<section id="HDE31B678CCB545148C29410F239A89E5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Forced Abortions Act of 2026</short-title></quote>.</text></section> <section id="HD18CC3515714425FB48620E779E7957F"><enum>2.</enum><header>In general</header><text display-inline="no-display-inline">A Federal court—</text> 
<paragraph id="H55B9EAB9E88B421EBAC847C7B3AF27C2"><enum>(1)</enum><text display-inline="yes-display-inline">may not enforce any provision in a surrogacy contract that requires the surrogate mother to have an abortion at the request of any intended parent, party to a surrogacy contract, or agent of any party to a surrogacy contract; and</text></paragraph> <paragraph id="H345565375FD24DBAA19BF02A213C4716"><enum>(2)</enum><text display-inline="yes-display-inline">shall enforce any clause requiring the payment of a surrogate mother of any compensation agreed to in a surrogacy contract, notwithstanding any provision that requires the surrogate mother to have an abortion at the request of any intended parent, party to a surrogacy contract, or agent of any party to a surrogacy contract, including any provision providing for—</text> 
<subparagraph id="H20624E0EFA45421D9B0F756A3584D2E1"><enum>(A)</enum><text>liquidated damages based on a refusal to get an abortion;</text></subparagraph> <subparagraph id="H8D20D0C6DEC446169A028D4DD7C82D34"><enum>(B)</enum><text>reduction of payment based on a refusal to get an abortion; or</text></subparagraph> 
<subparagraph id="H6A62B0A6D6CD42BE92EC88568CDB158B"><enum>(C)</enum><text>otherwise requiring the surrogate mother to have an abortion at the request of any party or agent of any party to a surrogacy contract.</text></subparagraph></paragraph></section> <section id="H3A4CDF3FD94D4780A6E4BD326321B6BC"><enum>3.</enum><header>Jurisdiction of the courts</header> <subsection id="H926021897E544A558F6446A9CF1A4597"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/85">Chapter 85</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="H30C0044D601E413BBC1B0052C82B1F03" display-inline="no-display-inline"> 
<section id="HD8846ABD0DC64A66BF6B14565D69C2E1"><enum>1370.</enum><header>Surrogacy contracts</header><text display-inline="no-display-inline">The district courts shall have original jurisdiction of all civil actions where the matter in controversy is a surrogacy contract (as such term is defined in section 4 of the <short-title>Preventing Forced Abortions Act of 2026</short-title>) in or affecting interstate or foreign commerce.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HC5BA0B1A3DBB4F98A53D4C715D76FD21"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for such chapter is amended by adding at the end the following:</text>

<toc-entry level="section">1370. Surrogacy contracts.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HA546FD29906848CBB79CC683D5196D23"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H198B00B3C13D4E87A23BA3F3FFE53665"><enum>(1)</enum><header>Abortion</header><text display-inline="yes-display-inline">The term <term>abortion</term> means the use or prescription of any instrument, medicine, drug, or any other substance or device—</text> 
<subparagraph id="H3E18855BB14A4A2694CC2A98C45DBE0D"><enum>(A)</enum><text>to intentionally kill the unborn child of a woman known to be pregnant; or</text></subparagraph> <subparagraph id="H35121C74169E431E8C6BE226A19BCC4D"><enum>(B)</enum><text>to intentionally terminate the pregnancy of a woman known to be pregnant, with an intention other than—</text> 
<clause id="HC0DC66D6856F412E8A0EA08258D6FF04"><enum>(i)</enum><text>after viability to produce a live birth and preserve the life and health of the child born alive; or</text></clause> <clause id="H3D70AC14CE5F4068B5A00CC86B97C91D"><enum>(ii)</enum><text>to remove a dead unborn child.</text></clause></subparagraph></paragraph> 
<paragraph id="HB7F2C6F0A2E1498DAFF0911E69E03770"><enum>(2)</enum><header>Female</header><text>The term <term>female</term> means an individual who has, had, will have, or would have, but for a developmental or genetic anomaly or historical accident, a reproductive system that at some point produces, transports, and utilizes eggs for fertilization.</text></paragraph> <paragraph id="HB42E3440308B43F8AF621EC591E0C5CE"><enum>(3)</enum><header>Intended parent</header><text>The term <term>intended parent</term> means any individual who is a party to a surrogacy contract and who is the party who will take permanent custody of a child born pursuant to such contract.</text></paragraph> 
<paragraph id="H2A5A0B79ADDA4F4996CDF8011EB67810"><enum>(4)</enum><header>Surrogacy contract</header><text>The term <term>surrogacy contract</term> means an agreement setting forth the terms and conditions for the conception and birth of a child to a female with the intent of all parties being that such child shall immediately thereafter enter into the permanent custody of another individual.</text></paragraph> <paragraph id="HCE3A1190715E4E93AA0A912CBFF6EE2C"><enum>(5)</enum><header>Surrogate mother</header><text display-inline="yes-display-inline">The term <term>surrogate mother</term> means a female who is a party to a surrogacy contract and who is the party who will bear the child pursuant to such contract.</text></paragraph></section>
