<section id="H460ED900A09B47F889DEB0D9A35DCAEE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Removing Existing Pipes with Lead and Advancing Clean Environments Act</short-title></quote> or the <quote><short-title>REPLACE Act</short-title></quote>.</text></section> <title id="H67FB5463B2274F518C6610F0BE179109"><enum>I</enum><header>Housing Lead Hazard Remediation and Preservation</header> <section id="H6D2A343F64164E44A92C9EAC8D25D579"><enum>101.</enum><header>Modernization of existing lead-based paint hazard reduction grant program</header><text display-inline="no-display-inline">Section 1011 of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/4852">42 U.S.C. 4852</external-xref>) is amended—</text> 
<paragraph id="HD2F907D06E614E3799F0320E3B55A3B5"><enum>(1)</enum><text>in subsection (d)—</text> <subparagraph id="HAE090A6F6E51464CA329798957F1FC5A"><enum>(A)</enum><text>in paragraph (4), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="H8BF8A7042902468BA01231B61D2B2332"><enum>(B)</enum><text>in paragraph (5), by striking the period at the end and inserting a semicolon; and</text></subparagraph> <subparagraph id="HF43B12A2E0A042FCA19035EAC6D7DBF4"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph id="HCC3951FADDAF429B8147C28331B47A55"><enum>(6)</enum><text>the extent to which the proposed activities will preserve safe and habitable housing units that would otherwise remain unsafe for occupancy due to lead-based paint hazards; and</text></paragraph> <paragraph id="H17AAD70E543C4229B0AB340DF41A2EC7"><enum>(7)</enum><text>the extent to which the jurisdiction to be served has elevated childhood lead exposure and significant concentrations of housing constructed before January 1, 1978.</text></paragraph> <after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H81F6EAA459E24870B84EBC2CE54443B9"><enum>(2)</enum><text>in subsection (e)—</text> <subparagraph id="H7673EDAC54F8438EAF391C35B576800B"><enum>(A)</enum><text>by striking paragraph (10);</text></subparagraph> 
<subparagraph id="H8098C1793C72496DB8C4A125231F43A5"><enum>(B)</enum><text>by redesignating paragraphs (1) through (9) as subparagraphs (A) through (I), respectively;</text></subparagraph> <subparagraph id="H9459249FDE3146E18CB1631129C692B3"><enum>(C)</enum><text>by striking <quote>A grant</quote> and inserting the following: </text>

<paragraph id="H90C76B8F77424EEFA8D02B94695F0B16"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A grant</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HFB978C31C2CC47C9B227FA5173CB56D2"><enum>(D)</enum><text>in subparagraph (I), as so redesignated by subparagraph (A), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="H17AB992D6F414AC986A0A5206F479159"><enum>(E)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (I), as so redesignated by subparagraph (A), the following:</text> <quoted-block id="H93E6C441B8854A8EBDC2F876A53E67E8" style="OLC"> <paragraph id="H9D91C3F1CC68459EA278E215CA69B509"><enum>(J)</enum><text>conduct clearance examinations and related post-remediation testing;</text></paragraph> 
<paragraph id="H3EC6663E4C1E400EAD443B929E7FDA0F"><enum>(K)</enum><text>provide for repairs, rehabilitation, and housing preservation activities directly related to the elimination and long-term control of lead-based paint hazards, including repairs necessary to complete and maintain lead-safe conditions;</text></paragraph> <paragraph id="HCF5EC5D160024361873996FA03ABA1CE"><enum>(L)</enum><text>support local implementation capacity, including inspection support, lead-safe certification systems, rental registry integration, permitting systems, data modernization, and compliance administration;</text></paragraph> 
<paragraph id="HD46EBF7F94814F47B1D00ED123AB26E4"><enum>(M)</enum><text>support workforce development, contractor training, certification readiness, apprenticeship support, and other activities that expand the capacity of firms and workers to perform lead-safe housing remediation consistent with applicable Federal requirements; </text></paragraph> <paragraph id="H70CC911F92554ED7A503748306706781"><enum>(N)</enum><text>provide technical assistance and case management to owners and occupants to facilitate completion of lead hazard reduction activities; and</text></paragraph> 
<paragraph id="H029977CBFFB94E2098D7BF144B5D433E"><enum>(O)</enum><text>carry out such other activities that the Secretary determines appropriate to promote the purposes of this Act.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H37CD098762854623930CC6F91353777D"><enum>(F)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H007F5D36DA144A1DBB16A8F758D3BC66" display-inline="no-display-inline"> 
<paragraph id="HE6A5A30975C24DB8B3F031E02A2965E8"><enum>(2)</enum><header>Addressing water related hazards</header> 
<subparagraph id="HE3EB21B62A744F039C2F45DD9BF08A43"><enum>(A)</enum><header>In general</header><text>Any risk assessment, lead paint investigation, or remediation activity conducted under paragraph (1) shall include an evaluation of water-related lead hazards, including an evaluation of whether lead may be present in—</text> <clause id="H4B82858EF87545D2824786005333A720"><enum>(i)</enum><text>the water service line; and</text></clause> 
<clause id="H4C8E0C4608B74946822C2A8ECEE8278E"><enum>(ii)</enum><text>any interior plumbing.</text></clause></subparagraph> <subparagraph id="H1BD20C94BE2F4660AFCC471B791CB682"><enum>(B)</enum><header>Inspection and follow up</header><text>If the evaluation under subparagraph (A) indicates that there may be a water-related lead hazard present, the grantee shall provide for further inspection and follow-up to remediate such hazard.</text></subparagraph> 
<subparagraph id="HCDA85E8078F146169318529CA72F0B0D"><enum>(C)</enum><header>Interim protective measures</header><text>If a water-related lead hazard is identified under the evaluation described in subparagraph (A), the grantee shall provide interim protective measures until the hazard is remediated, including—</text> <clause id="H6D059B51FB454D8E9641A2413641DBF5"><enum>(i)</enum><text display-inline="yes-display-inline">the provision of point-of-use filters certified under NSF/ANSI standards for lead reduction; and</text></clause> 
<clause id="H2719B98BBC604DB28BF72A2A62CE4DB2"><enum>(ii)</enum><text display-inline="yes-display-inline">faucet replacements or compatibility measures where necessary.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HF996ABFAF09041DE95CC436934585C49"><enum>(3)</enum><text>in subsection (g), by striking paragraphs (1) and (2) and inserting the following:</text> 
<quoted-block id="HF71D8054031D4A95AA2C18757CAEEAA0" style="OLC"> 
<paragraph id="HB76A0FBAA4FC4FCD9467E045ADDC9D0D"><enum>(1)</enum><header>In general</header><text>The Secretary shall develop the capacity of eligible applicants to carry out activities under this section, including by providing technical assistance relating to program design, implementation, procurement, inspection capacity, financial management, compliance systems, data collection, and coordination with other Federal, State, local, and private resources.</text></paragraph> <paragraph id="HEAC8AEBBA46A4EDC996BD2B367B15E30"><enum>(2)</enum><header>Training and certification support</header><text>The Secretary may provide technical assistance and capacity-building support to assist eligible applicants and subrecipients in developing workforce capacity, contractor pipelines, and training, certification, or accreditation support consistent with section 402 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2682">15 U.S.C. 2682</external-xref>).</text></paragraph> 
<paragraph id="H5D430FCD1E154521A83AA832D1725AE0"><enum>(3)</enum><header>Use of amounts</header><text>Of amounts otherwise made available to carry out this section, the Secretary may use such amounts as may be necessary to carry out this subsection.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="HBC2CBE4B6E8544FAA0EBD98DB6E0CFC4"><enum>(4)</enum><text>in subsection (l)—</text> 
<subparagraph id="HF3F9F3B21C6B48D89EEF26C1ADB25335"><enum>(A)</enum><text>in paragraph (4), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="HEDA7B5AA924543D98729E8CB76EE0C10"><enum>(B)</enum><text>in paragraph (5), by striking the period at the end and inserting a semicolon; and</text></subparagraph> 
<subparagraph id="H66C464A0F317424281D076032A0F24D7"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block id="H76925E74021941838AB00E082285B10B" style="OLC"> <paragraph id="HA945D9C0367B42CC97FE4C2FFF868FCA"><enum>(6)</enum><text>states the number of households served and the number of occupants temporarily relocated;</text></paragraph> 
<paragraph id="H4DFC08F84DDB4F39A3D8D42378B7DC7E"><enum>(7)</enum><text>states the number of residential dwellings in which lead-based paint hazards have been cleared for reoccupancy following hazard reduction activities; and</text></paragraph> <paragraph id="H85F7D6AE2D4F4EAEA8D8538F8B01F7A4"><enum>(8)</enum><text>describes activities undertaken to preserve habitable housing units and strengthen local implementation capacity.</text></paragraph> <after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H2C74592DE7C24B45B688CB1858DC3C5D"><enum>(5)</enum><text>by redesignating subsections (o) and (p) as subsections (q) and (r), respectively; and</text></paragraph> <paragraph id="H2C60B3E796294C94A939903AC104EFFC"><enum>(6)</enum><text>by inserting after subsection (n) the following:</text>

<subsection id="H002BD6F2579C4BBCB9688582CAF94400"><enum>(o)</enum><header>Coordination with environmental protection agency</header> 
<paragraph id="HCFE625E6E3E14D6C818D68452086A44F"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out this section in consultation with the Administrator of the Environmental Protection Agency to ensure that activities assisted under this section are consistent with applicable requirements relating to lead-based paint activities, renovation, repair and painting, training, certification, disclosure, and lead-safe work practices in target housing and child-occupied facilities.</text></paragraph> <paragraph id="H0C6ED973EBA44D36B776040331581F7C"><enum>(2)</enum><header>Joint guidance</header><text>Not later than 1 year after the date of enactment of this subsection, the Secretary and the Administrator shall issue joint guidance regarding—</text> 
<subparagraph id="H49C4BBCA83374E6A8A21D3CA1994D0BF"><enum>(A)</enum><text>best practices for grantees and subgrantees carrying out lead-safe housing remediation, including with respect to water-related lead hazards, under this section;</text></subparagraph> <subparagraph id="HE75970A2101D46C8A57E3DB07E4803F8"><enum>(B)</enum><text>strategies to align assistance under this section with State and Tribal lead-based paint programs authorized or supported under title IV of the Toxic Substances Control Act; and</text></subparagraph> 
<subparagraph id="H288E0425853946C78D4CB14AA0B75CE1"><enum>(C)</enum><text>opportunities to streamline technical assistance, grantee education, and local implementation support.</text></subparagraph></paragraph> <paragraph id="H2E42647C72524E01AC56AE62D7526E13"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this subsection may be construed to modify, supersede, or limit any authority of the Administrator under the Toxic Substances Control Act or this Act.</text></paragraph></subsection> 
<subsection id="HB425C2742E084B8498A71C409BE4B64E"><enum>(p)</enum><header>Corrective action and expenditure support</header> 
<paragraph id="HC8761D0C86BF4F55B4A9C0D8DA274A70"><enum>(1)</enum><header>Notice and opportunity to cure</header><text>If the Secretary determines that a grantee under this section is at substantial risk of failing to obligate or expend grant amounts in a timely manner, the Secretary shall, before recapturing amounts made available to such grantee as described in paragraph (4), provide notice of such determination and an opportunity for the grantee to enter into a corrective action plan.</text></paragraph> <paragraph id="H2C666F176FCF4A63B5BFC2E76E8AAE64"><enum>(2)</enum><header>Corrective action plan</header><text>A corrective action plan under paragraph (1) may include—</text> 
<subparagraph id="H907181C4AF2442648FA0FC2E37CEE77F"><enum>(A)</enum><text>technical assistance;</text></subparagraph> <subparagraph id="H584E28F52DBC4F68B928D9E650D17557"><enum>(B)</enum><text>revised implementation benchmarks;</text></subparagraph> 
<subparagraph id="HA57EFD3F50824CC884086BA9C3816494"><enum>(C)</enum><text>approval of subgrants, subrecipients, or partnerships with qualified local entities;</text></subparagraph> <subparagraph id="H3B51608C8DB14F419CF50F4E8117B3FF"><enum>(D)</enum><text>procurement support;</text></subparagraph> 
<subparagraph id="HB528CAE476944AA49C428E9F036FE748"><enum>(E)</enum><text>workforce, contractor, inspection, or clearance capacity support;</text></subparagraph> <subparagraph id="HF8114679CD2C4986AC3976E397DBD395"><enum>(F)</enum><text>data or compliance system improvements; and</text></subparagraph> 
<subparagraph id="HF223D69848EC47AFA64762AF4DE4394F"><enum>(G)</enum><text>such other measures as the Secretary determines appropriate to facilitate timely expenditure and completion of lead hazard reduction activities.</text></subparagraph></paragraph> <paragraph id="HCF0CFB2C7BB347B9988AB9BB2B3F04B5"><enum>(3)</enum><header>Extensions</header><text>The Secretary may extend applicable expenditure or performance deadlines for a grantee that demonstrates good-faith efforts to carry out activities under this section and a reasonable likelihood of completing such activities within the extended period.</text></paragraph> 
<paragraph id="H620887CAF6AB45BD8FE8DB4C4FEBF825"><enum>(4)</enum><header>Retention of funds within jurisdiction where practicable</header><text>If, after providing the opportunity described in paragraph (1), the Secretary determines that the grantee remains unable to carry out activities under this section, the Secretary may recapture unobligated amounts and reallocate such amounts to another eligible grantee, subrecipient, or qualified local entity serving the same jurisdiction, to the extent practicable.</text></paragraph> <paragraph id="H5C1BD2F503134C6EA502DB5E84AC73D6"><enum>(5)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to require the Secretary to retain or extend assistance in cases involving fraud, waste, abuse, or persistent noncompliance with applicable law.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> </section></title> 
<title id="H79A7B219E4D44CD5B6728E0C93963B24"><enum>II</enum><header>Lead Service Line Coordination and Replacement</header> 
<section id="H3099148DF3744D3E99186504D03A2FFD"><enum>201.</enum><header>Amendments to existing lead reduction in drinking water authority</header><text display-inline="no-display-inline">Section 1459B of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-19b">42 U.S.C. 300j–19b</external-xref>) is amended—</text> <paragraph id="H2FE98693305341D1A8CEAA0F319718EC"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H4C0517085F3F44958352F244CD378149"><enum>(A)</enum><text>in paragraph (2)—</text> <clause id="H0123AB817A144839945AAE529550985D"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>lead service lines</quote> each place it appears and inserting <quote>covered service lines</quote>; and</text></clause> 
<clause id="H0678E235C13A4FF3B851FD0772CB404C"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>lead service line</quote> each place it appears and inserting <quote>covered service line</quote>; </text></clause></subparagraph> <subparagraph id="HA2C82C07EE854BDA93F8C065D86805F2"><enum>(B)</enum><text>by redesignating paragraphs (2) through (5) as paragraphs (4) through (7), respectively; and</text></subparagraph> 
<subparagraph id="H67424009B03549CE8F3744A26A29BCD8"><enum>(C)</enum><text>by inserting after paragraph (1) the following:</text> <quoted-block style="OLC" id="H042CA60BFAE047D982B05AC779B27CA2" display-inline="no-display-inline"> <paragraph id="H065F2695289043428B1AC43C66CE561B" commented="no"><enum>(2)</enum><header>Covered service line</header><text display-inline="yes-display-inline">The term <term>covered service line</term> means a lead service line or a galvanized requiring replacement service line.</text></paragraph> 
<paragraph id="H94AA5D22B4324599A1810A4963E9F3C4"><enum>(3)</enum><header>Galvanized requiring replacement service line</header><text display-inline="yes-display-inline">The term <term>galvanized requiring replacement service line</term> means a galvanized pipe and its fittings, which connect a drinking water main to a building inlet, that—</text> <subparagraph id="HFC68A6293F5447A0AEC065973382C446"><enum>(A)</enum><text>has ever been downstream of a lead service line;</text></subparagraph> 
<subparagraph id="H7FFB6976FBFA441BACD22812D56A2C89"><enum>(B)</enum><text display-inline="yes-display-inline">is downstream of a lead-status-unknown service line; or</text></subparagraph> <subparagraph id="H1C30F62D06E34D1B940248B4443B341E"><enum>(C)</enum><text>the applicable public water system is unable to demonstrate was never downstream of a lead service line.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HB9684AB4F4E3416D937ACDE0E6C212B8"><enum>(2)</enum><text>in subsection (b)—</text> <subparagraph id="H30F41046021247AB9B7A195173865A7E" commented="no"><enum>(A)</enum><text>in paragraph (3)—</text> 
<clause id="HE0B5288AC05748EDAE0FDDCBBFE56729" commented="no"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>shall give priority to an eligible entity that</quote>;</text></clause> <clause id="H4E89F2462A404572BDE83ADE75E3993D" commented="no"><enum>(ii)</enum><text>in subparagraph (B)—</text>

<clause id="H93BFFB851E934E9D8761D1805EDA79E2" commented="no"><enum>(iii)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively (and adjusting the margins accordingly);</text></clause> <clause id="H8A4105FF756C4A07BFEE8EB716E03C5D" commented="no"><enum>(iv)</enum><text>by inserting before clause (i), as so redesignated, the following: </text>

<quoted-block id="HC9C4C21A3B4B4E3285411B52E0213042" style="OLC"> 
<subparagraph id="H9C51E8AB3C0A46E88D10E79D430B5FF1" commented="no"><enum>(B)</enum><text>may give additional consideration, where practicable, to an eligible entity serving a jurisdiction with—</text> <clause id="H9F7488DF30FE46D4BA793CDFFCCC8875" commented="no"><enum>(i)</enum><text>elevated childhood lead exposure; or</text></clause> 
<clause id="H2555AE8E3E74479385BC25CBC84ECE69" commented="no"><enum>(ii)</enum><text>significant concentrations of housing that may contain lead hazards, including housing constructed before January 1, 1978.</text></clause> </subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H1AB9D0EDEED14A95887C112156DE9E7E"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking <quote>lead service lines</quote> each place it appears and inserting <quote>covered service lines</quote>;</text></subparagraph> 
<subparagraph id="H003F936024AB4C9388E823E6DAF66414"><enum>(C)</enum><text>in paragraph (6)—</text> <clause id="H38D3ADAFADD24180AA93D93EEF2D25FE"><enum>(i)</enum><text display-inline="yes-display-inline">in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">lead service line</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">covered service line</header-in-text></quote>;</text></clause>

<paragraph id="HEC5F95EAE4BA4EF09FDB674037E142E8"><enum>(7)</enum><header>Technical assistance and implementation support</header><text>The Administrator may provide, directly or through grants, cooperative agreements, or contracts, technical assistance and implementation support to eligible entities to assist with—</text> <subparagraph id="H212E1ACECFAD46F49089BB8C4F1B11A8"><enum>(A)</enum><text>identification and inventory of covered service lines;</text></subparagraph> 
<subparagraph id="HF0DB7794C9DD4D039E30DB6D229CB188"><enum>(B)</enum><text>lead reduction project planning and design;</text></subparagraph> <subparagraph id="H67FA4BFA9EE54E8BB0DA018C1B277D1B"><enum>(C)</enum><text display-inline="yes-display-inline">coordination of full replacement of publicly and privately owned portions of covered service lines;</text></subparagraph> 
<subparagraph id="HBBFE34DD7A8B46B1B4F0AD0C235DD455"><enum>(D)</enum><text>customer outreach and consent processes;</text></subparagraph> <subparagraph id="HABD051F5FFE842E4827F0B76A985AC1B"><enum>(E)</enum><text>coordination with assistance under section 1452 and other Federal, State, Tribal, local, or private resources; and</text> </subparagraph> 
<subparagraph id="HC26E87944C064B81B47C99F500E476C1"><enum>(F)</enum><text>such other activities as the Administrator determines appropriate to facilitate timely and complete lead reduction projects.</text></subparagraph></paragraph> <after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H6EDDF0CBE16B418E84FD88E07767B8B9"><enum>(3)</enum><text>in subsection (d)(4)(C), by striking <quote>lead service lines</quote> and inserting <quote>covered service lines</quote>; and</text></paragraph>
