<section id="H3375C0764C624C95B13061E2AC6F4082" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Northern Mariana Islands Labor Stabilization Act</short-title></quote>.</text></section> 
<section id="HC861069AD58349F79C9DBEF62888E97B"><enum>2.</enum><header>Modifications to labor stabilization program transition</header> 
<subsection id="H79F04A1E869B4EE8A75BA115BEE94E39"><enum>(a)</enum><header>Extension of transition period</header><text display-inline="yes-display-inline">Section 6 of the Joint Resolution entitled <quote>A Joint Resolution to approve the <quote>Covenant to Establish a Commonwealth of the Northern Mariana Islands in Political Union with the United States of America</quote>, and for other purposes</quote> (<external-xref legal-doc="usc" parsable-cite="usc/48/1806">48 U.S.C. 1806</external-xref>) is amended—</text> <paragraph id="H4CA4E659DA7D4A99AEAAED7A76893581"><enum>(1)</enum><text>in subsection (a)(2), by striking <quote>December 31, 2029</quote> and inserting <quote>the date that is the later of December 31, 2039, or the date on which the labor stabilization program period expires pursuant to subsection (d)(8)</quote>;</text></paragraph> 
<paragraph id="HCD05B83CF2D04BE881A67C87DDBD7416"><enum>(2)</enum><text>in subsection (d)—</text> <subparagraph id="H5048F41D6F1648A0AF4EC77321B68FB2"><enum>(A)</enum><text>in paragraph (2)—</text> 
<clause id="H50AFE78F487D44318005C2549B66E406"><enum>(i)</enum><text>in subparagraph (A)—</text> <subclause id="H87E6A70558AF43A3A3F1A0B39EFF75AA"><enum>(I)</enum><text>in clause (i), by striking <quote>Beginning</quote> and inserting <quote>Subject to clause (iii) and beginning</quote>; and</text></subclause> 
<subclause id="HF4F9F2C8735D4DC9A7859E705E103C4F"><enum>(II)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H8F74DA150FDD4265903D7DCF235E30A9" display-inline="no-display-inline"> <clause id="H4BB1FAD5652C43AF8B03530CF8D3FE30"><enum>(iii)</enum><header>Application of Guam temporary labor certification procedures</header> <subclause id="H0AC2B4B7006E4D6687F7B1A0989C5045"> <enum>(I)</enum> <header>In general</header> <text display-inline="yes-display-inline">Beginning with petitions filed with employment start dates in the first fiscal year after the date of enactment of the <quote>Northern Mariana Islands Labor Stabilization Act</quote>, the temporary labor certification requirements and procedures applicable to temporary employment on Guam under clauses (iii) and (v) of section 214.2(h)(6) of title 8, Code of Federal Regulations (or a successor regulation), shall apply in the Commonwealth in the same manner as such requirements and procedures apply in Guam, except that any reference to the Governor of Guam shall be deemed to refer to the Governor of the Commonwealth of the Northern Mariana Islands.</text>
                                        </subclause> 
<subclause id="H089DD24564A042C7829F9DF7C7FC5C8B"><enum>(II)</enum><header>Petition requirement</header><text display-inline="yes-display-inline">An approved temporary labor certification issued pursuant to this clause shall satisfy the requirement under clause (i) and shall be submitted with any petition filed with the Secretary under clause (ii).</text> </subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause> <clause id="H69C9DB16A76F4827A400401BEAA1B4FF"><enum>(ii)</enum><text>in subparagraph (B)—</text> 
<subclause id="HD95532BD67904964A44E5FBEEF1DDE8C"><enum>(I)</enum><text>in clause (i)—</text> <item id="HB8B7BF66DDA146649F19873B87483D5B"><enum>(aa)</enum><text>by inserting <quote>and subject to clause (iii),</quote> after <quote>clause (i),</quote>; and</text></item> 
<item id="H179D6A23216F4E219698658EFDDBAAE2"><enum>(bb)</enum><text>by striking <quote>an annual basis</quote> and inserting <quote>a biennial basis</quote>; and</text></item></subclause> <subclause id="H4B4DB8FD156D4059A7D18FBA820419B0"><enum>(II)</enum><text>by adding at the end the following:</text>

                                        <enum>(iii)</enum>
                                        <header>Calibration of alternative method</header>
 <text display-inline="yes-display-inline">The prevailing wage required to be paid pursuant to clause (ii) shall be 75 percent of the wage determined pursuant to that section or the Federal minimum wage, whichever is greater.</text>
                                    </clause><after-quoted-block>.</after-quoted-block></quoted-block></subclause></clause></subparagraph> 
<subparagraph id="H04218F32B54C481CA0749FFB95331F73"><enum>(B)</enum><text>in paragraph (3)—</text> <clause id="H475E8A4757BA42B1BB0D4DC6F90A8E55"><enum>(i)</enum><text>in subparagraph (A), by inserting <quote>, in consultation with the Governor,</quote> after <quote>the Secretary</quote>; and</text></clause> 
<clause id="H1DE4436FD32C47FEB6BAA4D0B3918D5E"><enum>(ii)</enum><text>by amending subparagraph (B) to read as follows:</text> <quoted-block style="OLC" id="H6BE2CDC9D47B4A2FBDC799345FB26562" display-inline="no-display-inline"> <subparagraph id="H6404197B3D154D88BE2C88B3BEA0D2F2"><enum>(B)</enum><header>Numerical cap</header> <clause id="HABD323FFE0FC4109AC59CBA464091FB0" commented="no"><enum>(i)</enum><header>In general</header> <subclause id="H3FFE046D507D493D9B7F2AED5CF862F2"><enum>(I)</enum><header>Annual numerical limitation</header><text display-inline="yes-display-inline">For each fiscal year during the labor stabilization program period, the Secretary, in consultation with the Governor, shall establish the numerical limitation on permits that may be issued under subparagraph (A) for such fiscal year. The numerical limitation established under this subclause may be increased or decreased from the numerical limitation established for the preceding fiscal year, except that such numerical limitation may not exceed 15,000 for any fiscal year.</text></subclause> 
<subclause id="H0E202080469741BB9050E2BCB3F15701"><enum>(II)</enum><header>Notice</header><text display-inline="yes-display-inline">The Secretary shall publish in the Federal Register the numerical limitation established under subclause (I) not later than 180 days before the first day of the fiscal year for which such limitation applies.</text></subclause> <subclause id="H78041210FA0846A28CBC28B7BC9FCB19"><enum>(III)</enum><header>Default limitation</header><text display-inline="yes-display-inline">If the Secretary does not publish a numerical limitation under subclause (II) for a fiscal year, the numerical limitation for such fiscal year shall be the numerical limitation in effect for the preceding fiscal year, except that such limitation may not exceed 15,000.</text></subclause> 
<subclause id="HA087CAA6E3354DE7B165E4C51E9299CF"><enum>(IV)</enum><header>Supplemental construction and extraction allocation</header><text> Notwithstanding any numerical cap set forth in subclause (I), the Secretary of Homeland Security shall increase by 3,000, for each such fiscal year, the total number of permits available under this subsection for Construction and Extraction Occupations (as defined by the Department of Labor as Standard Occupational Classification Group 47–0000).</text></subclause></clause> <clause id="H492C12DD72284441923B312FF29E204E" commented="no"><enum>(ii)</enum><header>Construction occupations</header><text display-inline="yes-display-inline">The permits allocated for Construction and Extraction Occupations (as defined by the Department of Labor as Standard Occupational Classification Group 47–0000) pursuant to this subparagraph may only be made available to foreign workers who are nationals of a country designated eligible to participate in the program under section 101(a)(15)(H)(ii)(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(ii)(b)</external-xref>) during calendar year 2024. </text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="H5CCC2B508C3C47F2B32E2480ECA4A619"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (D)—</text> <clause id="H05DB68B945144B58BF85CA3A1E9DAFAA"><enum>(i)</enum><text>in clause (iii)(I)(bb), by striking <quote>10 days</quote> and inserting <quote>90 days</quote>; and</text></clause> 
<clause id="HA7B6B4D63F29499797BE5B5366D42FB6"><enum>(ii)</enum><text>by striking clause (v); and</text></clause></subparagraph> <subparagraph id="H4B4E8C422D9642C2AB17E0F45D15CD23"><enum>(D)</enum><text>by striking subparagraph (E);</text></subparagraph></paragraph> 
<paragraph id="H52FBF7FBD2CA4A0DB616E6F0A4E113B7" commented="no"><enum>(3)</enum><text>by amending paragraph (7) to read as follows:</text> <quoted-block style="OLC" id="HFFF9187319FF4EC69CF9B5E419C2AC80" display-inline="no-display-inline"> <paragraph id="H2E57EA3E3B1043508485819490816FCE"><enum>(7)</enum><header>Permit validity; long-term workers</header> <subparagraph id="H726B634D4AE7433CB9F191A6497BA957"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), a permit for a Commonwealth Only Worker shall be valid for a period not to exceed 1 year.</text></subparagraph> 
<subparagraph id="H0B6685AF7D974381A7C62A19DBB92009"><enum>(B)</enum><header>Renewal</header><text display-inline="yes-display-inline">A permit issued under subparagraph (A) may be renewed for additional periods of not more than 1 year each, subject to the requirements of this subsection.</text></subparagraph> <subparagraph id="H967FDAEDA504438AA143F478ACFF8B6D"><enum>(C)</enum><header>Long-term workers</header><text>An alien who was admitted to the Commonwealth as a Commonwealth Only Transitional Worker—</text> 
<clause id="HD77566BF841C47C9A5052353344C0999"><enum>(i)</enum><text>during fiscal year 2015, and </text></clause> <clause id="HB0CCDDBD27714998A51D3026F763BFC9"><enum>(ii)</enum><text>during two of the fiscal years 2016, 2017, 2018, or 2019, </text></clause>
                                <continuation-text continuation-text-level="paragraph">may be
                                    admitted as a Commonwealth Only Transitional Worker for a period
                                    that may not exceed 3 years and may be renewed for additional
                                    3-year periods during the transition period. A permit issued
                                    pursuant to this subparagraph shall be counted toward the
                                    numerical cap for each fiscal year for which the permit is
                                    valid.</continuation-text></subparagraph></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block> </paragraph> 
<paragraph id="HFF54544DAE724F49BFBD28CB4D515AF5" commented="no"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block style="traditional" id="H75DD9F4043C241CCB550F146A24EE196" display-inline="no-display-inline"> <paragraph id="H8E62925B79064C1A8C9E6F265DBD2A44" commented="no"><enum>(8)</enum><header>Labor stabilization period</header> <subparagraph id="H7A2A9ED3559F44C8A7B51C2393AAB28D" display-inline="no-display-inline" commented="no"><enum>(A)</enum><header>Labor needs</header><text>The Secretary of Labor, in consultation with the Secretary, the Secretary of Defense, the Secretary of the Interior, and the Governor, shall, not later than July 1, 2039—</text> 
<clause id="H17D178D0AF27494586BBF927A05CDC49" commented="no"><enum>(i)</enum><text>determine the labor needs of the Commonwealth for the ensuing 10-year period; and</text></clause> <clause id="H327C0277F4B44AC1BE0579F2C3CACE1E" commented="no"><enum>(ii)</enum><text>determine whether an extension of up to 10 years is necessary to ensure an adequate number of workers will be available for legitimate businesses in the Commonwealth.</text></clause></subparagraph> 
<subparagraph id="HD8DC2B91603445D9A1EAD88795EC4712" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Subsequent determinations</header><text display-inline="yes-display-inline">If the labor stabilization program period is extended under subparagraph (C), the Secretary of Labor, in consultation with the officials described in subparagraph (A), shall make a new determination under subparagraph (A) not later than July 1 of the calendar year in which the labor stabilization program period, as so extended, is scheduled to expire.</text></subparagraph> <subparagraph id="H260BD76007E54A8CB89B6075E5FFD9DA"><enum>(C)</enum><header>Extension</header><text display-inline="yes-display-inline">If the Secretary of Labor makes an affirmative determination under subparagraph (A) or (B), the Secretary of Labor may extend the labor stabilization program period for an additional period of up to 10 years by publishing notice of such extension in the Federal Register. Each extension under this subparagraph shall begin on the day after the date on which the labor stabilization program period would otherwise expire.</text></subparagraph> 
<subparagraph id="H3539A0B835D344E4A19ED8C1045695F3"><enum>(D)</enum><header>Successive extensions</header><text display-inline="yes-display-inline">The authority under this paragraph may be exercised for successive additional periods of up to 10 years, subject to a new determination under subparagraph (B) before each such extension.</text></subparagraph> <subparagraph id="H41529FECD02949849CCF238A4B917A4F" indent="up1" commented="no"><enum>(E)</enum><header>Factors considered</header><text display-inline="yes-display-inline">In making a determination under this paragraph, the Secretary of Labor may consider, among other factors, labor market studies within the Commonwealth, the unemployment rate of United States workers and foreign workers in the Commonwealth, the good faith efforts made by the Commonwealth to locate, educate, train, or prepare United States workers and other individuals eligible to work in the United States to assume employment, available evidence that United States workers or other individuals eligible to work in the United States within the Commonwealth are not willing to accept jobs that are available, the effect of foreign workers on compensation, benefits, and living standards of existing workers, and the prior use of foreign workers to fill industry jobs including whether the industry requires foreign workers to fill such jobs.</text></subparagraph></paragraph> 
<paragraph id="H8527AF48423E4AB98BDF9BB4933807E4" commented="no"><enum>(9)</enum><header>Enforcement fee</header> 
<subparagraph id="H988875BADDA84C1A9C7C92EBD5E4F181"><enum>(A)</enum><header>In general</header><text>In addition to any other fee applicable to a petition filed under this subsection, the Secretary shall impose a fee of $150 on each prospective employer filing such petition.</text></subparagraph> <subparagraph id="HCF5E44D71EC4452DBFBC90CC70B6EAA9"><enum>(B)</enum><header>Use of amounts</header><text>Notwithstanding section 703(b) of this Joint Resolution, all amounts collected under subparagraph (A) shall be made available to the Secretary of Homeland Security to carry out enforcement of the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act) and this section.</text></subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H4EB728851ECC46D992101C845BA9A7EA"><enum>(b)</enum><header>Qualified alien</header><text>Section 431(b) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1641">8 U.S.C. 1641(b)</external-xref>) is amended—</text> <paragraph id="H182632F6C70947EAB9B393BA82105656"><enum>(1)</enum><text>in paragraph (7), by striking <quote>, or</quote> and inserting a comma at the end;</text></paragraph> 
<paragraph id="H1B5B8C64F4DB4B558F5670E25096AD25"><enum>(2)</enum><text>in paragraph (8), by striking the period at the end and inserting <quote>, or</quote>; and</text></paragraph> <paragraph id="H306DDD4145AF4379BDD4FED206A2ED4C"><enum>(3)</enum><text>by adding at the end the following:</text>

<paragraph id="H63BEBBD4E4294A78BA431A20DED4E00F"><enum>(9)</enum><text display-inline="yes-display-inline">an alien who is lawfully admitted for long-term residence in the Commonwealth of the Northern Mariana Islands under section 6(e)(6) of the Joint Resolution entitled <quote>A Joint Resolution to approve the <quote>Covenant to Establish a Commonwealth of the Northern Mariana Islands in Political Union with the United States of America</quote>, and for other purposes</quote>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H2E59DD589B714BBB9A3DCAC2FD8554C2"><enum>(c)</enum><header>Immigration and naturalization fees</header><text display-inline="yes-display-inline">Section 703(b) of the Joint Resolution entitled <quote>A Joint Resolution to approve the <quote>Covenant to Establish a Commonwealth of the Northern Mariana Islands in Political Union with the United States of America</quote>, and for other purposes</quote> (<external-xref legal-doc="usc" parsable-cite="usc/48/1801">48 U.S.C. 1801</external-xref> note) is amended by striking <quote>quarantine and passport fees</quote> and inserting <quote>quarantine, passport, immigration and naturalization fees</quote>.</text></subsection> 
<subsection id="H63660F52F0DC4479991E24595243D691"><enum>(d)</enum><header>Commonwealth of the northern mariana islands</header><text>Section 235(b)(1)(A)(iii)(II) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)(A)(iii)(II)</external-xref>) is amended—</text> <paragraph id="HEF15E49F5BAD46F49E911DBF45CE2BAB"><enum>(1)</enum><text>by striking <quote>been</quote> and inserting <quote>been—</quote>; and</text></paragraph> 
<paragraph id="H18BC0575E9CA4A2283304C998966F815"><enum>(2)</enum><text>by striking <quote>admitted or paroled into the United States, and who has not affirmatively shown, to the satisfaction of an immigration officer, that the alien has been physically present in the United States continuously for the 2-year period immediately prior to the date of the determination of inadmissibility under this subparagraph.</quote> and inserting the following:</text> <quoted-block style="OLC" id="HCB978F0145B24037BC89C1EB82A1F7D4" display-inline="no-display-inline"> <item id="H1C7E5D02A058463FA36A911368DFDFF6"><enum>(aa)</enum><text display-inline="yes-display-inline">admitted or paroled into the United States, and who has not affirmatively shown, to the satisfaction of an immigration officer, that the alien has been physically present in the United States continuously for the 2-year period immediately prior to the date of the determination of inadmissibility under this subparagraph; or</text></item> 
<item id="HB6F9FD6041284DFE9A202C356C9FF153"><enum>(bb)</enum><text display-inline="yes-display-inline">admitted or paroled into the United States, and who has not affirmatively shown, to the satisfaction of an immigration officer, that the alien has been physically present in the Commonwealth of the Northern Mariana Islands continuously for the 5-year period immediately prior to the date of the determination of inadmissibility under this subparagraph.</text></item><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HE750838FC98A4CCAB684DBFAF675B725"><enum>(e)</enum><header>Labor stabilization program</header><text display-inline="yes-display-inline">Section 6 of the Joint Resolution, as amended by subsection (a), is further amended—</text> 
<paragraph id="HF68A15D9FB934778836ADE471E42CC19"><enum>(1)</enum><text>by striking <quote>transition period</quote> each place it appears and inserting <quote>labor stabilization program period</quote>;</text></paragraph> <paragraph id="H946168348A6C4179B66FBC38E244572D"><enum>(2)</enum><text>by striking <quote>transition program</quote> each place it appears and inserting <quote>labor stabilization program</quote>;</text></paragraph> 
<paragraph id="H15949F4BB324434C9BF80DC8D3A0F39B"><enum>(3)</enum><text>by striking <quote>Commonwealth Only Transition Worker</quote> each place it appears and inserting <quote>Commonwealth Only Worker</quote>; and</text></paragraph> <paragraph id="H27C63BE9F81B47C7B99C95B51A444532"><enum>(4)</enum><text>by striking <quote>Commonwealth Only Transitional Worker</quote> each place it appears and inserting <quote>Commonwealth Only Worker</quote>.</text></paragraph></subsection> 
<subsection id="H5ED3A40BFA1541928F09783003DD62A5">
        <enum>(f)</enum>
        <header>Effective date for permit validity; long-Term workers</header>
 <text display-inline="yes-display-inline">The amendments made by subsection (a)(2)(C) shall take effect as if included in the enactment of <external-xref legal-doc="public-law" parsable-cite="pl/115/218">Public Law 115–218</external-xref>.</text>
      </subsection> </section> 
<section id="HC8F85E99CBD5496F93A38EACFC19DFDD"><enum>3.</enum><header>Rulemaking</header> 
<subsection id="HA7289E641FA6426884187B737C5010F7"><enum>(a)</enum><header>Secretary of Homeland Security</header><text display-inline="yes-display-inline">Notwithstanding the requirements under section 553(b) of title 5, United States Code, the Secretary of Homeland Security shall publish in the Federal Register, not later than 180 days after the date of the enactment of this Act, an interim final rule that specifies how the Secretary intends to implement the amendments made by section 2 that relate to the responsibilities of the Secretary.</text></subsection> <subsection id="HD779E61FAD094437BDE4F51037455F2B"><enum>(b)</enum><header>Secretary of Labor</header><text>Notwithstanding the requirements under section 553(b) of title 5, United States Code, the Secretary of Labor shall publish in the Federal Register, not later than 180 days after the date of the enactment of this Act, an interim final rule that specifies how the Secretary intends to implement the amendments made by section 2 that relate to the responsibilities of the Secretary.</text></subsection> 
<subsection id="HB15A0315ABB04956BE517D926909AEC8"><enum>(c)</enum><header>Recommendations of the Governor</header><text>In developing the interim final rules under subsections (a) and (b), the Secretary of Homeland Security and the Secretary of Labor—</text> <paragraph id="H870C1FCE283945D58859C0AC5D60D6CE"><enum>(1)</enum><text>shall each consider, in good faith, any written public recommendations regarding the implementation of this Act, or an amendment made by this Act, that are submitted by the Governor of the Commonwealth not later than 60 days after the date of the enactment of this Act; and</text></paragraph> 
<paragraph id="HF0ADB1BE852F4E99B7823E7BF32BBAFD"><enum>(2)</enum><text>may include provisions in such rule that are responsive to any recommendation of the Governor that is not inconsistent with this Act.</text></paragraph></subsection></section> <section id="H9921CC2ED6A94ADCBE0D9756D84C1506"><enum>4.</enum><header>Unlawful presence</header><text display-inline="no-display-inline">Section 212(a)(9)(B)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(9)(B)(iii)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H00DB3E5482CD4458B67FC94BE78F4D89" display-inline="no-display-inline"> 
<subclause id="H778ABE9A68244CA6893EBE55C25A0189"><enum>(VI)</enum><header>Commonwealth Only Transitional Worker</header><text display-inline="yes-display-inline">Clause (i) shall not apply to an alien who—</text> <item id="H93F1A755062340D2ADE5C8C9CFD0E8C6"><enum>(aa)</enum><text>was admitted as a Commonwealth Only Transitional Worker prior to the fiscal year 2020;</text></item> 
<item id="HD7BB650780624BA5A80F310340F4A4F4"><enum>(bb)</enum><text display-inline="yes-display-inline">has been unlawfully present in the United States for a period of less than 5 years prior to the date of the enactment of the ‘Northern Mariana Islands Labor Stabilization Act’;</text></item> <item id="H0057CDD7702C43E9957FADCD084DB7CC"> <enum>(cc)</enum> <text display-inline="yes-display-inline">has continuously resided in the Commonwealth of the Northern Mariana Islands beginning in fiscal year 2020 through the date of filing of a petition for classification as a Commonwealth Only Worker under section 6(d) of <external-xref legal-doc="public-law" parsable-cite="pl/94/241">Public Law 94–241</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/48/1806">48 U.S.C. 1806(d)</external-xref>), as amended by section 2 of the ‘Northern Mariana Islands Labor Stabilization Act’; and</text>
          </item> 
<item id="HA977FE17366D4A1EA17DE80283D4C1AD"><enum>(dd)</enum><text>seeks admission to the Commonwealth of the Northern Mariana Islands pursuant to an approved petition described in item (cc).</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H175E92E808064E248063D835BDE287DE"><enum>5.</enum><header>Effective date; Applicability</header><text display-inline="no-display-inline">Except as specifically otherwise provided, this Act and the amendments made by this Act—</text> 
<paragraph id="H63D3848D6C0745ED96FF51498FFA84C9"><enum>(1)</enum><text display-inline="yes-display-inline">shall take effect on the first day of the first fiscal year after the date of the enactment of this Act; and</text></paragraph> <paragraph id="H5F71074F90DE4648B9E72F79CF8C171F"><enum>(2)</enum><text>shall apply to petitions for Commonwealth Only Transitional Workers filed on or after such date.</text></paragraph></section>
