Committee on Ways and Means, and in addition to the Committee on Energy
and Commerce, for a period to be subsequently determined by the
Speaker, in each case for consideration of such provisions as fall
within the jurisdiction of the committee concerned

A BILL
To amend title XVI of the Social Security Act to treat certain
individuals receiving child's insurance benefits as receiving
supplemental security income benefits for purposes of determining
Medicaid eligibility.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Childhood Disability Benefits
Fairness Act''.
SEC. 2. TREATING CERTAIN INDIVIDUALS RECEIVING CHILD'S INSURANCE
BENEFITS AS RECEIVING SUPPLEMENTAL SECURITY INCOME
BENEFITS FOR PURPOSES OF DETERMINING MEDICAID
ELIGIBILITY.
(a) In General.--Section 1634(c) of the Social Security Act (42
U.S.C. 1383c(c)) is amended to read as follows:
``(c) Any individual entitled to child's insurance benefits which
are payable under section 202(d) shall be treated for purposes of title
XIX as receiving benefits under this title so long as such individual
would be eligible for benefits under this title in the absence of such
child's insurance benefits.''.
(b) Effective Date.--The amendment made by this section shall apply
with respect to any determination or redetermination of eligibility for
medical assistance under a State plan (or a waiver of such plan) under
title XIX of the Social Security Act (42 U.S.C. 1396 et seq.) made on
or after the date of the enactment of this section.
