> has the meaning given that term in section 102 of the Cybersecurity Information Sharing Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/6/1501">6 U.S.C. 1501</external-xref>).</text></paragraph> <paragraph id="H61003B6D0D05483AA963D85D79AB6EE7"><enum>(9)</enum><header>Unauthorized access</header><text>The term <quote>unauthorized access</quote> with respect to artificial intelligence—</text>
<subparagraph id="HEB8295930A6343F999154B622261BE19"><enum>(A)</enum><text>means unauthorized access or use of artificial intelligence; and</text></subparagraph> <subparagraph id="HB76411B32493473998A96C6F8037EB16"><enum>(B)</enum><text>includes—</text>
<clause id="H13026E42E4A044C0A92E97A5211B7859"><enum>(i)</enum><text>extraction or copying of model weights, parameters, or other nonpublic model information;</text></clause> <clause id="HE3EC9B3CBE454F988E2231E712B48503"><enum>(ii)</enum><text>systematic querying or automated extraction designed to distill, replicate, or reconstruct model capabilities; and</text></clause>
<clause id="H138F1AD69C504D9689C72303F86214D1"><enum>(iii)</enum><text>compromise affecting the integrity, reliability, or security of artificial intelligence, including through malicious code, a backdoor, manipulated data, or compromise of an artificial intelligence model, training dataset, or artificial intelligence component.</text></clause></subparagraph></paragraph></section> <section id="H025A5D62AB184FA19995DB322D22FF21"><enum>3.</enum><header>Antitrust exemption</header> <subsection id="H5BB13FA531DB4465B2C8D9324327B501"><enum>(a)</enum><header>In general</header><text>It shall not be considered a violation of any provision of the antitrust laws for—</text>
<paragraph id="HE120893DC1F54DB798A046DB02DD7B55"><enum>(1)</enum><text>2 or more non-Federal entities to provide or exchange information or assistance relating to a covered artificial intelligence security risk in good faith for the exclusive purpose of a covered artificial intelligence security purpose; or</text></paragraph> <paragraph id="HC66091F4F09744B7A40929173AF5BBF9"><enum>(2)</enum><text>2 or more non-Federal entities to coordinate or enter into agreements for the exclusive purpose of reducing covered artificial intelligence security risks via delaying or otherwise limiting the release, deployment, use, development, training, testing, or evaluation of artificial intelligence, provided that the non-Federal entities submit to the Assistant Attorney General, before undertaking the proposed coordinated delay or limitation, written notice detailing the specific covered artificial intelligence security risk and the scope of the proposed restriction.</text></paragraph></subsection>
<subsection id="H317176B3202747E59E5F56DEFDE5D281"><enum>(b)</enum><header>Limitation</header><text>Subsection (a) shall not apply to a non-Federal entity receiving information or assistance unless the non-Federal entity uses such information or assistance for a covered artificial intelligence security purpose and has implemented reasonable internal controls to limit the extent to which such information or assistance can be used for other purposes.</text></subsection> <subsection id="HAEC8D5CFEDB649F88FDD4F5F6B26118F"><enum>(c)</enum><header>Affirmative defense</header><text>In any action or proceeding brought under the antitrust laws, the exemption provided under subsection (a) shall constitute an affirmative defense, and any non-Federal entity claiming the exemption shall bear the burden of proving by a preponderance of the evidence that the entity’s actions were taken in good faith and for the exclusive purpose described in subsection (a).</text></subsection>
<subsection id="H64BF14ADB33D415FB22A5DF0C2D79B0F"><enum>(d)</enum><header>Rule of construction</header>
<paragraph id="HE6DC2416EF794C619108B49C3A3706C0"><enum>(1)</enum><header>In general</header><text>Subsection (a)(1) shall not be construed to permit price-fixing, allocating a market between competitors, monopolizing or attempting to monopolize a market, boycotting, or exchanges of price or cost information.</text></paragraph> <paragraph id="HFC75622A65B34E3CB432D6B372695990"><enum>(2)</enum><header>Private right of action</header><text>Nothing in this Act shall be construed as limiting any private right of action with respect to any violation of the antitrust laws that is not exempt under this section.</text></paragraph></subsection>
<subsection id="HC340E168A7AB440699A485F542E2D96B"><enum>(e)</enum><header>Exemption from disclosure</header><text>Any information submitted to the Assistant Attorney General pursuant to subsection (a)(2), including any written notice submitted under that subsection and any information derived from such submission that would reveal the substance of such submission, shall be—</text> <paragraph id="H963A2F6F9E1F4AC597715DA907C540EE"><enum>(1)</enum><text>used solely for the purpose of section 4;</text></paragraph>
<paragraph id="HBA5DE523B69840F1BBDF246D8C86EFEA"><enum>(2)</enum><text>deemed voluntarily shared information and exempt from disclosure under section 552 of title 5, United States Code; and</text></paragraph> <paragraph id="H95EFCCC962564040A29782A7C3A300C0"><enum>(3)</enum><text>withheld, without discretion, from the public under section 552(b)(3) of title 5, United States Code.</text></paragraph></subsection></section>
<section id="H1C3E9B99CFA44B6E8D6FEE6C9E9C7FA9"><enum>4.</enum><header>Injunctive relief</header>
<subsection id="H9BAA3EFF41014FF9A2E4D93DF4078949"><enum>(a)</enum><header>In general</header><text>The Attorney General may seek, in a court of competent jurisdiction, an injunction against the non-Federal entities described in section 3 to prohibit an action that violates the antitrust laws.</text></subsection> <subsection id="H6CDC576A4C4646D686243B948AE6B643"><enum>(b)</enum><header>No immunity or exemption</header><text>In any action described in subsection (a), this Act shall not be construed to create any immunity or exemption from injunctive relief if—</text>
<paragraph id="HDBF3940A235D48C4A13F069E13706715"><enum>(1)</enum><text>the non-Federal entities do not satisfy the burden of proof under section 3(c); or</text></paragraph> <paragraph id="H827F8848F290432FAD671839214722ED"><enum>(2)</enum><text>the Attorney General demonstrates that, notwithstanding the covered artificial intelligence security purpose, the actions are reasonably likely to result in an overall increase in covered artificial intelligence security risks.</text></paragraph></subsection></section>
