<section section-type="subsequent-section" id="H6E3388A354064C34AE0AA84D938CC63E"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Western South Dakota Water Supply Project Feasibility Study Act</short-title></quote>.</text></section> <section id="H4A3AE71D308B4F338DCFDD32E695CF43"><enum>102.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H917B3699A72548B58D67510F802E767C"><enum>(1)</enum><header>Non-Federal project entity</header><text>The term <term>non-Federal project entity</term> means the Western Dakota Regional Water System, Inc., a nonprofit corporation.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H4B652448513642FD9F27CE23384E5558"><enum>(2)</enum><header>Proposed rural water supply project</header><text display-inline="yes-display-inline">The term <term>proposed rural water supply project</term> means the proposed project to supply municipal, rural, and industrial water from the Missouri River to the Western Dakota Regional Water System.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HCD1859DF0F6B4F13BBEA77D03E64C89D"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section> <section id="H44561BE09B5344149E27FB138145F458"><enum>103.</enum><header>Western South Dakota water supply project feasibility study</header> <subsection commented="no" id="HECBBBE7141824066992695382B58A340"><enum>(a)</enum><header>Study</header> <paragraph commented="no" display-inline="no-display-inline" id="H86A05AD663424FB9A6768A495C4C9C59"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary, in coordination with the non-Federal project entity, shall carry out a study to determine the feasibility of the proposed rural water supply project.</text></paragraph> 
<paragraph commented="no" id="H4940CDCD5AB642D193AD0FEC3F903813"><enum>(2)</enum><header>Feasibility report</header><text>After completion of the feasibility study for the proposed rural water supply project under paragraph (1), the Secretary shall—</text> <subparagraph commented="no" id="H79D12E154CBF49B496B341B129C025F1"><enum>(A)</enum><text>develop a feasibility report that includes a recommendation of the Secretary on—</text> 
<clause commented="no" id="H28ADBF5AFDD64636A2EEE570CBDD5EA3"><enum>(i)</enum><text>whether the proposed rural water supply project should be authorized for construction; and</text></clause> <clause commented="no" id="H54DE1BF1522547299410CDB02E98C7CA"><enum>(ii)</enum><text>the appropriate non-Federal share of construction costs, which shall be—</text> 
<subclause commented="no" id="H606CB93C297C404897C5E583208EFD67"><enum>(I)</enum><text>at least 25 percent of the total construction costs; and</text></subclause> <subclause commented="no" id="H68B6553BDEB344DAAB4C86ADE2671C48"><enum>(II)</enum><text>determined based on an analysis of the financial capability-to-pay the allocated construction and operations, maintenance, and replacement costs of the recommended plan;</text></subclause></clause></subparagraph> 
<subparagraph commented="no" id="H88AE9882989B4F75AE392993BB7AED6C"><enum>(B)</enum><text>submit the report under subparagraph (A) to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives; and</text></subparagraph> <subparagraph commented="no" id="H0A188349699C436F8D5AB31AE02EAF25"><enum>(C)</enum><text>make the report under subparagraph (A) publicly available, along with associated feasibility study documents.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H151E6340329E4683A56E9C12686EC8C1"><enum>(3)</enum><header>Consultation and cooperation</header><text>In addition to the non-Federal project entity, the Secretary shall consult and cooperate with appropriate Federal, State, Tribal, regional, and local authorities during the conduct of the feasibility study and development of the feasibility report under this subsection.</text></paragraph></subsection> <subsection id="HF53CFE527D554207ACBD2ADB6DD92E53"> <enum>(b)</enum> <header>Cost-Sharing agreement for feasibility study costs</header> <text>The Secretary shall enter into a cost-sharing agreement (or an appropriate financial assistance agreement, as determined by the Secretary) with the non-Federal project entity to conduct a study under subsection (a) that complies with the reclamation feasibility standards.</text>
        </subsection> 
<subsection id="HF455FBA6999E4A46888E7902919A70FA"><enum>(c)</enum><header>Federal share of feasibility study costs</header><text>The Federal share of the total costs of carrying out the feasibility study under subsection (a) shall not exceed 50 percent.</text></subsection> <subsection id="H019CE8E797294C98871E3D81EBF01722"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section $10,000,000.</text></subsection> 
<subsection id="HA935602E41DB41EDAC8369C153B8C2BC"><enum>(e)</enum><header>Termination of authority</header><text>The authority provided by this section expires on the date that is 10 years after the date of enactment of this Act.</text></subsection></section> </title> <title id="H807BE215BF3A4B64A3095C6C0681B171"><enum>II</enum><header>LEWIS AND CLARK REGIONAL WATER SYSTEM EXPANSION FEASIBILITY STUDY</header> <section id="H0068EF44D0554AF1A6A3426E7EFD976C" section-type="subsequent-section"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Lewis and Clark Regional Water System Expansion Feasibility Study Act</short-title></quote>.</text></section> 
<section id="HE2CF50F3B6FD4B1082438EA3D83D5D25"><enum>202.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="H58ED171B80C04409A441BA1DF95E171D"><enum>(1)</enum><header>Non-Federal project entity</header><text>The term <term>non-Federal project entity</term> means—</text> 
<subparagraph id="HED09DF0000FE43EFBCC0DBC51D098EFA"><enum>(A)</enum><text>the Lewis and Clark Regional Water System, Inc.; and</text></subparagraph> <subparagraph id="HC3F94EAB39124307B5F9C53544BBEB43"><enum>(B)</enum><text>any nonprofit successor entity to the corporation described in subparagraph (A).</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H63232935C2604F62A6D942319398662C"><enum>(2)</enum><header>Proposed rural water supply project</header><text>The term <term>proposed rural water supply project</term> means the proposed project to supply municipal, rural, and industrial water to expand the capacity and reach of the Lewis and Clark Regional Water System in the States of Iowa, Minnesota, and South Dakota.</text></paragraph> <paragraph id="HBD46D42C8FDE4466971DB6786CB1DDCC" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section> 
<section id="H6D96A28621D0439E905C2748E43E8A03"><enum>203.</enum><header>Lewis and Clark Regional Water System expansion feasibility study</header> 
<subsection id="H06DF167C49DE4B02B45EC646E15B24C7" commented="no"><enum>(a)</enum><header>Study</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H311EA69BCA874EA887910316A9917B99"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary, in coordination with the non-Federal project entity, shall carry out a study to determine the feasibility of the proposed rural water supply project.</text></paragraph> <paragraph id="H2CCDB646F09C4A6192BC9F60498EC42B"><enum>(2)</enum><header>Feasibility report</header><text>After completion of the feasibility study for the proposed rural water supply project under paragraph (1), the Secretary shall—</text> 
<subparagraph id="H18A031DA40FE4D9CA46DFFE3B084BD92"><enum>(A)</enum><text>develop a feasibility report that includes a recommendation of the Secretary on—</text> <clause id="H32E9C268C6494B84B912F17DBA35E790"><enum>(i)</enum><text>whether the proposed rural water supply project should be authorized for construction; and</text></clause> 
<clause id="HF115764970E84982B79354A477347D89"><enum>(ii)</enum><text>the appropriate non-Federal share of construction costs, which shall be—</text> <subclause id="HB5D4B03EB3444050B56E603F8DFA7FA4"><enum>(I)</enum><text>at least 25 percent of the total construction costs; and</text></subclause> 
<subclause id="HFBAD04B1EBA94EB8A51E276FBE534A23"><enum>(II)</enum><text>determined based on an analysis of the financial capability-to-pay the allocated construction and operations, maintenance, and replacement costs of the recommended plan;</text></subclause></clause></subparagraph> <subparagraph id="HDE36E754A04742AD93A1DB26403CDD13"><enum>(B)</enum><text>submit the report under subparagraph (A) to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives; and</text></subparagraph> 
<subparagraph id="H9601A1924E174579B89632055BEC4E0E"><enum>(C)</enum><text>make the report under subparagraph (A) publicly available, along with associated feasibility study documents.</text></subparagraph></paragraph> <paragraph id="HE93ED4F0D1A049D2A471FEC0860438FA"><enum>(3)</enum><header>Consultation and cooperation</header><text>In addition to the non-Federal project entity, the Secretary shall consult and cooperate with appropriate Federal, State, Tribal, regional, and local authorities during the conduct of the feasibility study and development of the feasibility report under this subsection.</text></paragraph></subsection>

          <enum>(b)</enum>

<section id="HD1445D233FA149659B6F0CCA25D08C4C"><enum>302.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph commented="no" display-inline="no-display-inline" id="HD16A1F1B50B84AFC9BC658B2991E7108"><enum>(1)</enum><header>Dakota Mainstem Regional Water System</header><text display-inline="yes-display-inline">The term <term>Dakota Mainstem Regional Water System</term> means the Dakota Mainstem Regional Water System, Inc., a nonprofit corporation established and operated substantially in accordance with the reclamation feasibility standards to serve as a non-Federal project entity for purposes of the cooperative agreement entered into under section 303(a)(1).</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H2BFD610736A24B3C9C4810E2B107CD5D"><enum>(2)</enum><header>Reclamation feasibility standards</header><text>The term <term>reclamation feasibility standards</term> means the eligibility criteria and feasibility study requirements described in part 404 of title 43, Code of Federal Regulations (or successor regulations).</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H94A0F2C0EFE14FEEAFB6F70CF8A48B67"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section> 
<section id="H3B56A03D6E7E4C5C9660E6BAE2FC65F5"><enum>303.</enum><header>Dakota Mainstem water supply project feasibility study</header> 
<subsection id="HB217032E196F41A19817DA391EB8EC5C"><enum>(a)</enum><header>Study</header> 
<paragraph id="HE33FE192C93B4876A8B9DA6872557200"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Dakota Mainstem Regional Water System, through a cooperative agreement, may undertake a study to determine the feasibility of constructing a project to supply municipal, rural, and industrial water to the Dakota Mainstem Regional Water System service area in the States of South Dakota, Iowa, Nebraska, and Minnesota.</text></paragraph> <paragraph id="H2D6CCD2B9CAB4633A34A4ED0BFF23B10"><enum>(2)</enum><header>Requirement</header><text>The study under paragraph (1) shall comply with the reclamation feasibility standards.</text></paragraph></subsection>
