<section id="H358220FED28446F8AB0CADE6B71F3BE1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lawful Hemp Protection Act</short-title></quote>.</text></section> <section id="H6BA5E2536FCF44B98DD947F83D3EBA57"><enum>2.</enum><header>Findings</header> <text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HD3C630166034444592622AD989BFA7B0"><enum>(1)</enum><text>Protecting minors and preventing children’s access to hemp products is central to the public interest and to the long-term credibility of the hemp industry. Strong age-control measures are necessary to prevent misuse and safeguard public health.</text></paragraph> <paragraph id="H713E68C4D1104FE9873EE39302292BE6"><enum>(2)</enum><text>Many Americans, including veterans and seniors, rely on consumer hemp products for wellness. Ensuring that such products are consistently manufactured, accurately labeled, and domestically sourced is essential to maintaining public trust and protecting consumers.</text></paragraph> 
<paragraph id="H9A630D2807594B6BB9692A645EE6A662"><enum>(3)</enum><text>Clear provenance standards and the elimination of deceptive or look-alike products promote responsible industry growth, protect consumers, and reinforce confidence in lawful hemp commerce.</text></paragraph> </section> <section id="HBB42CDCAD11844369A6838A304611B10" commented="no"><enum>3.</enum><header>Definition of hemp</header> <subsection id="H1679C176A665401B91F7DB525A920D1D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 297A of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639o">7 U.S.C. 1639o</external-xref>) is amended—</text> 
<paragraph id="HC608C6CCA45545B9A0FD9794842B42A0" commented="no"><enum>(1)</enum><text>by redesignating paragraphs (2) through (6) as paragraphs (4) through (8), respectively; and</text></paragraph> <paragraph id="H96ED2B9D60F141D48FAF672AB500D4F6" commented="no"><enum>(2)</enum><text>by striking paragraph (1) and inserting the following:</text>

<paragraph id="HD650F44002F14F5CB47025DC0197100C" commented="no"><enum>(1)</enum><header>Hemp</header></paragraph> 
<subparagraph id="HA45A6F1909194D37BAC35ACF9F88F2F8" commented="no">
                            <enum>(A)</enum>
                            <header>In general</header>
 <text display-inline="yes-display-inline">The term <term>hemp</term> means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all naturally occurring derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a total tetrahydrocannabinol concentration (including tetrahydrocannabinol acid) of not more than 1 percent on a dry weight basis.</text>
                        </subparagraph> 
<subparagraph id="H2F883166B5494886B739AE07212CB9DD" commented="no"><enum>(B)</enum><header>Inclusion</header><text>Such term includes industrial hemp.</text></subparagraph> <subparagraph id="H5E61F5EC1A774A38BCC8BEAEAC52DBE5" commented="no"><enum>(C)</enum><header>Exclusions</header><text>Such term does not include—</text> 
<clause id="HE22A2E10D58F40D8BA77C6B9481BB566">
                                <enum>(i)</enum>
 <text display-inline="yes-display-inline">any viable seed from a Cannabis sativa L. plant where the seed exceeds a total tetrahydrocannabinol concentration (including tetrahydrocannabinol acid) of more than 1 percent on a dry weight basis;</text>
                            </clause> 
<clause id="HA262767FF65F4183AFC2B16E3095A488"><enum>(ii)</enum><text>any intermediate hemp-derived cannabinoid product containing—</text> <subclause id="HBC7529E37CCD43FA865AAD219312CDA2"> <enum>(I)</enum> <text>cannabinoids that are not capable of being naturally produced by a Cannabis sativa L. plant; or</text>
                                </subclause> 
<subclause id="H3B62840E077842C89C4C7DC0D7992CAD" commented="no">
                                    <enum>(II)</enum>
 <text display-inline="yes-display-inline">cannabinoids that are capable of being naturally produced by a Cannabis sativa L. plant and—</text>
                                    <item id="H2E830D8D22354AE09E3018851EEC2C6E" commented="no">
                                        <enum>(aa)</enum>
 <text display-inline="yes-display-inline">are produced, manufactured, or converted using chemical synthesis, hydrogenation, acetylation, alkylation, or any other artificial process that adds to, removes from, or otherwise alters the molecular structure of a cannabinoid so that it contains one or more functional groups or substituents that are not present in any naturally occurring cannabinoid constituent of Cannabis sativa L., including—</text>
                                        <subitem id="H7E377071F20A45939F29D8CF029C4CDD" commented="no">
                                            <enum>(AA)</enum>
 <text>hexahydrocannabinol (HHC);</text> </subitem> <subitem id="H437F52058D994E63B4C3B5AF57C452E9" commented="no"> <enum>(BB)</enum> <text>tetrahydrocannabinol acetate (THC–O–acetate);</text>
                                        </subitem>
                                        <subitem id="H5A7C2A9807284511ACE9807E06254ADA" commented="no">
                                            <enum>(CC)</enum>
 <text>tetrahydrocannabiphorol (THCP); and</text> </subitem> <subitem id="HBCFFDC23A0864CA2B2206216B7700E9D" commented="no"> <enum>(DD)</enum> <text>any other artificially modified analog or homologue of a naturally occurring cannabinoid, as determined by the Secretary in consultation with the Secretary of Health and Human Services; or</text>
                                        </subitem>
                                    </item>
                                    <item id="H1C5FFA7ADBF74278AD72D4329B417890" commented="no">
                                        <enum>(bb)</enum>
 <text display-inline="yes-display-inline">are produced, manufactured, or converted using any solvent, extraction method, or other means of production determined by the Secretary, in consultation with the Secretary of Health and Human Services, to pose a risk to the public health;</text>
                                    </item>
                                </subclause></clause> 
<clause id="H154AD702F7D347519E7518031BA5DFF4"><enum>(iii)</enum><text display-inline="yes-display-inline">any intermediate hemp-derived cannabinoid product marketed or sold as a final product or directly to an end consumer for personal or household use; and</text></clause> <clause id="H806211403E9A4CB4900E95E451AC8304"><enum>(iv)</enum><text>any final hemp-derived cannabinoid products containing—</text> 
<subclause id="H0B3FDBA511F24ED9BD27559D440A5380">
                                    <enum>(I)</enum>
 <text>cannabinoids that are not capable of being naturally produced by a Cannabis sativa L. plant; or</text>
                                </subclause> 
<subclause id="H0B498B387B5E4A589040673BD2AA72F2" commented="no">
                                    <enum>(II)</enum>
 <text display-inline="yes-display-inline">cannabinoids that are capable of being naturally produced by a Cannabis sativa L. plant and—</text>
                                    <item id="H179F84C98AF24DED986618777FA933C0" commented="no">
                                        <enum>(aa)</enum>
 <text display-inline="yes-display-inline">are produced, manufactured, or converted using chemical synthesis, hydrogenation, acetylation, alkylation, or any other artificial process that adds to, removes from, or otherwise alters the molecular structure of a cannabinoid so that it contains one or more functional groups or substituents that are not present in any naturally occurring cannabinoid constituent of Cannabis sativa L., including—</text>

                                            <enum>(AA)</enum>
 <text>hexahydrocannabinol (HHC);</text> </subitem> <subitem id="HBF500C16BDDB486D92148A5789FC491D" commented="no"> <enum>(BB)</enum> <text>tetrahydrocannabinol acetate (THC–O–acetate);</text>
                                        </subitem>
                                        <subitem id="H78660EDCB90D43C7B38B61816F45A403" commented="no">
                                            <enum>(CC)</enum>
 <text>tetrahydrocannabiphorol (THCP); and</text> </subitem> <subitem id="HAE86A27424BB42A3AF619B2620A0C417" commented="no"> <enum>(DD)</enum> <text>any other artificially modified analog or homologue of a naturally occurring cannabinoid, as determined by the Secretary, in consultation with the Secretary of Health and Human Services; or</text>
                                        </subitem>
                                    </item>
                                    <item id="H25AFB8AA816A41F587F48E8C65B1532B" commented="no">
                                        <enum>(bb)</enum>
 <text display-inline="yes-display-inline">are produced or manufactured using any solvent, extraction method, or other means of production determined by the Secretary, in consultation with the Secretary of Health and Human Services, to pose a risk to the public health.</text>
                                    </item>
                                </subclause></clause></subparagraph> 
<paragraph id="H6B79CA6E1F1C451E9958E9BD14B8F741" commented="no"><enum>(2)</enum><header>Industrial hemp</header><text>The term <term>industrial hemp</term> means hemp—</text> <subparagraph id="H9E9D4205EDB8493FA38CA1793789B524" commented="no"><enum>(A)</enum><text>grown for the use of the stalk of the plant, fiber produced from such a stalk, or any other non-cannabinoid derivative, mixture, preparation, or manufacture of such a stalk;</text></subparagraph> 
<subparagraph id="H48163D93F05D49EBA4E513441F22EBCF" commented="no"><enum>(B)</enum><text>grown for the use of the whole grain, oil, cake, nut, hull, or any other non-cannabinoid compound, derivative, mixture, preparation, or manufacture of the seeds of such plant;</text></subparagraph> <subparagraph id="HA76C13CC1FD04C24B03455AB60E4BAD0" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">grown for purposes of producing microgreens or other edible hemp leaf products intended for human consumption that are derived from an immature hemp plant that is grown from seeds that do not exceed the threshold for total tetrahydrocannabinol concentration specified in paragraph (1)(C)(i);</text></subparagraph> 
<subparagraph id="H63F272D27EE648FEACFD3AB16110BA82" commented="no"><enum>(D)</enum><text>that is a plant that does not enter the stream of commerce and is intended to support hemp research at an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)) or an independent research institute;</text></subparagraph> <subparagraph id="H2DF62DAD07AA499184648F04ECB2FA50" commented="no"><enum>(E)</enum><text>grown for the use of a viable seed of the plant produced solely for the production or manufacture of any material described in subparagraphs (A) through (D); or</text></subparagraph> 
<subparagraph id="H8DCBACA977F34FDF85862AF458950279"><enum>(F)</enum><text display-inline="yes-display-inline">grown for the use of the whole plant, or any part thereof, for the extraction, production, or manufacture of any non-intoxicating non-cannabinoid essential oil, aromatic compound, terpene, or other non-intoxicating non-cannabinoid volatile organic compound derived from such plant.</text></subparagraph></paragraph> <paragraph id="H6FC517CEF0234FF193CCC81375A12BC2"><enum>(3)</enum><header>Unfinished hemp-cannabinoid ingredient</header><text display-inline="yes-display-inline">The term <term>unfinished hemp-cannabinoid ingredient</term> means an oil, extract, concentrate, distillate, or other intermediate substance that—</text> 
<subparagraph id="HAA2B7635656F4109AFE488AC8F219064"><enum>(A)</enum><text display-inline="yes-display-inline">that meets the criteria specified in paragraph (1) to be considered hemp, except that such ingredient may contain concentrations of total tetrayhdrocannabinol exceeding 1 percent during processing, provided that the material—</text> <clause id="H19DFD4F513D243789FA31BD007A854B7"><enum>(i)</enum><text>remains exclusively with actors or entities licensed or otherwise lawfully permitted to manufacture, transport, or store the material under the <short-title>Lawful Hemp Protection Act</short-title>; and</text></clause> 
<clause id="HCAF24B0CDC8341A9B35911A38DF40966"><enum>(ii)</enum><text>is not offered for retail sale;</text></clause></subparagraph> <subparagraph id="H8A062EE95A634901BF7EF37FD42B4F91"><enum>(B)</enum><text>is not for consumer use;</text></subparagraph> 
<subparagraph id="HADCF1D4F32964D52A674C0402BB764D3"><enum>(C)</enum><text>is not a finished hemp product; and</text></subparagraph> <subparagraph id="H3D9CD49163534741B165B65E847F6D8A"><enum>(D)</enum><text>is produced solely for incorporation into a finished cannabinoid product through further processing.</text></subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HF7C952B2BF42402F8BF5D44C78547709"><enum>(b)</enum><header>Conforming repeal</header><text display-inline="yes-display-inline">Section 781 of the Agriculture, Rural Development, Food and Drug Administration, and Related Agency Appropriations Act, 2026 (division B of <external-xref legal-doc="public-law" parsable-cite="pl/119/37">Public Law 119–37</external-xref>) is repealed.</text></subsection></section> <section id="H01F69DC5A5DC41FF9151A3F74809415A"><enum>4.</enum><header>FDA oversight and milligram limitations</header> <subsection id="H0FECA6DE640547C1A1384E776E34C79E"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>) is amended—</text> 
<paragraph id="H21464A7F26B34FB6B2ACA2EC13C25157"><enum>(1)</enum><text>in paragraph (g)(1), by adding at the end the following: <quote>Such term does not include a hemp-derived cannabinoid product.</quote>;</text></paragraph> <paragraph id="HC60DB9AEED56492590C4777F162747D6"><enum>(2)</enum><text>in paragraph (s), in the matter preceding subparagraph (1), by striking <quote>food (including any substance</quote> and inserting <quote>food (including industrial hemp intended for human or animal use and hemp seed, hemp seed oil, or hempseed protein not containing cannabinoids, any substance</quote>; and</text></paragraph> 
<paragraph id="HCAA78403CAC04DD2AC1E398908A8AC22"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H27AD4CF1432A425A8CE34C4E459583F5" display-inline="no-display-inline"> <subsection id="HD841533DA23742D7AC259C5A172A73E2"><enum>(tt)</enum> <paragraph id="H447ADA1999604DAA8114AB08E16897C7" display-inline="yes-display-inline"><enum>(1)</enum><text>The term <term>hemp-derived cannabinoid product</term>—</text> 
<subparagraph id="H880409DCDC74416B8C736240F069F3F2" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">means any finished product for human or animal use that—</text> <clause id="H77005241BAD8492190B874E6C8ECFBC7"><enum>(i)</enum><text>that meets the criteria specified in paragraph (1) to be considered hemp; and</text></clause> 
<clause id="H1115C7D637F0469BAC019C35B005EBE6"><enum>(ii)</enum><text>contains one or more cannabinoids;</text></clause></subparagraph> <subparagraph id="H96C3E77768754FB1BC95FF149B9A52B4" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">includes a hemp-derived cannabinoid dietary supplement;</text></subparagraph> 
<subparagraph id="HB626265D065646B38E055EA73E01E8EB" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">includes, in cases that the Secretary determines appropriate, an intermediate hemp-derived cannabinoid product; and</text></subparagraph> <subparagraph id="HE7079B85D3D947D3B183AB42F2429C5F" indent="up1"><enum>(D)</enum><text>may include ingestibles, beverages, oral tinctures and sublinguals, capsules and tablets, inhalables, and topicals and transdermals.</text></subparagraph></paragraph> 
<paragraph id="H9B24A91ACCA74222981DF43B56021967" indent="up1"><enum>(2)</enum><text>A hemp-derived cannabinoid product shall be deemed to be a food within the meaning of this Act.</text></paragraph></subsection> <subsection id="H29AD1E02FEDB42A3BBB584A28EB59BAB"><enum>(uu)</enum><text>The term <term>hemp-derived cannabinoid dietary supplement</term>—</text> 
<paragraph id="H63387FF34B0C4843B4BDBEB995680C3E"><enum>(1)</enum><text display-inline="yes-display-inline">means a dietary supplement that—</text> <subparagraph id="H2794E757B4D14F928C17BE82C32EC53F"><enum>(A)</enum><text>is derived from hemp;</text></subparagraph> 
<subparagraph id="HC37FB1EBD760401F904C54B7EE8C73F4"><enum>(B)</enum><text>contains one or more cannabinoids; and</text></subparagraph> <subparagraph id="H33C8073E541748CE9AF552D0FD449E03"><enum>(C)</enum><text>is for ingestion in tablet, capsule, softgel, gelcap, powder, gummy, chew, lozenge, tincture, oil, spray, strip, or liquid form;</text></subparagraph></paragraph> 
<paragraph id="HC3935F23AD3E461984C85F3CE8B512D0"><enum>(2)</enum><text>may include ingestibles, oral tinctures and sublinguals, and capsules and tablets; and</text></paragraph> <paragraph id="H25E77B4A86FA4F67AA7B56FA9A0FCD21"><enum>(3)</enum><text>does not include—</text> 
<subparagraph id="HBE52644D9CAE47C3B732186BCF96DF85"><enum>(A)</enum><text>any product for inhalation, application to the skin, or transdermal absorption;</text></subparagraph> <subparagraph id="H5048D6AD75EA41AC85B5373D5F7E0063"><enum>(B)</enum><text display-inline="yes-display-inline">raw, floral hemp material, an unfinished hemp-cannabinoid ingredient, or work-in-process materials;</text></subparagraph> 
<subparagraph id="H0CF74992D8B042F184F8AB4255B5AADC"><enum>(C)</enum><text>industrial hemp;</text></subparagraph> <subparagraph id="HEC65AFC8896649529765FFC6B37B36C9"><enum>(D)</enum><text>hemp seed, hemp seed oil, or hempseed protein not containing cannabinoids; and</text></subparagraph> 
<subparagraph id="HA67F4B8ABEE047159917977D8FE9DA61"><enum>(E)</enum><text display-inline="yes-display-inline">a product containing any cannabinoid not found in, or capable of being produced in, the hemp plant, as identified on the lists published and updated under section 425(d).</text></subparagraph></paragraph></subsection> <subsection id="H4B874DCFF2FA4B02AA4610E107E3F3CB"><enum>(vv)</enum><text display-inline="yes-display-inline">The terms <term>hemp</term>,<term>industrial hemp</term>, and <term>unfinished hemp-cannabinoid ingredient</term> have the meanings given those terms in section 297A of the Agricultural Marketing Act of 1946.</text></subsection> 
<subsection id="HAF2D91D9E0A4458CBD3554E7BA57C09E"><enum>(ww)</enum><text display-inline="yes-display-inline">The term <term>GRAS substance</term> means a substance that is generally recognized, among experts qualified by scientific training and experience to evaluate its safety, as having been adequately shown through scientific procedures (or, in the case of a substance used in food prior to January 1, 1958, through either scientific procedures or experience based on common use in food) to be safe under the conditions of its intended use, as described in section 201(s). </text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H64BD95277B3B4BAE8D8B6F628883463B"><enum>(b)</enum><header>Prohibited acts</header><text>Section 301 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H26788BFA440C40BC9A805463D61DAB0D" display-inline="no-display-inline"> 
<subsection id="H71E62D7DEB3D4398B8E512C42FC264CC"><enum>(jjj)</enum><text display-inline="yes-display-inline">The introduction or delivery for introduction into interstate commerce of a hemp-derived cannabinoid product that is not derived exclusively from hemp cultivated in the United States, processed within the United States, and finished, packaged, and labeled within the United States.</text></subsection> <subsection id="H6365BB68E1834F7D91DDC2D8C25DCD9B"><enum>(kkk)</enum> <paragraph id="H7FF93061D5D747E5B3C1EFADB988681D" display-inline="yes-display-inline"><enum>(1)</enum><text>The sale of a hemp-derived cannabinoid product to any person younger than 21 years of age.</text></paragraph> 
<paragraph id="H66A28883B2A747B5A2C5A4CD02E82CE2" indent="up1"><enum>(2)</enum><text>The possession or consumption of a hemp-derived cannabinoid product by any person younger than 21 years of age.</text></paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block> </subsection> <subsection id="H3594CCE3693348E39B0E886EBBAC0BCA"><enum>(c)</enum><header>Adulteration</header><text>Section 402 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/342">21 U.S.C. 342</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HB2D4F422F80D48059D00A4CD6CAF47CC" display-inline="no-display-inline"> 
<subsection id="H17889962F56E493690252312AEE03BF7"><enum>(j)</enum><text display-inline="yes-display-inline">If it is a hemp-derived cannabinoid product, and—</text> <paragraph id="HE40B64DFEDBE44A1BFF0990EA4525190"><enum>(1)</enum><text display-inline="yes-display-inline">its cannabinoid content exceeds a maximum allowable amount established under section 425(b);</text></paragraph> 
<paragraph id="H1DF2EC14FB70430296893D2D72D6E2E3"><enum>(2)</enum><text display-inline="yes-display-inline">it contains a cannabinoid not included on the lists published and updated under section 425(d);</text></paragraph> <paragraph id="H32AF238533CF4D98AA6B3BB07E0D1BAB"><enum>(3)</enum><text>it is a cannabinoid hemp product for, or to be used in or on, food-producing animals;</text></paragraph> 
<paragraph id="HD4DE8D3D17054898AAE21E3A0F82A581"><enum>(4)</enum><text>it contains any added substance, such as alcohol, caffeine, tobacco, nicotine, or melatonin, which, when combined with cannbinoids, could interact with such cannabinoids or enhance or alter the effects of such cannabinoids in a manner that is harmful to the consumer, as determined by the Secretary;</text></paragraph> <paragraph id="H73F250B69DF34410AD91C7825083CF01"><enum>(5)</enum><text>it contains a food additive or a GRAS substance, which when combined with the cannabinoids in such product, could cause harm to the consumer (as determined by the Secretary); or</text></paragraph> 
<paragraph id="H0274110ABEDD4765AE3F667F95606E27"><enum>(6)</enum><text>it has been manufactured, processed, packed, or held in any factory, warehouse, or establishment and the owner, operator, or agent of such factory, warehouse, or establishment delays, denies, or limits an inspection of, or refuses to permit entry to, or inspection of, such factory, warehouse, or establishment.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HC30D38484C6740DF8D8E8E7D14D49365"><enum>(d)</enum><header>Misbranding</header><text>Section 403 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H06DAD50B98E049B6A9095EC5F6136A8C" display-inline="no-display-inline"> 
<subsection id="H73B5B81AA3FC42298A4E4F624C0BD53A"><enum>(z)</enum><text>If it is a hemp-derived cannabinoid product, and—</text> <paragraph id="H8D2010CBE1CA4AA8BC6D4995CE9766E4"><enum>(1)</enum><text display-inline="yes-display-inline">its labeling does not adhere to the requirements under section 425(a);</text></paragraph> 
<paragraph id="HCEF852F52FB44E9AA86915486A8BD849"><enum>(2)</enum><text>its advertising or promotion is false or misleading in any particular;</text></paragraph> <paragraph id="H3FF1EF6510504A779DDBA70659AAD413"><enum>(3)</enum><text>it is in package form, unless it bears a label formatted in such manner as the Secretary may prescribe by order;</text></paragraph> 
<paragraph id="H7E20AB142AEA40298A41FD51E11C3E2E"><enum>(4)</enum><text>its labeling does not bear adequate directions for use, or adequate warnings against use by children, that are necessary for the protection of users, or conform to such other requirements in all respects as may be prescribed by the Secretary;</text></paragraph> <paragraph id="HAB0D54670B314360BB96752904889C46"><enum>(5)</enum><text>its labeling does not include a disclaimer of risks posed by the specific cannabinoid contained or purported to be contained in the product, including the risk of drug test failure;</text></paragraph> 
<paragraph id="H6C3C6F2CB9E24CF8A62797B97873DA6F"><enum>(6)</enum><text>its labeling does not include a disclaimer that the Food and Drug Administration has not determined the product to be safe or effective for treating any condition;</text></paragraph> <paragraph id="H03D9C372779C4055B7C2D52F74D128F6"><enum>(7)</enum><text>its labeling makes a claim regarding the product’s effect (or lack thereof) on the structure or any function of the body of humans or other animals;</text></paragraph> 
<paragraph id="H1CF42D805D544906B0FDCA2EC6E86171"><enum>(8)</enum><text>it is in package form for use by humans, and it contains product packaging features imitating images popularly used to advertise to children or otherwise market to anyone under 21 years of age, including—</text> <subparagraph id="H45DC7F2C1D034203B9D15F5DD5E5E986"><enum>(A)</enum><text>labeling depicting, or in the shape of, characters (real or imaginary), animals, vehicles, cartoons, candy, or fruit; and</text></subparagraph> 
<subparagraph id="H84D6482397CF4863A1E8746B7180C198"><enum>(B)</enum><text>brightly colored products and packaging;</text></subparagraph></paragraph> <paragraph id="H4194EF3601E34230A408963338AF32D0"><enum>(9)</enum><text>it is in package form for use in animals, and its label and labeling do not contain prominently placed, conspicuous—</text> 
<subparagraph id="HD3486575895E4A6CA6DEC9C19A4106A9"><enum>(A)</enum><text>warnings that the product should not be used by humans; and</text></subparagraph> <subparagraph id="HD1AF8877F6F04E4196993FA22E8DD1D4"><enum>(B)</enum><text>statements that the product is for use in animals, including any such statements specifying the intended species;</text></subparagraph></paragraph> 
<paragraph id="HE1CCE5A5633942B39F7E90E9A0ADE1C4"><enum>(10)</enum><text display-inline="yes-display-inline">it was manufactured, processed, packed, labeled, or held by or in an establishment that has not been issued a permit under <external-xref legal-doc="usc" parsable-cite="usc/26/5902A">section 5902A</external-xref> of the Internal Revenue Code of 1986;</text> </paragraph> <paragraph id="H7C1582D4B0AE4EADA353645A3967E8AC"><enum>(11)</enum><text display-inline="yes-display-inline">it does not adhere to the uniform manufacturing and testing requirements established under section 425(c) or there was a failure or refusal to provide access to any records as required under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/56">chapter 56</external-xref> of the Internal Revenue Code of 1986; or</text></paragraph> 
<paragraph id="H2EB994C94F1349C78FD2077C9C266003"><enum>(12)</enum><text display-inline="yes-display-inline">it is not in compliance with such formatting requirements as the Secretary may specify (such as a requirement for the use of standard and uniform labeling and an identifying symbol) with respect to any word, statement, or other information the Secretary requires to appear on the label or labeling of the product.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H0747C7D185254EB0B23F111BF537F9F7"> <enum>(e)</enum> <header>Hemp-Derived cannabinoid products</header> <text display-inline="yes-display-inline">Chapter IV of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/341">21 U.S.C. 341 et seq.</external-xref>) is amended by adding at the end the following:</text>

                            <enum>(a)</enum>
                            <header>Labeling requirements</header>
 <text>A hemp-derived cannabinoid product shall be considered misbranded within the meaning of section 403(z) unless such labeling meets the following requirements:</text>
                            <paragraph id="H0BC1FB7BE33444EC9CBC0303B241A0F1">
                                <enum>(1)</enum>
 <text display-inline="yes-display-inline">Its principal display panel displays, in a font size not smaller than 8 points, the statement <quote>Contains __ mg THC per serving and __ mg THC per package. For users 21+ only.</quote>, where the blanks shall be filled in with the applicable quantity of THC in milligrams per serving and per package, respectively.</text>
                            </paragraph>
                            <paragraph id="HA79DB031566141F19C86EDEF8F95EBF9">
                                <enum>(2)</enum>
                                <subparagraph id="HB047C8EA1B424187982EDA4A70B4E4A3"
                                    display-inline="yes-display-inline">
                                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">Its principal display panel bears a warning statement concerning the effects of consuming hemp-derived cannabinoid products, including with respect to pregnancy and impaired driving.</text>
                                </subparagraph>
                                <subparagraph id="H5936A932245B40BDA615321A56345004" indent="up1">
                                    <enum>(B)</enum>
 <text>The statement under subparagraph (A) shall—</text> <clause id="HDF5876322A12433381CFB147CF7FB2A4"> <enum>(i)</enum> <text>appear in a conspicuous and prominent location on the principal display panel;</text>
                                    </clause>
                                    <clause id="H5A518F49368F4E6898EFA5325AF7F0A0">
                                        <enum>(ii)</enum>
 <text>be printed in a font size not smaller than 6 points, or not smaller than the smallest type size used elsewhere on the label, whichever is larger;</text>
                                    </clause>
                                    <clause id="HFC225EDB20F24AB2BB4C0C3B3D01A5DF">
                                        <enum>(iii)</enum>
 <text>appear in a color that contrasts with the background on which it appears;</text>
                                    </clause>
                                    <clause id="H5A3A45D594EA46B3B482D78D8878C095">
                                        <enum>(iv)</enum>
 <text>include the words <quote>GOVERNMENT WARNING</quote> in capital letters and bold type; and</text>
                                    </clause>
                                    <clause id="H0EF2E586CC4B408292EFAB368FFFAB46">
                                        <enum>(v)</enum>
 <text display-inline="yes-display-inline">be worded in such manner as the Secretary, in consultation with the Surgeon General of the Public Health Service, determines appropriate.</text>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                            <paragraph id="HF4FB04D394E84B08AB30F889F8ED7AF1" commented="no">
                                <enum>(3)</enum>
 <text>If it is in package form, bears a label containing—</text> <subparagraph id="H615332B425014E7A920910DA4F7070A2" commented="no"> <enum>(A)</enum> <text>a statement on the front of the product packaging indicating that the product is a cannabinoid hemp product;</text>
                                </subparagraph>
                                <subparagraph id="H1142D1547B0D4851B5BD17726C01FADD" commented="no">
                                    <enum>(B)</enum>
                                    <clause id="H1330CD4E869A4FAF8D89EBBAE983E4C8" commented="no"
                                        display-inline="yes-display-inline">
                                        <enum>(i)</enum>
 <text>the serving size; and</text> </clause> <clause id="HEBE1A0FB8BCA4CC6A11B3AACF29842B4" indent="up1" commented="no"> <enum>(ii)</enum> <text>the number of servings per package;</text>
                                    </clause>
                                </subparagraph>
                                <subparagraph id="HFE550389C18847D795B232375F04A76F" commented="no">
                                    <enum>(C)</enum>
 <text>the ingredients;</text> </subparagraph> <subparagraph id="H3C49741365B942369A68FF7A57B7A642" commented="no"> <enum>(D)</enum> <text>the content per serving and per package of any and all cannabinoids, if present above a nominal level, as determined by the Secretary;</text>
                                </subparagraph>
                                <subparagraph id="H1D63836EE010478AA7343E64E79F491E" commented="no">
                                    <enum>(E)</enum>
 <text>for products for human use, a disclaimer of the presence in the product of any major food allergen, processing aid, or compound, which the Secretary may require to be disclosed;</text>
                                </subparagraph>
                                <subparagraph id="H29549E2D2E8B43DE8A034D140A1BF6FB">
                                    <enum>(F)</enum>
 <text>a statement clearly specifying if the product is intended for animal use, human use, or for use by humans and animals;</text>
                                </subparagraph>
                                <subparagraph id="H0F5172543AE644A4B3ABAA739108A8E8" commented="no">
                                    <enum>(G)</enum>
 <text>a disclaimer of known risks to special populations, including children, those who are pregnant or breastfeeding, and those taking drugs known to interact with the product;</text>
                                </subparagraph>
                                <subparagraph id="HF81C99A493734502BBF2B99BC3CBE70E" commented="no">
                                    <enum>(H)</enum>
 <text>a quick response (QR) code, any other scannable mechanism, or internet address that leads to a web page with testing results for the cannabinoid hemp product in the form of a certificate of analysis;</text>
                                </subparagraph>
                                <subparagraph id="H7046A84B264E4C46AB2068F4628016E8" commented="no">
                                    <enum>(I)</enum>
 <text>clear instructions of use, if applicable; and</text> </subparagraph> <subparagraph id="H1642D5140D4B4036B8567EEFF45FD2FC" commented="no"> <enum>(J)</enum> <text>information about how to report adverse events resulting from use of the product.</text>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection id="HB8A68589AF3C4A43AFFF674F1F0FE0FB">
                            <enum>(b)</enum>
                            <header>Maximum cannabinoid content</header>
                            <paragraph id="HB0BA97D721604724ADF023E4B369EA5A">
                                <enum>(1)</enum>
                                <header>Establishment</header>
 <text display-inline="yes-display-inline">Not later than 12 months after the date of enactment of this section, the Secretary shall establish, with respect to any hemp-derived cannabinoid product—</text>
                                <subparagraph id="H45440DCF1177457FBACE4C52A1C9B700">
                                    <enum>(A)</enum>
 <text>a maximum allowable amount of total cannabinoid content for such product and each serving of such product; and</text>
                                </subparagraph>
                                <subparagraph id="H62179C79923641E4AF690D79064C510F">
                                    <enum>(B)</enum>
 <text>for each cannabinoid present in such a product, a maximum allowable amount of such cannabinoid for such product and each serving of such product.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph id="HA4E51D9088C2452AB3BC09CEDCB0D0DB">
                                <enum>(2)</enum>
                                <header>Frequency of review</header>
 <text>The Secretary shall review and, as appropriate, revise the maximum allowable amounts under paragraph (1) not less frequently than—</text>
                                <subparagraph id="H11999A4F6C0846168C232DEDC31BF6FA"
                                    display-inline="no-display-inline">
                                    <enum>(A)</enum>
 <text>once every 3 years; or</text> </subparagraph> <subparagraph id="H00C6BE40D72043EE980EF96F76174084"> <enum>(B)</enum> <text>as soon as scientific evidence warrants reconsideration.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph id="H6C9766C02D3B408282EC3556EA37A144">
                                <enum>(3)</enum>
                                <header>Rulemaking</header>
 <text>The Secretary shall establish and revise the maximum allowable amounts under paragraph (1) through a notice-and-comment rulemaking process that is informed by—</text>
                                <subparagraph id="HB6447C6B2C8E44128335B61FF46CD7D5">
                                    <enum>(A)</enum>
 <text>peer-reviewed scientific research on the safety and physiological effects of individual cannabinoids;</text>
                                </subparagraph>
                                <subparagraph id="HDCC5B4EA6DB04DF0880E840065962118">
                                    <enum>(B)</enum>
 <text>consumer usage data and adverse event reports;</text> </subparagraph> <subparagraph id="H2B823B5319414A1EA7F3D5DE82083E4B"> <enum>(C)</enum> <text>input from qualified medical and scientific experts;</text>
                                </subparagraph>
                                <subparagraph id="HFF9F371AF2FA4F24BA3B8E3AE97AD83D">
                                    <enum>(D)</enum>
 <text>consultation with State regulatory authorities with experience overseeing hemp or cannabis markets; and</text>
                                </subparagraph>
                                <subparagraph id="H825CCDB210844BD68F2E59D076621CEA">
                                    <enum>(E)</enum>
 <text>consideration of product form, intended use, and target consumer population.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph id="H1E786635456A42BDA7777284D6DF53A6">
                                <enum>(4)</enum>
                                <header>Failure to timely establish maximum allowable
                                    amounts</header>
 <text display-inline="yes-display-inline">In the case that the Secretary fails to establish the maximum allowable amounts under paragraph (1) within the 12-month period described in such paragraph, until such time that the Secretary establishes alternative amounts, the following maximum allowable amounts for total tetrahydrocannabinol content shall apply:</text>

                                    <enum>(A)</enum>
 <text>With respect to a hemp-derived cannabinoid product for oral consumption, 5 milligrams per serving.</text>
                                </subparagraph>

                                    <enum>(B)</enum>
 <text>With respect to an inhalable hemp-derived cannabinoid product, 50 milligrams per serving.</text>
                                </subparagraph>
                                <subparagraph id="H497A3F08127F453080E09A543313652E">
                                    <enum>(C)</enum>
 <text>With respect to a topical hemp-derived cannabinoid product, 50 milligrams per serving.</text>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection id="HCF9CD83D02524874A9B6D9FB21B80D22">
                            <enum>(c)</enum>
                            <header>Manufacture and testing</header>
                            <paragraph id="H60ADDFAB2F47430182A6ED8DD58CBCE8">
                                <enum>(1)</enum>
                                <header>Establishment</header>
 <text display-inline="yes-display-inline">The Secretary shall establish such uniform manufacturing and testing requirements for hemp-derived cannabinoid products (including intermediate hemp-derived cannabinoid products) as the Secretary determines to be necessary. Such requirements shall include the following:</text>
                                <subparagraph id="H432F497D282C4BE4A70E923151996072">
                                    <enum>(A)</enum>
 <text>Manufacturing and testing requirements for key components, potential contaminants, and cannabinoid content.</text>
                                </subparagraph>
                                <subparagraph id="H191499DA2D2447BA8B1FD8AA52192E1A">
                                    <enum>(B)</enum>
 <text>A requirement that each such product be tested by a laboratory accredited to ISO/IEC 17025—</text>
                                    <clause id="H68F51750746C40E78568B99E601D2BC1">
                                        <enum>(i)</enum>
 <text>following post-harvest processing, extraction, or any other manipulation, as determined by the Secretary; and</text>
                                    </clause>
                                    <clause id="H52BC518D00494A2588D02C7FC461191C">
                                        <enum>(ii)</enum>
 <text>when the product is in the form in which it is to be sold to a consumer.</text>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                            <paragraph id="H3DA27DF9053D4043AC26DD005657884E">
                                <enum>(2)</enum>
                                <header>Reliance on standard-setting bodies</header>
 <text display-inline="yes-display-inline">In establishing the uniform manufacturing and testing requirements under paragraph (1), the Secretary may recognize and rely on standards developed by appropriate standard-setting bodies that have relevant expertise and are subject to third-party auditing.</text>
                            </paragraph>
                            <paragraph id="H2745724FB659470AB395C705FA16500F">
                                <enum>(3)</enum>
                                <header>Inspection of records</header>
 <text>The Secretary may inspect such records as may be necessary to determine compliance with the uniform manufacturing and testing requirements under paragraph (1).</text>
                            </paragraph>
                        </subsection>
                        <subsection id="HD66EA91F3D8B4017981A25C592CC3C14">
                            <enum>(d)</enum>
                            <header>Publication of list</header>
                            <paragraph id="H1358DCB6BB69493484E78B56F4DE8370">
                                <enum>(1)</enum>
                                <header>In general</header>
 <text>Not later than 90 days after the date of the enactment of the Lawful Hemp Production Act, the Secretary, in consultation with other relevant Federal agencies, shall publish—</text>
                                <subparagraph id="HD4E0FEB441174E3DB94844D5642DB04C">
                                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">a list of all cannabinoids known to the Secretary to be capable of being naturally produced by a Cannabis sativa L. plant, as reflected in peer reviewed literature; and</text>
                                </subparagraph>
                                <subparagraph id="H87DDB2E7EA6543D8B8D2B439D02AE6AB">
                                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">a list of all tetrahydrocannabinol class cannabinoids known to the Secretary to be naturally occurring in the plant.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph id="HBD45D320A69848119D93D79D71E1654B">
                                <enum>(2)</enum>
                                <header>Updates</header>
 <text display-inline="yes-display-inline">The Secretary shall periodically review and update the lists under subparagraphs (A) and (B) of paragraph (1).</text>
                            </paragraph>
                        </subsection>
                    </section>

                </quoted-block>
            </subsection> 
<subsection id="HAA5FAF2A40394B40906290FDF9669935"><enum>(f)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by this section shall only apply with respect to hemp and any products derived from or containing hemp, including industrial hemp, hemp-derived cannabinoid products, and unfinished hemp-cannabinoid ingredients introduced or delivered for introduction into interstate commerce on or after the date that is 180 days after the date of enactment of this Act.</text></subsection></section> <section id="HBEE6D497A8434C17A00A85E79D49DB1E" commented="no"><enum>5.</enum><header>Allowing coverage of hemp-derived cannabinoid products under Medicare Advantage as a special supplemental benefit for the chronically ill; codifying substance access beneficiary engagement incentive</header> <subsection id="H894899E84BDB472BAF9E70AEE4EBF088"><enum>(a)</enum><header>Medicare Advantage special supplemental benefit for the chronically ill</header><text display-inline="yes-display-inline">Section 1852(a)(3)(D)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-22">42 U.S.C. 1395w–22(a)(3)(D)(ii)</external-xref>) is amended by adding at the end the following new subclause:</text>

<subclause id="H6C89AB6083E5447383621C44C60412B9" commented="no"><enum>(III)</enum><header>Inclusion of hemp-derived cannabinoid products</header><text display-inline="yes-display-inline">Beginning with respect to the first plan year beginning after the date of enactment of this subclause, an MA plan may, in accordance with such criteria as the Secretary may specify, include as a supplemental benefit under this subparagraph coverage of a hemp-derived cannabinoid product (as defined in section 201(tt) of the Federal Food, Drug, and Cosmetic Act).</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H3942210BC4994EF4953CD208C80D6199"><enum>(b)</enum><header>Substance access beneficiary engagement incentive under CMI models</header><text>Section 1115A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315a">42 U.S.C. 1315a</external-xref>) is amended by adding at the end the following new subsection:</text>

<paragraph id="HB9079D7248894A68A3BD33FBB8460ACC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning on the date that is 1 year after the date of enactment of this subsection, a provider of services or supplier participating in a specified model may, in accordance with such criteria as the Secretary shall specify, offer an applicable individual receiving items or services from such provider or supplier a beneficiary engagement incentive consisting of—</text> <subparagraph id="HC316143DE64547588098A9015972A3BF"><enum>(A)</enum><text>consultation regarding the possible use of hemp-derived cannabinoid products (as defined in section 201(tt) of the Federal Food, Drug, and Cosmetic Act); and</text></subparagraph> 
<subparagraph id="HBAB468DBE2D54F2696EBAFCCE148CC9F"><enum>(B)</enum><text>subject to such limits as the Secretary shall specify, the provision of such hemp-derived cannabinoid products.</text></subparagraph></paragraph> <paragraph id="H3A1B9CA77415453C94CC12A2B21ACF33"><enum>(2)</enum><header>Specified model</header><text display-inline="yes-display-inline">For purposes of <internal-xref idref="HB9079D7248894A68A3BD33FBB8460ACC" legis-path="(h)(1)">paragraph (1)</internal-xref>, a specified model is a model tested under this section for which the Secretary determines that the beneficiary engagement incentive described in such paragraph is appropriate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> </section> 
<section id="H0305760C890546789B5C3EC8E8488A6E" section-type="subsequent-section"><enum>6.</enum><header>Taxes on hemp-derived cannabinoid products and related requirements</header>

<paragraph id="HA5CC403F24D44D5D9C156FFCD1E9F4D8" commented="no"><enum>(1)</enum><header>Hemp-derived cannabinoid product</header><text display-inline="yes-display-inline">The term <term>hemp-derived cannabinoid product</term> has the meaning given such term in section 201 of the Federal Food, Drug, and Cosmetic Act. Except as otherwise provided in this chapter, such term includes hemp-derived beverages.</text></paragraph> <paragraph id="H1B7BDBB1260842E2ADF3EDECEF32ED21" commented="no"><enum>(2)</enum><header>Hemp-derived beverage</header><text display-inline="yes-display-inline">The term <term>hemp-derived beverage</term> means a hemp-derived cannabinoid product which is a non-alcoholic beverage intended for human consumption.</text></paragraph> 
<paragraph id="H3ABDC40DBB1246DA98FD158928B97BFA" commented="no"><enum>(3)</enum><header>Removed for consumption or sale</header><text>The term <term>removed for consumption or sale</term> means any removal of a hemp-derived cannabinoid product from the premises of the manufacturer of such product.</text></paragraph> <paragraph id="HF694D002B28D442B84BBC135BED55815" commented="no"><enum>(4)</enum><header>Manufacturer</header> <subparagraph id="HD83BF0D28FB14087905F0FBF1A5FF96A" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>manufacturer</term>, when used with respect to hemp-derived cannabinoid products, means any person who—</text> 
<clause id="H93823F790C1C4F5FBDCFF1707F8A2022" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">is engaged in the business of preparing, processing, modifying, or manipulating hemp, including any unfinished hemp-cannabinoid ingredient, to produce such products for purposes of wholesale or retail distribution, and</text></clause> <clause id="HFC7E0310A81547D8BD116621DA9DFF1B" commented="no"><enum>(ii)</enum><text>has a permit to engage in such business under subchapter B.</text></clause></subparagraph> 
<subparagraph id="H8A9D36BA384B4F22931E5F456657EA4A" commented="no"><enum>(B)</enum><header>Hemp; unfinished hemp-cannabinoid ingredient</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the terms <term>hemp</term> and <term>unfinished hemp-cannabinoid ingredient</term> have the meanings given such terms in section 297A of the Agricultural Marketing Act of 1946.</text></subparagraph> </paragraph> <paragraph id="H0148689AC06D429EA2E7DB05DDBA4C97"><enum>(5)</enum><header>Wholesaler</header><text>The term <term>wholesaler</term>, when used with respect to hemp-derived beverages, means any person who is engaged in the business of purchasing such beverages for resale at wholesale and has a permit to engage in such business under subchapter B.</text></paragraph> 
<paragraph id="HB287753DF7ED4BB89CA180486768DF08"><enum>(6)</enum><header>Retailer</header><text>The term <term>retailer</term>, when used with respect to hemp-derived beverages, means any person who is engaged in the business of purchasing such beverages for resale to consumers.</text></paragraph></section> <section id="H89AF364C464C4440BF21BAFED19DBFF7"><enum>5901.</enum><header>Tax on hemp-derived beverages</header> <subsection id="HE14400ECEF0D4F269B1246CD37368FC7"><enum>(a)</enum><header>Imposition and rate of tax</header> <paragraph id="H7485BF09C26F473EAB7A302E318891CC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A tax is hereby imposed on all hemp-derived beverages produced, and removed for consumption or sale, within the United States. The rate of such tax with respect to each hemp-derived beverage shall be 5 cents on each milligram of tetrahydrocannabinol in such beverage.</text></paragraph> 
<paragraph id="HC739452BA4314FC399D3968815EEF74E" commented="no"><enum>(2)</enum><header>Illegally produced hemp-derived beverages</header><text>Any hemp-derived beverage which is produced at any place in the United States, on the premises of any person who does not have a permit under subchapter B, shall be subject to tax at the rate prescribed in paragraph (1).</text></paragraph></subsection> <subsection id="H81C68057A9A94F09982EA876C656BFB9"><enum>(b)</enum><header>Determination and collection of tax</header> <paragraph id="HF3E9F83281114B41A0B8002EC2D2B08B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The tax imposed by subsection (a)(1) on a hemp-derived beverage shall be—</text> 
<subparagraph id="HCE25548BA9244466B872BDE3EAFF3B5C"><enum>(A)</enum><text>determined at the time such beverage is removed for consumption or sale, and</text></subparagraph> <subparagraph id="H9C47295C8F6849349F627AE7FCCF4FA1" commented="no"><enum>(B)</enum><text>paid by the manufacturer of such beverage in accordance with section 5901C.</text></subparagraph></paragraph> 
<paragraph id="H90C8129EFC3C49FB97FCC737FF116185" commented="no"><enum>(2)</enum><header>Illegally produced hemp-derived beverages</header><text>The tax imposed by subsection (a)(2) on a hemp-derived beverage shall be due and payable immediately upon production.</text></paragraph> </subsection> <subsection id="H8E23300E7E3D485AB5D0128B02FD1A9A" commented="no"><enum>(c)</enum><header>Applicability of other provisions of law</header><text>All administrative and penal provisions of this title, insofar as applicable, shall apply to any tax imposed by subsection (a).</text></subsection></section> 
<section id="H5B02A9382F474540AE681BA99DF2C489"><enum>5901A.</enum><header>Tax on hemp-derived cannabinoid products</header> 
<subsection id="HCAB001F8BA41491781D3AA2DB0A5A6A0"><enum>(a)</enum><header>Imposition and rate of tax</header> 
<paragraph id="HB50869F536DA440881252F58E5377FA4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A tax is hereby imposed on all hemp-derived cannabinoid products (other than hemp-derived beverages) produced, and removed for consumption or sale, within the United States. The rate of such tax with respect to each hemp-derived cannabinoid product shall be the amount equal to 5 percent of the price for which such product is sold.</text></paragraph> <paragraph id="H9B4C5CA446CF4CEFA4FE03BBEE4FF3B4"><enum>(2)</enum><header>Illegally produced hemp-derived cannabinoid products</header><text>Any hemp-derived cannabinoid product (other than a hemp-derived beverage) which is produced at any place in the United States, on the premises of any person who does not have a permit under subchapter B, shall be subject to tax at the rate prescribed in paragraph (1).</text></paragraph></subsection> 
<subsection id="H8D2C959FE1DB484E9F7C133A2B037335" commented="no"><enum>(b)</enum><header>Determination and collection of tax</header> 
<paragraph id="H5D3E5E661A7B42EC95C2FBAF70278ECF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The tax imposed by subsection (a)(1) on a hemp-derived cannabinoid product shall be—</text> <subparagraph id="HFE0B62E84A654D5CA4E440CDF69089DC" commented="no"><enum>(A)</enum><text>determined at the time such product is removed for consumption or sale, and</text></subparagraph> 
<subparagraph id="HE58F0F73B4B84A629FADA894D63B49B5" commented="no"><enum>(B)</enum><text>paid by the manufacturer of such product in accordance with section 5901C.</text></subparagraph></paragraph> <paragraph id="H00BC9C99BBF24D7CB82CE6B99A176FA9"><enum>(2)</enum><header>Illegally produced hemp-derived cannabinoid products</header><text>The tax imposed by subsection (a)(2) on a hemp-derived cannabinoid product shall be due and payable immediately upon production.</text></paragraph></subsection> 
<subsection id="H21DC6E3D10204637B99DCDAF3AE57533"><enum>(c)</enum><header>Applicability of other provisions of law</header><text>All administrative and penal provisions of this title, insofar as applicable, shall apply to any tax imposed by subsection (a).</text></subsection></section> <section id="HA9463C2F701E47B3BC8ACA46EF738A38"><enum>5901B.</enum><header>Tax on sales revenue of manufacturers of hemp-derived cannabinoid products</header> <subsection id="H3A0871EBC9AC4E959E85F8C32D505835" commented="no"><enum>(a)</enum><header>Imposition and rate of tax</header><text display-inline="yes-display-inline">A tax is hereby imposed on all manufacturers of hemp-derived cannabinoid products. The rate of such tax with respect to each manufacturer shall be the amount equal to 5 percent of the sales revenue of such manufacturer for the taxable year.</text></subsection> 
<subsection id="HF16869E9B60A40A2BF613D3F6D9CB88B"><enum>(b)</enum><header>Sales revenue defined</header><text>For purposes of this section, the term <term>sales revenue</term> means the gross receipts from the sale of hemp-derived cannabinoid products.</text></subsection> <subsection id="HBFC769DAC55C4945B5D2FBD215B18783" commented="no"><enum>(c)</enum><header>Determination and collection of tax</header><text>The tax imposed by subsection (a) on a manufacturer of hemp-derived cannabinoid products shall be—</text> 
<paragraph id="H550AB630F4B04201AF0E381E449EBA88" commented="no"><enum>(1)</enum><text>determined at the close of the taxable year, and</text></paragraph> <paragraph id="H655B0378E8BD4ECCB384B629C805A9B4" commented="no"><enum>(2)</enum><text>paid by such manufacturer in accordance with section 5901C.</text></paragraph></subsection> 
<subsection id="HCFC489143D3545E383CB40E71C59EF51"><enum>(d)</enum><header>Applicability of other provisions of law</header><text display-inline="yes-display-inline">All administrative and penal provisions of this title, insofar as applicable, shall apply to any tax imposed by subsection (a).</text></subsection></section> <section id="HBF61E899DD2C4BCD85491326E524673B"><enum>5901C.</enum><header>Method of collecting tax</header> <subsection id="H4DAF4C0732A64CAD995156B8DE1067FC"><enum>(a)</enum><header>Collection by return</header><text display-inline="yes-display-inline">The taxes imposed by this subchapter shall be collected on the basis of a return. The Secretary shall by regulation prescribe the period or event for which such return shall be filed, the time for filing such return, the information to be furnished on such return, and the time for payment of such taxes.</text></subsection> 
<subsection id="H6C6242A5A01A4E61B285FE329C1D89E5" commented="no"><enum>(b)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Notwithstanding subsection (a), any tax imposed by section 5901(a)(2) or section 5901A(a)(2) shall be immediately due and payable at the time provided by such provisions. Such tax shall be assessed and collected by the Secretary on the basis of the information available to the Secretary in the same manner as taxes payable by return but with respect to which no return has been filed.</text></subsection> <subsection id="H91FAE4044B794529AF825E7BF6E601A0" commented="no"><enum>(c)</enum><header>Assessment</header><text display-inline="yes-display-inline">If any tax imposed by this subchapter is not paid in full at the time required for such payment, it shall be the duty of the Secretary, subject to the limitations prescribed in section 6501, on proof satisfactory to the Secretary, to determine the amount of tax which has been omitted to be paid, and to make an assessment therefor against the person liable for the tax. The tax so assessed shall be in addition to the penalties imposed by law for failure to pay such tax when required.</text></subsection></section></subchapter> 
<subchapter id="HA73BB734DDE34185B16ED786ABE09A77"><enum>B</enum><header>Qualification Requirements for Manufacturers of Hemp-derived Cannabinoid Products and Wholesalers of Hemp-derived Beverages</header>

<section id="H368D734259814F3FA06A97316DD4016C" commented="no"><enum>5902.</enum><header>Application for permit</header><text display-inline="no-display-inline">Every person, before commencing business as a manufacturer of hemp-derived cannabinoid products, or wholesaler of hemp-derived beverages, and at such other time as the Secretary shall by regulation prescribe, shall make application for the permit provided for in section 5902A. The application shall be in such form as the Secretary shall prescribe and shall set forth, truthfully and accurately, the information called for on such form. Such application may be rejected and the permit denied if the Secretary, after notice and opportunity for hearing, finds that—</text> <paragraph id="HEE9B1DB041A54CADAE9A6A68CD640030" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the premises on which it is proposed to conduct the business are not adequate to protect the revenue, or</text></paragraph> 
<paragraph id="HB2B9FB50A94E47169397458A91A37FAF" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">such person (or any person required by regulation to be listed in the application)—</text> <subparagraph id="H19504EEDBABC4127AD0A9C96BE993C56" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">is not likely to maintain operations in compliance with this chapter,</text></subparagraph> 
<subparagraph id="H21B6653BD22649D7BEB57F40C097EEBB" commented="no"><enum>(B)</enum><text>has been convicted of a felony violation of any provision of Federal or State criminal law relating to hemp-derived cannabinoid products, or</text></subparagraph> <subparagraph id="H6C62996FB06E4988A081E732D8B661E3" commented="no"><enum>(C)</enum><text>has failed to disclose any material information required or made any material false statement in the application.</text></subparagraph></paragraph></section> 
<section id="H8B3B3063EBB042E8AC9CDE5A593FFBF2"><enum>5902A.</enum><header>Permit</header> 
<subsection id="HA1B0294864BE48958A1A0DC33BDC72C4"><enum>(a)</enum><header>Issuance</header><text display-inline="yes-display-inline">A person shall not engage in business as a manufacturer of hemp-derived cannabinoid products, or wholesaler of hemp-derived beverages, without a permit to engage in such business. Such permit, conditioned upon compliance with this chapter and regulations prescribed thereunder, shall be issued, in such form and in such manner as the Secretary shall by regulation prescribe, to every person properly qualified under section 5902. A new permit may be required at such other time as the Secretary shall by regulation prescribe.</text></subsection> <subsection id="H1A17A7F0F51C415C9561C9649F150371"><enum>(b)</enum><header>Suspension or revocation</header> <paragraph id="HBFB300D0BE274D3197220BDBF0D91AE1"><enum>(1)</enum><header>Show cause hearing</header><text display-inline="yes-display-inline">If the Secretary has reason to believe that any person holding a permit—</text> 
<subparagraph id="H887CC66188CC42CDBAD9C062E94A4451"><enum>(A)</enum><text display-inline="yes-display-inline">has not in good faith complied with this chapter, or with any other provision of this title involving intent to defraud,</text></subparagraph> <subparagraph id="H7890069B8E694D3EBBC57122FCCE4F36"><enum>(B)</enum><text>has violated the conditions of such permit,</text></subparagraph> 
<subparagraph id="H794AA532AEB1484EB83763AD6EA05609"><enum>(C)</enum><text>has failed to disclose any material information required or made any material false statement in the application for such permit,</text></subparagraph> <subparagraph id="H3130ABE2519A40F6B384F8DAA237D565"><enum>(D)</enum><text>has failed to maintain the premises in such manner as to protect the revenue,</text></subparagraph> 
<subparagraph id="HD90F9776086649DE83D8C13B03CDECCD"><enum>(E)</enum><text>is, by reason of previous or current legal proceedings involving a felony violation of any other provision of Federal criminal law relating to hemp-derived cannabinoid products, not likely to maintain operations in compliance with this chapter, or</text></subparagraph> <subparagraph id="HCC3A09846AB545EB820A463A7DF0F762"><enum>(F)</enum><text>has been convicted of a felony violation of any provision of Federal or State criminal law relating to hemp-derived cannabinoid products,</text></subparagraph><continuation-text continuation-text-level="paragraph">the Secretary shall issue an order, stating the facts charged, citing such person to show cause why the permit should not be suspended or revoked.</continuation-text></paragraph> 
<paragraph id="H1C43CDCAD02E4C93BBD39D32F67F066D"><enum>(2)</enum><header>Action following hearing</header><text display-inline="yes-display-inline">If, after a hearing, the Secretary finds that such person has not shown cause why the permit should not be suspended or revoked, such permit shall be suspended for such period as the Secretary deems proper or shall be revoked.</text></paragraph></subsection></section> <section id="H7E5F966353974C8FAAFB20F1634DFBC7" commented="no"><enum>5902B.</enum><header>Judicial review</header><text display-inline="no-display-inline">If the Secretary denies a person a permit under section 5902, or suspends or revokes the permit of a person under section 5902A, such person may obtain judicial review by filing in the United States Court of Appeals for the circuit wherein the person resides or has the person’s principal place of business, or in the United States Court of Appeals for the District of Columbia, within 60 days after such denial, suspension, or revocation, as the case may be. Any findings of fact by the Secretary, if supported by substantial evidence, shall be conclusive.</text></section></subchapter> 
<subchapter id="HF5DC265F9D464018B7C846A19168777B"><enum>C</enum><header>Operations by Manufacturers of Hemp-derived Cannabinoid Products and Wholesalers of Hemp-derived Beverages</header>

<toc-entry level="section">Sec. 5903A. Reports.</toc-entry> 
<toc-entry level="section">Sec. 5903B. Packages, marks, labels, and notices.</toc-entry></toc> 
<section id="HC2561C88059D45FD96178C11F1F5CEF3"><enum>5903.</enum><header>Inventories</header><text display-inline="no-display-inline">Every manufacturer of hemp-derived cannabinoid products, and every wholesaler of hemp-derived beverages, shall make a true and accurate inventory at the time of commencing business, at the time of concluding business, and at such other times, in such manner and form, and to include such items, as the Secretary shall by regulation prescribe. Such inventories shall be subject to verification by any internal revenue officer.</text></section> <section id="HEBC88D2CE8C144ACB752D7B16598D4AD"><enum>5903A.</enum><header>Reports</header><text display-inline="no-display-inline">Every manufacturer of hemp-derived cannabinoid products, and every wholesaler of hemp-derived beverages, shall make reports containing such information, in such form, at such times, and for such periods as the Secretary shall by regulation prescribe.</text></section> 
<section id="HC449B02D59674FC886AC8879ACE9184E"><enum>5903B.</enum><header>Packages, marks, labels, and notices</header><text display-inline="no-display-inline">Every hemp-derived cannabinoid product shall, before such product is removed for consumption or sale, be put up in such package and bear the marks, labels, and notices, if any, that the Secretary by regulation prescribes.</text></section></subchapter> <subchapter id="HA62D9191B0E64962A504F2BBD3879850" commented="no"><enum>D</enum><header>Distribution System for Hemp-derived Beverages</header> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 5904. Distribution system.</toc-entry></toc> <section id="H6BF097BEC68247419CEF880AA5099E47" commented="no"><enum>5904.</enum><header>Distribution system</header> <text display-inline="no-display-inline">The Secretary shall prescribe regulations to establish and implement a three-tiered distribution system for hemp-derived beverages. Such regulations shall, at a minimum, require the following:</text> 
<paragraph id="H15FA3FDAE5044254BB24ADD31CDE2BE9" commented="no"><enum>(1)</enum><header>Tier 1—Manufacturers</header><text display-inline="yes-display-inline">A manufacturer of hemp-derived beverages may only sell or transfer such beverages to a wholesaler of hemp-derived beverages.</text></paragraph> <paragraph id="HD59E989B418A428BA7E13B8B65D75A41" commented="no"><enum>(2)</enum><header>Tier 2—Wholesalers</header><text display-inline="yes-display-inline">A wholesaler of hemp-derived beverages may only—</text> 
<subparagraph id="H587A4B8AEF104F999F62B5CC23B6D2ED" commented="no"><enum>(A)</enum><text>purchase such beverages from a manufacturer of hemp-derived beverages, and</text></subparagraph> <subparagraph id="H41D718B0577742FFAA232313296D1D1D" commented="no"><enum>(B)</enum><text>sell or transfer such beverages to a retailer of hemp-derived beverages.</text></subparagraph></paragraph> 
<paragraph id="H3AE1931C59F24117AA63B736FA90E361" commented="no"><enum>(3)</enum><header>Tier 3—Retailers</header><text display-inline="yes-display-inline">A retailer of hemp-derived beverages may only purchase such beverages from a wholesaler of hemp-derived beverages.</text></paragraph><continuation-text continuation-text-level="subsection">No person may hold permits under subchapter B as both a manufacturer of hemp-derived beverages and a wholesaler of hemp-derived beverages, and no person may hold any interest, directly or indirectly, in more than one tier. The separation among the three tiers shall be strictly maintained.</continuation-text></section> </subchapter> <subchapter id="H0283F096676343B8AEFC31F4CC0CB645"><enum>E</enum><header>General Provisions Relating to Hemp-derived Cannabinoid Products</header> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 5905. Restrictions relating to marks, labels, notices, and packages.</toc-entry></toc> <section id="HA53E2916B6CC4555B69FF018E3D9B8F0"><enum>5905.</enum><header>Records to be maintained</header><text display-inline="no-display-inline">Every manufacturer of hemp-derived cannabinoid products, and every wholesaler of hemp-derived beverages, shall keep such records in such manner as the Secretary shall by regulation prescribe.</text></section> 
<section id="H7063A72D6B784FEB9AECA9377C153646"><enum>5905A.</enum><header>Right of entry and examination</header><text display-inline="no-display-inline">The Secretary may, during business hours, enter the premises of any manufacturer of hemp-derived cannabinoid products, or wholesaler of hemp-derived beverages, for the purpose of examining—</text> <paragraph id="HD8BFE1DC3A06494AB511CC417D9C9573"><enum>(1)</enum><text>any records required under section 5905, or</text></paragraph> 
<paragraph id="H5A2F765D1F1F46898BD43C8560A18DC6"><enum>(2)</enum><text>any hemp-derived cannabinoid products stored on such premises.</text></paragraph></section> <section id="HFBCD2B3A23174318A4C55D8AAA812535"><enum>5905B.</enum><header>Purchase, receipt, possession, or sale of hemp-derived cannabinoid products after removal</header> <subsection id="H8CD2EB742EEA413AB399B0AD369F9D7D"><enum>(a)</enum><header>Restriction</header><text display-inline="yes-display-inline">No person shall—</text> 
<paragraph id="H7C89A43AB9914E43BE923B94F49853F6"><enum>(1)</enum><text display-inline="yes-display-inline">with intent to defraud the United States, purchase, receive, possess, offer for sale, or sell or otherwise dispose of, any hemp-derived cannabinoid product (after such product has been removed for consumption or sale) upon which the tax has not been paid or determined in the manner and at the time prescribed by this chapter or regulations thereunder,</text></paragraph> <paragraph id="HE0C74FF0140643EA9211C2C729DA3B77"><enum>(2)</enum><text display-inline="yes-display-inline">with intent to defraud the United States, purchase, receive, possess, offer for sale, or sell or otherwise dispose of, any hemp-derived cannabinoid product (after such product has been removed for consumption or sale) which is not put up in a package as required under section 5903B or which is put up in a package not bearing the marks, labels, and notices required under such section, or</text></paragraph> 
<paragraph id="H2C43239DDF764F4DAF7A56C95CE1BEAA"><enum>(3)</enum><text>otherwise than with intent to defraud the United States, purchase, receive, possess, offer for sale, or sell or otherwise dispose of, any hemp-derived cannabinoid product (after such product has been removed for consumption or sale) which is not put up in a package as required under section 5903B or which is put up in a package not bearing the marks, labels, and notices required under such section.</text></paragraph><continuation-text continuation-text-level="subsection">Paragraph (3) shall not prevent the sale or delivery of hemp-derived cannabinoid products directly to consumers from proper packages, nor apply to such products when so sold or delivered.</continuation-text></subsection> <subsection id="H9B3ABB3354E54E058F47B0FC69782711"><enum>(b)</enum><header>Liability to tax</header><text display-inline="yes-display-inline">Any person who possesses hemp-derived cannabinoid products in violation of subsection (a)(1) or (a)(2) shall be liable for a tax equal to the tax on such products, as applicable under subchapter A.</text></subsection></section> 
<section id="H92D175A5C0DA4CC89C566C443CCC0BAB"><enum>5905C.</enum><header>Restrictions relating to marks, labels, notices, and packages</header><text display-inline="no-display-inline">No person shall, with intent to defraud the United States, destroy, obliterate, or detach any mark, label, or notice prescribed or authorized, by this chapter or regulations thereunder, to appear on, or be affixed to, any package of hemp-derived cannabinoid products before such package is emptied.</text></section></subchapter> <subchapter id="H9904A78BC6A7408497C5D134B7F61A11"><enum>F</enum><header>Miscellaneous General Provisions</header> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 5906. Regulations.</toc-entry> <toc-entry level="section">Sec. 5906A. Application of State laws.</toc-entry></toc> <section id="H50007EA375544AB0890C42F542F48E69"><enum>5906.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary shall prescribe such regulations or other guidance as may be necessary or appropriate to carry out the purposes of this chapter.</text></section> 
<section id="H16D69F8F6E6E440386ECED662A2B8868" commented="no"><enum>5906A.</enum><header>Application of State laws</header><text display-inline="no-display-inline">Compliance with this chapter with respect to carrying on any trade or business shall not be held to exempt any person from any penalty or punishment provided by the laws of any State for carrying on such trade or business within such State, or in any manner to authorize the commencement or continuance of such trade or business contrary to the laws of such State; nor shall the payment of any tax imposed by this chapter be held to prohibit any State from placing a tax on the same trade or business for State or other purposes.</text></section></subchapter> <subchapter id="H7D6476DBB02440D8825FFEBD985B1FF2"><enum>G</enum><header>Penalties</header> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 5907. Civil penalties.</toc-entry> <toc-entry level="section">Sec. 5907A. Criminal penalties.</toc-entry></toc> <section id="H0B5E1E0A3D89425AB8A409DA2F890482"><enum>5907.</enum><header>Civil penalties</header> <subsection id="H281651E7489C41D08A1344708976024D"><enum>(a)</enum><header>Omitting things required or doing things forbidden</header><text display-inline="yes-display-inline">Whoever willfully omits, neglects, or refuses to comply with any tax imposed by this chapter, or to do, or cause to be done, any of the things required by this chapter, or does anything prohibited by this chapter, shall, in addition to any other penalty provided in this title, be liable to a penalty of $1,000 for each such omission or commission.</text></subsection> 
<subsection id="H942AD714046A44CAAA5A8495D34260FA">
                                    <enum>(b)</enum>
                                    <header>Failure To pay tax</header>
 <text display-inline="yes-display-inline">Whoever fails to pay any tax imposed by this chapter at the time prescribed by law or regulations, shall, in addition to any other penalty provided in this title, be liable to a penalty of 5 percent of the tax due but unpaid.</text>
                                </subsection> 
<subsection id="H2767C88F0DAE4FA98A8BE183E789F397"><enum>(c)</enum><header>Applicability of section 6665</header><text display-inline="yes-display-inline">The penalties imposed by this section shall be assessed, collected, and paid in the same manner as taxes, as provided in section 6665(a).</text></subsection></section> <section id="HD236793996F04CD391A1E1F133847E52"><enum>5907A.</enum><header>Criminal penalties</header> <subsection id="H319526F90E854EA4A3F310DF64890DA7"><enum>(a)</enum><header>Fraudulent offenses</header><text display-inline="yes-display-inline">Whoever, with intent to defraud the United States—</text> 
<paragraph id="H25D29BCA909F46718D968EEFA613285B"><enum>(1)</enum><header>Engaging in business unlawfully</header><text display-inline="yes-display-inline">Engages in business as a manufacturer of hemp-derived cannabinoid products, or wholesaler of hemp-derived beverages, without obtaining the permit required by this chapter or regulations thereunder, or</text> </paragraph> <paragraph id="HBFDA78ECB96148CBB4EED1FB1CC50D4D"><enum>(2)</enum><header>Failing to furnish information or furnishing false information</header><text display-inline="yes-display-inline">Fails to keep or make any record, return, report, or inventory, or keeps or makes any false or fraudulent record, return, report, or inventory, required by this chapter or regulations thereunder, or</text></paragraph> 
<paragraph id="HBB4F3051E41B4730933EF50B4B0EC627"><enum>(3)</enum><header>Refusing to pay or evading tax</header><text display-inline="yes-display-inline">Refuses to pay any tax imposed by this chapter, or attempts in any manner to evade or defeat the tax or the payment thereof, or</text></paragraph> <paragraph id="H624EB89D57194D909F66C39FA2E1682B"><enum>(4)</enum><header>Removing hemp-derived cannabinoid products unlawfully</header><text display-inline="yes-display-inline">Removes for consumption or sale, contrary to this chapter or regulations thereunder, any hemp-derived cannabinoid product subject to tax under this chapter, or</text></paragraph> 
<paragraph id="H245C8BC324B3464F9BE13F2A3E8495A2"><enum>(5)</enum><header>Purchasing, receiving, possessing, or selling hemp-derived cannabinoid products unlawfully</header><text display-inline="yes-display-inline">Violates any provision of section 5905B(a)(1) or (a)(2), or</text></paragraph> <paragraph id="H6DE70F7863984BACA6FFA97668565F68"><enum>(6)</enum><header>Destroying, obliterating, or detaching marks, labels, or notices before packages are emptied</header><text display-inline="yes-display-inline">Violates any provision of 5905C,</text></paragraph><continuation-text continuation-text-level="subsection">shall, for each such offense, be fined not more than $10,000, or imprisoned not more than 5 years, or both.</continuation-text></subsection> 
<subsection id="H87FDD09E85EF4D6190BD2507A62FF3F0"><enum>(b)</enum><header>Other offenses</header><text display-inline="yes-display-inline">Whoever, otherwise than as provided in subsection (a), violates any provision of this chapter, or of regulations prescribed thereunder, shall, for each such offense, be fined not more than $1,000, or imprisoned not more than 1 year, or both.</text></subsection></section></subchapter></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H5225A6B487284F2E8022A2C242081B21" commented="no"> <enum>(b)</enum> <header>Trust Fund for Oversight of Hemp-Derived Cannabinoid Products</header> <text>Subchapter A of chapter 98 of such Code is amended by adding at the end the following new section:</text>

                            <header>Creation of trust fund</header>
 <text display-inline="yes-display-inline">There is hereby established in the Treasury of the United States a trust fund to be known as the <quote>Trust Fund for Oversight of Hemp-derived Cannabinoid Products</quote>, consisting of such amounts as may be appropriated to such Trust Fund as provided in this section.</text>
                        </subsection>
                        <subsection id="H7773FF78E09B4AE1A766D8050D55A0D8" commented="no">
                            <enum>(b)</enum>
                            <header>Transfer to trust fund of amounts equivalent to certain
                                taxes</header>
 <text display-inline="yes-display-inline">There are hereby appropriated to the Trust Fund for Oversight of Hemp-derived Cannabinoid Products amounts equivalent to the taxes received in the Treasury under sections 5901A and 5901B.</text>
                        </subsection>
                        <subsection id="H71D69CDBD10148CB847348E333311A4E" commented="no">
                            <enum>(c)</enum>
                            <header>Expenditures from trust fund</header>
 <text display-inline="yes-display-inline">Amounts in the Trust Fund for Oversight of Hemp-derived Cannabinoid Products shall be available, without further appropriation, to the Secretary for making expenditures—</text>
                            <paragraph id="H0459EAB1FEB2483E9DFE2163A0861E85">
                                <enum>(1)</enum>
 <text>to carry out the requirements of chapter 56,</text> </paragraph> <paragraph id="HBE03322BA2AA40438496413FFA9B8339" commented="no"> <enum>(2)</enum> <text>to administer or conduct oversight of any hemp commerce regulatory program, as authorized by law,</text>
                            </paragraph>
                            <paragraph id="HFC8167FF5DE345F9932370E783DED23F" commented="no">
                                <enum>(3)</enum>
 <text>to carry out any consumer protection activities related to hemp-derived cannabinoid products, as authorized by law, and</text>
                            </paragraph>
                            <paragraph id="H27E186E17E8D4ED39E275AE39AB63255" commented="no">
                                <enum>(4)</enum>
 <text>to support States that cooperate with the Secretary in carrying out the requirements of chapter 56.</text>
                            </paragraph>
                        </subsection>
                        <subsection id="H5DCE0698142C418CA9098B8E1F7F9CE6">
                            <enum>(d)</enum>
                            <header>Annual report to Congress</header>
 <text display-inline="yes-display-inline">The Secretary shall submit an annual report to Congress and include in such report with respect to the preceding year—</text>

                                <enum>(1)</enum>
 <text>the amounts appropriated to the Trust Fund for Oversight of Hemp-derived Cannabinoid Products under subsection (b), and</text>
                            </paragraph>

                                <enum>(2)</enum>
 <text>any expenditures made from such Trust Fund under subsection (c).</text>
                            </paragraph>
                        </subsection>
                    </section>

                </quoted-block>
            </subsection> 
<subsection id="H766C29D2187342D8A2E39E368D248814" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Highway Trust Fund</header><text>Section 9503 of such Code is amended by adding at the end the following new subsection:</text> <quoted-block style="OLC" id="HF79414540C4E4F7F8C0E3144CDD500E6" display-inline="no-display-inline"> <subsection id="H55762E562ED14CBD907BE076DA56D2C8" commented="no"> <enum>(g)</enum> <header>Zero-Tolerance for impaired driving</header> <text display-inline="yes-display-inline">There are hereby appropriated into the Highway Trust Fund amounts equivalent to 1 percent of the total taxes received in the Treasury each year under section 5901 (relating to taxes on hemp-derived beverages). Such amounts shall be available for making expenditures to support State-level enforcement, training, and testing technologies related to the zero-tolerance for impaired driving standards described in section 180 of title 23, United States Code.</text>
                    </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7F5B606876FE4C7785408FA98EF49FFF"><enum>(d)</enum><header>Disclosure of returns and return information</header><text display-inline="yes-display-inline">Section 6103(l) of such Code is amended by adding at the end the following new paragraph:</text> <quoted-block style="OLC" id="H087F19FB30214672BBA91A93FE588E25" display-inline="no-display-inline"> <paragraph id="H74F75E3813CA4F2D9F877D5423D2F50C"> <enum>(23)</enum> <header>Disclosure of returns and return information to Federal, State, tribal, and local agencies administering or enforcing hemp laws</header> <subparagraph id="HB9E8E1059D2B4C08BE7112EC61F2B642"> <enum>(A)</enum> <header>In general</header> <text display-inline="yes-display-inline">Returns and return information with respect to taxes imposed by chapter 56 may be open to inspection by, or disclosure to, any Federal, State, tribal, or local agency charged under any Federal, State, tribal, or local hemp law with responsibility for the administration or enforcement of such law for the purpose of, and only to the extent necessary in, the administration or enforcement of such law. However, such returns and return information shall not be so disclosed if the Secretary determines that such disclosure would seriously impair Federal tax administration.</text>
                        </subparagraph>
                        <subparagraph id="H9160E296BB3F499C89526B6D36CC9E21" commented="no">
                            <enum>(B)</enum>
                            <header>Public information</header>
 <text display-inline="yes-display-inline">The Secretary shall make publicly available the name and business address of each manufacturer of hemp-derived cannabinoid products and each wholesaler of hemp-derived beverages.</text>
                        </subparagraph>
                        <subparagraph id="H850AB73D64BB4CD19931EC179DB96E03">
                            <enum>(C)</enum>
                            <header>Definitions</header>
 <text>Any term used in this paragraph which is also used in chapter 56 shall have the same meaning for purposes of this paragraph as when used in such chapter.</text>
                        </subparagraph>
                    </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subparagraph id="HB5ECDB22F1514F37816FFE7887F7C94C"><enum>(B)</enum><text>in the heading thereof, by striking <quote><header-in-text level="paragraph" style="OLC">and firearms</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">firearms, and hemp-derived cannabinoid products</header-in-text></quote>.</text></subparagraph></paragraph> <paragraph id="H8A961B4FF87743EA9B4A354240536138"><enum>(2)</enum><text>Section 7613(a)(2) of such Code is amended by striking <quote>and firearms</quote> and inserting <quote>firearms, and hemp-derived cannabinoid products</quote>.</text></paragraph>

<subsection id="H0C4BBBE09E1E450FBDEEE01716D777CB"><enum>(f)</enum><header>Deadline for regulations</header><text>The Secretary of the Treasury (or the Secretary’s delegate) shall prescribe regulations to implement <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/56">chapter 56</external-xref> of the Internal Revenue Code of 1986 (as added by this section) not later than 1 year after the date of the enactment of this Act.</text></subsection> <subsection id="HB13D1C1AB9404AA5BB3120D23573CE57" commented="no"><enum>(g)</enum><header>Effective date</header> <paragraph id="HE1BAAFD8FE624CA095767C19D23D36CA" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this subsection, the amendments made by this section shall apply to hemp-derived cannabinoid products sold on or after the date on which the Secretary publishes the regulations prescribed under subsection (f).</text></paragraph> 
<paragraph id="H168647E72E0748CDB618771F8BC377CB" commented="no"><enum>(2)</enum><header>Transition rule</header> 
<subparagraph id="H6B66D1F335994B079656837936B64EA5" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">No person may engage in business as a manufacturer of hemp-derived cannabinoid products, or wholesaler of hemp-derived beverages, after the date of the enactment of this Act until such person has a permit in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/56">chapter 56</external-xref> of the Internal Revenue Code of 1986 (as added by this section) and regulations prescribed thereunder. Notwithstanding the preceding sentence, any person who is engaged in business as a manufacturer of hemp-derived cannabinoid products, or wholesaler of hemp-derived beverages, on the date of the enactment of this Act may continue to engage in such business on the condition that—</text> <clause id="H4E2AD5BCAFC04E62A71ED4A78CD34B66" commented="no"><enum>(i)</enum><text>the person applies for a permit within 30 days after the date described in paragraph (1), and</text></clause> 
<clause id="HAB2DEAEA46594C6CA3353EA9E609F337" commented="no"><enum>(ii)</enum><text>beginning on the date described in paragraph (1), complies with such chapter 56 and such regulations.</text></clause></subparagraph> <subparagraph id="H69A157A09BB14FBCA66933D9251621DD" commented="no"><enum>(B)</enum><header>Penalties</header><text display-inline="yes-display-inline">A violation of subparagraph (A) by any person shall be treated for all purposes in the same manner as a violation of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/56">chapter 56</external-xref> of the Internal Revenue Code of 1986 (as added by this section), and such person shall be subject to the same penalties, and to the same extent, as for a violation of such chapter.</text></subparagraph></paragraph> 
<paragraph id="H42F3E29A06CE4FC8A9CD7393866BA4B5"><enum>(3)</enum><header>Trust funds</header><text>The amendments made by subsections (b) and (c) shall apply to taxes received after the date described in paragraph (1).</text></paragraph> <paragraph id="HB598D6AD4C8A4CE09CD81434ADB85EBF"><enum>(4)</enum><header>Disclosure of returns and return information</header><text>The amendment made by subsection (d) shall apply to disclosures after the date described in paragraph (1).</text></paragraph></subsection></section> 
<section id="HDD04101D8FB442F896CCF25D507C1524" commented="no"><enum>7.</enum><header>Unfair competition and unlawful practices</header> 
<subsection id="HEE3DC6C293AF4245B9A3D02832939E0F" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">It shall be unlawful for any person engaged in business as a manufacturer or wholesaler of hemp-derived beverages to directly or indirectly—</text> <paragraph id="H668735EE20C54F47B080562F8645260D" commented="no"><enum>(1)</enum><text>require, by agreement or otherwise, that any retailer of hemp-derived beverages purchase such beverages from such person to the exclusion, in whole or in part, of hemp-derived beverages sold or offered for sale by other persons if—</text> 
<subparagraph id="H3973CF033CC046F3AD519C388E9BC9D8"><enum>(A)</enum><text>such requirement is made or such person engages in such practice to such an extent as substantially to restrain or prevent transactions in any such beverages, or</text></subparagraph> <subparagraph id="HCD57A46EEEDD4A359BED40B8E1A4369B"><enum>(B)</enum><text>the direct effect of such requirement is to prevent, deter, hinder, or restrict other persons from selling or offering for sale any such beverages to such retailer,</text> </subparagraph></paragraph> 
<paragraph id="H6AADFF6F0474425B82AAF01EC29C0496" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">induce any retailer of hemp-derived beverages to purchase any such beverages from such person to the exclusion, in whole or in part, of hemp-derived beverages sold or offered for sale by other persons if—</text> <subparagraph id="HD0FCCCE66F854250ADF4BFE176A0A899"><enum>(A)</enum><text>such inducement is made or such person engages such practice to such an extent as substantially to restrain or prevent transactions in any such beverages, or</text></subparagraph> 
<subparagraph id="HFCEAE41D4881436F9C4A84C8EB962A00" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the direct effect of such inducement is to prevent, deter, hinder, or restrict other persons from selling or offering for sale any such beverages to such retailer by—</text> <clause id="H0F4ED78C356145C393A0F141FF3B9240" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">acquiring or holding (after the expiration of any existing permit) any interest in any permit with respect to the premises of the retailer,</text></clause> 
<clause id="H09E9540C8833482086B870BF6CAB4D65" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">acquiring any interest in real or personal property owned, occupied, or used by the retailer in the conduct of the retailer’s business,</text></clause> <clause id="H277A5A4466144F11A8F32BCCDD738736" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">furnishing, giving, renting, lending, or selling to the retailer, any equipment, fixtures, signs, supplies, money, services, or other thing of value, subject to such exceptions as the Secretary shall by regulation prescribe, having due regard for public health, the quantity and value of articles involved, established trade customs not contrary to the public interest and the purposes of this subsection,</text></clause> 
<clause id="HCC5142C36A90423DB5FA128BB764A83E" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">paying or crediting the retailer for any advertising, display, or distribution service,</text></clause> <clause id="H66BD6831ABF04982AE2BA9B209ED56A7" commented="no"><enum>(v)</enum><text display-inline="yes-display-inline">guaranteeing any loan or the repayment of any financial obligation of the retailer,</text></clause> 
<clause id="HA9E4775A317448479F294A5065B27FB4" commented="no"><enum>(vi)</enum><text display-inline="yes-display-inline">extending to the retailer credit for a period in excess of the credit period usual and customary to the industry for the particular class of transactions, as the Secretary shall by regulation prescribe, or</text></clause> <clause id="H29115EB1420F436792B98DCA3C48741B" commented="no"><enum>(vii)</enum><text display-inline="yes-display-inline">requiring the retailer to take and dispose of a certain quota of any of such beverages,</text></clause></subparagraph></paragraph> 
<paragraph id="H9DAE7E705A364A7AAEC58D6E07BD6301" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">induce any trade buyer engaged in the sale of hemp-derived beverages to purchase such beverages from such person to the exclusion, in whole or in part, of hemp-derived beverages sold or offered for sale by other persons if—</text> <subparagraph id="H9CEA6291149A48F3A459DC1CBCBCE7F6" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">such inducement is made or such person engages in such practice to such an extent as substantially to restrain or prevent transactions in any such beverages, or</text></subparagraph> 
<subparagraph id="HCA39C7AE7BB142AF970029832C8D753B" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the direct effect of such inducement is to prevent, deter, hinder, or restrict other persons from selling or offering for sale any such beverages to such trade buyer by—</text> <clause id="H1749903C99634586AB8251124AFF352C" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">commercial bribery, or</text></clause> 
<clause id="H7FD17E9C64614FEE9F2E509309FBD867" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">offering or giving any disproportionate bonus, premium, or compensation to any officer, employee, or representative of the trade buyer, or</text></clause></subparagraph></paragraph> <paragraph id="H16101C927E3046EABBC3E458E08A38E8" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">sell, offer for sale, or contract to sell to any trade buyer engaged in the sale of hemp-derived beverages, or for any such trade buyer to purchase, offer to purchase, or contract to purchase, any such beverages on consignment or under conditional sale or with the privilege of return or on any basis other than a bona fide sale, or where any part of such transaction involves, directly or indirectly, the acquisition by such person from the trade buyer or such person’s agreement to acquire from the trade buyer other hemp-derived beverages if—</text> 
<subparagraph id="HE550597FA57A4A33B2733973B473D95E" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">such person or trade buyer engages in such practice to such an extent as substantially to restrain or prevent transactions in any such beverages, or</text></subparagraph> <subparagraph id="HA685CC3FEC234BF1BB2DD9F5B9DFDC79" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the direct effect of such sale, purchase, offer, or contract is to prevent, deter, hinder, or restrict other persons from selling or offering for sale any such beverages to such trade buyer.</text></subparagraph></paragraph> </subsection> 
<subsection id="HB554F186BC7B4A41813298D014E18439" commented="no"><enum>(b)</enum><header>Application to bona fide return of merchandise</header><text>Subsection (a) shall not apply to any transaction involving solely the bona fide return of merchandise for ordinary and usual commercial reasons arising after the merchandise has been sold.</text></subsection> <subsection id="H0A3806F451AC4D8EBFDEF62C66EC2470" commented="no"><enum>(c)</enum><header>Application to State and local agencies</header><text display-inline="yes-display-inline">Paragraphs (1), (2), and (3) of subsection (a) shall not apply to any agency of a State or any political subdivision thereof, or to any officer or employee of such an agency.</text></subsection> 
<subsection id="HED6EA0389E324A908DDF949CF171BE76" commented="no"><enum>(d)</enum><header>Penalties</header><text>Any person who violates a requirement of subsection (a) shall be guilty of a misdemeanor, and upon conviction, be subject to a fine of not more than $1,000 and the seizure and forfeiture of all hemp-derived beverages involved in such violation.</text> </subsection> <subsection id="H42B884D4185E4F9B9CF2AF5D91396823"><enum>(e)</enum><header>Secretary defined</header><text>For purposes of this section, the term <term>Secretary</term> means the Secretary of the Treasury (or the Secretary’s delegate).</text></subsection> 
<subsection id="H4D8785D2499841A5BA41302AF332F40A"><enum>(f)</enum><header>Other definitions</header><text>Any term used in this section which is also used in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/56">chapter 56</external-xref> of the Internal Revenue Code of 1986 (as added by this Act) shall have the same meaning for purposes of this section as when used in such chapter.</text></subsection> </section> <section id="HA3960764250445AEB1BEAC8F643CC8FC" commented="no"><enum>8.</enum><header>Prohibition related to unfinished hemp-cannabinoid ingredients</header> <subsection id="H9CD0A6CBD46140E5ADC72760FE266472" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">It shall be unlawful to market, sell, distribute, or ship an unfinished hemp-cannabinoid ingredient to any person other than a manufacturer of hemp-derived cannabinoid products who has a permit under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/56">chapter 56</external-xref> of the Internal Revenue Code of 1986 (as added by this Act) for the purpose of further manufacturing such product into a finished hemp-derived cannabinoid product.</text></subsection> 
<subsection id="HBFF0765B4D9E4022B79B29A9DF54903A" commented="no"><enum>(b)</enum><header>Penalties</header><text display-inline="yes-display-inline">Any person who violates subsection (a) shall be guilty of a misdemeanor, and upon conviction, be subject to a fine of not more than $1,000. In addition to such fine, such person may have their permit under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/56">chapter 56</external-xref> of the Internal Revenue Code of 1986 (as added by this Act) suspended or revoked.</text></subsection> <subsection id="H169AE6D736754064BE3CA8D2AF8830DB"> <enum>(c)</enum> <header>Unfinished hemp-Cannabinoid ingredient defined</header> <text display-inline="yes-display-inline">For purposes of this section, the term <term>unfinished hemp-cannabinoid ingredient</term> has the meaning given such term in section 297A of the Agricultural Marketing Act of 1946.</text>
            </subsection></section> 
<section id="HAB854A0E0021405492552C98BCB16FD7"><enum>9.</enum><header>Zero tolerance for impaired driving</header> 
<subsection id="H5C37AA418A3F484AA130CFD1DF06A950"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="H1748D1FAF02B4B3FAC809BB7526CE6E1" display-inline="no-display-inline"> <section id="H83D0DB85190C439A995AD0BDF4AD5485"><enum>180.</enum><header>Zero tolerance for impaired driving</header> <subsection id="H08C653EEB631457CA740A52E1C7445EF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For fiscal year 2027 and each fiscal year thereafter, the Secretary shall withhold 10 percent of the amount required to be apportioned to any State under paragraphs (1) and (2) of section 104(b) if such State does not have in effect a law that meets the requirements of subsection (b).</text></subsection> 
<subsection id="H85613956A90649179988B687AC6D866F"><enum>(b)</enum><header>Requirements</header><text>The requirements of this subsection are as follows:</text> <paragraph id="HF0CBFCCA421A4BCB8A12BFE939E4E97C"><enum>(1)</enum><text>For purposes of enforcing laws relating to impaired driving, impairment due to hemp shall be assessed using the same field sobriety evaluation standards and protocols that law enforcement officers apply to determine impairment caused by lawfully prescribed pharmaceutical substances, including opioids, benzodiazepines, and other controlled medications.</text></paragraph> 
<paragraph id="HF6D756C79EC04C969C823C03778BFF71"><enum>(2)</enum><text>Any person determined to be operating a motor vehicle while impaired by hemp shall be subject to the same penalties, fines, license suspensions, and other sanctions as apply to driving under the influence of alcohol or other impairing substances under the laws of the State in which the violation occurs.</text></paragraph></subsection> <subsection id="H1BE21B6041884963A2B1968BE5E85381" commented="no"><enum>(c)</enum><header>State enforcement</header><text>Nothing in this section shall be construed to limit the authority of any State to enforce its own laws relating to impaired driving, provided such laws apply penalties for hemp impairment that are no less stringent than those applied to alcohol-related impairment.</text></subsection> 
<subsection id="HFFEB73AA263143A49B2E36451BEC8E51" commented="no"><enum>(d)</enum><header>Rule of construction</header><text>This section shall not be construed to require the development of a per se blood or bodily fluid concentration threshold for hemp-derived cannabinoids as a precondition for enforcement of impaired driving laws.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H74A93ED780424FFFAD72D158C50522C0"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text>

<section id="HC8922B0F628C45C8ADE1D527628D1688"><enum>10.</enum><header>Protection of State regulatory authority and interstate commerce</header> 
<subsection id="H8A28D01640114F979950F2059B8198F9"><enum>(a)</enum><header>Preservation of State rights</header><text display-inline="yes-display-inline">Except as provided in subsection (b), nothing in this Act or the amendments made by this Act shall be construed to preempt or limit the authority of a State, territory, or Indian Tribe to enact or enforce laws and regulations governing the production, manufacture, distribution, importation, or sale of hemp or hemp-derived cannabinoid products within the borders, or exportation out of the borders, of such State, territory, or Indian Tribe that are more stringent than, or at least as protective as would be permitted under an alcoholic beverage regulatory scheme comparable to, the standards in this Act and the amendments made by this Act.</text></subsection> <subsection id="H54DC5D003D7243699AB6CA531785BAB1"> <enum>(b)</enum> <header>Non-Interference with interstate commerce</header> <text display-inline="yes-display-inline">Pursuant to clause 3 of section 8 of article I, United States Constitution, no State, territory, or Indian Tribe may enact or enforce any law that prevents the passage and delivery of a hemp-derived cannabinoid product through the borders of such State, territory, or Indian Tribe if such product complies with this Act and the amendments made by this Act.</text>
            </subsection> 
<subsection id="HF6F091742B044F00ADF89D51DAEE5B66" commented="no"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H8280090472DA40EA8331FE1D6665E1E1" commented="no"><enum>(1)</enum><header>Hemp</header><text display-inline="yes-display-inline">The term <term>hemp</term> has the meaning given the term in section 297A of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639o">7 U.S.C. 1639o</external-xref>), as amended by section 3 of this Act.</text></paragraph> 
<paragraph id="H46D1E6CB0B7946689601EEB1C7B21F28" commented="no"><enum>(2)</enum><header>Hemp-derived cannabinoid product</header><text display-inline="yes-display-inline">The term <term>hemp-derived cannabinoid product</term> has the meaning given the term in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>), as amended by section 4(a) of this Act.</text> </paragraph></subsection></section> <section id="H83583F34EDBD4AAB8B38BD335F1F5047"><enum>11.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or the amendments made by this Act, or the application of any such provision to any person or circumstance, is held to be unconstitutional or otherwise invalid by a court of competent jurisdiction, the remainder of this Act and the amendments made by this Act, and the application of the provisions of this Act and the amendments made by this Act to any other person or circumstance, shall not be affected thereby.</text> </section>
