<section id="HA11ECC6B09FE47A19642C64E54E452F4" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Deputy Darren Almendarez Act</short-title></quote>.</text></section> 
<section id="H23B47951DBB44AF7A4C6C0EB86BFBA1F"><enum>2.</enum><header>Trafficking in catalytic converters</header> 
<subsection id="HFD65C3DB156440BBB545374A135C482B"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113">Chapter 113</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/2321">section 2321</external-xref> the following:</text> <quoted-block id="H0F8BCBB6CD224C45BAA83A445218332F" style="USC"> <section id="HE18ADA3DBC784F8EA98B50B8D0DF7323"><enum>2321A.</enum><header>Trafficking in catalytic converters</header> <subsection id="HE50419DE0BAD4C19B963BF69B666CE65"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">Except as provided under subsection (c), whoever, in or affecting interstate commerce, knowingly—</text> 
<paragraph id="H7FAB5BBD8662400B8BF5A7F4412A6867"><enum>(1)</enum><text display-inline="yes-display-inline">possesses one or more catalytic converters that was removed from a motor vehicle; or</text></paragraph> <paragraph id="HF3F5ECC04565469AA487EA33519475B2"><enum>(2)</enum><text display-inline="yes-display-inline">purchases one or more catalytic converters that was removed from a motor vehicle, with the intent to distribute, sell, or dispose of such catalytic converter or any precious metal removed from such converter,</text></paragraph><continuation-text continuation-text-level="subsection">shall be punished as provided in subsection (b) for each possession or purchase.</continuation-text></subsection> 
<subsection id="H3FD207066D00455FB87888DCC681A40B"><enum>(b)</enum><header>Penalties</header><text>Whoever commits an offense under subsection (a)—</text> <paragraph id="HAD442CE6C3B249AEBC24483364FC73F1"><enum>(1)</enum><text display-inline="yes-display-inline">shall be fined not more than $100,000, imprisoned not more than 5 years, or both; and</text></paragraph> 
<paragraph id="H441B964C76AE481EB89A6335E5D647CF"><enum>(2)</enum><text>for a second or subsequent offense under subsection (a), shall be fined not more than $200,000, imprisoned not more than 10 years, or both.</text> </paragraph></subsection> <subsection id="H8B9D710A8E744936B8BF3AB8E3198F29"><enum>(c)</enum><header>Affirmative defense</header><text display-inline="yes-display-inline">It is an affirmative defense to prosecution under subsection (a) if the person complied with all State and local identification requirements and record-keeping practices relating to catalytic converters in the State which the transaction occurred and—</text> 
<paragraph id="H8A4F7D87396C4313A39B666A02B1758D"><enum>(1)</enum><text>the catalytic converter was removed from a motor vehicle by a motor vehicle owner or by the lessee of a leased motor vehicle;</text></paragraph> <paragraph id="H471F9C8EF29349E28E5DFCF2C2A21CFD"><enum>(2)</enum><text display-inline="yes-display-inline">an person possessed or purchased a catalytic converter in the ordinary course of their official duties for a motor vehicle manufacturer, distributor, or dealer;</text></paragraph> 
<paragraph id="HB0FDBA73418D454EB02E43AEB7D0B5D2"><enum>(3)</enum><text>an employee or agent of a person acting in their official duties as a motor vehicle repair facility engaged in diagnosis, service, maintenance, repair, or calibration of a catalytic converter of a motor vehicle if the employee or agent does not—</text> <subparagraph id="H3AF66C1F76664E7CAFBED5FF522D87FB"><enum>(A)</enum><text>extract any precious metals from the catalytic converter;</text></subparagraph> 
<subparagraph id="HE23EF8FDB43D4318B6E2D0B425E91E7E"><enum>(B)</enum><text>remove the identity, including the vehicle identification number or derivative thereof, or other identification marking, of such vehicle or catalytic converter; or</text></subparagraph> <subparagraph id="H45A3B64B50914968BED398927FAE5BB2"><enum>(C)</enum><text>distribute, sell, or dispose of the vehicle, or catalytic converter, or precious metals extracted from such catalytic converter; or</text></subparagraph></paragraph> 
<paragraph id="H54283CFC5CA7416B86A86DB747B0A24C"><enum>(4)</enum><text>a metal recycling entity that purchases or otherwise acquires a catalytic converter that was removed from a motor vehicle if the person selling the catalytic converter to the metal recycling entity acquired the catalytic converter in the ordinary course of business of such entity, including in the ordinary course of business of—</text> <subparagraph id="HE02650FA11724A2FA58EABDDB7E24668"><enum>(A)</enum><text>a licensed automotive wrecking and salvage yard;</text></subparagraph> 
<subparagraph id="H0D5A3ADB68244BA598C7D50542920121"><enum>(B)</enum><text>a registered metal recycling entity;</text></subparagraph> <subparagraph id="HE8EB1896B04E4DDABA21411C68D89022"><enum>(C)</enum><text>a licensed motor vehicle manufacturer, distributor, converter, or dealer, including any department of a dealer or converter that repairs or services motor vehicles;</text></subparagraph> 
<subparagraph id="HBC45143BA32F4C8EB5B16FE3B5BFD268"><enum>(D)</enum><text>a licensed motor vehicle repair facility;</text></subparagraph> <subparagraph id="HB0DCA503AED141F7AAE66E3897B31C2A"><enum>(E)</enum><text>a licensed used automotive parts recycler;</text></subparagraph> 
<subparagraph id="H4684EBB1C0AB4EDB99A4FA4F1333A19A"><enum>(F)</enum><text>a licensed motor vehicle demolisher;</text></subparagraph> <subparagraph id="HC6DF1445C70743CBB839206FE54D55CC"><enum>(G)</enum><text>a school or training program in which students are provided instruction on building, repairing, or restoring motor vehicles;</text></subparagraph> 
<subparagraph id="H6F2C38F0750145ADB549319498DC3F32"><enum>(H)</enum><text>a Federal, State, or local law enforcement agency;</text></subparagraph> <subparagraph id="H6FFDD92138634648B587C0876089B447"><enum>(I)</enum><text>the National Insurance Crime Bureau;</text></subparagraph> 
<subparagraph id="HA39DDDFDDB114EB5A5F8883BE88666C9"><enum>(J)</enum><text>a business that is—</text> <clause id="H6146DF787A0F4587BE08EDC971F24D70"><enum>(i)</enum><text>located in and regulated by State or a political subdivision of a State; and</text></clause> 
<clause id="H2895352DA1FF4F079660B2AE92C82685"><enum>(ii)</enum><text>engaged in an activity relating to catalytic converters that is regulated by a State or a political subdivision of a State; and</text></clause></subparagraph> <subparagraph id="H717F200A7EDA4AD789A9EA1ABD7AED5C"><enum>(K)</enum><text>a business that—</text> 
<clause id="HE9234B59834B4E1FA39A8A4881CFDB35"><enum>(i)</enum><text>is located in a jurisdiction outside the United States and operated in a business form recognized by the laws of that jurisdiction; and</text></clause> <clause id="H78D7F69DDF844C7FB1F689F8A2A302BF"><enum>(ii)</enum><text>imports catalytic converters into the United States in accordance with the Harmonized Tariff Schedule of the United States published by the U.S. International Trade Commission (or a successor schedule).</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HD6D62A09FF544374AD5EB33027B8EF41"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H9CE0CE3E32C142B898267DCE5FBECCA4"><enum>(1)</enum><header>Catalytic converter</header><text>The term <term>catalytic converter</term> means an emission pollution-control device that converts toxic byproducts of combustion in the exhaust of an engine to less toxic substances by means of catalyzed chemical reactions.</text></paragraph> 
<paragraph id="H8EDC43675FD4448CA3401CE3634F2716"><enum>(2)</enum><header>Dealer; motor vehicle; motor vehicle distributor; motor vehicle manufacturer</header><text>The terms <term>dealer</term>, <term>motor vehicle</term>, <term>motor vehicle distributor</term>, <term>motor vehicle manufacturer</term> have the meanings given the terms in section 30102 of title 49.</text></paragraph> <paragraph id="HE84F0562410D4485BC9E93D8984C4C6E"><enum>(3)</enum><header>Metal recycling entity</header><text>The term <term>metal recycling entity</term> means a business that operates from a fixed location and is predominantly engaged in—</text> 
<subparagraph id="HBDB413F657B545B0A02650EC10BA1C7B"><enum>(A)</enum><text>performing the manufacturing process by which scrap, used, or obsolete ferrous or nonferrous metal is converted into raw material products consisting of prepared grades and having an existing or potential economic value, by a method that in part requires the use of powered tools and equipment, including processes that involve processing, sorting, cutting, classifying, cleaning, baling, wrapping, shredding, shearing, or changing the physical form of that metal;</text></subparagraph> <subparagraph id="H04182DF9B3134C78BA36ECCC35D9D78C"><enum>(B)</enum><text>using raw material products described under subparagraph (A) in the manufacture of producer or consumer goods; or</text></subparagraph> 
<subparagraph id="H85756EC34C644B0D9858F089AA16A7CD"><enum>(C)</enum><text>purchasing or otherwise acquiring scrap, used, or obsolete ferrous or nonferrous metals for the eventual use of the metal for the purposes described in subparagraph (A) or (B).</text></subparagraph></paragraph> <paragraph id="HC008F5FC3E8442C1870FAC6F99B5CCCE"><enum>(4)</enum><header>Motor vehicle dealer</header><text>The term <term>motor vehicle dealer</term> means a dealer that has an agreement with a motor vehicle manufacturer related to the diagnostics, repair, or service of a motor vehicle.</text></paragraph> 
<paragraph id="H4ABA0ADC6E804AF585F532D8F66F2EBB"><enum>(5)</enum><header>Motor vehicle owner</header><text>The term <term>motor vehicle owner</term>—</text> <subparagraph id="H99B5C866D7EF442FA37B458F8EE3B251"><enum>(A)</enum><text>means a person with a present possessive ownership right in a motor vehicle or a lessee of a motor vehicle; and</text></subparagraph> 
<subparagraph id="H1033841F115948B9AE146CE8A2450A53"><enum>(B)</enum><text>does not include a motor vehicle manufacturer or a person operating on behalf of a motor vehicle manufacturer, a motor vehicle financing company, a motor vehicle dealer, or a motor vehicle lessor.</text></subparagraph></paragraph> <paragraph id="HF9D854D4D75741D98A612CD6D29557BA"><enum>(6)</enum><header>Motor vehicle repair facility</header><text>The term <term>motor vehicle repair facility</term> means any person that, in the ordinary course of its business, is engaged in the business of diagnosis, service, maintenance, repair, or calibration of motor vehicles or motor vehicle equipment.</text></paragraph> 
<paragraph id="HBBB1BACAF5354D8BAD3C9400FBC1E9F4"><enum>(7)</enum><header>Precious metals</header><text>The term <term>precious metals</term> has the meaning given the term in section 109–27.5101 of title 41, Code of Federal Regulations (or a successor regulation).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H429BB496BE6147738E13B626AD145A05"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113">chapter 113</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/2321">section 2321</external-xref> the following:</text>
