<section id="HD4B03E22C4B04A668521CE487F4840F5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Polling Place Standards Act</short-title></quote>.</text></section> <section id="HB3ADBE14276B47359C67D0E9EF1341D8"><enum>2.</enum><header>Minimum required polling stations</header> <subsection id="H7078C68E64F347739F777CD8D59ACCAF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title III of the Help America Vote Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/252">Public Law 107–252</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081 et seq.</external-xref>) is amended by adding at the end the following new subtitle:</text>

<subtitle id="H85CA57317933409DB33528C44131D9AB"><enum>C</enum><header>Additional polling place standards</header> 
<section id="H959835125ED74800A47DECAD53E3EC63"><enum>321.</enum><header>Polling place requirements</header> 
<subsection id="H505054F3F8E441E2B97E6956704B103F"><enum>(a)</enum><header>Minimum number of polling places in a State</header><text>Not later than 30 days prior to the day the voting period begins for any election for Federal office, the appropriate State or local election official shall begin preparations to ensure that during such voting period within each State there is not less than 1 covered polling place or vote center for every 2,000 voters registered to vote in such State.</text> </subsection> <subsection id="H51E41DFB9B1E463B8717B9853835C2D8"><enum>(b)</enum><header>Location requirements</header><text display-inline="yes-display-inline">The appropriate State or local election official shall ensure that, within a State, the covered polling places and vote centers available for a voter to cast a ballot in an election for Federal office are—</text> 
<paragraph id="HFA897B2779084D68996D8F781EF1E0E7">
                                    <enum>(1)</enum>
 <text>not concentrated in a specific area of such State; and</text>
                                </paragraph> 
<paragraph id="H84D0190F01D74CADBFFA5E3E775D1921"><enum>(2)</enum><text>located in geographically diverse areas.</text></paragraph></subsection> <subsection id="HED53713230C044FD801391CAA2BD5522"><enum>(c)</enum><header>Exception</header><text display-inline="yes-display-inline">The requirements in subsection (a) and subsection (b) shall not apply with respect to a State if such State allows each voter in such State to, or permits a jurisdiction of such State to allow each voter in such jurisdiction to, cast a ballot in an election for Federal office by—</text> 
<paragraph id="H76D40E34BA994F6D826769F8796D80E8"><enum>(1)</enum><text>depositing such ballot in a drop box; or</text></paragraph> <paragraph id="HA3F5D678A2054FE1AF6EC01F6AC2D65A"><enum>(2)</enum><text>mailing such ballot to the appropriate State or local election official.</text> </paragraph> </subsection> 
<subsection id="H54F6E60239EF4245B8B88E06969BB57B"><enum>(d)</enum><header>Staffing</header> 
<paragraph id="HADB9B3076F8C4D0EA180B0F6D80B6ADA"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">The appropriate State or local election official shall ensure that each covered polling place and vote center required by this section is adequately staffed to ensure—</text> <subparagraph id="H5EDA663B0B424A30BE5152FD0F3DBAEC"><enum>(A)</enum><text>that ballots cast in an election for Federal office are processed in a timely manner as required by any applicable Federal or State law;</text></subparagraph> 
<subparagraph id="H4C51AAA36F70495B973D9A40FE5EA209"><enum>(B)</enum><text>all equipment and ballots are handled in a method that ensures the general safety and secure storage of such equipment and ballots; and</text></subparagraph> <subparagraph id="H04E4E3AEC23F4BFEB5FDA01C3E0B707C"><enum>(C)</enum><text display-inline="yes-display-inline">compliance with any relevant accessability related Federal, State, or local law.</text></subparagraph></paragraph> 
<paragraph id="HEF88071627234EA4B3A5A62A9914A40B"><enum>(2)</enum><header>Factors</header><text>In determining whether a covered polling place or vote center is adequately staffed pursuant to paragraph (1), the appropriate State or local election official shall consider—</text> <subparagraph id="H6DA0FE7B7EB143B9AE530446C4740B5A"><enum>(A)</enum><text>the number of—</text> 
<clause id="H010C9414C37B4392817ED00F24AFE971"><enum>(i)</enum><text>registered voters in the relevant precinct;</text></clause> <clause id="H8B148EA87F8F455C89E3F60C61C7C5D4"><enum>(ii)</enum><text display-inline="yes-display-inline">check-in stations, including stations for the purposes of collecting ballots and verifying the identity of a voter, at such covered polling place or vote center;</text></clause> 
<clause id="H2B5CF63C9624401CB1816FEB7E2C79FC"><enum>(iii)</enum><text>machines where a voter can fill out or submit a ballot electronically, if available, at such covered polling place or vote center; and</text></clause> <clause id="H6D267AF5D7E94A05AE4BCE265A3E8B48"><enum>(iv)</enum><text display-inline="yes-display-inline">ballot scanning machines at such covered polling place or vote center;</text></clause></subparagraph> 
<subparagraph id="HE005F8B20E9C4A3C9AE7334AC32A3B45"><enum>(B)</enum><text>the accessability needs of the voters in such precinct; and</text></subparagraph> <subparagraph id="H3F10789A886E474BA0C54A9C92D81C11"><enum>(C)</enum><text display-inline="yes-display-inline">whether the wait time for a voter to cast a ballot in an election for Federal office at such covered polling place or vote center is 30 minutes or less.</text></subparagraph></paragraph></subsection> </section> 
<section id="H9061F0004B7B4C1481B306E5E8BCE843"><enum>322.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> <paragraph id="H12ECE4CBF6B5446084E45FFF2836F740"><enum>(1)</enum><text>The term <term>covered polling place</term> means a polling place that accepts ballots cast for a Federal election only from voters in a particular precinct.</text></paragraph> 
<paragraph id="H79F3932E71C44BE88038A4EEB59CA7A8"><enum>(2)</enum><text>The term <term>vote center</term> means a polling place that accepts a ballot cast for a Federal Election from any voter regardless of the precinct of such voter.</text> </paragraph></section> </subtitle><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H2206A766BE994AFBAD7EDAB16E074AC9"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents of such Act is amended by inserting after the item relating to section 312 the following:</text>

<subsection id="H46F692D2BCDE4ECFA8865043ADB8FC15"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle D of title II of the Help America Vote Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/252">Public Law 107–252</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/52/21001">52 U.S.C. 21001 et seq.</external-xref>) is amended by adding at the end the following new part:</text> <quoted-block style="OLC" id="H02C94FF783ED4D0DA6B9E4F28DEF5B73" display-inline="no-display-inline"> <part id="H13C5802354F64A59A4421B9E7A72CF9D"><enum>7</enum><header>Grant Program for Polling Place Standards</header> <section id="H5E47FDD3569E4BD690C8D7CE2EAA9E30"><enum>298.</enum><header>Grant program for polling place standards</header> <subsection id="HD9A67CB0B42D4EEDA811B09F8954592E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall award grants to States to carry out the requirements of section 321.</text></subsection> 
<subsection id="HC62E567DFDDB4702BCA92A3E9FFE06B3"><enum>(b)</enum><header>Staffing</header><text>The Commission may hire employees as necessary to facilitate the grant program required in subsection (a).</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HCE52A744A60641A2918990CB758679B6"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents of such Act is amended by inserting after the item relating to section 296 the following:</text>

<section id="HA0CE066B32E1458A9C2993254AEFBC75"><enum>4.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated such sums as may be necessary to carry out this Act.</text></section> </legis-body></bill>
