R. 9807</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20260721">July 21, 2026</action-date><action-desc><sponsor name-id="L000596">Mrs. Luna</sponsor> (for herself, <cosponsor name-id="D000216">Ms. DeLauro</cosponsor>, <cosponsor name-id="M001184">Mr. Massie</cosponsor>, and <cosponsor name-id="P000597">Ms. Pingree</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Insecticide, Fungicide, and Rodenticide Act to prevent preemption of State law claims that are consistent with the misbranding standards of such Act, and for other purposes.</official-title></form><legis-body id="H7091E13060574A1ABFAFAB7A32E1F4EB" style="OLC"><section id="H5B86E04E06394A85B987A3FF73D04E2C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Americans vs. Poisonous Pesticides Act</short-title></quote>.</text></section><section id="H42DB2C8037FD45D4803E07B97D0F15C2"><enum>2.</enum><header>State law claims on misbranding of pesticides</header><subsection id="HF921658B19FB408A8E582A5D3CFE17E3"><enum>(a)</enum><header>Preservation of State failure-to-Warn claims</header><text display-inline="yes-display-inline">Section 24(b) of the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136v">7 U.S.C. 136v(b)</external-xref>) is amended—</text><paragraph id="H3AEC46DA1FEE4C549CEACF858A6174AF"><enum>(1)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="subsection" style="OLC">of labeling standards</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">Uniformity</header-in-text></quote>; and</text></paragraph><paragraph id="H0F3FD03180364AE2A35A0D7E4A3E2685"><enum>(2)</enum><text>by inserting <quote>This subsection does not preempt any State law claim that is consistent with the misbranding standards of section 2(q).</quote> after <quote>this Act.</quote>. </text></paragraph></subsection><subsection id="H70ED7BB8940F460299F8682A93204A73"><enum>(b)</enum><header>Misbranding information</header><text display-inline="yes-display-inline">Section 3(f) of the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136a">7 U.S.C. 136a(f)</external-xref>) is amended—</text><paragraph id="HE5F553F00D4B42899980A8ACC1B5B93C"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting <quote>The registration of a pesticide, and the approval of the labeling of such pesticide by the Administrator, shall not be construed as a defense to any State law claim. In any proceeding, including a proceeding on any State law claim, registration of a pesticide and the approval of the labeling of such pesticide by the Administrator, shall be prima facie evidence (but not conclusive evidence) that the pesticide and its labeling comply with this Act.</quote> after <quote>of the Act.</quote>; and</text></paragraph><paragraph id="H94C1B2B36F7548AAA22E5E9AFF16DB5D"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H2D29E009D3EF4D99B46CE46B401AAE1B" display-inline="no-display-inline"><paragraph id="H2D0240A04503425B82CAF347E6E505BF"><enum>(6)</enum><header>Duty to address misbranding information</header><subparagraph id="HC8EB983012A44D33B475E130420830F1"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If the registrant or the Administrator obtains information indicating that a pesticide may be misbranded under section 2(q) due to potential effects on human health or the environment which are not disclosed on the label of such pesticide, the registrant of such pesticide may amend the labeling of such pesticide to address such information without prior approval of the Administrator.</text></subparagraph><subparagraph id="H57AC43A66A2B480A8FCDB4F4946157D0"><enum>(B)</enum><header>Disapproval</header><text>The Administrator may disapprove, or otherwise take action under section 6 with respect to, the amendment of the labeling of a pesticide under subparagraph (A).</text></subparagraph><subparagraph id="H01D9F1DE2F514157A2DDA59C79B02961"><enum>(C)</enum><header>Information defined</header><text>In this paragraph, the term <quote>information</quote> means any reliable data, findings, study, report, or documentation and includes—</text><clause id="H0316A00BC2A545BA967D0EDC61EB62E8"><enum>(i)</enum><text>a government report;</text></clause><clause id="HD348EEF19582463F9DA67837902371C3"><enum>(ii)</enum><text>an independent peer-reviewed study;</text></clause><clause id="H1889993B31F7481CAAAC9FA35F12E307"><enum>(iii)</enum><text>data of the registrant;</text></clause><clause id="HCDD5BC9946CE48B082967462C2101E9F"><enum>(iv)</enum><text>material obtained through legal discovery;</text></clause><clause id="HA5FD9DF1E79949879B252C194EA58F68"><enum>(v)</enum><text>a disclosure by a whistleblower;</text></clause><clause id="H644361BBDC374D81856DF28C1FB2BB40"><enum>(vi)</enum><text>material from a congressional or other oversight investigation; and</text></clause><clause id="H0DBABF9F2FB444AF81EED1534DA38707"><enum>(vii)</enum><text>pesticide incident data under section 6(a)(2). </text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HD03355835967497BB81331F81BD10CC8"><enum>(c)</enum><header>Application to pending actions</header><text display-inline="yes-display-inline">The amendments made by this Act shall apply to any civil action, including any action on remand or appeal, that is pending on, or commenced on or after, the date of enactment of this Act, regardless of the date on which the conduct that gave rise to such action occurred.</text></subsection><subsection id="HEC95596B63D347BABD2EEA805424340C"><enum>(d)</enum><header>Rule of construction</header><text>None of the amendments made by this Act shall be construed to modify, restrict, or otherwise affect any action for damages or injunctive relief, or the liability of any person under the law of any State. </text></subsection></section></legis-body></bill>
