<section id="H5878657844F94609A9A830FAE691B1E1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Employee Financial Protection Act of 2026</short-title></quote>.</text> </section> <section id="HDEA7C33D2456456FBE061014146E289B"><enum>2.</enum><header>Protection of credit reporting</header> <subsection id="H43391D8842CF4123B648C27E8E2D13C8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 605 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c">15 U.S.C. 1681c</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H62FBE893E88F432FB97D782443B250B7"><enum>(i)</enum><header>Government shutdowns</header> 
<paragraph id="H91408772C2C545C2B01CF1513BAC3807"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A consumer reporting agency may not make any consumer report containing an adverse item of information related to a late payment or nonpayment on an account of a covered employee that occurred during a covered period.</text></paragraph> <paragraph id="H5EFA9E762E364EB1806B8811CE3E6BF9"><enum>(2)</enum><header>Treatment of certain payments</header><text display-inline="yes-display-inline">For purposes of making any consumer report, a consumer reporting agency shall treat any late payment or nonpayment described in paragraph (1) as if the consumer had made the payment.</text></paragraph> 
<paragraph id="H15D1AA3AFA44406D9D52CE11BF13DB37"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> <subparagraph id="H25D3032CA2464DB8A742D750C56DB045" display-inline="no-display-inline"><enum>(A)</enum><header>Covered employee</header><text>The term <term>covered employee</term> means any employee of the Federal Government who is furloughed or required to work without pay during a lapse in appropriations.</text></subparagraph>
<subparagraph id="HE14718FD5D5C4C36A7F9425EEA16D1DB"><enum>(B)</enum><header>Covered period</header><text display-inline="yes-display-inline">The term <term>covered period</term> means any period during which there is a lapse in appropriations resulting in delayed compensation to a covered employee.</text></subparagraph></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H49FC67C3BD0749179EFE7F24708FF9D1"><enum>(b)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Director of the Bureau of Consumer Financial Protection shall issue rules to carry out the amendment made by this section.</text></subsection></section> 
<section id="HA260AB4AB8BE456FB65573408633A1B8"><enum>3.</enum><header>Sense of Congress regarding private lenders</header><text display-inline="no-display-inline">It is the sense of Congress that private lenders should—</text> <paragraph id="H68A29D21F30D4CBC8CB82797B234B7C9"><enum>(1)</enum><text display-inline="yes-display-inline">provide temporary forbearance or payment flexibility to covered employees (as defined in section 605(i)(3) of the Fair Credit Reporting Act);</text></paragraph> 
<paragraph id="H9274D65A175549CCBD5B5A1B4C95C5EB"><enum>(2)</enum><text>waive late fees and penalties incurred during the covered period (as defined in such section 605(i)(3)); and</text></paragraph> <paragraph id="H9CCA864786604065859138752A7EF868"><enum>(3)</enum><text>refrain from furnishing adverse credit information related to late payments or nonpayments during the covered period.</text></paragraph></section>
