<section id="H0F8C2C649ECC4782B69CCBE25AE3E447" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>AIDEN (Advancing Integrated Data for Equitable National Child Welfare)</short-title></quote>.</text></section> 
<section id="H0193533914844DF482069D490C603B0D"><enum>2.</enum><header>Offender child welfare intervention history survey</header> 
<subsection id="H116798DCDFD54CE6B7AD21D06EC20396"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/305">Chapter 305</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="H2E5251A509824EA8828D0CB00CACF555" display-inline="no-display-inline"> <section id="H6FD445D63C4B40AE828C5803F51AA388"><enum>4087.</enum><header>Offender child welfare intervention history survey</header> <subsection id="H108107B53DC14DC8B49DC13C467FB9AA"><enum>(a)</enum><header>Survey</header><text display-inline="yes-display-inline">The Attorney General shall develop and distribute to each offender who is committed to the custody of the Attorney General by a court of the United States a survey on the child welfare intervention history of the offender that includes the collection of the following information:</text> 
<paragraph id="HCF36DD1D7B95424EBC80CD0DE8CF95F2"><enum>(1)</enum><text display-inline="yes-display-inline">Whether the offender is aware of any child welfare intervention with a caregiver that occurred while the offender was a minor, including at home, at school, or from a law enforcement officer.</text></paragraph> <paragraph id="HC71E864B0F52460FA516DCDC9BB60297"> <enum>(2)</enum> <text display-inline="yes-display-inline">If the offender is aware of a child welfare intervention described in paragraph (1), whether the offender is aware of the condition on which such intervention was based, and if so, the nature of the condition, including physical abuse, sexual abuse, emotional or spiritual abuse, substance exposure, or domestic violence.</text>
                            </paragraph> 
<paragraph id="HE12B306D6A4248A585342ABA9DCAFBF0"><enum>(3)</enum><text display-inline="yes-display-inline">If the offender is aware of a child welfare intervention described in paragraph (1), the type of intervention, including visits from caseworkers, in-home services, foster care, juvenile detention, or any other intervention.</text></paragraph> <paragraph id="H46CD2C863ABF4C1F8B877F52F6C87BDD"><enum>(4)</enum><text>If the offender was placed in foster care as a result of a child welfare intervention, the manner in which the case was resolved, including reunification with the caregiver, guardianship, adoption, or aging out of the foster care system.</text></paragraph> 
<paragraph id="HE2F090E90F0140AAA8588481DF8F1083"><enum>(5)</enum><text display-inline="yes-display-inline">If the offender was placed in foster care as a result of a child welfare intervention, the support services that the offender received, if any, while in foster care, including check-ins from the State child welfare agency and support from community-based organizations.</text></paragraph> <paragraph id="H316317DF35924B5EBF167CA791FF7B3F"><enum>(6)</enum><text display-inline="yes-display-inline">If the offender was not placed in foster care as a result of the child welfare intervention, the manner in which the case was resolved.</text></paragraph></subsection> 
<subsection id="H77A7C42A13A64B27A08E7B5BDCCD5467"><enum>(b)</enum><header>Timing for distribution</header> 
<paragraph id="H3212B80F8A7646F1A94BCCEFF46166C2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For each offender who is committed to the custody of the Attorney General after the date that is 90 days after the date of enactment of this section, the Attorney General shall distribute the survey under subsection (a) to the offender during the intake process.</text></paragraph> <paragraph id="HB5702DC25B2B48478CAB8404C0D4F906"><enum>(2)</enum><header>Existing prisoners</header><text display-inline="yes-display-inline">For each offender who was committed to the custody of the Attorney General before the date that is 90 days after the date of enactment of this section, the Attorney General shall distribute the survey under subsection (a) to the offender before the date that is 180 days after the date of enactment of this section. Surveys distributed pursuant to this paragraph shall indicate that they were distributed to prisoners described in this paragraph.</text></paragraph></subsection> 
<subsection id="H3DD3A6C1CADE4C9FAAB0246FCD9DD611"><enum>(c)</enum><header>Notification</header><text display-inline="yes-display-inline">The Attorney General shall notify each offender to whom a survey is distributed, at the time of distribution, of the protection described in subsection (d)(2), and each survey shall include a confirmation of receipt of such notice.</text></subsection> <subsection id="H6C2EE31D672E409FADB02181880F79B3"><enum>(d)</enum><header>Report</header> <paragraph id="H700495C47D494E8FAC9323BFFE617411"><enum>(1)</enum><header>In general</header><text>On an annual basis, the Attorney General shall submit to the Associate Commissioner of the Children’s Bureau of the Administration for Children and Families of the Department of Health and Human Services a report on the information collected pursuant to the survey under subsection (a).</text></paragraph> 
<paragraph id="HC0C4F2785C3849859A53DE69E3980EF0"><enum>(2)</enum><header>Protection of information</header><text>The report under paragraph (1) may not include the personally identifiable information of any offender or any individual identified by an offender in the survey.</text></paragraph> <paragraph id="HC10A2859BB864F1E9800D025408035F7"><enum>(3)</enum><header>Report to States</header><text display-inline="yes-display-inline">On an annual basis, the Associate Commissioner of the Children’s Bureau of the Administration for Children and Families of the Department of Health and Human Services shall submit a report containing the information received under paragraph (1) to the chief executive of each State in a manner that is consistent with the framework of the Adoption and Foster Care Analysis and Reporting System, the National Child Abuse and Neglect Data System and the National Youth in Transition Database, for use by States as an evidentiary resource in evaluating child welfare agency case planning and support service frameworks.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H64E1CA16EB764E8590A96609A32CDF3D"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/305">chapter 305</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="HC9D0B4EE85C84BC49D2B03B2FF137F98" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">4087. Offender child welfare intervention history survey.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="HE1C7E5316DC64DA5961B138576228A01"><enum>3.</enum><header>State requirement</header><text display-inline="no-display-inline">Beginning in the first fiscal year that begins after the date of enactment of this Act, in order to be eligible for a grant program administered by the Department of Justice, a State shall—</text> 
<paragraph id="H00A9197C4D4F4EA0AC6395CD49BE5218"><enum>(1)</enum><text>develop and distribute to offenders in the custody of the State a survey that is substantially similar to the survey under section 4087(a) of title 18, United States Code; and</text></paragraph> <paragraph id="HB3A0B3F46116437F83ECF26B369DDC28"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the Associate Commissioner of the Children’s Bureau of the Administration for Children and Families of the Department of Health and Human Services a report on the information collected pursuant to the survey, in a manner that does not contain the personally identifiable information of any offender or any individual identified by an offender in the survey.</text> </paragraph></section>
