<section id="H8F9934844A1641FABD09F5833557BD0A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Formula Oversight, Regulation, and Manufacturing Uniformity for Life-sustaining Assurance Act of 2026</short-title></quote> or the <quote><short-title>FORMULA Act of 2026</short-title></quote>.</text></section> <section id="HCB57084FC2BC4272A460DDFC0B2D7A8F"><enum>2.</enum><header>Requirements for infant formulas</header> <subsection id="H9F14A033F8F1402DA3E4ECDA1C6DECAD"><enum>(a)</enum><header>Criteria for determining if an infant formula is adulterated</header><text display-inline="yes-display-inline">Section 412(a) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/350a">21 U.S.C. 350a(a)</external-xref>) is amended—</text> 
<paragraph id="HC0B4E7E1937B45ACA365E4E8DDB65FF2"><enum>(1)</enum><text>in paragraph (2), by striking <quote>or</quote> at the end;</text></paragraph> <paragraph id="HB4E4299E491C4B9EBB9897409017A782"><enum>(2)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>, or</quote>; and</text></paragraph> 
<paragraph id="H4C6C99F6DA1D4641A8B66D039511CD29"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H2B9F2CB1FDF247B6B4E9EA1F493BEB73" display-inline="no-display-inline"> <paragraph id="H1801CF714A634A3A8E4EE008ECD75389"><enum>(4)</enum><text display-inline="yes-display-inline">such infant formula does not comply with the maximum permissible levels for contaminants in infant formula established by the Secretary under subsection (n).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H20637ECC0DD147FE823625BB314E1753"><enum>(b)</enum><header>Maximum permissible levels for contaminants in infant formula</header><text>Section 412 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/350a">21 U.S.C. 350a</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H2A2BA22909DF465F89B11B496DBE2B5E" display-inline="no-display-inline"> <subsection id="H82AAE8AF85154CEA81A8EB0A9DD9AD0F"><enum>(n)</enum><header>Maximum permissible levels for contaminants in infant formula</header> <paragraph id="H5C63C3290EA04C7882201E87DDD94C74"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall by regulation establish maximum permissible levels for contaminants in infant formula.</text> </paragraph> 
<paragraph id="HDFB6EB6E96104800848736D7BE7D1B89"><enum>(2)</enum><header>Maximum contaminant levels</header><text display-inline="yes-display-inline">In prescribing regulations under paragraph (1), the Secretary shall ensure that the level of any contaminant in infant formula is as close to the maximum contaminant level goal as is feasible with the use of the best available technology, treatment techniques, and other means which the Secretary finds are available, taking cost into consideration.</text></paragraph> <paragraph id="HF8BC19BD18CC4B8FA33C0B0209701B87"><enum>(3)</enum><header>Factors to consider</header><text display-inline="yes-display-inline">In establishing the maximum permissible level for a contaminant under paragraph (1), the Secretary shall consider—</text> 
<subparagraph id="HE2B56F281F6543388DFF8D8096450949"><enum>(A)</enum><text display-inline="yes-display-inline">the cumulative health impacts of low-level exposure of the contaminant on infant neurodevelopment;</text></subparagraph> <subparagraph id="H6A135D95E91442E79E45F908848EB070"><enum>(B)</enum><text>the prevalence of the contaminant in agricultural soil and manufacturing source-water; and</text></subparagraph> 
<subparagraph id="H466C1B1166F74EC88E2F944899EB4FEE"><enum>(C)</enum><text display-inline="yes-display-inline">the bioaccumulative nature of the contaminant in the human body.</text> </subparagraph></paragraph> <paragraph id="H05BB6A24ACD64E8E862F4CE186E81EDD"><enum>(4)</enum><header>Testing and records</header><text>In prescribing regulations under paragraph (1), the Secretary shall require a manufacturer of infant formula—</text> 
<subparagraph id="HE5F017EF1DCB4ADDBEA5D3F53FA954B8"><enum>(A)</enum><text display-inline="yes-display-inline">to conduct testing to ensure compliance with the maximum permissible contaminant levels established by the Secretary under paragraph (1);</text></subparagraph> <subparagraph id="H7DCB5EE843D546A3A6CEE8EC06326BD7"><enum>(B)</enum><text display-inline="yes-display-inline">to maintain records relating to such testing for not fewer than 2 years after the expiration of the shelf life of such infant formula; and</text></subparagraph> 
<subparagraph id="H0E44609B37F64DBF92D063A07247AB35"><enum>(C)</enum><text>to make such records available to the Secretary upon request.</text> </subparagraph></paragraph> <paragraph id="H58213B89FDC1480D8A17BFD88EB3544F"><enum>(5)</enum><header>Contaminant defined</header><text display-inline="yes-display-inline">In this subsection, the term <quote>contaminant</quote> means any physical, chemical, biological, or radiological substance or matter that is man-made or introduced into the environment via human activity, including heavy metals, per- and polyfluoroalkyl substances, phthalates, microplastics, synthetic pesticides, and biological toxins, including cyanotoxins associated with harmful algal blooms.</text></paragraph> 
<paragraph id="H3FEBABD263064EACB5CDC9BBE06D02C9"><enum>(6)</enum><header>Annual report to Congress</header><text>As part of the annual report required under subsection (l), the Secretary shall include—</text> <subparagraph id="HD32F678AFA9748FBA31E546BE9104BB5"><enum>(A)</enum><text display-inline="yes-display-inline">a list of any manufacturers found to be in violation of the maximum permissible contaminant levels established by the Secretary under paragraph (1);</text></subparagraph> 
<subparagraph id="HC6CA1597E8D74E4DB85BA024287CE053"><enum>(B)</enum><text>the specific concentrations of contaminants, including microplastics and cyanotoxins, detected in infant formula during routine surveillance testing; and</text></subparagraph> <subparagraph id="H357830A5B68D41CF8BDED504C82EC758"><enum>(C)</enum><text>an assessment of the progress made toward achieving the lowest feasible levels for contaminants in infant formula in the domestic supply chain.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H71192CD1AD944DA3AFB76E0E2CF638BC"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Health and Human Services shall issue regulations to implement section 412(n) of the Federal Food, Drug, and Cosmetic Act (as added by subsection (b) of this section). Such regulations shall apply to infant formula manufactured on or after the date that is 180 days after the date of issuance of the regulations.</text></subsection></section> </legis-body></bill>
