<section id="HA135B5EEAACB42B69F7807CEECBD6B9B" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advancing Capital for Critical Energy Supply and Security Act</short-title></quote> or the <quote><short-title>ACCESS Act</short-title></quote>.</text></section> 
<section id="H6546FBB3B5D74D39895A52BB99F0BF08"><enum>2.</enum><header>Modernization of rules related to publicly traded partnerships</header> 
<subsection id="H1E9E26986B6C43B083EC2431140BF91C"><enum>(a)</enum><header>Exclusion of certain publicly traded classes of units from unrelated business taxable income</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/512">Section 512(b)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text> <quoted-block style="OLC" id="H0F4B4AB5D91245D2BA97D1C31C22F50D" display-inline="no-display-inline"> <paragraph id="H8BE1B93852EE4E38922EAA7346AB0B72"><enum>(20)</enum><header>Treatment of publicly traded classes of units of publicly traded partnerships</header><text display-inline="yes-display-inline">There shall be excluded any income, gain, deduction, loss, or credit attributable to publicly traded classes of units of a publicly traded partnership (as defined in section 7704(b)) which is not treated as a corporation under section 7704(c), provided that the beneficial owner of such publicly traded classes of units owns (or is considered as owning within the meaning of section 318) less than 5 percent of the capital or profits of such publicly traded partnership.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB2C9300B4E9942EAAC64BAD580261B01"><enum>(b)</enum><header>Modification of 25 percent asset test for regulated investment companies</header><text>Section 851(b)(3)(B) of such Code is amended—</text> <paragraph id="HE32BF014F80A495F80F8D32FD0BC6B61"><enum>(1)</enum><text>in clause (i), by adding <quote>or</quote> at the end,</text></paragraph> 
<paragraph id="H2F148F9CF3804087A0C36FD0C8894F18"><enum>(2)</enum><text>in clause (ii), by striking <quote>, or</quote> at the end and inserting a period, and</text></paragraph> <paragraph id="H8622ECE4B669429FB561B3EC2D385776"><enum>(3)</enum><text>by striking clause (iii).</text></paragraph></subsection> 
<subsection id="HC18EA04672D744689F25F26C9D8B938C"><enum>(c)</enum><header>Elimination of separate application of passive activity rules in case of publicly traded partnerships</header><text>Section 469 of such Code is amended by striking subsection (k) and by redesignating subsection (l) as subsection (k).</text></subsection> <subsection id="HB018ACCE3FCB4287A458EE9B453F08A6" commented="no"><enum>(d)</enum><header>Certain interests in publicly traded partnerships not treated as effectively connected income</header> <paragraph id="H775A30336A4F4DB89F9C53587CAF059D" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 864(c)(8) of such Code is amended by redesignating subparagraphs (C) through (E) as subparagraphs (D) through (F), respectively, and by inserting after subparagraph (B) the following new subparagraph:</text>

<subparagraph id="HE8ED0DA844174D098A2902DAB97F3D7D" commented="no"><enum>(C)</enum><header>Exception for certain interests in publicly traded partnerships</header><text display-inline="yes-display-inline">Subparagraph (A) shall not apply in the case of a partner’s sale or exchange of a class of partnership interest which is regularly traded on an established securities exchange, but only if at all times during the 5-year period ending on the date of such sale or exchange, the partner held not more than 10 percent of such class.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H2A21E964E7A447A58564C392FE11A09B" commented="no"><enum>(2)</enum><header>Withholding requirements</header><text display-inline="yes-display-inline">Section 1446(f)(1) of such Code is amended by inserting <quote>, other than a class of partnership interest which is regularly traded on an established securities exchange,</quote> after <quote>interest in a partnership</quote>.</text></paragraph></subsection> 
<subsection id="H60D04F5AF199428186AA0BCC4461BFF6"><enum>(e)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2026.</text> </subsection></section> </legis-body></bill>
