<section id="HF8493A3BEAEF4BF1ADB401749195831A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Private Detention Corporate Accountability Act of 2026</short-title></quote>.</text></section> <section id="H858C4237CE2A4D2C929C30011823AE4E"><enum>2.</enum><header>Private detention center liability</header> <subsection id="H7502E803EBE14C4D8F34AF361DEB8B1A"><enum>(a)</enum><header>Private right of action</header><text display-inline="yes-display-inline">An officer or employee of a private detention center that causes the wrongful death of any person that was being held in such private detention center shall be liable, under the relevant State law, to the decedent or any successor in interest for—</text> 
<paragraph id="HB6B51642D41E4FB0B12348A8BDF7DBD7"><enum>(1)</enum><text display-inline="yes-display-inline">statutory damages in an amount not less than $5,000,000 and economic damages; and</text></paragraph> <paragraph id="H63C77179550F4614BE6730F0BBD60145" display-inline="no-display-inline"><enum>(2)</enum><text>punitive damages, as appropriate.</text></paragraph></subsection> 
<subsection id="H1E4CAD64CF524C509BC357D982F50EC6"><enum>(b)</enum><header>Action in district court</header><text display-inline="yes-display-inline">The decedent or any successor in interest that suffered the harm described under subsection (a) may bring an action in the appropriate district court of the United States for the relief described under such subsection.</text></subsection> <subsection id="H81D14BDBE5364A37AEA5DCC16E00CE8E"><enum>(c)</enum><header>Vicarious liability</header><text display-inline="yes-display-inline">A private detention center shall be vicariously liable for any harm described under subsection (a).</text></subsection> 
<subsection id="HFF93C91DFA274F298C46B08A8929A661"><enum>(d)</enum><header>No immunity defense</header><text display-inline="yes-display-inline">No officer or employee of a private detention center shall be entitled to assert any form of absolute or qualified immunity as a defense to liability under this section.</text></subsection> <subsection id="HD59A2552141A44F5932B6C9C0E75BA52"><enum>(e)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to limit the ability of the decedent or any successor in interest that suffered the harm described under subsection (a) from bringing an action in a State court for such harm.</text></subsection> 
<subsection id="HA5E427C2F0BD46BC82BBCA6AB67BFF1C"><enum>(f)</enum><header>Private detention center</header><text display-inline="yes-display-inline">The term <term>private detention center</term> means a private entity that has a contract with the Federal Government to hold any person due to any alleged or purported violations of civil, criminal, or immigration laws.</text></subsection> </section> </legis-body></bill>
