which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a grant program to support students, families, and school personnel impacted by immigration enforcement actions to ensure that schools remain safe, trauma-informed learning environments, and for other purposes.</official-title></form><legis-body id="H69F6BA8B5AC6491BB49671128580EA0D" style="OLC"><section id="HCC077F157543483FB3B0E2BA4319F682" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may cited as the <quote><short-title>Right to Learn Act of 2026</short-title></quote>.</text></section><section id="H1B7149B1D34F4F70B5B9B84E76B85E02"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H90F0ED0906EC4EB69F14F8FC95877158"><enum>(1)</enum><header>Community-based nonprofit organization</header><text display-inline="yes-display-inline">The term <term>community-based nonprofit organization</term> means a nonprofit entity that—</text><subparagraph id="H4924BEBC43634DA4A15A36D3E9D93803"><enum>(A)</enum><text>demonstrates expertise in trauma-informed care, educational equity, or immigrant family services; and</text></subparagraph><subparagraph id="H9CFBBC9800DA46ECBA489DBCEB29B777"><enum>(B)</enum><text>is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(a) of such Code.</text></subparagraph></paragraph><paragraph id="H156E1C8F07CB45178EC494D4941A5E94"><enum>(2)</enum><header>Culturally responsive care</header><text>The term <term>culturally responsive care</term> means practices, policies, or interventions that—</text><subparagraph id="H21F9ED77BC9945C586C4AD5E64F1A9DE"><enum>(A)</enum><text>recognize and affirm students’ cultural, linguistic, and community backgrounds;</text></subparagraph><subparagraph id="HB15E70F6AC534BC082576543DF29E0E8"><enum>(B)</enum><text>ensure that educational and mental health services are inclusive, equitable, and accessible to individuals of all racial, ethic, and national origins; and</text></subparagraph><subparagraph id="H454E8F0C61DE432EA9887136A697C278"><enum>(C)</enum><text>integrate students’ and families’ cultural strengths and perspectives into trauma-informed and educational support programs.</text></subparagraph></paragraph><paragraph id="H5A6164109A404AF2A9A62264E58F5FAA"><enum>(3)</enum><header>Early childhood program</header><text display-inline="yes-display-inline">The term <term>early childhood program</term> means a Head Start or Early Head Start program carried out under the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>), or a prekindergarten program that is licensed or regulated by a State and that receives Federal or State funds.</text></paragraph><paragraph id="HE9B043084E2F4004BEA2810CCD70C6F9"><enum>(4)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H584D831A83F34EFD9064A868B5FC1BFA"><enum>(A)</enum><text>a local educational agency;</text></subparagraph><subparagraph id="HAF2EAC678A0948DA973E2EECDE466C2C"><enum>(B)</enum><text>a public school;</text></subparagraph><subparagraph id="H0B39C2887D9D4F2BAED10832468C65BF"><enum>(C)</enum><text>an early childhood program;</text></subparagraph><subparagraph id="H35E4854B5BCE4C97A7CA89F4E2A7ACFB"><enum>(D)</enum><text>an institution of higher education;</text></subparagraph><subparagraph id="H25D5F81DAFFD402FBC367DF8742F484D"><enum>(E)</enum><text>a community-based nonprofit organization; or</text></subparagraph><subparagraph id="H244817671F1B496C8E0B2F90271BA887"><enum>(F)</enum><text>a legal service provider.</text></subparagraph></paragraph><paragraph id="H644AA3E8C5A2477C945F7BD6504379A3"><enum>(5)</enum><header>Immigration enforcement action</header><text display-inline="yes-display-inline">The term <term>immigration enforcement action</term> means any action carried out by or on behalf of the Department of Homeland Security for the purpose of enforcing the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)).</text></paragraph><paragraph id="H1A0B63CEEB0546FF86DE8C46DB0AF8D9"><enum>(6)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph id="H89EC8ED98C2E43CE8E817515DD562C16"><enum>(7)</enum><header>Know Your Rights services</header><text>The term <term>Know Your Rights services</term> means services that provide accurate, age-appropriate, and culturally and linguistically responsive information to students, families, educators, and school personnel regarding legal rights and available protections under Federal, State, and local law, including with respect to interactions with immigration enforcement, access to education and related services, due process rights, and protections against discrimination and unlawful search or questioning. </text></paragraph><paragraph id="H38B18851162E4D259CDDB369AE6D1CE1"><enum>(8)</enum><header>Legal service provider</header><text>The term <term>legal service provider</term> means a nonprofit legal services organization, legal aid organization, law school legal clinic, or pro bono legal network that provides representation, referral, or Know Your Rights services to immigrant children and families.</text></paragraph><paragraph id="HCA388D579857454CA7ABD146B5721ED0"><enum>(9)</enum><header>Local educational agency</header><text>The term <term>local educational agency</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="H35D98DFDC78947878744E697A987CFBC"><enum>(10)</enum><header>School personnel</header><text>The term <term>school personnel</term> means teachers, principals, administrators, school counselors, social workers, school psychologists, nurses, paraprofessionals, transportation staff, food service workers, custodial staff, security personnel, and any other individuals employed by, under contract with, or volunteering on behalf of an eligible entity described in subparagraphs (A) though (D) of <internal-xref idref="HE9B043084E2F4004BEA2810CCD70C6F9" legis-path="2.(4)">paragraph (4)</internal-xref>.</text></paragraph><paragraph id="H083244109D4A474592F35FF31D7E2248" commented="no"><enum>(11)</enum><header>Specified individual</header><text display-inline="yes-display-inline">The term <term>specified individual</term> means an individual—</text><subparagraph id="HD4B6088E142349BD92D4E97547C06444" commented="no"><enum>(A)</enum><text>who is not a United States national and who is present in the United States with or without lawful status under the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)); or</text></subparagraph><subparagraph id="H47A53F0D363B434AB035AECC91575A9C" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">who has a household member who is not a United States national and who is present in the United States with or without lawful status under the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)).</text></subparagraph></paragraph><paragraph id="H6DC10FF8CD4046B3BAF4CF7B98CD1753" commented="no"><enum>(12)</enum><header>Trauma-informed practice</header><text>The term <term>trauma-informed practice</term>, when used with respect to an approach to immigration enforcement action, means an approach in education or social services that recognizes and addresses the impact of traumatic stress on students, families, and staff, including through principles of safety, trust, empowerment, peer support, choice, and cultural responsiveness.</text></paragraph></section><section id="HEE6EE03108CB447D939F9433F4A2621E"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">The purposes of this Act are to—</text><paragraph id="H4DB8568EAF204FB39B837FCBA02D3EAC"><enum>(1)</enum><text display-inline="yes-display-inline">provide emergency resources to eligible entities to support students and educators impacted by immigration enforcement actions; </text></paragraph><paragraph id="HD381E45BC8CF44EE9EBEB886839D07F0"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that schools remain safe, trauma-informed environments for learning, especially for students who are specified individuals; </text></paragraph><paragraph id="HE8575F0A97C54FE28BF7E5896DC79D37"><enum>(3)</enum><text display-inline="yes-display-inline">affirm and reinforce the constitutional right to free, public education for all children, regardless of immigration status, as recognized in <italic>Plyler</italic> v. <italic>Doe</italic>, (457 U.S. 202 (1982)), and to prohibit discriminatory measures based on immigration status;</text></paragraph><paragraph id="H9DAFF1DF43C341439E34F7F90858C192"><enum>(4)</enum><text>reduce absenteeism, disengagement, bullying, and academic decline resulting from immigration enforcement action-related trauma and instability; and</text></paragraph><paragraph id="HA9C691FBB86E43DF9BC7277CC49F96AD"><enum>(5)</enum><text>support educators and staff in effectively responding to the needs of students who are specified individuals and their families.</text></paragraph></section><section id="H0FD1258C804C4A13A59B7241DC5A3993"><enum>4.</enum><header>Grant program establishes</header><subsection id="H7F2541FD247E4612A1D33914F2354981"><enum>(a)</enum><header>Authority</header><text>The Secretary of Education shall establish a competitive grant program to award funds to eligible entities for the purposes described in <internal-xref idref="H4F6DB3F5968148E684B58D98D79E4403" legis-path="4.(c)">subsection (c)</internal-xref>.</text></subsection><subsection id="H5FCB37D167D74106A67FE6E32ADFAC05"><enum>(b)</enum><header>Period of grants</header><text>Grants awarded under this Act shall be for a initial period not to exceed 3 years, but may be renewed annually as determined appropriate by the Secretary of Education based on performance and evaluation.</text></subsection><subsection id="H4F6DB3F5968148E684B58D98D79E4403"><enum>(c)</enum><header>Use of funds</header><text>An eligible entity receiving a grant under this Act may use grant funds for the following purposes:</text><paragraph id="HC33672CE72EA4A36BFEAD03E4DD312DC"><enum>(1)</enum><text display-inline="yes-display-inline">Student-focused stabilization services for students impacted by immigration enforcement actions, including—</text><subparagraph id="HDB1E929732CC4FF9B50E9348BF37DE49"><enum>(A)</enum><text>hiring or expanding access to bilingual counselors, social workers, trauma-informed staff, or school psychologists;</text></subparagraph><subparagraph id="H745592D2C7474C89BDEFFEDB65D1975C"><enum>(B)</enum><text display-inline="yes-display-inline">providing emergency assistance, including transportation, food, clothing, temporary shelter, or legal service navigation (including referral to legal service providers, partnerships with legal service providers, and payment of administrative or court fees related to immigration proceedings);</text></subparagraph><subparagraph id="H869E8411B6724E72B8C0B88EA6A76D80"><enum>(C)</enum><text display-inline="yes-display-inline">supporting in-school mental health services, community-based mental health providers, peer support groups, family-based counseling or therapeutic services, and safe and supporting school environments for students experiencing anxiety, fear, or trauma stemming from immigration enforcement actions; and </text></subparagraph><subparagraph id="HAD42038239EC41388B1AAB09AC673E10"><enum>(D)</enum><text>developing and delivering curriculum or instructional content concerning the history, contributions, and experiences of immigrants in the United States to foster inclusion and cultural awareness.</text></subparagraph></paragraph><paragraph id="H37505CE7D954424EB4E85FD49DE3399B"><enum>(2)</enum><text display-inline="yes-display-inline">School personnel-focused services and training, including—</text><subparagraph id="HF5ED6FD58AE649A5B017F22742E4D513"><enum>(A)</enum><text display-inline="yes-display-inline">providing mental health services, peer-support networks, or counseling to school personnel impacted by immigration enforcement actions (including school personnel who are specified individuals); and</text></subparagraph><subparagraph id="H14B78FA27D5B458391969C9EA41B711A"><enum>(B)</enum><text>professional development and training on—</text><clause id="HCB25F316BCE14FEE8661B5D9F4697172"><enum>(i)</enum><text>trauma-informed practices with respect to immigration enforcement actions;</text></clause><clause id="HF6C895F1EE2F4E1BA0AF439E36B62563"><enum>(ii)</enum><text>legal rights of immigrant students and families; and</text></clause><clause id="HFFD81704C11A443EBBF9F5AFAC1B2C42"><enum>(iii)</enum><text>culturally responsive care and immigration-related crisis response protocols.</text></clause></subparagraph></paragraph><paragraph id="H37F4D693A2224B21B9166F48C9871A6E"><enum>(3)</enum><text display-inline="yes-display-inline">Community collaboration and family engagement with respect to immigration enforcement actions, including—</text><subparagraph id="HD0F9E189C0FF47DB9CFED37434F323DE"><enum>(A)</enum><text>partnering with legal service providers, community-based nonprofit organizations, or family advocacy centers to provide Know Your Rights services, family reunification resources, and deportation defense or legal support;</text></subparagraph><subparagraph id="HFB198EDE903F44B389E80B4CE0681F95"><enum>(B)</enum><text>coordinating with local governments, local educational agencies, and community stakeholders to develop or revise protocols for school responses during immigration enforcement actions;</text></subparagraph></paragraph></subsection><subsection id="H1FC52EBD4FB84698A0035257B29E180A"><enum>(d)</enum><header>Selection criteria; priorities</header><text>In awarding grants under this Act, the Secretary of Education shall determine appropriate selection criteria, and shall give priority to an eligible entity that meets one or more of the following criteria:</text><paragraph id="H59FBAC3760AC4334AA70DEC0289C9DF3"><enum>(1)</enum><text>Serves a local educational agency or student population that is located in a community with immigration enforcement action.</text></paragraph><paragraph id="HE7C910BF5E3E4A3B873AD8BD8BDE95C0"><enum>(2)</enum><text display-inline="yes-display-inline">Serves populations with high rates of specified individuals.</text></paragraph><paragraph id="HA6DD58C23DB84DA6935F833256078D07"><enum>(3)</enum><text>Has established partnerships with community-based nonprofit organizations or legal service providers.</text></paragraph></subsection><subsection id="HC2177DA67FB8438CBFF02A5C79C06EA3"><enum>(e)</enum><header>Technical assistance, oversight, and evaluation</header><text>The Secretary of Education may reserve up to 5 percent of funds made available to carry out this Act for evaluation, oversight, monitoring, and technical assistance to grantees.</text></subsection></section><section id="H2E51770724434F0194F3D15F255BE68D"><enum>5.</enum><header>Protections and nondiscrimination</header><subsection id="HBE004DEAC4AF430CB38BCEAE0D808000"><enum>(a)</enum><header>Collection, use, and treatment of data</header><paragraph id="HE88E17DBF8DA4811ABF63E65B1562306"><enum>(1)</enum><header>Prohibition on status inquiry or disclosure</header><text display-inline="yes-display-inline">In carrying out this Act, the Secretary of Education or an eligible entity receiving funds under this Act may not request, collect, or disclose personally identifiable information concerning the immigration or citizenship status of any student or family member, except where such disclosure is expressly required by a Federal law other than this Act that relates to the collection or disclosure of immigration or citizenship information for the administration of a Federal program or investigation, or by a judicial order issued under such a law.</text></paragraph><paragraph id="H03E8087BEA904A4188C75A5C2939C7EB" commented="no"><enum>(2)</enum><header>Data to administer grant</header><text display-inline="yes-display-inline">To administer and carry out the grant program under this Act, the Secretary of Education and any eligible entity receiving funds under this Act may use non-personally identifiable information from Federal, State, or local governments or local educational agencies to determine, within a community to be served by a grant under this Act, the occurrence of immigration enforcement action and the population of specified individuals. </text></paragraph></subsection><subsection id="H1A31C22DFBC9499E94A4F1267956E6EC" commented="no"><enum>(b)</enum><header>Nondiscrimination</header><text>No eligible entity may deny or limit services or supports provided under this Act on the basis of actual or perceived immigration status of a student, family member, or school personnel who is impacted by immigration enforcement action. </text></subsection><subsection id="H5B52DFAAE8E649C7BF2AAC53BA64874E"><enum>(c)</enum><header>Compliance</header><text>Each eligible entity applying for a grant under this Act shall certify compliance with applicable Federal privacy and civil rights laws, as determined by the Secretary of Education, including the Family Educational Rights and Privacy Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>) and title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>).</text></subsection></section><section id="H9ECDB35A632F45A892B5183B59D1607E"><enum>6.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this Act $250,000,000 for each of the fiscal years 2027 through 2031.</text></section></legis-body></bill>
