<section id="HB7013A700582422D8048EFF649B339FF" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Shipbuilding Investment and Workforce Act</short-title></quote>.</text></section> 
<section id="H90C61D965472428CBD97F45FBBE72675"><enum>2.</enum><header>Maritime prosperity zones designated as qualified opportunity zones</header> 
<subsection id="HA1C64D2E9086434BBFDA396D37AB7CBB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/1400Z">Section 1400Z–1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subsection:</text> <quoted-block style="OLC" id="H1A53F74419B846C5A516DA98EE35148F" display-inline="no-display-inline"> <subsection id="H81A1818A3ED540D2A913378922F190F9"><enum>(f)</enum><header>Maritime prosperity zones</header> <paragraph id="H7A3816C809584A7E88C6811F26FD4F66"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, a population census tract that is a maritime prosperity zone that is designated as a qualified opportunity zone under paragraph (2) shall be treated as a qualified opportunity zone for purposes of this subchapter.</text></paragraph> 
<paragraph id="H5DE87944A16947518FB1D4CD4FE1B6E2"><enum>(2)</enum><header>Designation</header><text display-inline="yes-display-inline">For purposes of paragraph (1), a population census tract that is a maritime prosperity zone is designated as a qualified opportunity zone if—</text> <subparagraph id="H957D5753555B4098B01B34BA4FF026B4"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of Commerce—</text> 
<clause id="HE91EA4465F834C9A9739018BEE1CC1FA"><enum>(i)</enum><text display-inline="yes-display-inline">in consultation with the appropriate officials, nominates the tract for designation as a qualified opportunity zone, and</text></clause> <clause id="HDE8ECFF325DE413B9EF8A316F02AD029"><enum>(ii)</enum><text>notifies the Secretary in writing of such nomination, and</text></clause></subparagraph> 
<subparagraph id="H4877EF534EAB45D6BC3B95B648AC0D66"><enum>(B)</enum><text>the Secretary certifies such nomination and designates such tract as a qualified opportunity zone.</text> </subparagraph></paragraph> <paragraph id="H317F93AC5F394C0C9720BEE15FF19DB3"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection—</text> 
<subparagraph id="H17AD021DF6F340F2AEE24D270ABDD7F4"><enum>(A)</enum><header>Maritime prosperity zone</header><text display-inline="yes-display-inline">The term <term>maritime prosperity zone</term> means a population census tract that is determined by the Secretary of Commerce, in consultation with the appropriate officials, to be an appropriate site for the operation of a maritime industry.</text></subparagraph> <subparagraph id="HD71BEC6F170A475BAEA29CDB5FF30CD4" commented="no"><enum>(B)</enum><header>Appropriate officials</header><text>The term <term>appropriate officials</term> means—</text> 
<clause id="H1ACBB6F3B3A545AC90039C217BA06E08" commented="no"><enum>(i)</enum><text>the Secretary of Defense,</text></clause> <clause id="H827681BCED644741942FE6753FD7D931" commented="no"><enum>(ii)</enum><text>the Secretary of the Navy,</text></clause> 
<clause id="H56BE402C1E3844E68D07F876C2EA944E" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">the Secretary of Transportation,</text></clause> <clause id="HA179A349A7624A7E913E8E99EF70EA39" commented="no"><enum>(iv)</enum><text>the United States Trade Representative, and</text></clause> 
<clause id="H1F593E35BA5248929418EE44CB4F64C0" commented="no"><enum>(v)</enum><text>the Director of the Office of Management and Budget.</text></clause></subparagraph></paragraph> <paragraph id="H7629B98EA98F41C9A0E37A66ED70B36A"><enum>(4)</enum><header>Special rules</header> <subparagraph id="H4CE79A41D7574E71A6AEE7DDFD87BF7F"><enum>(A)</enum><header>Treatment of property and trade or business with respect to maritime prosperity zones</header> <clause id="HBB7F519DDC9242ABB06F6F529DC1F84F"><enum>(i)</enum><header>In general</header><text>For purposes of this subchapter, in the case of a population census tract which is designated as a qualified opportunity zone solely by reason of paragraph (2)—</text> 
<subclause id="H736FD0193D904C599AB162D6EF61D06A"><enum>(I)</enum><text display-inline="yes-display-inline">property shall not be treated as qualified opportunity zone business property (as defined in section 1400Z–2(d)(2)(D)) with respect to such qualified opportunity zone unless substantially all of the use of such property, during substantially all of the holding period for such property, is in connection with a maritime industry, and</text></subclause> <subclause id="H1D92C80D19384EE5B854BA9839BDBAE8"><enum>(II)</enum><text display-inline="yes-display-inline">a trade or business shall not be treated as a qualified opportunity zone business (as defined in section 1400Z–2(d)(3)) with respect to such qualified opportunity zone unless substantially all of the operation of such trade or business is in connection with a maritime industry.</text></subclause></clause> 
<clause id="HD5DE9412004943ACBB6B6D23AB5F74F6"><enum>(ii)</enum><header>Maritime industry</header><text display-inline="yes-display-inline">For purposes of this subsection—</text> <subclause id="H989CE579A32941D2B85AE0CE0783081A"><enum>(I)</enum><header>In general</header><text>The term <term>maritime industry</term> means any industry which is determined by the Secretary to support, directly or indirectly, the construction, reconstruction, repair, rehabilitation, or refurbishment of shipyards, ports, harbor facilities, or vessels.</text></subclause> 
<subclause id="HD5B0AE50387C4492A118E37D63601435"><enum>(II)</enum><header>Certain industries included</header><text>Except as otherwise provided by the Secretary, any industry assigned one of the following codes under the 2022 North American Industry Classification System shall be treated as a maritime industry:</text> <item id="H0D11D200F81B445D901BB0312870BD6A"><enum>(aa)</enum><text>332 (Fabricated Metal Product Manufacturing).</text></item>

<item id="H06A3678BBD3249D7856B5005AEDD51E5"><enum>(dd)</enum><text>333923 (Overhead Traveling Crane, Hoist, and Monorail System Manufacturing).</text></item> <item id="HF11715DA2C574E8BB207C3AA8BAA8EF5"><enum>(ee)</enum><text>334511 (Search, Detection, Navigation, Guidance, Aeronautical, and Nautical System and Instrument Manufacturing).</text></item>

<item id="H915584634EBE4CB5B75B87ED7C7C1D3A"><enum>(jj)</enum><text>541330 (Engineering Services).</text></item></subclause></clause></subparagraph> <subparagraph id="HFFA498062297472EB2ACDD496B69F459"><enum>(B)</enum><header>Limitations</header> <clause id="HC934DD51A83640ECB3F8B39373895457"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The number of population census tracts that are maritime prosperity zones that may be designated as qualified opportunity zones under paragraph (2) at any time may not exceed 100.</text></clause> 
<clause id="H85EC6B16B90A41A283B629A0494BDFC6"><enum>(ii)</enum><header>Limitation on number of low-income community designations unchanged</header><text>A population census tract that is a maritime prosperity zone that is designated as a qualified opportunity zone under paragraph (2) shall not be taken into account in determining the limitation under subsection (d).</text></clause></subparagraph> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H68FCD8EDABE2401F833288460052EFD8" display-inline="no-display-inline"><enum>(b)</enum><header>Basis increase for investments in qualified maritime prosperity funds</header><text>Section 1400Z–2(b)(2) of such Code (as amended by section 70421(c)(2) of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>) is amended—</text> 
<paragraph id="HC10CE3751B564190A20851966A118583"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B)(iii)(I), by inserting <quote>or a qualified maritime prosperity fund</quote> after <quote>qualified rural opportunity fund</quote>, and</text></paragraph> <paragraph id="HC386A5A083F64E7F974E0DE6295E8AEA"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H615A0F22EFDC41F88C189BBC60CABB2E"> 
<subparagraph id="H4C3E848A393E401AA09A41358E9DB3CA"><enum>(D)</enum><header>Qualified maritime prosperity fund</header><text display-inline="yes-display-inline">For purposes of subparagraph (B)(iii), the term <term>qualified maritime prosperity fund</term> has the same meaning given the term <term>qualified rural opportunity fund</term>, determined by substituting <quote>maritime prosperity zone (as defined in section 1400Z–1(f)(3)(A))</quote> for <quote>qualified opportunity zone comprised entirely of a rural area</quote> each place it appears.</text> </subparagraph> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H32F6DC0335FD4A5B94C8A70BDFB4A699" display-inline="no-display-inline"><enum>(c)</enum><header>Conforming amendments</header> <paragraph id="H1B239041FCD1426481FA3F3736C974A5"><enum>(1)</enum><text display-inline="yes-display-inline">Section 1400Z–1(d)(1) of such Code is amended by striking <quote>under this section</quote> and inserting <quote>under subsection (b)</quote>.</text></paragraph> 
<paragraph id="H5E095ED91FD14627AF64C76349C6AA34"><enum>(2)</enum><text>Section 1400Z–1(e)(2) of such Code is amended—</text> <subparagraph id="HDD15563DF8F043E5B62AABD83524989F"><enum>(A)</enum><text>by striking <quote>under this section</quote> and inserting <quote>under subsection (b) or (f)(2)</quote>, and</text></subparagraph> 
<subparagraph id="H82E9EF895F094358BD1F4E93F36BDA8E"><enum>(B)</enum><text>by striking <quote>subsection (b)(1)(B)</quote> and inserting <quote>subsection (b)(1)(B) or (f)(2)(B) (as the case may be)</quote>.</text></subparagraph></paragraph></subsection> <subsection id="HCDE851628D3F4CAEBAAE0C927E702403"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect beginning after December 31, 2026.</text></subsection>

        <enum>(e)</enum>
        <header>Deadline To begin nomination and notification process</header>
 <text display-inline="yes-display-inline">Not later than July 1, 2027, the Secretary of Commerce shall begin the nomination and notification process referred to in clauses (i) and (ii) of <external-xref legal-doc="usc" parsable-cite="usc/26/1400Z">section 1400Z–1(f)(2)(A)</external-xref> of the Internal Revenue Code of 1986 (as added by subsection (a)).</text>
