<section id="H4E0F19C84446443AAACB2A7B943B40D0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Never Forget the Victims of Terrorism: Joseph D. Mistrulli and Alan Kleinberg USVSST Fund Solvency Act</short-title></quote>.</text></section> <section id="HA08C3A8788D847AAA4CD8F70107B3AE1"> <enum>2.</enum> <header>Temporary borrowing authority and mandatory distribution for the United States Victims of State Sponsored Terrorism Fund</header> <text display-inline="no-display-inline">Section 404 of the Justice for United States Victims of State Sponsored Terrorism Act (<external-xref legal-doc="usc" parsable-cite="usc/34/20144">34 U.S.C. 20144</external-xref>) is amended by adding at the end the following:</text>

                    <enum>(l)</enum>
                    <header>Temporary Borrowing and Mandatory Distribution Authority</header>
                    <paragraph id="H15DA89D6B42D4FCD88C7A1FB2868FB80">
                        <enum>(1)</enum>
                        <header>Mandatory Annual Borrowing</header>
 <text display-inline="yes-display-inline">For each of fiscal years 2027, 2028, and 2029, the Secretary of the Treasury shall loan to the Fund $3,000,000,000, which shall be deposited into the Fund not later than 30 days after the beginning of each such fiscal year.</text>
                    </paragraph>
                    <paragraph id="HFC103D984166481CBE72F11FE5737F4F">
                        <enum>(2)</enum>
                        <header>Mandatory Inclusion in Annual Payment</header>
                        <subparagraph id="H21EE58797DA64438984225586D91642E">
                            <enum>(A)</enum>
                            <header>Inclusion</header>
 <text display-inline="yes-display-inline">The full amount borrowed under paragraph (1) for each fiscal year shall be included in the annual payment required under subsection (d) and shall be distributed as part of that annual payment.</text>
                        </subparagraph>
                        <subparagraph id="H3D1E5744BAB74C92AB0788251CD7F48F">
                            <enum>(B)</enum>
                            <header>Limitation</header>
 <text display-inline="yes-display-inline">Amounts borrowed under this subsection shall not be reserved, retained, or carried forward for any payment other than the annual payment required under subsection (d).</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="H32CD690D83D54F0FBECBF3EF64588B4C">
                        <enum>(3)</enum>
                        <header>Terms of borrowing</header>
 <text>Amounts borrowed under this subsection—</text> <subparagraph id="H0D4D2D8416F6411BBB5284B9B2A8D719"> <enum>(A)</enum> <text display-inline="yes-display-inline">shall be available without further appropriation;</text>
                        </subparagraph>
                        <subparagraph id="HB068FCBA9C8741BF9EA3AE1FCCF9DFB3">
                            <enum>(B)</enum>
 <text display-inline="yes-display-inline">shall bear interest at a rate determined by the Secretary of the Treasury, taking into consideration the average market yield on outstanding Treasury obligations of comparable maturity; and</text>
                        </subparagraph>
                        <subparagraph id="H65E13A65E47B49598DE32B3D33070EB4">
                            <enum>(C)</enum>
 <text>upon the termination of the Fund, the amounts borrowed under this subsection, including interest, shall be repaid solely from criminal and civil fines, penalties, and forfeitures involving a state sponsor of terrorism that, after such expiration, are directed to the Secretary of the Treasury for the purpose of such repayment.</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="HDCF8E5AB940C42968C78C16788CB4AE9">
                        <enum>(4)</enum>
                        <header>Budgetary treatment</header>
 <text>Amounts borrowed under this subsection shall be treated as direct spending authority and shall not be scored as new appropriations.</text>
                    </paragraph>
                    <paragraph id="H2F6AACEADFD4495C9116201799E24623">
                        <enum>(5)</enum>
                        <header>Sunset</header>
 <text>The authority provided under this subsection shall expire on September 30, 2029, except that amounts borrowed before that date shall remain available until expended and shall remain subject to repayment under paragraph (3)(C).</text>
                    </paragraph>
