<section id="H513085AB31E042ED893BBD2554391D0C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Employer Health Plan Flexibility Act</short-title></quote>.</text></section> <section id="H4B78EA237E3241429F264BE5BCE47203"><enum>2.</enum><header>Exempting certain employer-sponsored group health plans from the Affordable Care Act's Essential Health Benefits requirements</header> <subsection id="H26448EB47D3547398B1A556329B9BB10"><enum>(a)</enum><header>Amendment to ERISA</header><text display-inline="yes-display-inline">Section 715 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185d">29 U.S.C. 1185d</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H241FECB7B33C46FBA098F4A2D49D9677" display-inline="no-display-inline"> 
<subsection id="H10CD6C84454B4D0D86E641CDB95A1715"><enum>(c)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of Federal law, a group health plan sponsored by an employer and governed by this Act shall not be required to provide coverage for the Essential Health Benefits described in section 1302(b) of the Patient Protection and Affordable Care Act solely by reason of such Federal requirement.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H45DFC5B95EDA4216A4D1E23158B9A731"><enum>(b)</enum><header>Amendment to the Public Health Service Act</header><text>Section 2707(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-6">42 U.S.C. 300gg–6(a)</external-xref>) is amended by inserting <quote>This section shall not apply to any employer-sponsored group health plan governed by the Employee Retirement Income Security Act of 1974.</quote> at the end.</text></subsection> 
<subsection id="H1C7436C95D664EF798A57FBD7BC2A270"><enum>(c)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall revise applicable regulations to reflect the exemption established under this Act.</text> </subsection></section> <section id="H4DBD5162577A40F3B7B01666375F96A7"><enum>3.</enum><header>Preservation of other Federal requirements</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to exempt a group health plan from compliance with—</text> 
<paragraph id="H70BB5BA682334BC9816A198EF56969DC"><enum>(1)</enum><text display-inline="yes-display-inline">the portability and nondiscrimination provisions of the Health Insurance Portability and Accountability Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/201">42 U.S.C. 201 et seq.</external-xref>);</text></paragraph> <paragraph id="HD5AFAA2A511444F1A5B4FC4257157C9A"><enum>(2)</enum><text>the Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008 (subtitle B of title V of division C of <external-xref legal-doc="public-law" parsable-cite="pl/110/343">Public Law 110–343</external-xref>);</text></paragraph> 
<paragraph id="HE7B4F49224D4499E8E73B28E1CC4D946"><enum>(3)</enum><text>the Consolidated Omnibus Budget Reconciliation Act of 1985;</text></paragraph> <paragraph id="H49E00D6B2DE74A63AC5C4CD05A31EA20"><enum>(4)</enum><text display-inline="yes-display-inline">fiduciary duties under the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1001">29 U.S.C. 1001 et seq.</external-xref>);</text></paragraph> 
<paragraph id="H7C4A0ED8D2B943879DAFA56386DA72DF"><enum>(5)</enum><text>Internal Revenue Code requirements applicable to employer-sponsored health plans;</text></paragraph> <paragraph id="HE062C9E6E4CF47F3BD9EB227BF117496"><enum>(6)</enum><text>Federal nondiscrimination requirements; or</text></paragraph> 
<paragraph id="HEE312EA9DE4246E69CF28EF9CA62B18E"><enum>(7)</enum><text>preventive services requirements, unless otherwise provided by law.</text></paragraph></section> <section id="H52B5DE8D83274B84B9330AA4EB85AABF"><enum>4.</enum><header>Employer disclosure requirements</header><text display-inline="no-display-inline">A group health plan claiming the exemption under this Act shall annually provide participants with a notice that includes—</text> 
<paragraph id="HE9EACAB4F1924317ABCFB0FD33B39F9D"><enum>(1)</enum><text>a description of benefits covered under the plan;</text></paragraph> <paragraph id="H53DCF3D50F344CDEAB8B0646E6A01C61"><enum>(2)</enum><text>identification of any Essential Health Benefits not covered;</text></paragraph> 
<paragraph id="H8D59590513A24EC8B8416014F57B6722"><enum>(3)</enum><text>information regarding cost-sharing; and</text></paragraph> <paragraph id="H5B24558B9A714FF5B115C219DF5C15E2"><enum>(4)</enum><text>instructions for obtaining the Summary Plan Description.</text></paragraph></section> 
<section id="HF1EE176A45A74CECA25C78638AB3C450"><enum>5.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall—</text> <paragraph id="H145172EBEF6D4C369AB90FFCE6242633"><enum>(1)</enum><text>prohibit an employer from voluntarily providing all or part of the Essential Health Benefits;</text></paragraph> 
<paragraph id="H85E9D1A37F2D4F1D840285E75D354605"><enum>(2)</enum><text display-inline="yes-display-inline">alter existing Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1001">29 U.S.C. 1001 et seq.</external-xref>) preemption; or</text></paragraph> <paragraph id="HF6E6910324224FC094F506EADDDAB690"><enum>(3)</enum><text>affect State regulation of health insurance issuers except as expressly provided.</text></paragraph></section> 
<section id="H83D62492FF73488EA356519A7E576D68"><enum>6.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply to plan years beginning on or after January 1, 2028.</text></section> </legis-body></bill>
