<section section-type="section-one" id="H2800413098DE409BB3D7A7CE0DF124AA"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Hospital Cybersecurity Enhancement Act</short-title></quote>.</text></section> <section id="HD096034D3B1248E6A1885BEF595920DA"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HCC0857C1071F48C69BC443400F43E618"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 551 of title 5, United States Code.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HA7112ABE8002431CBBD90E5C5993DCC2"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate committees of Congress</header><text>The term <quote>appropriate committees of Congress</quote> means—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HEF0905E713FD435FA65659CB4FC00B9D"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Health, Education, Labor, and Pensions of the Senate;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HB16B893DEF274779AEAAB4601DAB755D"> <enum>(B)</enum> <text display-inline="yes-display-inline">the <committee-name committee-id="SSFI00">Committee on Finance of the Senate</committee-name>;</text>
                </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF067109CCC3C4E588CD92B4F7D089CBD"><enum>(C)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H90CCD393AB6C4B888E1090750B278ECF"> <enum>(D)</enum> <text>the <committee-name committee-id="HWM00">Committee on Ways and Means of the House of Representatives</committee-name>.</text>
                </subparagraph></paragraph> 
<paragraph id="HFC4559A88F8D4399AD6B3B57D7DDE316"><enum>(3)</enum><header>Geographic division</header><text>The term <term>geographic division</term> means a geographic division that is among the 9 geographic divisions determined by the Bureau of the Census.</text></paragraph> <paragraph id="H7ACA3CDCF3CB49F098726DF58C88C5EF"><enum>(4)</enum><header>Rural hospital</header><text>The term <term>rural hospital</term> means—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD983BC42D5B4419DA6EA9AEEF835E203"><enum>(A)</enum><text display-inline="yes-display-inline">a subsection (d) hospital (as defined in section 1886(d)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(1)(B)</external-xref>)) that—</text> <clause commented="no" display-inline="no-display-inline" id="H092A79E203D34DBE97E3C1B70F974768"><enum>(i)</enum><text display-inline="yes-display-inline">is located in a rural area (as defined in paragraph (2)(D) of section 1886(d) of such Act);</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H023C9826A52440A0BE9662CB2B831E69"><enum>(ii)</enum><text display-inline="yes-display-inline">is treated as being located in a rural area pursuant to paragraph (8)(E) of such section 1886(d); or</text></clause> <clause commented="no" display-inline="no-display-inline" id="H0008B048EE254CA1A7EEFEC0192A48E2"> <enum>(iii)</enum> <text display-inline="yes-display-inline">is located in a rural census tract of a metropolitan statistical area (as determined under the most recent modification of the Goldsmith Modification, originally published in the Federal Register on February 27, 1992 (57 Fed. Reg. 6725));</text>
          </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD33EE0BBBD444074A5C27E60A2B7DFB2"><enum>(B)</enum><text display-inline="yes-display-inline">a critical access hospital (as defined in section 1861(mm)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(mm)(1)</external-xref>));</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE8AA83DB84794DC09C0BCB0CB24A81CF"><enum>(C)</enum><text display-inline="yes-display-inline">a sole community hospital (as defined in section 1886(d)(5)(D)(iii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(5)(D)(iii)</external-xref>));</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD8EAE37068D94040BD2582CCAC2CC389"><enum>(D)</enum><text display-inline="yes-display-inline">a medicare-dependent, small rural hospital (as defined in section 1886(d)(5)(G)(iv) of such Act (42 U.S.C. 1395(ww)(d)(5)(G)(iv)));</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H5B6D1C2E2ABE42B6A3B276070616E6DC"><enum>(E)</enum><text display-inline="yes-display-inline">a low-volume hospital (as defined in section 1886(d)(12)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(12)(C)</external-xref>)); or</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8BAD371D072648719F9E5C67AD8E1BA7"><enum>(F)</enum><text display-inline="yes-display-inline">a rural emergency hospital (as defined in section 1861(kkk)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(kkk)(2)</external-xref>)).</text></subparagraph></paragraph> <paragraph id="H0AEEC6360CA94ABCA9B1093C433D07CA"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph></section> 
<section id="HE5015209FB9645A0A036DE99EA73AB5E"><enum>3.</enum><header>Rural hospital cybersecurity workforce development strategy</header> 
<subsection id="H5338168A01954C5B828130EDFA2F1AE6"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall develop and transmit to the appropriate committees of Congress a comprehensive rural hospital cybersecurity workforce development strategy to address the growing need for skilled cybersecurity professionals in rural hospitals.</text></subsection> <subsection id="HCD6BB53828644186A2FB280CA2270F4D"><enum>(b)</enum><header>Consultation</header> <paragraph commented="no" display-inline="no-display-inline" id="HFB79376B6C8E4BF0B313577D5861C489"><enum>(1)</enum><header>Agencies</header><text display-inline="yes-display-inline">In carrying out subsection (a), the Secretary shall consult with the Director of the Cybersecurity and Infrastructure Security Agency, the Secretary of Education, the Secretary of Labor, the National Cyber Director, and any other appropriate head of an agency.</text></paragraph> 
<paragraph id="H7029211954B14290B5F8831218D40B38"><enum>(2)</enum><header>Providers</header><text>In carrying out subsection (a), the Secretary shall consult with not fewer than 2 representatives of rural health care providers from each geographic division in the United States.</text></paragraph></subsection> <subsection id="HD972FCB971AE4A16AF96113B435B7224"><enum>(c)</enum><header>Considerations</header><text>The rural hospital cybersecurity workforce development strategy developed under subsection (a) shall, at a minimum, consider the following components:</text> 
<paragraph id="H8E2DA7B231974EFE88A8D88722648FEC"><enum>(1)</enum><text>Partnerships between rural hospitals, hospitals that are not rural hospitals as defined in section 2(4), educational institutions, and private nonprofit or for-profit entities, to develop, promote, and expand the rural hospital cybersecurity workforce, including through education and training programs tailored to the needs of rural hospitals.</text></paragraph> <paragraph id="HBC1B1DCFD66349F7BD5BCDD16C17E7A7"><enum>(2)</enum><text>The development of a cybersecurity curriculum and teaching resources that focus on teaching technical skills and abilities related to cybersecurity in rural hospitals for use in community colleges, vocational schools, and other educational institutions located in rural areas.</text></paragraph> 
<paragraph id="H546A4000C77D4FF199ED4524F2F76639"><enum>(3)</enum><text>Identification of—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H6DA9FFE5E50540D7B8D87853627B0447"><enum>(A)</enum><text display-inline="yes-display-inline">cybersecurity workforce challenges of rural hospitals; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8E76CE3B8129404B93BB6D101B8EF9AA"><enum>(B)</enum><text display-inline="yes-display-inline">common practices to mitigate the challenges described in subparagraph (A).</text></subparagraph></paragraph></subsection> <subsection id="H49856B2FBDA14AB398F77375ABAE6299"><enum>(d)</enum><header>Annual briefing</header><text>Not later than 60 days after the date on which the first full fiscal year ends following the date on which the Secretary transmits the rural hospital cybersecurity workforce development strategy developed under subsection (a), and not later than 60 days after the date on which each fiscal year thereafter ends, the Secretary shall provide a briefing to the appropriate committees of Congress that includes, at a minimum, information relating to—</text> 
<paragraph id="HCD7FB5CA851B4E8EAE97AFF721F05E80"><enum>(1)</enum><text>updates to the rural hospital cybersecurity workforce development strategy, as appropriate;</text></paragraph> <paragraph id="H0D85AF4A13DE4A4381858331A508410C"><enum>(2)</enum><text>any programs or initiatives established pursuant to the rural hospital cybersecurity workforce development strategy, and the number of individuals trained or educated through such programs or initiatives; and</text></paragraph> 
<paragraph id="H414B000F83CD4B9B959865ED4B893C04"><enum>(3)</enum><text>the effectiveness of the rural hospital cybersecurity workforce development strategy in addressing the need for skilled cybersecurity professionals in rural hospitals.</text></paragraph></subsection></section> <section id="H2F99CB3FC91E4D26BF173F07E3929569"><enum>4.</enum><header>Instructional materials for rural hospitals</header> <subsection id="HF939121A76C44FD6AFB01760035365A5"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall publish on the website of the Department of Health and Human Services and make available through other appropriate means, at no cost, instructional materials for rural hospitals that can be used to train staff on fundamental cybersecurity efforts.</text></subsection> 
<subsection id="HB56079CD20294D2A97611CD2FE696741"><enum>(b)</enum><header>Duties</header><text>In carrying out subsection (a), the Secretary shall—</text> <paragraph id="H977B3B803A574C95AB6BE1B572ACF43B"><enum>(1)</enum><text>consult with appropriate heads of agencies, experts in cybersecurity education, and rural health care experts;</text></paragraph> 
<paragraph id="HA2C2C321325148BB81F2606852C16513"><enum>(2)</enum><text>identify existing cybersecurity instructional materials that can be adapted for use in rural hospitals and develop new materials as needed; and</text></paragraph> <paragraph id="HB9F43D0B586441038AFD92E3B5DE5842"><enum>(3)</enum><text>conduct an awareness campaign to promote the materials available to rural hospitals developed under subsection (a).</text></paragraph></subsection></section> 
<section id="HBDDC5CA0FE0F4B7C8032E13537C72CDB"><enum>5.</enum><header>No additional funds</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriated for the purpose of carrying out this Act.</text></section> </legis-body></bill>
