<section id="H32863221C99A45C09CA6D16D3B52BF83" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ethical Investigations and Integrity Act</short-title></quote>.</text></section> 
<section id="H64E16662A3C549B0A3BC3B322B3ADCFF"><enum>2.</enum><header>Adverse interest agreement requirements</header> 
<subsection id="HA96E68AA9F6D4C2FA6233FC16E752752"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the event that the Secretary of Labor provides adverse assistance to an individual, prior to providing the adverse assistance, the Secretary shall—</text> <paragraph id="H044349BF4F194D588DC75B0D3F9EC3A6"><enum>(1)</enum><text>enter into a written agreement with the individual that details the nature and scope of such assistance; and</text></paragraph> 
<paragraph id="H2336375233624A64B1B8177E922F96DD"><enum>(2)</enum><text>provide a copy of such agreement to any employer or contractor that may be directly and adversely impacted by such assistance.</text></paragraph></subsection> <subsection id="H30CBC52651A345F4A80BE70D5B3F7D16"><enum>(b)</enum><header>Report</header> <paragraph id="H4AAA43FD0A44441B8D767DCC1F2467C5"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this Act, and by December 31 of each year that begins after such date, the Secretary shall submit to Congress a report containing information on all agreements to provide adverse assistance in effect for the preceding fiscal year, including, in relation to each such agreement—</text> 
<subparagraph id="HF4E792E1340849D4AA60CACC88833DA2"><enum>(A)</enum><text display-inline="yes-display-inline">a copy of the agreement, with any information described in subparagraph (2)(B) redacted;</text></subparagraph> <subparagraph id="H778B8BA1EB8642EFA8D006A21DBF77DE"><enum>(B)</enum><text>the date the agreement was entered into; and</text></subparagraph> 
<subparagraph id="HD540C84083EC4CC79DA12EEDCD699F2B"><enum>(C)</enum><text>a detailed description of the nature and scope of the assistance provided during the fiscal year, including—</text> <clause id="H221FE300C9814AFDA1DF8AD7E9F7315A"><enum>(i)</enum><text>the information shared, including the source, type, and amount of the information, and the date on which such information was shared;</text></clause> 
<clause id="H6E723E9441144E7BB6DB175CB09399EC"><enum>(ii)</enum><text>a log of verbal communications, including—</text> <subclause id="H6173723F71554585A67572DB7351D764"><enum>(I)</enum><text>the date of each communication;</text></subclause> 
<subclause id="HD2D14055052B4A99B9957DA9EB8BB6CF"><enum>(II)</enum><text>the parties engaged in such communication;</text></subclause> <subclause id="H2D53E739626448E6B39D96F6557F9B82"><enum>(III)</enum><text>the mode of communication; and</text></subclause> 
<subclause id="HF96F97FC25564D47803BBB87C90DC0CE"><enum>(IV)</enum><text>the nature of any information shared; and</text></subclause></clause> <clause id="HBF6C2C91F8C244B4B2141666B26330A6"><enum>(iii)</enum><text>a log of meetings, including—</text> 
<subclause id="H1C1F6524ABF845B981C6070E57A57B01"><enum>(I)</enum><text>the date of each meeting;</text></subclause> <subclause id="H424BEC0C6E114864B428F54FFAB71FD8"><enum>(II)</enum><text>the parties present at the meeting;</text></subclause> 
<subclause id="HA65AF09186074403BD1D6B81AC36E1DD"><enum>(III)</enum><text>mode of the meeting; and</text></subclause> <subclause id="H42541E5E22674BFDBB1A785EBE75FD8E"><enum>(IV)</enum><text>the purpose of such meeting and the nature of any information shared.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HE251CA4D0C5143C3A8A89852BEDD3D46"><enum>(2)</enum><header>Identifying information</header><text display-inline="yes-display-inline">The report described under paragraph (2)—</text> <subparagraph id="H8E45E2A048154964BD9E5FDA9AC8A0EE"><enum>(A)</enum><text>shall identify the parties to each agreement; and</text></subparagraph> 
<subparagraph id="H6B2024EEE23049AFA7D83084B1105839"><enum>(B)</enum><text>may not include any information that may be used to identify any other person (including an employer, contractor, or any other potential defendant).</text></subparagraph></paragraph></subsection> <subsection id="HED7A74792BAB42A68DE9CC34FDC0BC0D"><enum>(c)</enum><header>Existing arrangements</header><text display-inline="yes-display-inline">For the purposes of subsection (a), if, not later than 60 days after the date of enactment of this Act, the Secretary of Labor takes the actions required in paragraphs (1) and (2) of such subsection in relation to an existing arrangement to provide adverse assistance, the Secretary shall be deemed to have taken such actions prior to providing such adverse assistance.</text></subsection> 
<subsection id="H6AEC61DF27474D3DAEF0541179A80527"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="HB62EB9B529F1400F99D9D62D4F488641"><enum>(1)</enum><header>Adverse assistance</header><text display-inline="yes-display-inline">The term <term>adverse assistance</term> means assistance or advice, including the disclosure of information, that is directed specifically toward an attorney for potential use in a civil action under any covered law.</text></paragraph> 
<paragraph id="H86F45517A45A4DA5A44217D14DCB5F98"><enum>(2)</enum><header>Covered law</header><text>The term <term>covered law</term> means any provision of law that is enforced by the Wage and Hour Division of the Department of Labor as of the date of enactment of this Act.</text></paragraph> <paragraph id="H27F71C480E944B0DAA943082087BD9F8"><enum>(3)</enum><header>Employer</header><text>The term <term>employer</term> has the meaning given the term in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>). </text> </paragraph></subsection> </section>
